AN ORDINANCE VACATING CERTAIN PUBLIC STREETS
and RIGHT OF WAY IN HORATIO GARDENS SUBDIVISION
(FRANK AVENUE)
WHEREAS, the Village of Buffalo Grove is a Home Rule Unit pursuant to the Illinois
Constitution of 1970; and
WHEREAS, the hereinafter described public street and right of way in the Horatio Garden
subdivision is a municipal right of way and is currently unimproved and no longer necessary; and
WHEREAS, it has been determined that the lands abutting Frank Avenue are owned by
the Village of Buffalo Grove; and
WHEREAS, the Corporate Authorities have determined that the nature and extent of the
public use or public interest to be subserved is such as to warrant the vacation of said public street
and right of way and that the relief to the public from any burden and responsibility of maintaining
same constitutes a public use or public interest authorizing said vacation.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES,
ILLINOIS.
Section 1: The preambles hereto are hereby incorporated and made a part if this
ordinance.

Section 2: The following described public street and right of way be and hereby is
vacated:
THAT PART OF FRANK AVENUE IN HORATIO GARDENS, BEING A
SUBDIVISION OF PART OF THE SOUTH 1/2 OF THE NORTHEAST 1/ OF SECTION
33 AND PART OF THE NORTHWEST 1/ OF SECTION 34, TOWNSHIP 43 NORTH,
RANGE 11, EAST OF THE THIRD PRINCIPAL MERIDIAN, ACCORDING TO THE
PLAT THEREOF RECORDED JULY 13, 1927 AS DOCUMENT NUMBER 302090,
LYING SOUTHWESTERLY OF A LINE BEING DRAWN 210.00 FEET
SOUTHWESTERLY OF AND PARALLEL WITH THE SOUTHWESTERLY RIGHT
OF WAY LINE OF THE WISCONSIN CENTRAL LTD., RAILROAD (FORMERLY
THE MINNEAPOLIS ST. PAUL & SAULT ST. MARIE RAIL WAY), IN LAKE
COUNTY ILLINOIS.
Section 3: A Plat of Vacation of said public street and right of way is attached hereto
and made a part hereof as Exhibit "A".
Section 4: That title to said vacated public street and right of way is hereby declared
to be vested in the Village of Buffalo Grove, who is the owner of the subdivided land abutting said
public street and right of way.
Section 5: This ordinance shall be full force and effect from and after its passage by
the affirmative vote of at least three-fourths (3/a) of the Village Trustees then holding office. This
ordinance shall not be codified.
