1998-06-03 - Plan Commission - Minutes PUBLIC HEARING BUFFALO GROVE PLAN COMMISSION June 3, 1998 The Walsh Property, 16613 W.Park Avenue,Prairie View Annexation with Zoning in the R-3 One-Family Dwelling District Chairman Goldspiel called the hearing to order at 7:30 p.m. in the Village Council Chambers, Buffalo Grove Municipal Building, 50 Raupp Boulevard, Buffalo Grove, Illinois. Chairman Goldspiel read the Notice of Public Hearing as published in the Buffalo Grove Daily Herald, explained the procedure to be followed for the public hearing, and swore in all persons who wished to give testimony. Commissioners present: Chairman Goldspiel Mr. Krug Ms. Howard Mr. Samuels Mr. Berman Mr. Trilling Mr. Ottenheimer Mr. Viehman Commissioners absent: Mr. Moons Also present: Mr. Christopher Walsh Ms. Julie Walsh Mr. Charles Hendricks,Village Trustee Mr. William Raysa,Village Attorney Mr. Richard Kuenkler,Village Engineer Mr. Robert Pfeil,Village Planner The following exhibits were presented by the petitioner at the public hearing: Exhibit A: Elevation of proposed house on Lot 1 Exhibit B: Preliminary Plan of proposed Lot 1 and Lot 2 dated May 18, 1998 Exhibit C: Plat of Survey dated as revised May 6, 1995 by Mid America Survey Company Exhibit D: Proposed Site Plan of Lot 1, 9,770.4 square feet and Lot 2, 10,091.7 square feet Buffalo Grove Plan Commission-Public Hearing-June 3, 1998-Page 1 Mr. Walsh stated he is requesting annexation into Buffalo Grove for his property in Prairie View. The property is approximately 20,000 square feet. He stated he proposes splitting the property into two lots that are approximately 10,000 square feet each. Lot 1 would be 9,770.4 square feet and Lot 2 which has an existing residence is approximately 10,097 square feet. This area in Prairie View is very old and he has therefore chosen an elevation and style to that is turn of the century for the proposed new house in order to blend in with the area. The proposed residence will be approximately 2,700 square feet with a 2-car garage. Mr. Walsh stated he will need to run the sewer line along the length of the property across the north side of Park Avenue to approximately the middle of the two lots and then south to the edge of Lot 1. Water is already existing between the sidewalk and Park Avenue crossing Main Street and out to another subdivision on the other side of the railroad tracks. Mr. Walsh stated he had conferred with the Village Engineer about a sidewalk and he was told a sidewalk will be required along Main Street. He noted that there is a timing issue concerning whether the sidewalk is required to be installed at the time of construction of the proposed residence or if money could be set aside for construction of a sidewalk at a later date when other improvements are made in the Prairie View area. Commissioner Krug asked if the existing septic field and well will be filled in. Mr. Walsh noted the Village Engineer has stated the septic field in the area where the proposed residence is to be built will have to be taken out of service. The new sanitary sewer will run through the septic field so the field will need to be properly filled in. The well will be capped as required. Commissioner Krug asked where the other utilities are presently located. Mr. Walsh stated the natural gas line probably runs along the property line near the water line. The electric line is overhead across the street on the north side of Park Avenue. Commissioner Krug asked if the easement for the sanitary sewer will be divided equally between the two proposed lots. Mr. Walsh stated one lot will take a bit more of the easement area. He stated the Village Engineer was mainly concerned that repair vehicles be able to drive down the easement and he noted 14 feet should be sufficient. Commissioner Samuels asked if Lot 2 will be platted with building setbacks and side yard lines at the time of annexation. He said that the required building lines, setbacks, easements, etc. should be delineated on Lot 2 even though the existing structure will not comply with all of the required dimensions. These dimensions should,however, appear on the plat of subdivision so that future development on the property will comply with the zoning standards. Buffalo Grove Plan Commission-Public Hearing-June 3, 1998-Page 2 Mr. Walsh stated he assumes that anyone intending to build on that lot in the future would have to receive approval from the Plan Commission. Chairman Goldspiel noted the ordinance requires that the plat have the setback lines. Because this is a corner lot it needs a building setback line both on the north and east. The existing house would then become non-conforming in terms of compliance with the R-3 setback standards. Commissioner Trilling noted if the setbacks are shown on the plat of subdivision and the existing house is demolished,the Plan Commission would not review the plan for the new house if all required setbacks were met. Commissioner Viehman noted the situation with the sidewalk along Main Street on the east side of the property needs to be clarified for the petitioner. Mr. Kuenkler stated he has recommended the sidewalk be added at the time of construction of the proposed residence. Commissioner Krug stated he is in favor of adding the sidewalk at construction of the proposed residence. Commissioners Goldspiel, Howard, and Ottenheimer agreed that the sidewalk should be put in at the time of construction of the residence. Chairman Goldspiel noted that when the residence is constructed it will be subject to installing the sidewalk on Main Street. Mr. Raysa noted there should be some testimony relative to the variations. Mr. Walsh stated the variations are necessary because the lot is only 92 feet deep although it is very wide. The R-3 zoning requires 10,000 square feet which is consistent with Lot 2. Lot 1 is just barely under 10,000 square feet R-3 zoning requires a 30 foot front yard and 40 foot rear yard. This would not be feasible for building a residence. Therefore he is asking for a 30 foot rear yard. The front porch is a trellis front porch,not covered,which would not require a variance under the code. Mr. Pfeil stated he has discussed the porch issue with Mr. Schar who stated the term"trellis" is not the correct term for the proposed cover over the porch. Mr. Schar's assessment is that this is actually a projection that would require a variation. Commissioner Samuels agreed that the porch would be projecting into the required front yard setback since it would be attached to the house and have a foundation. These features make it a permanent structure that is subject to the front yard setback requirement. Buffalo Grove Plan Commission-Public Hearing-June 3, 1998-Page 3 Commissioner Krug noted that someone may eventually remodel the home and cover the porch. Therefore it would be better to address the variation now. Commissioner Krug asked if the same variation would go to Lot 2. Mr. Walsh stated no. Mr. Pfeil stated the porch is consistent with the design and style of the area and is therefore an appropriate feature to be added to this particular house. Chairman Goldspiel read the Notice of public Hearing as published in the Buffalo Grove Daily Herald, explained the procedure to be followed for the public hearing, and swore in all persons who wished to give testimony. They have a state license and would like one from the Village. Chairman Goldspiel noted the Village does not give out licenses; a child day care home can be permitted as a special use in residential districts if approved by the Village. Chairman Goldspiel asked how many children will be cared for. Buffalo Grove Plan Commission-Public Hearing-June 3, 1998-Page 1 Mrs. Zelenetsky stated it is a different number every day, although she is licensed for eight children. Mr. Zelenetsky stated the health officer,electrical inspector, and fire inspector were at the home and left instructions for items needing attention. All the work has now been done and they will be called for a reinspection of the premises. Chairman Goldspiel noted that there are also specific rules that govern the operation of such a day care. Mr. Zelenetsky stated his wife is familiar with the rules. Commissioner Samuels asked if the home day care center will be a benefit to the public and if it will serve the public. Mr. Zelenetsky stated most of the children and parents live in Buffalo Grove. Commissioner Samuels asked if the day care center is operated in a safe manner and no harm is brought to others. Mr. Zelenetsky stated yes. Commissioner Samuels asked if the children are comfortable with the space in the home and the area in the yard. Mr. Zelenetsky stated it is a large home and the yard is approximately 8,000 square feet. There is also a 6 foot high fence in the yard. Commissioner Samuels asked how many children the Zelenetskys have of their own. Mr. Zelenetsky stated they have only two grandchildren who visit but do not live with them. Commissioner Samuels asked if the day care children are kept quiet and orderly so that they do not bother the neighbors. Mr. Zelenetsky stated yes. He noted there are only 5 to 6 kids in the yard and are quiet except for the occasional crying of a child. Commissioner Samuels asked if it is convenient for parents to drop of their kids and if there is sufficient parking for drop off. Mr. Zelenetsky stated there certainly is sufficient parking on the street and four cars can be parked in his driveway. However, the children never come all together so there is not much of a Buffalo Grove Plan Commission-Public Hearing-June 3, 1998-Page 2 problem. Commissioner Samuels asked what time the children come and what times they are picked up. Mr. Zelenetsky stated the kids come around 8:00 a.m. and are usually picked up by 6:00 p.m. at the latest and rarely by 6:30 p.m. Commissioner Samuels asked if there is a play area for the kids in the yard and if there are any outside speakers. Mr. Zelenetsky stated the yard is large with a deck and kids toys and there are no speakers. Commissioner Samuels asked if there are any other day care centers in the area. Mr. Zelenetsky stated he did not think so. Chairman Goldspiel asked who cares for the children. Mr. Zelenetsky stated his wife and mother care for the kids. Commissioner Krug asked how long the day care has been operating Mr. Zelenetsky stated 3 years. Commissioner Krug asked when they first were told they needed to get a zoning approval for this operation. Mr. Zelenetsky stated Brian Shehan first notified them about a year ago. Commissioner Krug noted there is a huge evergreen tree on the right side of the driveway which has branches hanging over the sidewalk and this will need trimming before a permit is granted as it cuts down on sight for both cars backing up and children playing. Commissioner Krug asked if all 12 items specified by the health officer had been corrected. Mr. Zelenetsky stated yes and the only thing remaining was to have the Village back to inspect once again. Commissioner Krug noted the street is a very narrow street with a curve and on his recent visit there were cars parked on both sides of the street. Cars traveling faster than they should could cause a problem with cars backing out of the driveway, especially with the large tree there. Commissioner Ottenheimer asked how long cars are left when parents kids are dropped off Buffalo Grove Plan Commission-Public Hearing-June 3, 1998-Page 3 Mr. Zelenetsky stated his wife meets the parents at the front door. In the evenings the parents do take 2 to 3 minutes to pick up the kids. Commissioner Ottenheimer asked if the day care services are contracted for a certain period of time or if same is day by day. Mr. Zelenetsky stated there is no specific contract. They have some kids coming part time and other have been coming for quite some time. Commissioner Ottenheimer noted his concern with the maintenance of the landscaping and the failure to cut the grass. Mr. Zelenetsky noted this happened only one time when he had a problem with the lawnmower. Commissioner Howard noted that the parents dropping off children need to be instructed not to use the neighbors driveways to park and turnaround. Mr. Zelenetsky stated it did happen 2 to 3 times and he has asked them not to do so again. Commissioner Berman asked if the neighbors have ever brought their concerns relative to drop offs,traffic,parking and landscaping issues to the Zelenetskys. Mr. Zelenetsky stated no and the only time they heard anything was the one warning for the grass cutting. Commissioner Trilling asked what the ages of the kids are. Mr. Zelenetsky stated the kids range in age from 1 V2 to 6 years. Commissioner Trilling asked if Mrs.Zelenetsky takes care of any children after school for after school care. Mr. Zelenetsky stated this is an occasional occurrence. Chairman Goldspiel asked if there will be any changes in the number of children or the ages of children if approval is given by the Commission. Mr. Zelenetsky stated no because they can only have 8 children. Caroline Felton, 305 Windsor Drive, stated thepetition in effect creates a commercial property.p p rty. In addition there are screaming and crying children in the yard. Cars are in and out all the time with car doors slammed early in the morning. Cars are also parked in different directions and across my driveway. She noted the drop off is much lengthier than 2 to 3 minutes as these are Buffalo Grove Plan Commission-Public Hearing-June 3, 1998-Page 4 small children who require seat belts and various baggage taken out and brought in. In addition many young children now live on the block and there are serious risks to these childrens' safety. The house itself is in bad shape and the lawn maintenance and garbage are always in disarray. Commissioner Samuels asked if the general maintenance issues are somehow related to the operation of the day care facility or if they are issues that neighbors would be concerned with as to the appearance of the neighborhood. Mrs. Felton stated these issues are all devaluing her property as well as others on the block. Jane Edwards, 330 Windsor Drive, stated she is concerned with the increased traffic and the danger to all the new children on the block. Many cars block driveway and they are left idling while parents take their children into the home. Recently there were five cars picking up kids within a one hour period. This is a curved street which makes things even more difficult to maneuver. In addition the large evergreen at the edge of the drive to the day care home blocks the view for anyone coming from the north. The general upkeep at this home is also not consistent with the other residences on the street. There is also a total lack of consideration for the neighbors' properties. Two children have already been told not to ride their bikes on the neighbor's lawns and driveways close to cars. She stated she is asking the Commission to consider the public health, safety,morals,comfort and general welfare as stated in the zoning ordinance and reject this Special Use permit. Andrew and Gina Kapinos,286 Windsor Drive,stated their biggest concern is for their 3 children whose safety is jeopardized in front of their own house during the time children are being picked up at the day care home. She stated cars are parked on the grass oftentimes,pulling into her driveway and sometimes pulling out of driveways without looking and disregarding other children coming along. She further stated the grass is frequently uncut and the Village has been called many times. Walter Vail,295 Windsor Drive,noted he is concerned with the health standards and safety issues of the day care home. He noted if the exterior of the home is any indication of the interior of the home then there may well be health concerns. Garbage is often left out for days at a time. The lawn is left unmowed,paint is chipping on the house and shutters are hanging precariously on the side of the house. There is a discharging sump pump in the yard. The cars parked randomly and the tree are clearly a safety concern Chairman Goldspiel noted there is a distinct difference between a home day care and a commercial day care operation due to the size of the two operations. Commissioner Samuels noted the nature of the complaint seems to be that the use is too intense for the area and asked if there was any kind of compromise possible to make this operation more amenable to the neighbors. Buffalo Grove Plan Commission-Public Hearing-June 3, 1998-Page 5 1 Commissioner Trilling noted that under the ordinance a home day care operation can have between 3 and 8 children. Gloria Lorenz, 318 Windsor Drive,noted this home day care site presented a noise nuisance, extreme car congestion and various safety issues and was therefore not fit for this area. Bob Lorenz, 318 Windsor Drive, stated this area is not conducive to a day care operation. Mr. Felton stated that it often seems that the elderly mother living with the Zelenetskys is most often the one providing care for the children and not Galina Zelenetsky. Commissioner Viehman stated he was on Windsor at about 11:15 a.m. and stated there were many cars parked on two sides of the street and there seems to be a great deal of congestion there on a regular basis. Mr. Zelenetsky noted that many of the neighbors seem to dislike them because they are newcomers to the United States. In addition he noted that this day care operation is part of their income. All Commissioners were in favor of the motion and the motion passed unanimously with Commissioner Howard abstaining. Buffalo Grove Plan Commission-Regular Meeting-June 3, 1998-Page 1 COMMITTEE AND LIAISON REPORTS Commissioner Howard stated she attended the Village Board meeting on June 1, 1998 and noted the following items discussed: 1. Referral to the Plan Commission of the New Life Lutheran Church/Kensington School proposal at Buffalo Grove Road and Deerfield Parkway �✓ 2. Pre-application conference for the proposed development on Aptakisic Road east of the Wisconsin Central Railroad tracks with B-2 and B-4 zoning 3. Continuance of the public hearing for the Northwest Community Hospital antenna 4. Construction of a pedestrian overpass connecting Busch park and Willow Stream which has received a grant from the state WALSH PROPERTY. 16613 W. PARK AVENUE-ANNEXATION WITH ZONING IN THE R-3 DISTRICT FOR A TWO-LOT SUBDIVISION Moved by Commissioner Samuels, seconded by Commissioner Ottenheimer to recommend approval of to the Villagepetition for annexation with zoningin the R-3 One-Family Board of a p o Dwelling District and approval of a Preliminary Plan with the following variations: ZONING ORDINANCE - Section 17.40.020.B to allow the existing setbacks for the structures on proposed Lot 2 as delineated on the plat of survey dated May 6, 1995 and to allow a front yard setback of 25 feet(only for the proposed covered porch) and a rear yard setback of 30 feet for the residence to be constructed on proposed Lot 1,and to allow a lot area of approximately 9,770.4 square feet instead of 10,000 square feet for proposed Lot 1,pursuant to the testimony hereto and subject to: 1. Construction of a five foot sidewalk alongMain Street as part of the initial improvements on the property. Commissioner Samuels stated this proposal is an opportunity for both the petitioner and the Village to improve an area consistent with the Village's planning goals and the petitioners' needs. Chairman Goldspiel agreed with Commissioner Samuels' statement and further noted he very much liked the design of the plan which is consistent with the Village's concept for encouraging redevelopment in the Prairie View area. Commissioner Krug echoed Commissioner Samuels' statement and noted this proposal is a welcome addition to Buffalo Grove both in design and the fact that it is in keeping with the other structures existing in the area. Buffalo Grove Plan Commission-Regular Meeting-June 3, 1998-Page 2 Chairman Goldspiel called for a vote on the motion and the vote was as follows: AYES: Krug, Howard, Samuels, Berman,Trilling, Ottenheimer,Viehman, Goldspiel NAYES: None ABSTAIN: None ABSENT: Moons The motion passed 8 to 0. 296 WINDSOR DRIVE- SPECIAL USE FOR A CHILD DAY CARE HOME IN THE R-5A DISTRICT Moved by Commissioner Samuels, seconded by Commissioner Krug to recommend approval to the Village Board of the petition for approval of a Special Use to operate a Child Day Care Home in a single-family residence in the R-5A One-Family Dwelling District, subject to: 1. Compliance with all points suggested by the Village Health Officer's report. 2. Removal of the lower branches and obstructions to the line of sight of the evergreen tree at the driveway entrance. Commissioner Samuels stated there is a need for affordable day care in the Village. However, this property seems to be a totally inappropriate place for such a day care due to the overwhelming testimony by neighbors. He further noted the petitioner does not meet the Zoning Ordinance requirements for a Special Use. Commissioner Berman noted the use in and of itself is not inappropriate in this area. However, the traffic safety issue is a legitimate concern. Some of this traffic,however, appears to be the result of ignorance. Educating the day care customers relative to parking and other traffic issues may improve the situation. He stated he would suggest granting the Special Use for perhaps six months to determine if the petitioner can adequately remedy the problems. Another hearing could be held to provide neighbors the opportunity to comment and for the Plan Commission to review any new comments from the Police Department and other Village staff. At that time the Plan Commission could determine if sufficient improvements have been accomplished to warrant continuation of the day care operation. Commissioner Ottenheimer noted his agreement with Commissioner Berman but stated he is in favor of a three month trial period for the Special Use. Commissioner Viehman stated he is not convinced that the Special Use criteria have been satisfied and that the intensity of this operation is not in harmony with the area. Education of the people using the day care facility and the trimming of trees may not be sufficient improvements to allow a day care home at this property. Buffalo Grove Plan Commission-Regular Meeting-June 3, 1998-Page 3 Commissioner Krug stated he will not support this motion as he does not feel it meets the Special Use criteria, particularly items 1, 3 and 6. Commissioner Howard concurred with Commissioners Viehman,Krug and Samuels and specifically noted items 1, 3 and 6 of the Special Use criteria do not seem to have been met. Commissioner Trilling stated item 3 of the Special Use criteria..."That the special use will not be injurious to the use and enjoyment of other property in the immediate vicinity of the subject property for the purposes already permitted in such zoning district,nor substantially diminish and impair other property valuations with the neighborhood"...is the strongest argument against the motion. This coupled with the safety concerns of the residents does not bode well for this operation. However,he noted the petitioners can still have three children in their home without any approval from the Village and therefore it may be best to try a Special Use for a three month period to give some cohesiveness to the neighborhood and allow for the requirements to be met. Chairman Goldspiel noted there have been other home day care hearings before the Commission which had neighbors and parents come in support of the petitioners,whereas in this case it appears no efforts to harmonize with the neighborhood have been made and he is therefore not comfortable with even a restricted special use. Chairman Goldspiel asked if there is any time restriction for bringing a new petition. Mr. Pfeil stated no. Mr. Raysa stated no. He further noted that in theory the new petition should address deficiencies that were identified in the initial hearing process. Commissioner Berman noted his concern with the fact that there appears to be a cultural problem here as well as a lack of understanding of what is involved. He stated it is not fair to shut down this business which may not be readily able to restart. He further noted Commissioner Trilling's statement that 3 children will be allowed without any Village approval is a valid one and noted that the problem here appears to be that the neighbors are not communicating. Commissioner Samuels noted the burden is always on the petitioner to prove everything is being done to comply with the special use requirements and to provide a safe and pleasant use. Commissioner Trilling noted the petitioner will certainly continue to operate with three children and therefore some guidance may provide a better situation and solution for all concerned. Commissioner Samuels stated this petitioner has done nothing to meet the requirements of the statute. In all the other cases,petitioners have done all they can to create a conducive environment. Buffalo Grove Plan Commission-Regular Meeting-June 3, 1998-Page 4 Commissioner Viehman stated he would like to call the motion. Commissioner Ottenheimer noted the motion should be subject to a three month special use which will give the Plan Commission a certain degree of control and will also alert the Village Authorities to take a very close look at enforcement. Commissioner Berman stated he would agree to a 3 month special use permit with a limit of 5 children for the day care home. Commissioners Samuels and Krug accepted the amendments to the motion for a 3 month special use permit with 5 children on the premises. Mr. Pfeil noted the Village Health Officer would have to make regular inspections of the premises. Chairman Goldspiel called for a vote on the motion and the vote was as follows: AYES: Berman,Trilling, Ottenheimer NAYES: Krug, Howard, Samuels,Viehman, Goldspiel ABSTAIN: None ABSENT: Moons The motion failed 5 to 3. STAMELOS' SUBDIVISION(AMOCO. LAKE COOK ROAD/IL ROUTE 83)-PLAT OF SUBDIVISION Moved by Commissioner Krug, seconded by Commissioner Viehman to recommend approval to the Village Board of the Final Plat of the Stamelos Subdivision dated January, 1998 as submitted. Chairman Goldspiel asked if the Village Engineer had reviewed the plat and if same complies with all requirements. Mr. Kuenkler stated yes and recommended approval. CHAIRMAN'S REPORT Chairman Goldspiel noted volunteers are needed for committees to participate in discussions concerning revisions to the Zoning Ordinance and the Development Ordinance. The Zoning Ordinance Committee will be meet from 8:00 to 10:00 a.m. on the 2nd and 4th Tuesdays of the month.
