Subject Property: The approximately 3.84 acres located at 940 McHenry Road

Chairman Sheldon called the public hearing to order at 7:39 P.M. in the
Municipal Building, 50 Raupp Boulevard, Buffalo Grove, Illinois.

Chairman Sheldon read the notice of the public hearing as published in the
Buffalo Grove Herald and informed the audience of the format the meeting
would take. She then swore in Mrs. Dojutrek.
The exhibits used in the hearing were those contained in Mr. Pfeil's May 29,
1987 memo to the Plan Commission titled Dojutrek Subdivision Preliminary Plan
- Public Hearing.
Ms. Dojutrek explained they have a barn and old farm house on the property
now and would like to build a single family residence. It is zoned R-3.
They have to subdivide the site into two parcels to do this. The home would
be built in a park like setting and they would not disturb the surrounding
area. They would be building a 2,800 square foot single family, two story
residence. Only one apple tree will be removed. The house would be in
between the existing trees with a drive coming in and going around the trees
to the house. The building would be 78' from the lot line. The gravel drive
will remain. They would be making a connection into an existing storm sewer
in the rear and provide a little detention in the front with berming of a low
spot. They are requesting a well because there is no close connection to
Village water.
Mr. Skelton stated that if in the future the land were to be developed, they
should be required to remove the non conforming use. This could be covered
by a covenant which would state that upon sale all of the requirements of the
Village would have to be met. There is room for emergency vehicles. They
presently rent the farm house out.
Commissioner Davis was concerned with the variation for a well.
Mrs Dojutrek stated they are requesting a variation of the 4' right-of-way
for a sidewalk and are providing a 5' easement instead. The waiving of the
parkway tree requirement is requested because there are approximately 158
existing trees on site, many of which are along Route 83.
Commissioner Goldspiel does not see a way that the variation for the water
could be granted because of the agreement for Lake Michigan water. He would
like to see anything that would allow this in the Development Ordinance.
Staff and legal were requested to inform the Commission where the Village
would get the authority to vary the water hook up.
Mr. J. Erickson felt the distance from the house and the Shady Grove water
line is well beyond 200' . He was concerned that the area would remain
residential.
Ms. Dojutrek stated that they would probably go down 300' for a well.
Commissioner Goldspiel felt that the Commission needed some shallow aquifier
information.
An unidentified resident stated he liked the present park setting on site and
was concerned if a variation was granted that no other buildings be built on
this land and that the Village ordinance applies so that the property values
of the surrounding residences will not be effected.
Chairman Sheldon closed the public hearing at 8:15 P.M.

treatments and waiving of mechanical aeration requirement) ; and Section
16.50.030.D.17.b. (waive 6:1 slope and paved access requirements for open
drainage) . ZONING ORDINANCE Variation: Section 17.44.040.D.4. (to allow 20
foot setback) .

Chairman Sheldon welcomed new Commissioners Silz and Lundine.
COMMITTEE & LIAISON REPORTS
Mr. Davis attended the June 1, 1987 Village Board meeting. Mr. Pfeil noted
that the Otis Office Preliminary Plan and annexation agreement were approved.
Chambord was also approved.
DOJUTREK SUBDIVISION
Moved by Commissioner Musfeldt, seconded by Commissioner Goldspiel and
unanimously carried that the Plan Commission defer consideration of the
Dojutrek parcel until the next regular scheduled meeting of June 17, 1987 to
allow time to research some of the points raised in the public hearing.

CHEVY CHASE BUSINESS PARK-EAST PRELIMINARY PLAN
Since there was no public hearing, there was nothing for the Commission to
review.
BUFFALO GROVE TOWN CENTER
Moved by Commissioner Goldspiel, seconded by Commissioner Davis to defer
consideration of the final plat of subdivision for the Buffalo Grove Town
Center until June 17, 1987.
Discussion:
Mr. Pfeil noted that Mr. Balling has requested that the Commission approve
the plat subject to the Village Engineer's approval.
Commissioner Goldspiel noted there are no interior angles and there has not
been a review by the Village Staff on the plat. The Commission has never
approved a plat under these conditions. He felt the plat was not in
compliance with the Village code and should be reviewed by staff. The street
that runs from Buffalo Grove Road to Checker and on to Route 83 is not
dedicated and he thought it was supposed to be. The angles were absent and
he questioned if the developer owns the entire site.
Mr. Schwartz noted they have a very close time table and would appreciate
action on this item at this meeting. The Assistant Village Engineer has
reviewed the plan. Once the Commission votes on this it goes to the Board
for another review. The final plat of subdivision has to be modified by the
Village Board. He felt that they had the plat in the Village on time and
were not aware that Mr. Kuenkler would be on vacation or they would have made
plans accordingly.
Mr. Brim stated it was their understanding that all of the proposed roads,
including those to be dedicated were to be shown as presented per discussion
with the Commission at the September 24, 1986 meeting.
Mr. Haeger stated that bearings are angles.
Commissioner Goldspiel stated the Village requires both bearings and angles.
Mr. Schwartz noted the developer owns the complete site.
AYES: Commissioners Goldspiel, Davis, Krug, Katz, Silz, and Lundine
NAYES: Commissioner Musfeldt
ABSTAIN: None
ABSENT: Commissioner Rhodes
The motion passed 6 - 1.
The Commissioner Davis' suggesting the Commission was poled and they agreed
to hold a special meeting on June 10, 1987 to discuss the Dojutrek and Town
Center projects.

CHAIRMAN'S REPORT
Chairman Sheldon reported on several threatening phone calls from residents
opposed to the Otis development. It seems there are three groups of
residents, one that wants nothing built on the site, one that wants
residential and one that would accept the plan without the food store.
The developer has suggested he might drop the food store. A meeting will be
held between June 7, 1987 and June 15, 1987 between 2 representatives of the
homeowners, Trustee Reid, staff and Chairman Sheldon.
Two letters from irate residents opposed to the Otis development addressed to
the Trustee's will be copied and distributed to the Commission.
Commissioner Davis felt that unlisted home phone numbers of Commissioners
should not be given out to the public. He has received several threatening
phone calls the past week.
Mr. Pfeil will check into the Taco Bell proceeding with development before a
signed final plat and the Building Department will check the footings of the
building.

Moved by Commissioner Davis, seconded by Commissioner Musfeldt, and
unanimouslycarried to the meeting. Chairman Sheldon adjourned the
