Chairman Goldspiel called the hearing to order at 7:30 p.m. in the Village Council Chambers,
Buffalo Grove Municipal Building, 50 Raupp.Boulevard, Buffalo Grove, Illinois. Chairman
Goldspiel read the Notice of Public Hearing as published in the Buffalo Grove Daily Herald,
explained the procedure to be followed for the public hearing, and swore in all persons who
wished to give testimony.

Ms. Liberman stated she plans to have no more than 8 children in her home at any time of the day.
She stated she plans to allow 3 school age children to be dropped off at her home by parents in
the morning. These children will be in the home until the school bus arrives to pick them up
which would be before 8:30 a.m. From 9:00 a.m. she plans to care for children younger than age
5 until 5:00 p.m. when they are picked up by their parents. By 5:00 p.m. school age children
might be dropped off at her home if there is a need for additional care until their parents come
from work which is usually around 6:00 p.m.
`./ Commissioner Samuels asked if the petitioner had reviewed the special use ordinance and if she
plans on complying with all the terms of the ordinance.
Ms. Liberman stated she plans to comply with all requirements of the ordinance.

Commissioner Samuels asked if the petitioner had notified her neighbors of her desire to run a day
care out of her home and if there had been any objections.
Ms. Liberman stated she has notified her neighbors and has received no objections.
Commissioner Samuels asked if the street is a busy in terms of vehicular traffic.
Ms. Liberman stated it is an average residential street in terms of traffic.
Commissioner Samuels asked if there is anything about the location of the house on the street that
makes it difficult for people to drive past the house or see around the corner of the house
Ms. Liberman stated no, not to her knowledge. She stated there is a two car garage with plenty
of parking space.
Commissioner Samuels asked if there is enough room for parents to drop off and pick up their
children without blocking traffic or interfering with other neighbors' driveways.
Ms. Liberman stated yes.
Commissioner Samuels asked if parents dropping off or picking up kids honk their horn.
Ms. Liberman stated no.
Commissioner Samuels asked how long on average it takes someone to drop of their children.
Ms. Liberman stated it takes no more than about 3 minutes. The child walks in and is greeted by
her whereupon the parent leaves.
Commissioner Samuels noted the petitioner had received a memo from the Health Department
and Fire Department relative to various items requiring attention.
Ms. Liberman stated she has discussed the items requiring repair and has agreed to correct all
necessary items.
Commissioner Samuels asked if she has already received a license from the State.
Ms. Liberman stated her license was issued about three weeks ago.
Commissioner Samuels asked if the children are confined to only certain rooms in her home.
Ms. Liberman stated the only rooms the children will not be in are the laundry room or the
garage.

Commissioner Samuels asked if the home is large enough to accommodate the number of children
planned on being there.
Ms. Liberman stated yes. She stated she has been in the business for 12 years and is confident the
home will work.
Commissioner Ottenheimer asked where Ms. Liberman did this work before applying for the
license.
Ms. Liberman stated she had a professional day center for four years in DesPlaines. Before that
she also had a home license.
Commissioner Ottenheimer asked if the petitioner would be the only supervisor in the house.
Ms. Liberman stated she will have help from an aunt who will be living with her. This will enable
her to be with the children at all times while her aunt does the cooking, cleaning and helping with
the children.
Commissioner Ottenheimer asked if the children will be playing outside.
Ms. Liberman stated yes, in the backyard.
Commissioner Ottenheimer asked if there were facilities for the kids in the backyard.
Ms. Liberman stated yes
Commissioner Ottenheimer asked if the yard is fenced.
Ms. Liberman stated the yard has a 4 foot high chain link fence.
Commissioner Trilling asked if the petitioner has any children of her own.
Ms. Liberman stated has a 4 year old son who will also be under her care.
Commissioner Trilling asked if the petitioner was starting fresh or has children ready to come to
her house from her previous place.
Ms. Liberman stated she has people waiting for her to open up who are her clients from the day
care center she previously owned.
Commissioner Trilling asked for a breakdown of how many children would be in the home at any
one time.

Ms. Liberman stated the school age children would be picked up by the school bus around 8:00
a.m. By 8:30 to 9:00 a.m. the rest of the five children come in and usually these children are
taken home by 5:00 p.m. The school age children also come back to her until the parents pick
them up.
Commissioner Trilling noted the school age children will more accurately be coming home around
3:00-3:30 p.m.
Ms. Liberman stated that is probably correct.
Commissioner Trilling asked the petitioner if she has a good relationship with her neighbors.
Ms. Liberman stated she certainly hopes so.
Commissioner Trilling asked how long the petitioner has been living in her home.
Ms. Liberman stated she just moved a couple of months ago. There was a great deal of work to
do before moving in.
Commissioner Viehman asked how many infants would be cared for.
Ms. Liberman stated there are two infants with the rest of the children between ages 2-6.
Commissioner Viehman asked how many children would be in her home between 3:30 to 5:00
p.m.
Ms. Liberman stated it would be just 8.
Commissioner Viehman asked if the driveway is adequate to accommodate several cars coming in
at a similar time.
Ms. Liberman stated it is adequate for at least 4 cars.
Commissioner Howard noted she would like to be assured that if any problems or concerns do
come up with the neighbors,the petitioner will address those concerns with the neighbors. She
further noted she herself used to live in the style of house Ms. Liberman is in and such a home can
adequately take care of 8 kids. In addition the parking situation should be manageable with the
kind of driveway there.
Commissioner Viehman asked when the items on the inspection memorandum will be taken care
of so that there can be a reinspection.
Ms. Liberman stated she hopes the work will be finished in a couple of days.

Commissioner Ottenheimer asked if the petitioner would be willing to commit to educating the
parents of the children that they must not honk horns and must obey all parking laws.
Ms. Liberman stated yes.
Rosie Makagon, 606 Armstrong Ct., stated she is one of the parents who is waiting for this day
care operation to start. She stated she has had her daughter with Ms. Liberman for three years
now and can only say she is a wonderful day care provider because she does a great deal for the
children.
Larry Tresness, 360 Springside Ln, stated his concern is mainly for the safety of the children as
there is a lot of traffic on the street from school buses and garbage truck.
Donna Stewart, 350 Springside Ln, stated that when she bought her house 29 years ago she did
so with the idea that she was buying a house in a residential area and she objects to the fact that
someone has bought a house with the purpose of opening a business.
Mr. Makagon, 606 Armstrong Ct., stated his kids have been with Ms. Liberman for a long time
and he has tremendous confidence in her abilities. He further noted the kind of parents dropping
off kids at the home are very solicitous of the neighbors. Every parent always walks their kids
into the home. In addition, not all parents arrive at the same time or pick up at the same time.
Commissioner Viehman asked where the school bus pickup was located.
Ms. Liberman stated the bus usually brings the child to the house. She has not as yet verified
where the bus comes.
Commissioner Viehman asked if the petitioner was currently residing at 371 Springside Lane.
Ms. Liberman stated yes.
Commissioner Samuels suggested that the petitioner make an attempt to insure this business use
of their home is not apparent to the neighbors and to keep control of the children as to the amount
of noise in the backyard and to try and stagger drop off and pick up times so that not everyone
arrives at once. This will help to insure that it does not appear as though there is a business in the
residential neighborhood.
Ms. Liberman stated she understands.
Chairman Goldspiel asked what school the bus will be taking the children to.
Ms. Liberman stated she does not even have these school children yet. So far, she only has pre-
school children.

Moved by Commissioner Samuels, seconded by Commissioner Ottenheimer to recommend
approval to the Village Board of a petition for approval of a Special Use to operate a Child Day
Buffalo Grove Plan Commission-Special Meeting-September 23, 1998-Page 1
Care Home in a single-family residence in the R-4A One-Family Dwelling District, at 371
Springside Lane, pursuant to the testimony given and the contents of exhibits, subject to:
1. Compliance with the recommendations of the Building and Zoning, Health and
Fire Departments.
Commissioner Viehman stated he finds nothing unfavorable about the petition other than the
necessary requirements to meet the upgrades as noted in the inspection. It appears that the
petitioner has at least had some background and experience in the field. The location of the house
and street appear average as to traffic so that staggering drop offs should pose no further
problem. Therefore he will support the motion.
Commissioner Samuels stated he agrees with Commissioner Viehman's comments and further
believes the petitioner has met the criteria set forth in the statute for satisfying the special use.
She has established a need and it serves the public convenience. Further this day care home
would not unduly overburden the streets or be a burden to the neighbors or neighborhood. He
cautioned the petitioner to be sensitive to the neighbors and try and operate this so that it appears
transparent to the neighborhood. The testimony has been consistent with the establishment of the
special use and he will support the motion.
Chairman Goldspiel noted the purpose of the special use is to make sure that something out of the
ordinary within any area is compatible and not harmful to the rest of the area. In two years if
there is any problem, it will come to the attention of the Village. The ordinance tries to make it
both feasible for the day care and also for the neighborhood.
Chairman Goldspiel called for a vote on the motion and the vote was as follows:

The motion passed 7 to 0.
The special meeting was then recessed at 8:20 p.m. and reconvened at 9:10 p.m.
LONG GROVE CONFECTIONERY. 333 LEXINGTON DRIVE.EXPANSION OF A
SPECIAL USE CONCERNING RETAIL SALES IN THE INDUSTRIAL DISTRICT
Moved by Commissioner Samuels, seconded by Commissioner Viehman, to recommend approval
to the Village Board of the petitioner for approval of a Special Use for expansion of an accessory
retail sales use in the Industrial District with the following variation: Zoning Ordinance- Section
17.48.020.C.14.b. (To allow a retail sales area of approximately 2,800 square feet) in order to

expand an existing retail sales area of 511 square feet to approximately 2,800 square feet
pertaining to the property commonly known as 333 Lexington Drive, pursuant to the testimony
presented at the public hearing and the exhibits submitted therewith, subject to:
1. Petitioner's willingness to continue to have access to offsite overflow parking at
252-60 Lexington Drive
Mr. Raysa stated the Village can require conditions on a special use such as extra parking or
hours of operation, etc.
Commissioner Samuels stated this is a desirable addition to the property and it will make the
property nicer and more useful. It will have favorable impact as far as sales tax generation and is
within the purview of what was intended for the adjunct use of being an outlet for the sale of
product that is manufactured on the premises. The petitioner has explained the additional square
footage requirement as wanting to make a nicer facility as opposed to just cramming additional
merchandise into an area. This will, therefore, be an enhancement both to the property and to the
village. He further noted that since there have been no negative comments from either the
industrial or residential neighbors, there is apparently no feeling that the existing retail use is
overburdening the street systems or anything else. He stated he therefore does not see this
expansion increasing traffic very much and sees nothing negative about the request.
Commissioner Ottenheimer stated the plans for the expansion appear to have been well thought
out and makes a great fit to what already exists. He therefore is in favor of the motion.
Commissioner Viehman stated he believes the petitioner has indicated his desire to maintain the
harmony within the industrial park he is operating in and will try to keep things going without
drawing attention to his operation.
Commissioner Moons stated he definitely looks forward to the expansion and to the possible
tours later on.
Chairman Goldspiel noted his concern with introduction of too much commercial use within the
Industrial District. He stated he is also mindful that one cannot go to far in saying that because a
particular company is compatible with the Village's objectives,you approve on that basis alone.
This is because buildings get sold and things change and the use goes on. However, because of
the availability of the overflow parking, and the smaller nature of this particular kind of retail
activity, he will support this motion.
Chairman Goldspiel called for a vote on the motion and the vote was as follows:

The following exhibits were presented by the petitioner at the public hearing:

Mr. Irelan stated Long Grove Confectionery is proposing to expand their existing outlet facility to
approximately 2800 square feet. This facility is located in an industrial park and this would be a

special use expansion. He stated they have previously submitted documents to the Appearance
Commission and have received approval on the size of the property, the overall appearance of the
property and the proposed parking for the manufacturing portion of the facility as well as the
office environment.
Mr. Irelan stated they have reviewed parking requirements for the proposed retail area at a rate of
1 parking space per 250 square feet which requires 12 spaces. Currently parking for the whole
facility stands at a requirement of 119 spaces and they are presently showing 125 spaces.
Mr. Irelan noted the proposed retail space is presently at the southwest corner of the site which
faces toward the south. Parking for the retail.is among the first twelve spaces which includes a
handicapped space. The office personnel will park along the south towards the east side of the
property entering about the middle of the facility. The manufacturing employees will park along
the back or the north side of the property and enter the building structure from the north side
through an employee entrance. The triangle shape on the drawing is where the retail will be
housed and currently is the office space.
Commissioner Samuels asked how many employees are currently employed.
Mr. Dwayne Hallan stated 85 employees are currently employed.
Commissioner Samuels asked if this is a 24 hour operation.
Mr. Irelan stated there are two shifts.
Commissioner Samuels asked how many parking spaces there are now for the 85 employees.
Mr. Irelan stated there are 46-52 spaces now. At this point there are approximately 8-10 spaces
designated for retail and the balance is for employees. There is off-site parking leased from a
neighboring site across the street which amounts to 10 more spaces. The majority of employees
drive in car pools.
Commissioner Samuels noted that the facility is then somewhat under parked at present.
Mr. Mangel stated they are not under parked. The only time they ever have anyone parking out
on the street is once a year when they have an open house for the community for the Easter open
house. Otherwise there is never a parking problem. He stated they have a number of car pool
situations which will continue. He stated the purpose of this expansion is to allow them to
consolidate their operations under one roof and to do the storage of their product on the premises
and to bring in some other machinery which they do not have space for. They now have a 12,500
square foot building at 708 Armstrong which is half Long Grove Confectionery products and
another 10,00 square foot building at 260 Lexington Drive used for storage. In addition to that
they have a cold storage warehouse in Chicago to which 500-600 pallets of merchandise is sent.

Therefore, they will not be adding that many more employees, it is more a matter of consolidating
all operations under one roof Mr. Mangel noted they have the building at 260 Lexington which
has 32 parking spaces now and that is and would be available for any overflow parking at peak
times.
Commissioner Samuels asked what operations would continue at this 260 Lexington building.
Mr. Mangel stated it is possible they will use it for some additional off premises storage and used
equipment. There is no manufacturing presently on that site and none will be done there. At the
present time they have their creative department housed in the building which does all the catalogs
and boxes and packaging. There is some storage in the back of the building.
Commissioner Samuels asked what kind of traffic is received now at the 500 foot retail space.
Mr. Mangel stated they average anywhere from 20-50 customers per day. Before a holiday, this
number does go up but then they take advantage of the leased parking spaces across the street
and move the employees there. They would also move employees to the 260 Lexington building
for parking also.
Mr. Mangel stated there has never been a complaint by the Fire or Police Departments relative to
parking and the traffic has never been a problem there.
Commissioner Samuels asked how the proposed space compares to the other average retail store
locations.
Mr. Mangel stated the stores are anywhere from 1500 to 700 square feet in size.
Commissioner Samuels asked how the volume at this outlet compares with the retail stores.
Mr. Mangel stated the average sale in the outlet store is significantly larger than most of the retail
stores because they are selling the candy at discount prices. It is mostly overruns and what they
consider seconds.
Commissioner Samuels noted he is concerned with only 12 parking spaces for a store that is five
times the size of the current store which will be twice as large as any of the other retail stores.
Mr. Mangel noted the parking for the manufacturing and office is based on Buffalo Grove
standards by square footage. They hope that with some of the new equipment being brought in
they will not be adding that many, if any, new production people.
Mr. Mangel further noted they still have the 10 leased spaces across the street and the 32 spaces
at the 260 building. It has not been a problem in the past and their hope is not to add additional
office personnel to avoid any problems.

Commissioner Samuels asked about sales and security people for that large a retail facility.
Mr. Mangel stated security has never been a problem for them. They have a security camera
system in the factory which they will upgrade and continue to use.
Commissioner Samuels asked why the petitioner feels there is a need to go beyond the 1,000
square foot limit under the ordinance.
Mr. Mangel stated that as their capacity and production goes up they will have more product to
house and they want to be able to sell it here instead of opening up another outlet location
elsewhere. He further noted they have done a lot of traveling around the country and have seen
interesting things that might be good to put in here in the way of packaging items to make it more
interesting to the people who come in here. The space will not be packed full. They want the
space to allow people to see the items well and be able to walk around.
Commissioner Viehman noted there is a considerable expansion to the office space under this plan
and asked if this is also a consolidation process.
Mr. Mangel stated they do not anticipate using more than 10,000 square feet but they do need a
fairly significant display room which they do not have at the present time. Most of the
photography done for the catalog will be done here now. They do not have an archive room and
they need space to keep that in. That type of stuff occupies a fair amount of things but does not
have people to go along with it.
Commissioner Viehman asked if the number of 85 employees is total and complete.
Mr. Mangel stated yes. The second shift of about 40 people has been operated for quite some
time and does not include more than one or two office people. The shift hours are 5:00 a.m. to
2:00 p.m. and 2:30 to 10:00 p.m.
Commissioner Trilling asked how many of the 85 employees are office people and production
people.
Mr. Hallan stated there are about 20 office and executive people and about 60 production people
and about 5 who are a combination of maintenance and repair.
Mr. Raysa noted the petitioner is showing 92 employees on Exhibit A-15.
Mr. Irelan stated there are currently 45 people on the second shift, first shift is 60 and corporate is
L./ 20 amongst all three locations.
Mr. Mangel stated they have 4 full time workers in the creative department at the 260 building.

Commissioner Trilling asked if the office personnel might be expanded.
Mr. Mangel stated it is their hope to keep only the number of office employees they have now
despite a new computer system.
Commissioner Trilling asked about the office space layout.
Mr. Mangel stated they have not yet started those plans.
Commissioner Trilling noted this building must be looked at for future tenants if for any reason
Long Grove Confectionery should move out..
Mr. Mangel stated the manufacturing part of the building was designed so that all the
manufacturing walls on the inside can all be leveled and opened up as one large 16 foot high open
area. The back is designed so that it can be opened up as 18 feet high. This building could then
be a warehouse or manufacturing type of facility with the 20,000 square feet on the second floor
as office space.
Commissioner Trilling asked about tours to the building.
Mr. Mangel stated they hope to have tours again when the expansion is complete. He said they
have an area that could hold one or two buses without a problem.
Mr. Irelan stated bus tours would be pre-scheduled tours with the bus entering on the north side
of property, circle the facility to the east. Guests would then enter on the southeast corner of the
facility after which the bus would continue back around to the north where the buses could park.
When the tour ends, a pager could be used to summon the bus back for pickup.
Commissioner Trilling noted there are no landscape islands for parking and asked if they are not
required.
Mr. Pfeil stated the ordinance does require a landscaped area of 180 square feet for every 20
parking spaces. There has been some flexibility in the application of that ordinance but
compensatory landscaping of some type would be placed on the property usually to screen the
property from the street. He stated he would have to check the landscaping plan reviewed by the
Appearance Commission to see if that type of concept was used here.
Mr. Irelan stated the landscape plan would be presented to the Appearance Commission shortly.
He noted they are planning trees along the perimeter of the property matching what is existing in
the property. Some screening will be done at the approaches to both parking lots, while
maintaining visibility for existing the property.
Ms. Howard asked how long the average customer stays to shop.

Mr. Mangel stated it is about 15 minutes.
Commissioner Moons asked if this is part of the property which was re-subdivided when the
Hastings property was incorporated into the Village.
Mr. Mangel stated yes. He noted they bought the back half of the property from the Missner
family.
Chairman Goldspiel asked if the parking computation is correct.
Mr. Pfeil stated they used the standard of one space per 250 square feet of floor area which is the
general retail standard applied in the Industrial District. The parking calculations provided by the
petitioner appear to be correct.
Mr. Mangel stated they pride themselves on trying to do unusual and good displays and make
things interesting. He noted they intend to take a good part of the area and put large chocolate
sculptures out as well as lots of interesting things for kids and customers. One area of
approximately 250 square feet will be devoted to decorating plaques. This area will not be
packed full of stuff He stated it will be more whimsical with mechanical displays and not just
merchandise.
Chairman Goldspiel asked what happens to the special use here if the building is sold.
Mr. Raysa stated it would run with the land.
Chairman Goldspiel stated he is concerned about the commercial aspect of this building once it is
sold.
Mr. Pfeil stated the special use in the Industrial District is supposed to be for products that are
manufactured on the premises. A business would not have the right to sell anything that was not
manufactured on the premises without getting a specific variation of the ordinance regulations.
Mr. Raysa stated the special use does run with the land but within that case law also comes that
the Village would be able to put certain conditions on that special use. So the ordinance might be
drafted to pertain more to only Long Grove Confectionery.
Mr. Pfeil asked if it could also be stipulated in the special use that off-street parking will provided
off-site for employees if necessary to accommodate the parking demand for the retail area.
�.J Chairman Goldspiel asked how far should the Commission go in allowing commercial in an
Industrial District. He stated he would like some reassurance that this will not create problems
with truck traffic issues because there is too much commercial going on.

Mr. Mangel stated the way the building will be set up, the two existing loading docks on
Lexington will be strictly for shipping and receiving will be on the north side of the building. As
far as parking is concerned, he noted the most recent tent sale created no parking problem for
customers as employees parked elsewhere.
Mr. Raysa suggesting entering Exhibit A-16 into testimony as there are some differences. New
production on A-16 shows 40,000 square feet whereas A-15 it shows 39, 917 square feet.
There being no further comments or questions from anyone else present, Chairman Goldspiel
closed the public hearing at 9:10 p.m.
