A RESOLUTION AUTHORIZING EXECUTION OF A
CONSENT AGREEMENT WITH SDG DUNDEE RD LLC
WHEREAS,the Village of Buffalo Grove is a home rule unit pursuant to the ILLinois Constitution
• of s97o;and
WHEREAS,SDG Dundee Rd LLC is the ovcmer of certain real property located in the Village of
Buffalo Grove,WheeLing Tovvnship, Cook County, fllinois,commonly knovcm as gs5 Dundee Rd.,
Buffalo Grove, ILLinois 6008g;and
WHEREAS,SDG Dundee Rd LLC and the Buffalo Grove Park District, Illinois,an Illinois Park
District("Buffalo Grove Park District")entered into that certain Nonexclusive DriveWay Access
Easement Agreement;(°Easement Agreement")and
WHEREAS,The Village is the hoLder of certain rights of reverter contained pursuant to a
Warranty Deed dated August 8,s978, recorded on August 8,s978,as Document No.24573�53
("Village Deed")in the Cook County, Illinois Recorder of Deeds With respect to Bison Park;and
WHEREAS,the VilLage has agreed to consent to the terms of the Easement Agreement and
to subject and subordinate the Village's right of reverter contained in the Village Deed to said
Easement Agreement,only insofar as required under the Village Deed to alloW for the improvements
set forth in the Easement Agreement,all conditioned upon SDG Dundee Rd LLC's satisfaction of the
terms and conditions set forth in this Consent Agreement attached as Exhibit A.
NOW THEREFORE,BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF BUFFALO GROVE,COOK AND LAKE COUNTIES,ILLINOIS,as folLoWs:
SECTION 1. The foregoing recitals are hereby adopted and incorporated and made a part of this
Resolution as if fuLLy set forth herein.
SECTION 2.The VilLage Manager is authorized to execute the Consent Agreement vvith SDG Dundee
Rd LLC.
SECTION 3. If any section, paragraph,clause or provision of this Resolution shall be held invalid,the
invalidity thereof shall not affect any other provision of this ResoLution.
SECTION 4. This ResoLution shaLl be in full force and effect from and after its passage and approval
and not be codified.
