SUMMARY: Adoption of this ordinance is required annually and,esbxbilshes the
effective prevailing wages for both Cook and Lake Counties for the calendar
beginning June 1, 2002 through May 31, 2003.

CALL TO ORDER
President Hartstein called the meeting to order at 7:32 P.M. Those present stood and pledged allegiance to the Flag.
ROLL CALL
Roll call indicated the following present: President Hartstein;Trustees Braiman,Glover,Berman,Johnson,Kahn
and Trilling.
Also present were: William Balling,Village Manager;William Raysa,Village Attorney;Robert Pfeil,Village
Planner;Fire Chief Sashko;and Joseph Tenerelli,Village Treasurer.

Moved by Berman,seconded by Johnson,to approve the minutes of the June 3,2002 Regular Meeting. Upon roll

RELAY FOR LIFE
President Hartstein reminded residents that this year's Relay for Life sponsored by the American Cancer Society
will be held at Stevenson High School on June 21-22,2002. Both Buffalo Grove and Stevenson High School
students are involved in this event. President Hartstein encouraged residents to form teams to participate in and
support this cause,and he noted that further information may be found on Channel 6 and the Village of Buffalo
Grove website.
Trustee Berman stated that he is again honored to be captain of the Village team,which has a full slate of
participants;he thanked everyone for their effort and support,with a special thanks to Stacey Kelly whose help has
made it easy to pull the Village team together.
GEESE
Trustee Johnson noted the memo from Mr.Balling regarding this issue,and he looks forward to staff presenting a
report to the Board to see what can be done to combat the problem of the abundance of geese on the Village golf
courses.
NICOR
Trustee Trilling noted that the Village website has incorporated the ability for residents to obtain information
relative to the different alternatives that are available for a natural gas supplier.

ART FESTIVAL

Trustee Trilling reported that he had the opportunity to attend an art festival over the weekend that was put on by
Amdur Productions,the same company that will handle the Buffalo Grove Fine Arts Festival next month;he noted
i that they did a wonderful job and he looks forward to them doing the same for the Village of Buffalo Grove.
ROLLING HILLS SUBDIVISION

Trustee Glover stated that she had spoken with a resident of the Rolling Hills Subdivision concerning the driveway
situation. Mr.Balling commented on the known status,and he stated that he will check further and present a report
to the Board.
LAKE COOK ROAD OVERPASS
Trustee Berman asked about the schedule on the Lake Cook Road overpass construction work. Mr.Balling
presented an update on the project. Trustee Berman asked that updates be posted on the Village website.
>Now MILWAUKEE AVENUE/DEERFIELD PARKWAY
elm Trustee Berman stated that he has been asked about the sign on Milwaukee Avenue and Deerfield Parkway that
suggests a shopping center will be built in 1997;he asked staff to check into this and encourage the owner to remove
the sign.
MANAGEMENT REPORT
Mr.Balling noted the submittal of the Management Report for the month of May,2002;there were no questions
regarding the report.

Mr.Balling reported that the regularly scheduled meeting of the Zoning Board of Appeals has been changed to
July 16,2002.
MUSCULAR DYSTROPHY
Fire Chief Sashko noted that the Muscular Dystrophy Association will be presenting the 5's annual Golden Boot
Award to the Village. Chief Sashko recognized Firefighter/Paramedic Joe Alexander who has tirelessly spearheaded
the efforts of the Fire Department for MDA,and noted that Mr.Alexander deserves a big round of applause.Chief
Sashko then introduced Matt Zubal from MDA.
Mr.Zubal,Director for North Shore Operations of the MDA,presented a brief background of the"Fill the Boot"
program;he is privileged to be here tonight to thank Board members,the citizens of Buffalo Grove,and the Fire
Department for their tireless efforts to raise money for MDA;all funds stay local and pay for summer camp
programs and research efforts. Buffalo Grove has raised over$60,000 over the past 5 years. This past year,Buffalo
Grove raised almost$10,000,which was the most in the Chicago area.
Mr.Alexander thanked residents and commuters that drive through the intersections where personnel are stationed;
he thanked all firefighters and stated that there are 45 people volunteering every year;he also thanked staff,the
Board and management for their support.
In answer to a question from President Hartstein,Mr.Alexander stated that collections this year will be on Friday,
August 23,2002 from 6:00 A.M.-6.00 P.M.
Chief Sashko noted that he received a statement from New York,and our community sent over$13,000 to New
York after 9/11/01.

CITIZENS FIRE ACADEMY
Chief Sashko presented a brief background on the Citizens Fire Academy and explained the activities in which the
participants are educated. This is the 7 graduating class of the Citizens Fire Academy,and there are nine graduates
that attended class one night per week for eleven weeks.The graduates then came forward where they were
presented with certificates by President Hartstein and Public Information Officer Skip Hart,the coordinator of the
program. Chief Sashko again thanked the Village for their support of this program.
QUESTIONS FROM THE AUDIENCE
President Hartstein asked if there were any comments or questions from the audience;there were none.
CONSENT AGENDA
President Hartstein explained the Consent Agenda,stating that any member of the audience or the Board could
request that an item be removed for full discussion;there were no such requests. The Village Clerk then read a brief
synopsis of each of the items on the Consent Agenda.

I ; Motion to approve the authorization to bid the 2002 Sanitary and Storm Sewer Televising Project.

Motion to approve Noah's Landing Development Improvement Agreement and Final Plat

ORDINANCE#2002-34—MUNICIPAL CODE/FIRE DEPARTMENT
Mr.Balling reviewed the reason for the proposed ordinance.
Moved by Trilling,seconded by Kahn,to pass Ordinance#2002-34,an ordinance that amends Buffalo Grove
Municipal Code 2.50(Fire Department)identifying the position classification of`Battalion Chief',replacing the
position classification"Captain"in alignment with the approved operational practice of the department staff
deployment. Upon roll call,Trustees voted as follows:
AYES: 6—Braiman,Glover,Berman,Johnson,Kahn,Trilling
NAYS: 0—None

ORDINANCE#2002-35-PARK DISTRICT GOLF DOME
Park District Director Rylko introduced the Commissioners present,after which he made a presentation to the Board
with regard to their request on the Golf Learning Center.
Mr.Rylko answered questions from the Board,mostly with regard to the number of days of operation.

Moved by Braiman,seconded by Kahn to pass Ordinance#2002-35,approving an amendment to the Special Use
concerning the Buffalo Grove Park District Golf Learning Center dome,801 McHenry Road.
Trustee Glover noted that this has been a difficult decision for her,and she explained the reasons why she cannot
support this proposal.
Chief Sashko reviewed the regulations with regard to permanent versus temporary structure.
Lengthy discussion took place regarding the number of days the structure should be allowed to be used and the
definition as to whether the structure is to be considered permanent or temporary.
Trustee Berman stated that he believes everyone is willing to work with the Park District,but he is uncomfortable
with moving forward tonight. Trustee Berman moved to defer action on this matter;Trustee Johnson seconded the
motion.
With regard to timing,Mr.Rylko said that they have a deadline for their fall brochure;
President Hartstein asked Mr.Raysa if the Board can approve this ordinance as it is proposed in its current form,and
also if Mr.Raysa believes that it is within the confines of what can legally be done. Mr.Raysa answered
affirmatively to both questions.
Upon roil call,Trustees voted as follows on the motion to defer:
— AYES: 2—Glover,Berman
NAYS: 4—Braiman,Johnson,Kahn,Trilling
Motion declared defeated.
Upon roll call,Trustees voted as follows on the motion to pass Ordinance#2002-35:

President Hartstein asked that staff get back to the Board with regard to further information clarifying the issues that
were raised by Trustee Braiman tonight so that it can be determined as to whether or not there should be any further
modification to this ordinance.
RESOLUTION#2002-31 -PACE
Moved by Berman,seconded by Trilling,to pass Resolution#2002-31,authorizing the execution of an Agreement
between the Village of Buffalo Grove and Suburban Bus Division of the Regional Transportation Authority(Pace).
Mr.Balling reviewed the changes in this new agreement,details of which are contained in Mr.Brimm's memo to
him of June 13,2002.
Rob Sherman,resident,stated that he supports the project,but he is concerned with what he considers to be flaws in
the agreement as to the schedule being too tight,and further definition of what routes will be followed.
In response,Trustee Berman stated that this is a draft,subject to further work by Pace,and all points raised are being
taken into account.
Upon roll call,Trustees voted as follows on the motion:
AYES: 6—Braiman,Glover,Berman,Johnson,Kahn,Trilling
NAYS: 0—None
Motion declared carried.
President Hartstein thanked Mr.Brimm for the extraordinary amount of work that he put into getting this agreement
drafted.

One of the ongoing challenges facing the Village is attracting and retaining a pool of qualified candidates to serve on
volunteer commissions, committees and boards. In addition, how to evaluate volunteer performance is also
necessary in relation to certain issues of tenure and reappointment. To that end,the following analysis is offered as
well as suggested solutions for consideration and implementation.
Talent Bank:
Through the use of the Talent Bank,the Village maintains a system of attracting and tracking individuals interested
in serving on volunteer committees, commissions and boards. The Talent Bank is an interactive program
maintained as part of the Lotus Notes database system and has been developed around citizen interest to serve an
identified need. Residents are asked to prioritize where they desire to serve and all efforts are made to match
interest with need. The application attachment identifies each volunteer group, their purpose and specific
qualifications. The application document is available for completion and submittal either in person or by mail;it can
be accessed from the Village's website.
The current Talent Bank inventory has generally been developed as a result of past Village News articles that have
encouraged volunteer participation. The solicitation process can be a recurring theme toward service within the
Village News. There has been interest in volunteer service but an applicant could become discouraged when there is
little or no turnover of membership,which limits opportunity. Additionally,when turnover does occur,there is not
always a"perfect"match between need and availability. However,when an opening does occur, the Talent Bank
has served in providing candidates for interview by the Village President,trustee or staff liaison.
Just as it is important to encourage volunteer participation,the Talent Bank should be purged of those individuals
who may no longer be interested in serving or may desire a different choice in committee, commission or board
priority of assignment. In addition,the database should be modified to permit comments to be added based on the
interview process so that a potentially better match of talents to assignment can be determined. It would be a
recommendation that those applicants to the Talent Bank that have not been assigned be reviewed and contacted,at
minimum every two years,about continued interest or whether their name should be dropped from consideration.
Talent Bank Application:
As inferred, the Talent Bank should remain the format for securing participation for our volunteer committees,
commissions and boards. The basis for documenting interest is through the submittal of a Talent Bank Application.
A review noted that several versions of this document exist, both in print and on-line. A review of that document
notes:
• Inconsistency between versions with dated information
• The request for information that is not really pertinent to the process
• An unclear reason why the Village may need to conduct a Police background investigation. That
process would only be required if one were interested in the Board of Fire and Police Commissioners.
• Need to include response from residents that may be interested in temporary, project-based
assignments.
To that end,a draft of a revised Talent Bank Application is attached. The format of the document has been changed
to read better. In addition the Fire and Police Commission statement has been clarified and a temporary project
interest response included. The proposal is in the proper format for inclusion on the website. What also has been
updated is the summary list of active committees, commissions and boards which includes both the basic group
framework along with summary purpose. This too shall be provided wherever the application is made available.
As an aside on access,a recent review of the Village's website noted that the path to the application was not clear. It
was available as a component of the"Volunteer Opportunities"as well as `Boards and Commissions" in both pdf
and doc format. While the posting locations are appropriate,to those that may not be clear on site design,they may
be difficult to find. It was recommended to Phil that a"front page"link be considered He has provided that feature
which should be advantageous in drawing attention from those that may be interested.
Recruitment Approach:
Probably the most viable approach toward recruitment would be the use of the Village News. As noted;the website
has been modified to make access to the application clearer. In thinking this through,promoting twice yearly in the
News may be frequent enough considering the limited turnover overall on all commissions,committees and boards.
A broader,more aggressive approach toward recruitment may prove problematic if an expectation of consideration
for appointment is suggested. Despite the number of openings,it is believed a semi-annual recruitment is sufficient.
One aspect of the recruitment process that should be noted up front,during the interview process, is that the ultimate
term,should one be appointed, is equal to the term of the Village President. We believe that there have been cases
of misunderstanding as to the potential of term of an appointee, especially when that might occur several years into
one's term of elected office.
Current Follow-up Efforts:
Jane Olson will be sending out a letter to all prior applicants that are in the Talent Bank to determine if they are still
interested in serving should an opening occur. This has been done every other year and this has become a good
housekeeping tool. In the past,approximately 25% of those in the Bank have been removed either based on choice
or due to the fact that some have moved. We will report out the results of this work mid-summer.
Volunteer Evaluation:
Approximately two years ago, an exercise was undertaken to obtain several levels of evaluation of all volunteer
members of committees, commissions and boards. Each volunteer was asked to evaluate his or her performance
based on a self-evaluation,a copy of which is attached. This was returned to the Village President for review and
comment. In addition,a second evaluation was distributed to the staff and trustee liaisons along with the volunteer
group Chairperson. As with the self-evaluation,this too was returned to the Village President.
The intent of the exercise was to allow for what is considered an objective assessment since time of appointment.
The evaluation is intended to be conducted prior to an individual's expiration of appointment so all volunteers may
not be done at one time. Evaluations are intended to follow an annual cycle but again only for those whose term is
set to expire. Ideally, the use of the evaluation will be viewed as an important component of an in-depth look at
performance of all volunteer groups that provide important review and oversight to the community in general and
the President and Board of Trustees in particular.
Tenure and Rotation:
This is probably the one critical issue to be considered within this overall review on volunteerism. Quite frankly,
our research has shown that there are no set policies or practices in place that effectively deal with tenure and
rotation. What was noted in those talked to was that appointment is a legislative function that in most cases starts
with the Village President/Mayor with the consent of a sitting board
In the long run,the success of the Village's volunteer boards,committees and commissions is directly related to the
time and effort that their members devote to their assigned tasks. Also,experienced,knowledgeable volunteers will
contribute to the continuity and stability of the volunteer boards,committees and commissions. However,one needs
to question whether the volunteer bodies individually, as well as the Village corporately,benefit when movement of
members of the boards,committees and commissions occurs. Movement may involve transfer to another volunteer
body as well as selection of a new member to a group. Although non-reappointment of a volunteer as well as the
suggestion of transfer may not always be an easy decision, it is possible to define certain parameters for continued
membership that offer the opportunities of providing for new participation by those interested in serving. Lastly,and
as a concurrent sidebar to the issue of tenure, continued interest in the Talent Bank will be fostered if residents
believe that there is some realistic,eventual opportunity to serve the Village in an area of their interest.
As suggested above, another measure of continued tenure can be performance driven. Both the Trustee and staff
liaison as well as the chairperson of the volunteer body should be responsible to inform the Village President if a
volunteer is no longer contributing at an acceptable level. Acceptable performance measures could be a component
of volunteer activity and self-review a part of the annual reporting process. Some performance review should also
deal with attendance patterns(a suggestion was a 75%standard,at minimum).
In closing,if term limits are not desired as a the standard for rotation,then a performance based measure should be
developed that leads to re-appointment based on strong interest to continue volunteer work in furthering the goals
and objectives of a volunteer committee, commission or board Preparation and contribution efforts are certain
criteria that are not subjective in the performance review of a volunteer.
Recommendations:
Based on the above analysis,the following is recommended:
1. That solicitation of interest in the Talent Bank is a recurring topic of the Village News as well as a
component of the website. The ideal frequency for these efforts should be semi-annually.
2. Those residents whose Talent Bank applications are two or more years old be contacted about
continued interest and whether their name should be dropped from consideration. This should be
performed annually.
3. The database should be modified to incorporate interview comments. Comments should be prepared
as a part of all interviews and submitted to the Village Cleric' s Office for incorporation. The style for
comments should be comparable to those that are the outcome from liquor license interviews.
4. In addition to format changes,the Talent Bank application should be modified to collect information
from those that might be interested in serving on a temporary,project-based assignment. This is a new
focus for the Talent Bank that may draw additional talent from within the community.
5. On an annual basis, all volunteers should be evaluated in an as objective manner as is possible. An
evaluation tool that incorporates three levels of review-self trustee liaison and staff liaison should
again be used In addition matters of attendance need to be collected and analyzed. Both levels of
evaluation should be the tools in understanding performance and commitment.
6. The use of the evaluation tools should become the basis to address concerns over tenure. Tenure can
be performance based and if used properly,become clear as to reappointment or rotation decisions. If
easily determined,they should be without bias,especially if supported by attendance records,which in
and of themselves are critical to performance and commitment.

1 yr.Qualifications:Must be Buffalo Grove resident or merchant.
Purpose:To promote and encourage the participation of the community in the annual Buffalo Grove Days festival.
COMMUNITY BLOOD DONOR COMMISSION:(Resolution#73-7)Members:8 Term:(April 30)Qualifications:
Must be Buffalo Grove resident.
Purpose:Commission meets to implement volunteer blood donor program through LifeSource. Four community blood
drives are held annually to assure blood availability for all residents who require blood transfusions.
ELECTRICAL COMMISSION:(Chapter 2.32 Buffalo Grove Municipal Code)Members:5 Term:3 Years(April 30)
Oualifications: Must be Buffalo Grove resident. Experience as electrical contractor,journeyman, testing laboratory
representative,or a public utility representative.
Purpose:Commission recommends(1)safe and practical standards and specifications for the installation,alteration,and
use of electrical equipment systems;(2)reasonable rules and regulations governing the issuance of permits;(3)reasonable
fees to be paid for the inspection by the Inspection Department of all electrical equipment installed.
EMERGENCY SERVICES& DISASTER AGENCY: (Chapter 2.34 Buffalo Grove Municipal Code) Members: 7

Purpose:Provide for the ongoing needs and concerns of older adults in the Village's service area;identify and recommend
programming for seniors;recommend firture directions relative to senior citizen issues.

oversight on issues of importance to the Village Board,Village staff and the business community,Elliott has requested your

SUBJECT: CANADA GOOSE CONTROL AT B.G. GOLF COURSE
We have had repeated inquiries from patrons and Board Members who use the Buffalo Grove
Golf Club on the proliferation of droppings from wild Canada Geese that have domiciled
themselves on the course. This a much more severe problem at Buffalo Grove than it has
been at Arboretum. In fact, we have spotted only ducks in the population count at
Arboretum.
The Director of Golf has prepared a memorandum and offers an attachment from Migratory
Bird Management on managing the Canada Goose problem on the Buffalo Grove Golf
Course, and we would like to present a program and recommendation for fall implementation.
I have also been in touch with Mike Rylko, Director of Parks, who is also interested in
coordinating activities around the Willow Stream Park which could become the new home for
the geese if they leave Buffalo Grove Golf Course. Other potential homes would be the
Busch Grove Community Park or Green Lake Park.
At this point, we believe the most effective program involves using a Border Collie
management program, coupled with a Department of Natural Resources permit over the
winter, which allows us to remove Canada Geese eggs found on golf course property. We
would like to get a specific proposal for this work to he done this fall, but would need consent
and direction from the Village Board with regard to operating this plan on the Buffalo Grove
Golf Course with trained, but unleashed, Border Collies, and the possibility of operating a
similar program at Park District expense at the Willow Stream Community Park. Some
years ago, the Park District experimented with a rohotic drone that sprayed deer urine in the
areas where geese were present. This presumably deterred geese from domiciling themselves
on that property. That program met with limited success. The report indicates that over a
pound and a half of droppings can occur per adult bird in a day, thus emphasizing the
nuisance level of this problem for our golf patrons.
I would appreciate the thoughts and directions oft illag on this matter.

In response to several complaints that both you and some board members have received
about the goose population at Buffalo Grove I have the following observations.
The number of geese on the Buffalo Grove Golf Course is in fact extremely higher this year than
in the past couple of years. We used the same tactics as in the past, but due to another mild winter
and a cold wet spring which had fewer golfers on the course the geese apparently felt more"at
home" and threatened less than in the previous years. Unfortunately once this geese hatch their
young, you can not, et them to move off the property until the young can fly. Rick Reed and
Mark Neuroth hav told me that 900/6-of the families of geese we now have on the course hatched
in the Willow Stream park and floated down the creek onto the course. A point of interest, is that
at Arboretum Golf we have very few geese and staff uses the same tactics as at Buffalo Grove.
We think the reason for that is that once we chase the geese off the Arboretum the geese actually
have to travel a good distance to another site where as at Buffalo Grove the geese actually just fly
to Willow Stream and then return to the course in a very short time span. I guess the fact that I
am trying to make is that we do have a serious goose problem at Buffalo Grove and that problem
is really the only constant, consistent complaint we get about the conditions at Buffalo Grove
Golf. I also have had several golfers concerned that the goose droppings becoming a health safety
issue. So there is a real problem.
The staff has in the past, tried all the gimmicks and tricks, to try and disperse the geese from
our course. While some tactics have had limited success, nothing has produced a long term
consistent solution to the geese problem. The only true success stories we have heard of all
involve a dog, either owning a dog or using a dog service to run the golf course and annoy geese
to the point that they feel the course is not a safe place to reside. The last time staff reviewed this
issue it was decided that if we ever proceeded with this option we would opt for the dog service
rather than the owning of a dog. Staff still is in agreement that a dog service makes more sense for
our operation than owning a dog.
This really gets us to the point where the movement stopped a couple of years ago. In order
for a dog to be effective the dog would really need to have free run of the course. Since the golf
course is not entirely fenced in this would put the village in violation of it's own lease law. Back
when this dog solution was brought to the board it was decided that a variance would not be
given to allow for the course to have a dog run loose. At that time the hiring of a dog service was
put to rest and staff did the best it could to annoy the pester the geese, with very limited success.
Since then the goose population has increased, not just at Buffalo Grove, but all over the state.
There has been some political discussions about, in fact, making some changes to the protection
issue involving the goose population.

A second issue the board may want to consider is that, in fact, if the course was given the ability
to hire a dog service to remove the geese from the golf course, where will we be chasing the
geese to. The obvious answer would be to Willow Stream Park and the surrounding area. Also
whether a dog is bought, or a dog service is hired this would not be an inexpensive solution. I
would anticipate that the first couple of years, cost of a dog service would run between $ 5,000 to
$ 10,000 a year. We have no funds allocated in the 2002 golf course budget for this service, since
it was not an anticipated program for this year. We could, if the board decided they wanted to try
something this fall on a trial basis, probably do some project switching to make some limited
amount of funds available.
Finally, I have attached an interesting article from the February 2002 Midwest Association of
Golf Course Superintendents magazine which gives, I think, a nice overview of owning verses a
dog service. The information also gives some success stories from other courses in Illinois that
have used dogs to rid themselves of geese.

fly in formation, and if you ivere lucky, land on your golf course for a drink and a snack. You would
run andgct your cavern so you couldget some great shots of,pildlife up close and personal!
All that has changed now. IN/Sanv Canada geese do not migrate as they
once did. �Ve now have what are referred to as resident geese. These geese will
remain in an area unless there is a heavy snow cover and no food or open water
is available. Between these resident geese and the true migratory geese, tile
goose population has become a problem that has grown out of control. Yes,
they are everywhere ... at golf courses, colleges, cemeteries, shopping centers,
office complexes, and even in your own backyard!
Over the years, at conferences and trade shows, my partner Susan Hag-
berg and I have repeatedly fielded the question as to Whether our company will
sell a Border collie that has been trained to chase geese. The answer is ycs, we
can,but let's examine some of the features, both pro and con,of owning a dog

Owning a Dog
A great reason for a resident dog is that he is always there When VOII are.
If you take him out routinely, he will do his job well and rid your course of
geese. However, owning a dog is a commitment and dogs are not disposable.
Border collies are very social animals. They love being With people. If you buy
a dog, it shouldn't be locked in the shop all night with the tractor and rnow-

part of a dog's will to work and sometimes a handler change can have an
adverse change in the dog's work habits and personality.

•At a previous facility, the grounds keeping crew took a lot of criticism from employees as a result of
utilizing bird control techniques involving dogs. How do you preclude such animosity at a site?
•
Using `dogs' as a hazing technique is a relatively new method of controlling geese and with it comes many
perceived problems. To have a successful program, it is important that all people involved (managers, employees, and
tenants)understand that it is critical that the dog be `highly trained' not to catch or harm the bird. This is why we only use
ABCA trained Border Collies—they are of high intelligence and bred to work or `herd' desired flocks to a particular
location—in this case,to get the geese to fly off the property.
Since the Canada goose is federally protected, there are fines that range from $5,000 to $10,000 if one is captured or
harmed. If an untrained dog has such an unfortunate incident, it would fall under these guidelines.
Most of our clients were apprehensive with this method for the very same reason you stated. Once a demonstration was
provided, or our professional video shown, all those involved were comfortable with the technique. However, we do
realize the education of the public regarding the do's and don'ts of goose control is an ongoing process, and the entire
Migratory Bird Management staff is qualified to answer questions and address concerns about goose control with Border
Collies.
In addition, we have a good relationship with the U.S. Fish and Wildlife Service. We have worked closely with their
goose expert, Steve Wildes, and he condones the techniques we use and has recommended our services for seagull control
as well.
•
•How does your program work?
We identify when and why the geese are attracted to a particular site.We further look at what goose control methods have
been used in the past. Then we design a goose control program that generally includes Border Collie patrols, habitat
modification,and egg depredation permits.
Our experience has taught us that the best results in using Border Collies to remove geese from a property are daily
random visits. We track each service visit so that at the end of a given service period, we can show a significant
decrease in numbers. It is generally not realistic to expect to eliminate all geese from a property,but more importantly
to keep numbers in `balance' so that all parties involved are satisfied.
•
• Pricing strategy—based on time on site, acreage,etc.?
Our pricing is based on time per service visit, size of property—especially water features, accessibility to problem areas,
and travel to location. After a site inspection is conducted, we are able to determine the above so that a site-specific
proposal can be provided.
•
•What results should I expect from your goose/control (Border Collie) control program?
A successful goose control program is first based on identifying all the factors/reasons that the geese are drawn to a site. It
is important to eliminate as many of these factors as possible in order to successfully manage the problem. For example,if
you have controlled the resident population of geese by annual spring egg depredation, but not taken any steps to
discourage hand feeding of the geese,than you will not likely see any significant improvement to the problem.
It is best to manage geese by incorporating a maintenance program utilizing Border Collies and eliminating as many
factors as possible.
Most of our programs include a spring and fall program and can vary from year to year as to the frequency needed in site
visits.
•
•How does landscaping help to control the presence of geese?
Canada geese have excellent eyesight and are inhibited in areas where vegetation grows dense and over 30 inches in
height. Thus geese are discouraged if access to water is difficult and with a vegetative barrier. It is best to use a
combination of deciduous, evergreen, and seasonal perennial color to provide an aesthetically pleasing yet effective
landscape.
•
•Why are only Border Collies used to control geese?
While other breeds of dogs have been attempted to be used in goose control work, it is the Border Collie that continually
comes out on top for the following reasons:
■ Border Collies natural ability is to"herd"not to retrieve or capture its flock!
■ Border Collies insatiable need to work!
■ Border Collies natural agility and ability to"stalk"its prey!
■ Border Collies are considered the most intelligent dogs of all breeds.
•
Why do we have goslings on our property if we performed egg-depredation?
It is not likely that the goslings hatched on your property if egg-depredation was carried out properly.
What generally happens in the month of May is new hatchlings and their parents will come from offsite in search of a
"summer vacation spot."It is not unheard of for families to walk over 50 miles in search of a spot that provides plenty of
grass and water for the summer during the molting season and while the young develop flight feathers!
This is why it is important to continue our Border Collie "harassment"until the geese become flightless in mid-June. We
will never harm the geese and most likely, the parents will not fly off during our visits, but we have found that constant
pressure from our consistent harassing convinces the families to go elsewhere during the summer.

Retail Complex
This account had no goose control program in place before June of 1998. This is a
retail property with a pond that had recently experienced upgrades to their
landscaping which included manicured and irrigated turf. This is a prime feeding
source for geese. In 1999 Migratory Bird Management began a program of
border collie hazing much earlier than in 1998. We also incorporated an egg
depredation program which directly controls the number of births of the geese.
2000 reflects the success of MBM's border collie hazing, egg depredation, and
education programs -with significant declines! (pictured in June in the chart below).

A Corporate Business Complex
Prior to MBM servicing this large business complex there was a severe "hand
feeding" problem which resulted in a significant resident goose population. This
complex is managed by 3 separate companies and only 5 out of the 7 buildings are
in Migratory Bird Management's program. Because 2 buildings are actually
encouraging geese"by hand feeding, this complex has hit a plateau in the hatchling
phase of the goose life cycle. Therefor this complex will not likely be able to break
this pattern in spring unless the neighboring properties begin a goose management
program as well. However, the two management companies involved with our
program feel that the overall benefit is that their landscape damage has been
significantly reduced and they are providing a cleaner environment for their tenants
with the goose management program. (Peaks in goose counts in Feb. Mar. & Dec.
are typical for migration.)
Large Park with Acreage
A 385 acre park with 75 acres of water is reflected in the graph below. This is a very
popular goose"bed and breakfast", a fabulous spa, and nursery all at one great
location! This can be seen by the extremely high numbers of geese in comparison to
the other charts. This kind of property is managed much differently than the other
properties. Migratory Bird Management is servicing this property many times a day.
There are many places available for the birds to be secluded from the sight of people
especially during nesting season. In spite of this-the goal here has been to maintain
less than 50 geese on the property at any given time and to have cleaner grounds
especially during the challenging fall migration season.

An Institution
The chart below depicts a situation where there was a high concentration of
"resident"geese on the property. Peaks of goose counts in February, March, and
October are typical and due to migratory activity. Migratory Bird Management
(MBM) began border collie control services in February of 1998 in addition to the
institution's own in-house egg depredation program. MBM drastically reduced the
resident population. The increase in May of 2000 reflects the continual `hand
feeding"problem that exists and is also the result of the elimination of their egg
depredation program that was in effect in 1998 and 1999. MBM has developed a
very thorough system to record, monitor, analyze and to provide solutions to the
problems that occur with populations of Canada Geese that are out of balance.

Golf Course
The chart here is a picture of a golf course. In geese lingo this is "bed and
breakfast" three meals a day territory! This golf course was losing business
because of the excessive amounts of goose droppings that golfers had to contend
with. They already had an egg depredation program in effect. With the addition of
Migratory Bird Management's hazing with trained border co/lies this golf course
has had a much cleaner property and they have incurred less money and less time
spent maintaining the course and best of all their business has rebounded!

SUBJECT: GOLF DOME EXTENDED USE
The Village board requested that Village Staff clarify its position on the safety concerns
associated with the use of the golf dome for periods longer than recently approved by the
Village Board. We believe there are risk factors and access factors which continue to
support Staff interpretation that the golf dome should only be used for the agreed upon
periods of the year rather than throughout the year.
First, the initial review of the facility was not based on the facility as a "membrane"
structure since this membrane structure was limited to 8400 s.f., about 115 the size of the
dome. It was reviewed as a public assembly structure, EXCEPT assembly structures of
this size would require sprinklers, which is not feasible in a golf dome. We, therefore,
interpreted the structure as a temporary structure which would not require sprinklers, but
as a public assembly use, requiring additional egress capacity, access and other systems to
improve its safety. This interpretation was based on the following:
1. The use complimented the District's plan to take the structure down seasonally.
2. The use itself planned for very few occupants and only one or two in the "Meld"
area to collect golf balls. We, therefore, were comfortable having only limited
paved access on the east side of the dome, since almost all occupants would be on
the west end.
3. The BOCA National Building Code and the BOCA National Fire Prevention
Code.
The conversion of this use adds several points of additional risk:
1. Greater occupant loading of the dome, much of which will be on the east end of
the dome.
2. More days of use of the facility, increasing exposure to peril.
3. Potential for summer weather risks, i.e., tornado, lightening, power loss.
4. Assembly use year round without sprinklers.
We continue to believe, on a staff basis, that the additional accommodation to the Parr
District is fair and reasonable and is a risk that can be managed. Twelve month use really
alters the original design and use concept to the detriment of safety. We recommend no
additional change to the ordinance.

LANDLORD: Commonwealth Edison Company, an Illinois corporation

ORIGINAL LEASE DATED: October 16, 1987 ("Original Lease")
PRIOR SUPPLEMENTS DATED: December 2, 1992 ("Lease Supplement Number One")
PURPOSE: Maintenance of a grass recreation area with the maintenance of an eight(8) foot
bike path all insofar as permitted by law and for no other reason whatsoever.
LOCATION OF PREMISES: That part of Commonwealth Edison Company's property lying
West of Weiland Road , and North of Busch Road located in
Buffalo Grove, Illinois.
LANDLORD and TENANT have entered into the Original Lease for a five year
period commencing on October 1, 1987, and expiring on September 30, 1992, which Original
Lease was extended by Lease Supplement Number One for an additional ten year period
commencing October 1, 1992, and expiring on September 30, 2002, and LANDLORD and
TENANT desire to amend the Original Lease as modified by Lease Supplement Number One
(the Original Lease as modified by Lease Supplement Number One is hereinafter referred to as
the "Amended Lease") as provided below.
MODIFICATIONS:
It is mutually agreed that the Amended Lease is hereby extended for an additional
twenty(20) year period commencing on October 1, 2002, and expiring on September 30, 2022,
unless sooner terminated as provided in Amended Lease.
Paragraph four under "USE OF PREMISES" on Page 5 of the Original Lease is
hereby deleted and amended to read as follows:
"Due to the presence of LANDLORD'S electrical wires located on the LEASED
PREMISES, no vehicles, equipment or anything else having a height more than fourteen (14) feet
from grade level including, but not limited to, any equipment attached to vehicles or equipment
such as antennas, shall be driven, moved or transported thereon. Neither shall any activity which
could result in a wire to ground electrical contact or damage to towers or poles be allowed. Such
activities include,but are not limited to, flying kites, model airplanes, driving minibikes, go carts
and snowmobiles. TENANT shall post signs prohibiting such activities."
The section titled "ENVIRONMENTAL PROTECTION" on Page 7 of the
Original Lease is hereby deleted and amended to read as follows:
ENVIRONMENTAL MATTERS:
a.) At all times during the term of this LEASE, TENANT, its employees, agents,
contractors, subcontractors, licensees and invitees, and any other person or entity in privity with
TENANT or entering upon LANDLORD'S property by, through or under any right granted to
TENANT herein (collectively, the "TENANT GROUP"), shall conduct their operations and
otherwise use and occupy the LEASED PREMISES and any other property of LANDLORD
hereunder in strict compliance with all applicable Environmental Laws (as hereinafter defined)
and, without limiting the generality of the foregoing, shall not cause any Hazardous Materials (as
hereinafter defined) to be introduced to or handled on the LEASED PREMISES or any other
portion of LANDLORD'S property.
b.) If there are wetlands on the LEASED PREMISES or any adjacent property of
LANDLORD at the commencement of the LEASE or if wetlands should develop on the
LEASED PREMISES or such adjacent property during the term of the LEASE, TENANT shall
strictly comply with and observe all laws, rules, statutes and regulations applicable to wetlands of
any federal, state, county or local regulatory agency and any other governmental authority having
jurisdiction over the LEASED PREMISES or the parties. At LANDLORD'S request, TENANT,
at its cost, shall furnish LANDLORD with a survey of the LEASED PREMISES delineating any
wetland areas located on the LEASED PREMISES. Under no circumstances shall TENANT
change the physical characteristics of any wetland areas located on the LEASED PREMISES or
any adjoining land or place any fill material on any portion of the LEASED PREMISES or
adjoining land, without in each instance obtaining LANDLORD'S prior written consent.
LANDLORD may grant or withhold such consent in its sole and exclusive discretion and, should
LANDLORD grant such consent, TENANT shall secure all wetland permits, licenses and
approvals as may be required from all appropriate governmental authorities prior to commencing
any work and shall immediately provide LANDLORD with copies of all such permits, licenses
and approvals.
c.) Prior to commencing any work or entering upon the LEASED PREMISES,
TENANT shall obtain all permits, consents, approvals or other authorizations required under any
applicable Environmental Laws in connection with such work and TENANT'S use and
occupancy of the LEASED PREMISES.

d.) TENANT hereby indemnifies and shall defend, with counsel acceptable to
LANDLORD, and hold harmless LANDLORD, Exelon Corporation, a Pennsylvania corporation,
and all of their respective subsidiaries and affiliates, successors and assigns, and the officers,
directors, employees, agents, shareholders and legal representatives of each of them (collectively,
the "LANDLORD GROUP"), from and against any suits, causes of action (whether asserted
under Environmental Laws or at common law), damages (including,but not limited to,
consequential damages), losses, claims, demands, injuries, liens, costs and expenses of any kind,
including without limitation court costs, attorneys' and consultants' fees, arising out of or in any
way related to any of the following: any breach by the TENANT GROUP, or any of them, of any
covenants or representations set forth in this Section; any violation by the TENANT GROUP, or
any of them, of any Environmental Laws; the presence, release or threatened release of any
Hazardous Materials in, at, on or beneath the LEASED PREMISES or any adjoining property of
LANDLORD,provided that such presence, release or threatened release of Hazardous Materials
is not due solely to LANDLORD'S actions. If, during the performance of any work by
TENANT'S hereunder, TENANT becomes aware that soil, groundwater, or other material on,
within or under LANDLORD'S property is contaminated by any Hazardous Materials, TENANT
shall notify LANDLORD and TENANT shall immediately secure the work area, at TENANT'S
cost, in such a manner as to adequately protect the public safety.
e.)As used in this LEASE,the term"Hazardous Materials"means any hazardous or
toxic substances,materials or wastes,including,but not limited to solid, semi-solid,liquid or
gaseous substances which are toxic, ignitable, corrosive, carcinogenic or otherwise dangerous to
human,plant or animal health or well-being and those substances,materials, and wastes listed in
the United States Department of Transportation Table (49 CFR 972.101) or by the Environmental
Protection Agency as hazardous substances(40 CFR Part 302)and amendments thereto or such
substances,materials and wastes regulated under any applicable local, state or federal law
including, without limitation, any material,waste or substance which is (i)petroleum, (ii)asbestos,
(iii)polychlorinated biphenyls, (iv)designated as"hazardous substances"pursuant to Section 1251
et seq. (33 U.S.C. Section 1321) or listed pursuant to Section 307 of the Clean Water Act(33
U.S.C. Section 1317), (v)defined as a"hazardous waste"pursuant to Section 1004 of the Resource
Conservation and Recovery Act, 42 U.S.C. Section 6901 et seq. (42 U.S.C. Section 6903), or(vi)
defined as a"hazardous substance"pursuant to Section 101 of the Comprehensive Environmental
Response, Compensation and Liability Act, 42 U.S.C. Section 9601 et seq. (42 U.S.C. Section
9601) or any other applicable Environmental Law.
. f.)As used in this LEASE"Environmental Laws"means all federal,provincial, state
and local environmental laws,rules,regulations,ordinances,judicial or administrative decrees,
orders or decisions, authorization or permits,including,but not limited to, the Resources
Conservation and Recovery Act, 42 U.S.C. §§6901, et seq.,the Clean Air Act,42 U.S.C. §§7401,
et seq.,the Federal Water Pollution control Act, 33 U.S.C. §§1251, et seq.,the Emergency Planning

natural resources, including without limitation the preservation of wetlands, and all regulations
pertaining thereto.
g.)With respect to all activities of the TENANT GROUP, or any of them, on the
LEASED PREMISES or on LANDLORD'S Property, TENANT shall be responsible for ensuring
that each member of the TENANT GROUP shall: (i)at its own expense comply with all
Environmental Laws; (ii) not consent to or authorize the presence of any Hazardous Materials on
the LEASED PREMISES or LANDLORD'S property; (iii)not take any action that would subject
the LEASED PREMISES or any portion of LANDLORD'S property to permit requirements under
RCRA or any other Environmental Laws for storage, treatment or disposal of Hazardous Materials;
(iv)not dispose of Hazardous Materials in any dumpsters provided by LANDLORD on the
LEASED PREMISES or LANDLORD'S property; (v)not discharge Hazardous Materials into
drain or sewers; (vi)not install any underground storage tanks on the LEASED PREMISES or any
portion of LANDLORD'S property; (vii)not cause or allow the release of any Hazardous
Substances on,to or from the LEASED PREMISES or LANDLORD'S property; (viii) at its own
cost arrange for the lawful transportation and off-site disposal of all Hazardous Materials that it
generates; and(ix)upon the termination or expiration of the LEASE,remove any Hazardous
Materials it used at or brought to the LEASED PREMISES or LANDLORD'S property in
accordance with all requirements of applicable law. TENANT shall return the LEASED
PREMISES and LANDLORD'S property to substantially the same condition as existed before the
commencement of the LEASE.
h.) TENANT acknowledges that LANDLORD may incur costs as a result of a
change in Environmental Laws. TENANT agrees that any such costs incurred by LANDLORD for
complying with such new laws and due in whole or in part to TENANT'S use and occupancy of the
LEASED PREMISES shall be an expense recoverable by LANDLORD. To the extent any such
expense paid by TENANT is subsequently recovered by or reimbursed to LANDLORD through
insurance or recovery from responsible third parties or other action, TENANT shall be entitled to a
proportionate share of such recovery or reimbursement.
i.) TENANT shall provide LANDLORD with written notice(i)upon TENANT'S
obtaining knowledge of any potential or known violations of applicable Environmental Laws or the
release or threat of release of any Hazardous Materials affecting the LEASED PREMISES or
LANDLORD'S adjacent property or(ii)of TENANT'S receipt of any notice,correspondence,
demands or communication of any nature from any governmental authority related to any alleged or
actual violation of any Environmental Laws affecting the LEASED PREMISES or LANDLORD'S
adjacent property.
j.)TENANT'S obligations under this Section shall survive the expiration or
termination of this LEASE.
The section titled"INSURANCE AND INDEMNITY"on Page 8 of the Original
Lease is hereby deleted and amended to read as follows:

INSURANCE AND INDEMNITY: To the fullest extent permitted by law,
TENANT hereby agrees to indemnify, defend (with counsel acceptable to LANDLORD) and
agrees to hold harmless LANDLORD GROUP from all claims, litigation and liability asserted
against them or any of them, and any costs and attorney's fees incidental thereto, on account of
injury to or death of any person or persons whomsoever, on account of damage to any property,
or on account of loss or interruption of electric service, caused by, connected with, or in any way
attributable to, the rights herein granted, or TENANT'S failure to comply with any of the terms
or condition of this Lease, or resulting from acts or neglect of TENANT or any member of
TENANT GROUP.
TENANT covenants and agrees, that it will not permit or suffer any lien to be put
upon, or arise or accrue against the LEASED PREMISES, in favor of any person or persons,
individual or corporate, for furnishing either labor or material, for work to be performed on the
LEASED PREMISES. TENANT further covenants and agrees to hold LANDLORD and the
LEASED PREMISES free from any and all liens, or rights or claims of lien, which may, or might,
arise or accrue under, or be based upon any mechanic's lien law, or other similar laws, of the State of
Illinois,now or hereafter in force. All contracts and agreements that may be made by TENANT,
relating to the provision of labor or material for any work to be performed on the LEASED
PREMISES, shall expressly state that the interest and reversion of LANDLORD in and to the
LEASED PREMISES shall be wholly free from, and not subject to, any lien or claim of any
contractor, subcontractor,mechanic, materialman or laborer,whether based upon any law or
regulation of the State of Illinois, or any other authority, now or hereafter in force to be enacted, and
TENANT also hereby covenants and agrees that it will not enter into any contract for such work,
which shall not, in express terms, contain the aforesaid provisions.
To the fullest extent permitted by law TENANT releases LANDLORD and each
member of LANDLORD GROUP from, and waives any claims for, any personal injury or any loss
or damage resulting from LANDLORD'S use, installation, construction, or maintenance of overhead
or underground electrical facilities, now or hereafter installed or constructed on or about the
LEASED PREMISES, or for damage caused by fire, vandalism or other casualty, to any vehicle,
equipment, merchandise or personal property on the LEASED PREMISES at any time during the
term hereof.
(a) TENANT agrees to require each of its contractors before providing any labor or materials
in connection with any work on the LEASED PREMISES, to purchase and maintain, or, at the
option of TENANT,to itself purchase and maintain, at the cost of TENANT or its contractor, a
policy or policies of insurance issued by good and responsible insurance companies and in a form
satisfactory to LANDLORD as follows:
(i) Workers' Compensation Insurance Policy: Coverage A -providing payment promptly
when due of all compensation and other benefits required of the insured by the
workers' compensation law; Coverage B - Employers' Liability: providing payment
on behalf of the insured with limits not less than$1,000,000 each accident/occurrence

for all sums which the insured shall become legally obligated to pay as damages
because of bodily injury by accident or disease, including death at any time resulting
therefrom. Coverage A and Coverage B will cover all contractors, subcontractors,
and their subcontractors;
(ii) Comprehensive General Liability Policy or Policies covering all contractors,
subcontractors and all their subcontractors with limits not less than the combined
single limit of$4,000,000 for bodily injuries to or death of one or more persons
and/or property damage sustained by one or more organizations as a result of any one
occurrence, which policy or policies shall not exclude property of LANDLORD.
LANDLORD shall be added as Additional Insured under endorsement GL 2010 or
CG 2010. Bodily injury means bodily injury, sickness, or disease sustained by any
person which occurs during the policy period, including death, at any time resulting
therefrom. Property damage means (1)physical injury to or destruction of tangible
property which occurs during the policy period, including the loss of use thereof at
any time resulting therefrom, or(2) loss of use of tangible property which has not
been physically injured or destroyed provided such loss of use is caused by an
occurrence during the policy period; and
(iii)Automobile Liability in the amount of not less than$2,000,000 per occurrence
combined single limit covering all owned leased, rented and non-owned vehicles.
There shall be furnished to LANDLORD, prior to commencing the work of installing,
repairing, replacing or removing the Installation, a certified copy of each policy of insurance or a
Certificate of Insurance evidencing the coverage's specified in subsections (i), (ii) and(iii) of this
Section. Insurance coverage as required herein in subsection (a) items (i), (ii), and (iii) shall be
kept in force until all work has been completed. Declarations in each of said policies shall
identify the work as being done by and for others on property owned by LANDLORD, and there
shall be no exclusions in any of said policies not approved by LANDLORD. LANDLORD
hereby reserves the right to amend, correct and change, from time to time, the limits, coverage
and form of policy as may be required from TENANT'S contractor or contractors before entering
the LEASED PREMISES or LANDLORD'S other property to perform any work thereon.
(b) TENANT shall, in any event,purchase and maintain at all times during the
term of this LEASE, at its sole cost, the following insurance coverages:
(i) an Owner's, LANDLORD'S and TENANT'S Liability Insurance Policy or it's
equivalent in the name of LANDLORD, as the insured,with limits of not less than the
combined single limit of$4,000,000 for bodily injuries to or death of one or more
persons and/or property damage sustained by one or more organizations as a result of
any one occurrence, which policy shall not exclude property of LANDLORD and shall
include automobile liability(owned and non-owned)with combined single limits of not

less than $2,000,000. Bodily injury means bodily injury, sickness, or disease sustained
by any person which occurs during the policy period, including death, at any time
resulting therefrom. Property damage means (1)physical injury to or destruction of
tangible property which occurs during the policy period, including the loss of use
thereof at any time resulting therefrom, or(2) loss of use of tangible property which
has not been physically injured or destroyed provided such loss of use is caused by an
occurrence during the policy period;
OR
(ii) as an alternative to the Owner's, LANDLORD'S and TENANT'S Liability
Insurance Policy or it's equivalent described hereinabove, TENANT may
purchase and provide a rider or an endorsement to its existing Comprehensive
General Liability policy or policies of insurance naming LANDLORD, as an
additional insured under endorsement GL 2010 or CG 2010, covering the location
of TENANT'S facilities, and including coverage extensions for
premises/products/completed operations and contractual liability for TENANT'S
indemnity obligations hereunder,provided that the limits and coverage in this
alternative form of insurance are equal to or greater than the limits and coverages
specified above in the Owner's, LANDLORD'S and TENANT'S
Liability Insurance Policy or it's equivalent. LANDLORD hereby reserves unto
itself the unrestricted right to either approve or reject, during the term of this
LEASE, any such alternative form of insurance that may be presented by
TENANT.
AND
(iii) Automobile Liability Policy in an amount of not less than $1,000,000.00 per
occurrence combined single limit for bodily injury and property damage covering all
owned, leased, rental or non-owned vehicles, which shall include automobile
contractual liability coverage.
(c) All insurance policies required by this Section shall be issued by good and
reputable companies having a Best's Rating of A-/VII or better and shall provide thirty(30) days
prior written notice of any substantial change in the coverage, cancellation or non-renewal. Any
policies of insurance maintained by TENANT, its contractors or subcontractors, shall be primary
without right of contribution or offset from any policy of insurance or program of self-insurance
maintained by LANDLORD. TENANT agrees and shall require each of its contractors and
subcontractors to agree that they shall each arrange for the issuers of all policies of insurance
required hereunder to waive their rights of subrogation against LANDLORD, its directors,
officers, employees and agents. LANDLORD hereby reserves the right to amend, correct and
change, from time to time,the limits, coverage and form of policy as may be required from
TENANT.

Prior to the date of this LEASE and within thirty(30) days prior to each
anniversary of the date of this LEASE occurring during the term hereof, TENANT shall furnish
LANDLORD with certificates of insurance evidencing TENANT'S compliance with the
requirements of this Section. There shall be no exclusion in any of such policies or renewals not
approved by LANDLORD.
The paragraph on page 12 of the Original Lease headed "TAXES" is hereby deleted
and amended to read as follows:
"TAXES": TENANT agrees to use its best efforts to provide LANDLORD with a
Certificate of Exemption of Real Estate Taxation for the LEASED PREMISES each and every
year during the term. However, if TENANT cannot provide LANDLORD with a Certificate of
Exemption of Real Estate Taxation for the LEASED PREMISES each and every year during the
term, TENANT agrees to reimburse LANDLORD for any property taxes for the LEASED
PREMISES within thirty(30) days after presentation of a bill.
Paragraph one under"TERMINATION OF LEASE"on page 14 of the Original
Lease is hereby deleted and amended to read as follows:
TERMINATION OF LEASE: This LEASE may be terminated with respect to all
or any portion of the LEASED PREMISES at any time by either party hereto by giving 90 days'
prior written notice to the other party of such termination. The mailing of such notice in
accordance with the provisions of the Paragraph hereof entitled "NOTICES" shall be deemed to
be sufficient service thereof.
The paragraph on Page 17 of the Original Lease headed "NOTICES" is hereby
deleted and amended to read as follows:
"NOTICES": "All notices to LANDLORD shall be in writing; to Commonwealth
Edison Company, c/o Manager, Land Leasing, Real Estate &Facilities, Three Lincoln Center, 4`h
Floor, Oakbrook Terrace, Illinois, 60181, or at such other place as LANDLORD may from
time-to-time designate in writing. All notices to TENANT shall be in writing; addressed to
TENANT, c/o Village Manager, 50 Raupp Boulevard, Buffalo Grove, IL. 60090, or at such other
place as TENANT may from time-to-time designate in writing. The term "in-writing" shall
include telegraphic, telecopier, telex, electronic mail or similar means of transmitting writings".
The following paragraphs are added to the Original Lease:
All of the terms and conditions of the Amended Lease are incorporated herein by
reference and except as expressly modified by this instrument, said terms and conditions shall
remain in full force and effect.

AUTHORITY TO ACT: This agreement shall be executed for and on behalf of the
TENANT pursuant to a resolution adopted by the Trustees of the Village of Buffalo Grove, the
TENANT, at a regular meeting held , 200_, and signed by the
officers therein designated as signatories and attested by the clerk of such TENANT and a
certified copy of such resolution shall be attached hereto and made a part hereof as evidence of
the authority herein exercised by the undersigned officers executing the Lease.

and expertise in the involved engineering specialty fields with a degree of consideration
given to the reasonableness of the involved proposed fees and rates schedules.

FOR ENGINEERING SERVICES
RELATED TO THE EVALUATION
OF SANITARY SEWER SYSTEM SURCHARGING
DURING HEAVY RAINFALL EVENTS
The Village of Buffalo Grove is requesting proposals from engineering firms with
background and experience related to evaluations of sanitary sewer system surcharging
which occurs during heavy rains and the development of solutions to address problems
related to these types of situations.
It is anticipated that the proposal will provide for the review of the various items of
information and reports related to previous I/I evaluations and correction activities and
records related to 2001 rain events and related sanitary sewer system operational records.
A further description of these reports and other items of information are available upon
request.
It is also anticipated that the proposal will provide for the provision of recommendations
for additional studies and/or corrective actions which would be cost effective to
implement, in order to optimize system performance in compliance with all applicable
regulations and the"best practices"related to sanitary sewer system design and
operation. The provision of estimates of costs of recommended activities and cost
comparisons and comparative description of other potential activities which are not
recommended for the Village's pursuit,but which are evaluated in the course of the
study, are also desired.
The proposal must be accompanied by a written Statement of Qualifications, all to be
delivered on or before 3:00 p.m. on Thursday,August 1, 2002.
A signature ready contract, suitable for Village approval in order to accept and initiate the
proposed evaluation is also requested.
The Statement of Qualifications shall include the following information as a minimum:
1. Descriptions of the specialized experience and technical competence of the firm
and its personnel in connection with the types of services required. These
descriptions shall include the resumes of personnel who will become involved in
the project.
2. Past record of performance on similar projects, including such factors as quality
of work, ability to meet schedules and control of costs,the name of individuals
who administered past contracts for the public bodies or other agencies for which
the firm has performed similar projects should be provided.

3. An inventory of pertinent equipment owned or leased by the firm or a description
of the anticipated arrangements for obtaining the equipment necessary to
complete the project in an expeditious manner.
4. A description of the ability of the firm to perform the work within a reasonable
time considering the firm's current and planned workload. A critical path
diagram or a tentative progress schedule for involved activities should be
provided.

The attached Ordinance creates the office of President Pro Tem for the Village. This Ordinance follows a
report and recommendation that was shared with the Village Board, and addressed to William R. Balling,
Village Manager from Ghida Neukirch,Assistant Village Manager dated 5/15/2002.
Thirteen (13)municipalities responded to a survey addressing their policies regarding appointments of
Vice Mayors and President Pro Tem positions. Research was also conducted regarding the policies of the
Metropolitan Mayors Caucus,Northwest Municipal Conference and Lake County Municipal League.
The attached Ordinance creates the office of President Pro Tem for the Village of Buffalo Grove.
Highlights of the Ordinance are as follows:
A. The Village President,by and with the advice and consent of the Board of Trustees, shall appoint
the senior Trustee as President Pro Tem. Seniority shall be based on the most continuous time served as a
Trustee. In the event that more than one Trustee has equal seniority,the Trustees having equal seniority
shall draw lots to determine who shall hold the position of President Pro Tem.
B. The President Pro Tem shall perform the duties pertaining to the office of the Village President
during an absence or disability of the Village President. The Village President shall be deemed absent
when he is outside of the State or otherwise unavailable,within one hour's notification of the need to
exercise the powers of his office by the Village Manager or designee.
C. If the absence or disability of the Village President lasts longer than thirty (30) days,the Board of
Trustees shall then elect one of its members to act as President Pro Tem at the first Board meeting
occurring at least thirty (30)days after said notice.
D. The President Pro Tem shall serve until any of the following occur:
1. Such person resigns as President Pro Tem, or
2. Such person is no longer a Village Trustee, or
3. A successor is chosen following the next general municipal election, or
4. An affirmative vote of the majority of the Trustees then holding office to remove the
President Pro Tem, or
5. A successor is chosen pursuant to subsection D. hereof.
F. In the event the Village President fails to attend a meeting of the Village Board,the President Pro
Tem shall act as a temporary chairman for the meeting of the Village Board, and while so serving as
temporary chairman, shall have only the power of a presiding officer and a right to vote in the capacity as
Trustee on any ordinance, resolution, or motion. In the absence of the Village President and President
Pro Tem from a meeting,the Board of Trustees may elect one of their members to act as a temporary
chairman.
Duties and responsibilities of the President Pro Tem as recommended in the 5/15/02 memorandum are
already within the authority of each of the Trustees and therefore are not included in the Ordinance, e.g.

AN ORDINANCE AMENDING CHAPTER 2.02,
BOARD OF TRUSTEES, OF THE
VILLAGE OF BUFFALO GROVE MUNICIPAL CODE
WHEREAS, the Village of Buffalo Grove is a Home Rule Unit pursuant to the Illinois
Constitution of 1970;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT and BOARD OF
TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, LAKE and COOK COUNTIES,
ILLINOIS, as follows:
Section 1. Section 2.02.015 is hereby added to the Village of Buffalo Grove Municipal
Code, to read as follows:
2.02.015 President Pro Tem
A. There is hereby created the office of President Pro Tem for the Village.
B. The Village President, by and with the advice and consent of the Board of

irrespective of the fact that anyone or more sections, subsections, sentences, clauses or
phrases had been declared invalid or unconstitutional.
Section 3. This ordinance shall be effective upon its passage and approval.

John Conrad Schiess of Metropolis Architects/Builders has submitted the attached petition and
concept plan on behalf of Millenium Holding Company.
The concept plan includes the property at 313 Dundee Road, zoned B-1, currently occupied by
the All-Suburban Dental Center and the property at 936 Betty Drive. The north portion of the
Betty Drive property is zoned B-1; the south portion is zoned R-4A. The site area including both
properties is 1.81 acres. The Village's 1998 Comprehensive Plan designates this area for office
development.
Mill enium is listed on the Petition for Concept and Preliminary Plan Review as the owner of the
property at 313 Dundee Road. The Petition does not include the property at 936 Betty Drive. The
Petition needs to be amended to include the pertinent information concerning ownership of the
Betty Drive property.
Millenium proposes to remove the current buildings on the site and construct an automobile sales
and leasing facility. The proposed building would be two stories with a total floor area of 14,703
square feet, including a showroom and offices. The outdoor parking area would include 49
parking spaces and an extensive paved area for vehicle storage.
The B-4 District is the appropriate zoning classification for this type of automotive facility. The
Zoning Ordinance requires a minimum area of four acres for a separate B-4 designation, but the
Ordinance allows the acreage of adjoining parcels with similar zoning to be included in
calculating the minimum area requirement. The property west of the site is zoned B-3
(Covington Office Plaza); the property to the east is zoned B-1.
Primary access to the site would be provided by a driveway to Dundee Road. Two driveways are
proposed on Betty Drive. A traffic impact analysis would be required as part of the Plan
Commission review process.
An underground storage facility is proposed for stormwater management.

has requested time to present his request to the Village Board to amend
13.04.320-Service Connections, suggesting some Village participation in repair work
associated with his property.
Presently, that section of the ordinance clearly defines that the service line maintenance
responsibilities rest with the homeowner and not the Village, and we have consistently
administered the sewer maintenance program following these provisions of the
Municipal Code. Mr. Culbertson believes that extenuating circumstances may be
present, along with excessive costs, that would warrant public participation. Mr.
Culbertson plans to make a verbal and taped presentation before the Village Board
requesting a change to this section of the Municipal Code.

SUBJECT: sewer Repair
Dear Mr. & Mrs. Culbertson:
In response to your letter of May 15, 2002, I have had the opportunity to review
with the Village Engineer the issues you've raised and offer you the following response.
Overall, the Village does not believe it has any financial exposure on the repairs to
your sewer line, as described in' your letter. We disagree with the assumption that the
sanitary sewer was not connected to the Village's main since your house was constructed
in the 1960's. We believe that such a condition would not have allowed you to have
service over the past 35 years. We believe that the blockage in your line was due to tree
roots and that the likely culprit in the pipe separation was the plumbing contractor
himself, who possibly broke the line and is seeping to disavow responsibility for his
actions.
Our own Public Works operators who were in the line and actually repaired the
Village's main, which was also damaged by Bishop Plumbing, confirmed evidence of a
recently cut sewer tile in the trench, confirming this scenario, and the Village Engineer,
as I mentioned, witnessed personnel from Bishop Plumbing using a rail pole to "service"
the sewer line, probably causing the damage to the line.
Please keep in mind that the Village, through its inspection process, is not a
guarantor or insurer of work within the community. We do everything in our power to
insure that all construction conforms to specifications, but the ultimate responsibility for
installation rests with the contractor himself. The utility installation in this subdivision,
both of the storm and the sanitary service, was done concurrently by the subdivider and
builder of your subdivision. We believe there is no relation between the pavement
settlement, which occurred in your subdivision over the past 30 some years, and the line
servicing your property.
You have asked for specific answers to several questions which include the
following:
1. The Village guarantee for its work done. As you know, the Village dismissed
Bishop Plumbing from the site after we had evidence that they had broken the main
service line. Public Works sewer operations personnel made the repair and reinstalled the
service line to your property. While it met the specifications of the Village, we offer no
guarantee for that work. However, we have a high correlation of servicing with our
repairs, and I do not anticipate any problems.
2. A detailed report of the repairs. Public Works personnel cut out approximately a
3' section of the public sewer and reinstalled the wye, then reinstalled a new riser and
connector pipe to your service line to the far side curb. All of the work was done in a
professional and workmanlike manner.
3. Return of the $1000 cash bond. The $1000 cash bond is intended to be held
until the parkway is restored, and we will be happy to return your bond as soon as the
parkway is brought back to its original condition.
4. Sewer work inspections. The Village Engineer was present and observed some of
the construction, however, the primary reconstruction was done under the Sewer Section
Division, Dept. of Public Works, and the sewer operators.
Concerning additional questions you asked, I would like to offer the following:
1. Relationship of storm sewer to sanitary. We do not believe that the theory of
settlement is relevant to the problem with your service line. We believe that it was caused
by root blockage and settlement was not a factor or relevant in the loss of service to your
property.
2. Could you have been running as a "septic system" under the street for 35 years.
We do not believe it is feasible that you would have service to your property for that length
of time if your sanitary sewer was not connected to the main service line. We do not
believe that the settlement on the street correlates to the problems you had with blockage
to your service line. With a 6" by 100' pipe, the hydraulic capacity of that line is
approximately 147 gallons.
3. Conversion of 10' of head to psi. Approximately 4.3 psi would be the pressure in
the sewer line servicing your property.
Mr. & Mrs. Culbertson, I must inform you that we cannot participate in any
reimbursement for this work. You may well have a claim against Bishop Plumbing for the
services they provided you, and you may wish to evaluate options to recover some of your
costs from them. I am sorry that the Village cannot be of further assistance to you in this
matter.

Dear Mr. Kuenkler,
We are asking for reimbursement of costs incurred for plumbing repairs in the parkway
across the street from our home at 429 Sussex Court and answers to some questions we
have relative to the repair done by the village.
We have lived in our home for 18 years and have never had a problem with the sewer
system that we knew about. On March 13, 2002,water backed up into our laundry room.
On March 14,2002, we rented a power rodder and at approximately 100 feet,the rodder
stopped. The sewer worked until April 18, 2002 when we again had water back up into
the floor drain. The village was called and they checked the sanitary sewer, which was
flowing fine. We called the village for assistance and we were told that the ordinance
makes the sewer line up to and including the connection our responsibility. We then
contacted Bishop Plumbing to video and power rod our sewer. Again at 100 feet, they
could not get through. We signed a contract to repair the damaged pipe. A permit was
obtained and$1000 bond was posted for work to begin. Bishop Plumbing began work
and located a fitting coming up from the sanitary sewer with no pipe connected to our
sewer line. They also discovered a village storm sewer main that appeared to have settled
on top of our sewer line. J.U.L.I.E. or the village did not mark this storm sewer. Dick
Kuenkler was informed and I (Doug) met him at the site along with the contractor at 9:00
a.m. on May 2, 2002. After the rainwater was pumped out of the hole we saw the fitting
with no pipe attached and the excavation under the main for my end of the sewer
progressed. Dick returned with some measuring devices and told me that the pipe would
probably be touching,but he wasn't sure. He did not measure the size of the pipe. The
water line to the neighbor at 430 Sussex was also visible and is in direct contact with the
storm sewer. We asked if the village wanted to take over the project due to these
findings. We got no response from Dick. I asked Dick whom I should call to get the,
village involved. He told me he was the person to contact and he would gather
information but that he did not make decisions. Work at the site continued and Bishop
found a small piece of sewer line buried approximately one foot below the elbow fitting
to the main. I was at the site when this was discovered and the pipe was perpendicular to
my sewer line. To my knowledge no other pieces were recovered under the storm sewer
main. Work progressed and Bishop tried to rod out the line to the sanitary sewer main.
We signed another contact with Bishop to further excavate and repair the connection to
the main because the cutter head could not make its way into the sewer main. Bishop
tried to video the connection prior to any work, but the connection was filled with
swirling sewer water making the video ineffective. Dick and I saw this together. Work
progressed slowly as the crew had to hand dig to the sanitary sewer because their
backhoe would not reach to 15 feet down. It was discovered by Bishop that the sanitary
sewer main was cracked and they called the village for authorization to repair. Ray
Rigsby and Dick Kuenkler`came to the site and said to Bishop to fix the main because
they broke it. Bishop asked if he was authorizing the repair and asked for Ray's name
but Ray and Dick got in his car and left the site with no response. My wife and five year
old were standing there while this occurred. (Is that any way to treat a resident of the
village?) The police were contacted on the non-emergency line for some resolution
assistance. Public works showed up in force and ordered Bishop off the job. I called Ray
and asked what was going on and who was going to pay for the sewer repairs. Ray stated
that the most important thing was to get us back in service and we would deal with the
financial responsibility later. The Village workers showed me a PVC pipefitting that
would be installed to repair the main and that PVC would be connected to my sewer line
and would be back in service by the next morning. We left at 5:45 p.m. and returned at
8:30 p.m. to find the village workers gone and the hole completely filled.
I have two theories on what may have happened to my missing sewer pipe. First, the
village owned storm sewer crushed my sewer line due to settling. This is a result of
defective planning and or installation by the contractor and village when the development
was being built. There should be several feet of earth between sewer and water lines in
my opinion. I assume the village inspected both my sewer and the storm sewer 35 years
ago. The whole reason for permits is to protect the current or future resident from poor
workmanship and defective plans. The second theory is that the excavation of the storm
sewer at the time of installation damaged our pipe. This could explain the broken pipe
piece turned sideways below the connection. The village also should have inspected this.
To this point the village has not accepted any responsibility for the damage the storm
sewer caused my sanitary sewer. How can the village deny even considering the
possibilities I have brought up? Could I have had a septic system under the street for 35
years? Look at the street in front of my house. It has a built in speed bump in it exactly
over my sewer line. Also the village repaired a sinkhole in front of my driveway(I
believe in Spring 2001). The parkway on the north side of Sussex has settled and
driveways on that side have settled. How much water does a 6-inch pipe 100 feet long
hold? 100 gallons? How much water pressure does that much water put on the end of an
open pipe 10 feet down? Is that enough to force sewage that is degrading into the gravel
soil around the sewer main? If the sewer line were connected I could have had a problem
with roots in the drop to the sewer main that could have caused a repairable stoppage at a
greatly reduced cost. Bishop Plumbing had a valid contract and proper permits to fix my
sewer line. I had never met any of the employees before this situation. Why would they
even tell me about the storm sewer damaging my sewer when they could have lost the job
to the city? I believe Bishop was honest with us and that they tried to keep the village
informed with their findings.

I have several questions that I would like answered in writing.
1. How long of a guarantee do you provide on the work that was done? I never want
to go through this process or expense again.
2. Please give a detailed report of the repairs to my sewer for my peace of mind.
3. When can I get my$1,000 bond back?
4. Was the sewer work inspected and by whom?
Again, we are asking to be reimbursed for our expenses related to the city storm sewer
damaging our pipe in the amount of$ 8,064. This includes the contract paid to Bishop of
$7,100,the diagnosis of the initial problem of$688 and the rodder rental and day off of
work of$276. We would also like our$1,000 bond back. We look forward to hearing
from you.

the daily activities. Additionally, the supervisors and the crew leaders should speak and read the
English language. Contract Cleaning Maintenance, Inc. will provide employees that can
communicate with staff.
Staff recommends awarding the 3-year contract in annual increments. Each year staff will
provide a performance report and recommendation to the Village President and Board of
Trustees for their approval.
Based on the review of the proposals and the interviews with contractors submitting proposals I
respectfully request that the Village President and Board of Trustees consider awarding the
contract for custodial services to Contract Cleaning Maintenance, Inc. for the first year contract
cost of $82,128.00.

RE: AWARD OF BID CUSTODIAL SERVICES
Bill, pursuant to Village Board authorization, staff solicited sealed bids for contract custodial
services for Campus facilities.
Sealed bids were received June 4, 2002 at 10:30 A.M. The bids were opened and read publicly. I
have attached the bid tabulation for your review.
Staff reviewed the proposals and interviewed the 6 contractors that submitted proposals. A
sample of the questionnaire is attached.
All contractors except the Millard Group submitted financial statements.
As staff interviewed each contractor we were able to determine if the contractors took the time to
consider manpower assignments in developing their proposals. Best Quality Cleaning, Inc.
suggested that 2 or 3 people could clean all the facilities spending 30 hours per day total for the
daily activities. Alpha Building Maintenance service suggested 3 full time people, 30— 36 hours
a day total for daily activities. Contract Cleaning Maintenance, Inc. proposed 5 or 6 employees,
40—48 hours total to perform daily activities. All other contractors were considering 3 —4
people in the 30—40 hour ranges. All contractors have separate detail crews that provide the
special floor care and windows.
The contractors were asked if they completed pre-employment background checks on new
employees and if they provided company ID's and uniforms. Best Quality Cleaning, Inc. does
not do pre-employment background checks, they do provide an ID card, no uniforms. Alpha
Building Maintenance Service performs background checks, provides the employee with a
company ID and a knit shirt uniform. Contract Cleaning Maintenance, Inc. completes a
background check on new employees, provides the employee with a company ID and uniforms.
All other contractors submitting proposals completed some form of background check, except for
the Millard Group. They provide company ID's and they provide uniforms, except B & B
services.
The contractors were asked if there would be a working supervisor with the crews. Best Quality
Cleaning, Inc. and Alpha Building Maintenance Service have roving supervisors. There is no
supervisor or crew leader on site during the crews working hours. All other contractors have a
crew leader who is responsible for the crews and roving supervisors to check in on the crews.

A walk through of all facilities was mandatory for all contractors submitting a proposal.
Mr. Czaplicki observed during the walk through that several contractors were more interested in
the previous contract cost rather than the performance specification. Those contractors did not
bid.

provide a performance report and recommendation to the Village President and Board of
Trustees for their approval.
