President Hartstein called the meeting to order at 7:33 P.M. Those present stood and pledged allegiance to the Flag.

PRESIDENT'S REPORT
President Hartstein read a proclamation declaring the week of May 18-24,2003 as National Public Works Week,
and urged all residents to recognize the contributions that Public Works personnel make every day to insure our
health,safety,comfort and quality of life.
President Hartstein read a proclamation declaring the week of May 18-24,2003 as Buckle Up Buffalo Grove Week
and urged residents to support the efforts of enforcement agencies to increase compliance with occupant protection
laws.
President Hartstein reported that he and several other representatives from the Village recently attended a luncheon
where special recognition was given to our Village Manager,William Balling,by IAMA as he was honored as the
Manager of the Year by this statewide organization. Mr.Balling was congratulated by the audience and the Board.
President Hartstein noted Twin Groves Middle School was recognized by SWANCC again for their efforts in
recycling,and he congratulated the students for this distinction,which they have also received in the past.

President Hartstein noted that several programs have been taped to be shown on Channel 6 featuring information on
the Relay for Life hosted by both Buffalo Grove and Stevenson High Schools,the Buffalo Grove Fine Arts
Festival to be held in July,and the Buffalo Grove Days festival to be held over Labor Day weekend. A special
program was also prepared to acquaint senior citizens with some of the programs that are available through the
Townships and other agencies relating to helping seniors control costs.
President Hartstein urged the community to attend the Memorial Day Observance on Monday,May 26,2003 at
11:00 A.M. at the Knopf Cemetery on Arlington Heights Road.
President Hartstein commended the Police Department for another successful Bike Rodeo held this past weekend.
TRANSPORTATION
Trustee Berman presented an update on the Route 22 improvement project. President Hartstein also reported on
meetings that he has had with appropriate parties concerning this project.
CITIZEN'S POLICE ACADEMY
Trustee Berman reported on his recent graduation from the Citizen's Police Academy;he presented a brief
background on the academy;he thanked all the members of the Police Department involved in conducting this
outstanding program,and urged any citizens with an interest in law enforcement to take advantage of this
Oworthwhile experience.
RELAY FOR LIFE
Trustee Berman reminded residents that this year's Relay for Life sponsored by the American Cancer Society
will be held at Buffalo Grove High School on June 13-14,2003;he provided information on ways to get involved in
this important event. Both Buffalo Grove and Stevenson High School students are involved in planning this event.
Trustee Berman urged residents to form teams to participate in and support this cause,and he noted that further
information may be found on Channel 6 and the Village of Buffalo Grove website.
NORTHWEST MUNICIPAL CONFERENCE
Trustee Braiman reported that he had attended the last NWMC meeting,noting that the Conference will now have a
website to enable members in research of various topics,and also noting that the slate of officers for the upcoming
years includes President Hartstein as the Vice President of the Conference.
POLICE CHIEF
Mr.Balling reviewed the process of selecting a new Police Chief to succeed retiring Chief Leo McCann,with that
process leading to the final selection of Deputy Chief Steven Balinski.
Mr.Balling asked Deputy Chief Balinski and his wife,Karen,to come forward. Mr.Balling then administered the
oath of office installing Police Chief Balinski.
President Hartstein congratulated the new Chief of Police on behalf of the Village Board and the entire community;
he noted that the Village has been very proud of Chief Balinski's service to date,and he is confident that Chief
Balinski will continue that same level of outstanding service as he leads one of the finest Departments in the State of
Illinois and the United States. Chief Balinski was heartily congratulated by the audience and the Board.
Chief Balinski spoke of the honor and privilege it is to be selected as the Chief of Police of the finest police
organization in the State of Illinois,and possibly the entire country;he pledged to continue to provide the vision of
delivering the highest qualify of police service to every citizen of the community with integrity,respect,and equality
of justice;he thanked the Village Board and the staff for their belief in him;he thanked his family,friends and
associates for their support. Chief Balinski pledged that the men and women of the Buffalo Grove Police
Department will continue to support the elected officials,the staff and community leaders in making the Village of
Buffalo Grove a very safe place to live,work and raise a family.

MANAGEMENT REPORT
Mr.Balling noted the submittal of the Management Report for the month of April,2003;there were no questions
regarding the report.
AMVETS BUFFALO GROVE POLICE OFFICER OF THE YEAR AWARD
j Chief Balinski introduced Tony Altieri of Amvets Post 66 to present the awards.
Commander Alfieri of Post 66 in Wheeling,and also Senior Vice Commander of the State of Illinois,noted that he
is present on behalf of Emmerich Post 255,as they had another commitment this evening;he thanked the members
of the Police Department for their assistance in selecting the recipients for these awards.
Commander Altieri noted that the Police Officer of the Year for 2902 award is presented to Officer James Hams;he

read a biography of Officer Harris' career and presented a plaque to him.
Commander Alfieri noted that the Police Department Special Commendation Award for 2002 is presented to Officer
>= Christy Bourbonnais;he read a biography of Officer Bourbonnais' career and presented a plaque to her.
Both recipients were congratulated by the audience and the Board. Chief Balinski thanked Amvets Post 255 for
their efforts in presenting these awards each year.
1 O DUI ENFORCEMENT CLUB AWARDS
Chief Balinski introduced Dwight Lockwood of IDOT to present the awards.

Mr.Lockwood thanked the Village for the privilege of being present to recognize the outstanding work of the
Buffalo Grove Police Department. Mr.Lockwood asked Corporal Bethge,Officers Goldstein,Halverson,Paul and
Sepot to come forward. Each of these officers has qualified for the DUI Club award for the past year;as a group
they arrested and changed over 280 impaired drivers. Mr.Lockwood presented each officer a pin and a certificate
commemorating his exemplary performance in removing impaired drivers from the highways.
PUBLIC HEARING—CY'S CRAB HOUSE
President Hartstein opened the Public Hearing at 8:12 P.M.
Moved by Johnson,seconded by Berman,to continue this Public Hearing until June 2,2003. Upon voice vote,the
motion was declared carried.
At 8:13 P.M.,President Hartstein continued the Public Hearing until June 2,2003.
QUESTIONS FROM THE AUDIENCE
President Hartstein asked if there were any questions from the audience
Jim Briskin,515 St.Mary's,asked about the upkeep of the empty Amoco station on Lake Cook Road;he stated that
it is beginning to look like an eyesore now that the grass and weeds are beginning to grow. Mr.Balling responded,
stating that the maintenance of the property is the responsibility of the owner,and that staff will be contacting the
owner to ensure that the property is maintained.
Mr.Briskin questioned the method of choosing the streets that will incur maintenance each year;Mr.Balling
responded and explained how the street maintenance schedule is determined.
CONSENT AGENDA
President Hartstein explained the Consent Agenda,stating that any member of the audience or the Board could
request that an item be removed for full discussion;there were no such requests. The Village Clerk then read a brief
synopsis of each of the items on the Consent Agenda.

Q1097 MILL CREEK DRIVE
Mr.Balling briefly reported on the performance of the drainage swale at 1097 Mill Creek Drive,details of which are
contained in the Village Board Meeting Agenda Item Overview prepared by Mr.Kuenkler..
Robert Penelle, 1066 Crofton Lane,distributed photographs depicting his property after a rainfall;he stated that
water ponds on his property just as it has since 1994.
Review of the situation by the Board followed.
Moved by Johnson,seconded by Braiman,to have staff take all necessary steps to cause the removal of the drain
line extension and the downspout and building sump pump discharge on the Padgett property at 1097 Mill Creek
Drive with all due speed,and to work with Mr.Penelle in terms of permitting any grading he wants to do on his
property to facilitate the flow of the swale.
Trustee Berman stated that it is important that the Village continue to monitor this situation and that we work closely
with the Padgetts as well as the Penelles;the Board must get follow up information on the conditions that are
presented in the swale and on the Penelle property after the disconnect,even before the regrading,so that there is a
better understanding of what took place and how better to evaluate these situations in the future.

' NORTH VILLAGE REDEVELOPMENT AREA
John Green,Groundwork Architects,Planners&c Engineers,representing Jacobs Homes,made a presentation to the
Board requesting Plan Commission referral for the proposed North Village Development Area at Aptakisic,Prairie
and Weiland Roads,annexation and zoning concerning a mixed-use development. Details of Mr.Green's
presentation are found in the Village Board Meeting Agenda Item Overview prepared by Mr.Pfeil.

Trustee Johnson stated that he previously represented one of the property owners,the Aldriches,however,that is no
longer the case. Trustee Johnson stated that the Village definitely needs the Weiland Road extension;he wants to
see that this area is developed in the best way possible;there is a lot on this proposal and he is concerned that this
parcel can hold everything proposed;there would be a large amount of traffic added to an already burdened area;he
believes there may be too much senior housing;he would like to ste the commercial proposed;he believes there is
too much multi-family;he would like to eliminate some density for more green space;he thinks the concept might
be a little too vague at this point;he is concerned with Plan Commission referral at this time.
Trustee Kahn echoes many of Trustee Johnson's comments,but he believes it is a wonderfully ambitious plan and
very intriguing.Trustee Kahn's concerns deal with the challenge of attracting retailers for the long run,the overall
density,increased traffic,and he is not yet sure if this is ready for Plan Commission referral.
Trustee Berman stated that,if not executed properly,this could be a disaster,but he believes that there is a lot to like
O in concept and theory;he sees that the plan as trading off density in exchange for other elements of the plan without
many details;he shares the concerns about the viability of the senior housing;we need realistic specialty commercial
but he does not see any details in the plan of the quality of the retail envisioned. Mr.Green stated that they do have
contractual control over the core development area. Trustee Berman has a concern with proceeding with the plan if
it is not a package deal and all ready to go together;he is concerned with deferring the commercial and the roadway
parcels and allowing the developer to go forward with the high-density townhouse development;he stated that he
will not support the proposal if it involves only the core development.
jTrustee Braiman shares many of the concerns mentioned,but he does not have a problem referring the proposal,
however,he definitely wants to see the whole parcel as one entire unit;he wants to reduce the density of the
j townhomes and the multi-family;he likes the idea of the cluster detached;he likes the idea of the commercial being
centered.

j Trustee Glover agrees with Trustee Braiman;her approval is subject to the entire parcel being developed or under
the control of the developer.
Mr.Green stated that the reason they are asking for referral is because they want to begin the dialogue to create the
tool that defines the entire program;they are aware that this will be a long process. Mr.Green stated that they will
not let the Village down,and if this proposal is approved,it will be the focus of the development team for the
several years that it takes to come to fruition.
Trustee Trilling thanked the developer for bringing this proposal to the Village;he believes that it is a wonderful
project;he believes the commercial area needs to be defined.
Moved by Braiman,seconded by Glover,to refer the proposed North Village Development Area—
Aptakisic/Prairie/Weiland Road,annexation and zoning concerning a mixed-use development,with the request that
the Plan Commission liaisons keep contact with the entire Board on the progress of this project.
Trustee Berman stated that he wants the developer to begin working with the school districts right away.

i TWIN CREEKS PARK

Moved by Berman,seconded by Johnson,to refer the proposed plan for Twin Creeks Park,401 Aptakisic Road,
Special Use in the R-1 District,to the Plan Commission for review.
I Trustee Johnson asked that the Park District to maximize the green space to the greatest extent possible;he
suggested that the park district building might be placed on the other side;he has a major concern with cars turning
east off of Aptakisic,and he suggested that possibly people could park at the existing water station south of this
property and walk from there.

Trustee Braiman agreed with Trustee Johnson with regard to the building;he also has a concern with the safety town
structures being maintained and aesthetically attractive,and he suggested perhaps that those structures be brought
j inside when they are not in use.
A resident stated that she does not see any value in Safety Town and would prefer to preserve the green space;Mr.
Green responded to her concern.
Trustee Berman and Trustee Johnson explained that this property belongs to the Park District and the Village may
not tell the Park District what they can and cannot do with their property;any concerns with the plan should be
directed to the Park District.

Staff and representatives of Cy's Crabhouse have reached an agreement for annexation and zoning of the
property located at 933 Milwaukee Avenue. This property is located immediately north of the proposed
restaurant use as part of Riverwalk North, approved by the Village Board in February, 2003. This
proposed location,considered for annexation, is part of the Village's Comprehensive Plan.
Exhibits of special consideration as part of the Agreement include the following:
1) Sign package (Exhibit D) - The existing signs on the property would be approved as part of the
Agreement. If any existing sign is damaged 50 percent or greater in terms of monetary
replacement value, said sign would not be reconstructed.
2) Ground Sign with Changeable Copy (Exhibit D-1) - As part of the Agreement, the proposed
changeable copy sign would be approved.
3) Code Compliance Required Corrections (Exhibit E). The Building& Zoning Department and
Fire Prevention Bureau conducted a pre-annexation inspection of the property and noted the
issues identified on this exhibit. As part of the Agreement, once the owner of the restaurant
connects the fire alarm system to Northwest Central Dispatch and installs panic hardware on all
egress doors, then the Village would provide a grant to the owner to complete all of the other
outstanding code compliance issues as detailed on the exhibit.
As part of the agenda, an Ordinance approving the Annexation Agreement is provided, as well as
an Ordinances annexing the property, and zoning the property B-3. Approval is recommended.

ANNEXATION AGREEMENT
This agreement(hereinafter referred to as the "Agreement")made and entered into this 2nd
day of June,2003,by and between the VILLAGE OF BUFFALO GROVE(hereinafter referred to
as "Village") by and through the President and Board of Trustees of the Village (hereinafter
collectively referred to as the "Corporate Authorities")and Cosmopolitan Bank and Trust Company,
as Trustee under Trust Agreement dated April 8, 1998 and known as Trust #30812 (hereinafter
referred to as "Owner").
WITNESSETH:
WHEREAS,the Village of Buffalo Grove is a Home Rule Unit by virtue of the provisions
of the Constitution of the State of Illinois of 1970; and,
WHEREAS,Owner is the owner of a certain tract of property(hereinafter referred to as the
"Property")comprising 0.91 acres legally described and identified in the Legal Description,attached
hereto as EXHIBIT A and made a part hereof, and which real estate is contiguous to the corporate
limits of the Village;and,
WHEREAS,a Plat of Annexation, including certain unincorporated highway right-of-way
adjacent to the Property, is attached hereto as EXHIBIT B,which depicts a total area of 1.82 acres
to be annexed; and,
WHEREAS, Owner desires and proposes pursuant to the provisions and regulations
applicable to the B-3 Planned Business Center District of the Village Zoning Ordinance to continue
operating the existing restaurant called Cy's Crab House on the Property; and,

WHEREAS, pursuant to the provisions of Section 5/11-15.1-1 et seq., of the Illinois
Municipal Code (65 ILCS 5/11-15.1-1 et seq.) and as the same may have been modified by the
Village's Home Rule Powers, a proposed Annexation Agreement was submitted to the Corporate
Authorities and a public hearing was held thereon pursuant to notice as provided by Statute;and,
WHEREAS,pursuant to due notice and advertisement,the Corporate Authorities have held
a public hearing and made its recommendations with respect to the requested zoning classification
in the B-3 District; and,
WHEREAS,the President and Board of Trustees after due and careful consideration have
concluded that the annexation of the Property to the Village and its zoning and development on the
terms and conditions herein set forth would further enable the Village to control the development
of the area and would serve the best interests of the Village.
NOW,THEREFORE, in consideration of the premises,mutual covenants and agreements
herein set forth,the parties hereto agree as follows:
l. Applicable Law. This Agreement is made pursuant to and in accordance
with the provisions of Section 5111-15.1-1 et seq., of the Illinois Municipal Code (65 ILCS 5/11-
15.1-1 et seq.)and as the same may have been modified by the Village's Home Rule powers. The
preceding whereas clauses are hereby made a part of this Agreement.
2. Agreement: Compliance and Validity. The Owner has filed with the Village Clerk
of the Village a proper petition pursuant to and in accordance with the provisions of Section 5/7-1-8
of the Illinois Municipal Code(65 ILCS 5/7-1-8)and as the same may have been modified by the
Village's Home Rule powers,conditioned on the execution of this Agreement and the compliance
with the terms and provisions contained herein,to annex the Property to the Village. It is understood
and agreed that this Agreement in its entirety, together with the aforesaid petition for annexation,

shall be null,void and of no force and effect unless the Property is validly annexed to the Village and
is validly zoned and classified in the B-3 District,all as contemplated in this Agreement.
3. Enactment of Annexation Ordinance. The Corporate Authorities within
twenty-one(21)days of the execution of this Agreement by the Village will enact a valid and binding
ordinance (hereinafter referred to as the "Annexation Ordinance") annexing the Property and
adjacent unincorporated highway to the Village. Said Annexation Ordinance shall be recorded at
the Lake County Recorder's Office along with the Plat of Annexation(attached hereto as EXHI131 T
B).
4. Enactment of Zoning Ordinance. Within twenty-one(21)days after the
passage of the Annexation Ordinance, the Corporate Authorities shall adopt a proper, valid and
binding ordinance,zoning the Property in the B-3 District subject to the restrictions further contained
herein and all applicable ordinances of the Village of Buffalo Grove as amended from time to time.
5. Approval of Plans. It is understood and agreed that the Owner has not submitted a
Preliminary Plan for review and approval by the Village since the intended use of the Property is
continuance of the existing restaurant. Any changes to the current building or site, or any new
development of the Property is subject to the requirements of this Agreement and applicable Village
Ordinances,including but not limited to the Zoning Ordinance and Development Ordinance.
6. Compliance with Applicable Ordinances. The Owner agrees to comply with all
ordinances of the Village of Buffalo Grove as amended from time to time in the use and
development of the Property,provided that all new ordinances,amendments,rules and regulations
relating to zoning,building and subdivision of land adopted after the date of this Agreement shall
not be arbitrarily or discriminatorily applied to the Property but shall be equally applicable to all
property similarly zoned and situated to the extent possible. Owner, in the development of the

Property, shall comply with the standards set forth in the Village of Buffalo Grove Development
Ordinance as amended from time to time.
7. Building Permit Fees. The building permit fees may be increased from time to time
so long as said permit fees are applied consistently to all other developments in the Village to the
extent possible. In the event a conflict arises between the Owner and the Village on any engineering
and technical matters subject to this Agreement,the Village reserves the right to pass along any and
all additional expenses incurred by the use of consultants in the review and inspection of the
development from time to time. Owner shall pay any non-discriminatory new or additional fees
hereinafter charged by the Village to owners and developers of properties within the Village.
8. Right of Way Dedication. The Owner acknowledges that it is the intention of the
Village and other involved agencies that at some time in the future Milwaukee Avenue will be
widened. At the request of the Village, but no later than upon approval of the first plat of
subdivision of any portion of the Property, Owner agrees to dedicate such additional right-of-way
along Milwaukee Avenue as may be required to provide a right-of-way of 75 feet from the center
line in conformance with the standards of the Illinois Department of Transportation.
9. Exhibits. The following EXHIBITS,some of which were presented in
testimony given by the Owner or the witnesses during the hearings held before the Corporate
Authorities prior to the execution of this Agreement,are hereby incorporated by reference herein,
made a part hereof and designated as shown below.

10. Building.Landscaping and Aesthetics Plans. If improvements are proposed for the
current use or if new development is proposed,Owner shall submit building and landscaping plans
(which landscaping plans shall conform to the requirements of Village Ordinances)for approval by
the Village before commencing construction of buildings. Lighting and signage shall be compatible
with surrounding areas as approved by the Village.
11. Facilitation of Development. Time is of the essence of this Agreement,and all
parties will make every reasonable effort to expedite the subject matters hereof. It is further
understood and agreed that the successful consummation of this Agreement is in the best interests
of all the parties and requires their continued cooperation. The Owner does hereby evidence his
intention to fully comply with all Village requirements,their willingness to discuss any matters of
mutual interest that may arise,and their willingness to assist the Village to the fullest extent possible.
The Village does hereby evidence its intent to cooperate in the resolution of mutual problems and
its willingness to facilitate the development of the Property, as contemplated by the provisions of
this Agreement.
12. Enforceability of the Agreement. This Agreement shall be enforceable in any court
of competent jurisdiction by any of the parties or by an appropriate action at law or in equity to
secure the performance of the covenants herein described. If any provision of this Agreement is held
invalid, such provision shall be deemed to be excised herefrom and the invalidity thereof shall not
affect any of the other provisions contained herein.

13. Term of Agreement. This Agreement is binding on all parties and the Property for
a term of twenty(20)years from the date of this Agreement. This Agreement shall not be assigned
without prior written consent of the Village,which consent will not be unreasonably withheld.
14. Binding_Effect of Agreement. This Agreement is binding upon the Property, the
parties hereto and their respective grantees, successors and assigns.
15. Corporate Capacities. The parties acknowledge and agree that the individuals that
are members of the group constituting the Corporate Authorities are entering into this Agreement
in their official capacities as members of such group and shall have no personal liability in their
individual capacities.
16. Notices. Any notice required pursuant to the provisions of this Agreement shall be
in writing and be sent by certified mail to the following addresses until notice of change of address
is given and shall be deemed received on the fifth business day following deposit in the U.S.Mail.

17. Default. In the event Owner defaults in performance of his obligations set forth
in this Agreement,then the Village may,upon notice to Owner,allow Owner sixty(60)days to cure
default or provide evidence to the Village that such default will be cured in a timely manner if it
cannot be cured during said period. If Owner fails to cure such default or provide such evidence as
provided above,then,with notice to Owner,the Village may begin proceedings to disconnect from
the Village any portion of the Property upon which obligations or development have not been
completed or at the option of the Village,to rezone such Property to the Residential Estate District.
In such event,this Agreement shall be considered to be the petition of the Owner to disconnect such
portion of the Property, or at the option of the Village,to rezone such Property to the Residential
Estate District.
18. Litigation.
A. The Owner,at his cost, shall be responsible for any litigation that may arise
relating to the annexation,zoning and development of the Property. Owner shall cooperate with the
Village in said litigation but Owner's counsel will have principal responsibility for such litigation.
B. The Owner shall reimburse the Village for reasonable attorneys' fees,
expenses and costs incurred by the Village resulting from litigation relating to the annexation,zoning
and development of the Property or in the enforcement of any of the terms of this Annexation
Agreement upon a default by the Owner.
C. Owner hereby indemnifies and holds the Village harmless from any actions
or causes of action that may arise as a result of development activities for which the Owner is
responsible.

19. Spgcial Conditions.
A. Incentives
l. For a ten-year period from the date of this Agreement,the Village
shall reimburse to the Owner the Village's Home Rule Sales Tax(of not more than
0.5%)received on all taxable sales generated from Cy's Crab House on the Property.
Reimbursement will be subject to the terms and conditions of a sales tax sharing
agreement to be entered into by the Owner and Village.
2. For a ten-year period from the date of this Agreement,the Village
shall reimburse to the Owner additional Village real estate taxes incurred as levied
against the Property each year beginning with the calendar year 2003 (2003 tax levy
for collection in calendar year 2004). The reimbursement for Village real estate taxes
shall cease with the calendar year 2012 tax levy collected in calendar year 2013. The
reimbursement shall be limited to the difference between the Village's combined tax
levy extension(final rate times equalized assessed valuation divided by100)and the
combined rate of the Lincolnshire-Riverwoods Fire Protection District extension
(calculated in the same manner). Owner shall provide on an annual basis a copy of
the real estate tax bill for the Property in order to calculate the annual reimbursement
due. The Village shall be responsible to obtain the final tax rate for the Lincolnshire-
Riverwoods Fire Protection District.
B. Signs
1. To accommodate the Owner's business needs,the Village hereby
allows the existing signs on the Property depicted on E3GMIT D hereto. If any
existing sign is damaged 50 percent or greater in terms of monetary replacement

value, said sign shall not be reconstructed.
2. The existing billboard advertising sign on a metal monopole located
in the north end of the parking lot shall only be used to market and promote
restaurants managed by the Owner.
3. The Village hereby grants variations of Sections 14.20.030, 14.20.070,
14.40.025 of the Village Sign Code to allow the construction and installation of one
ground sign with changeable copy as depicted on EXHIBIT D-1.
4. Except for the sign allowed by Paragraph 19.B.3. of this Agreement,
any signs installed after the date of this Agreement shall comply with the Village
Sign Code. It is understood and agreed that the Owner has the right to apply for
variations of the Village Sign Code.
C. Owner shall be allowed to install a guardrail on the south side of the Property,
subject to Village approval.The design shall adhere to recognized highway standards for guardrails.
D. Owner shall be allowed to construct a roof-like structure to replace the
existing cloth canopy on the Cy's Crab House restaurant pursuant to application to the Village for
required permits.
E. Village shall make best efforts to coordinate cross-easements between the
Property and the property at 931 Milwaukee Avenue to provide for 20 additional parking spaces for
Cy's Crab House. Owner shall provide a plat of survey or site plan depicting the existing parking
spaces and dimensions of said spaces and access aisles.
F. It is understood and agreed that the Village plans to achieve a north-south
access road("North Riverwalk Drive")east of the Property,and it is the Village's intent to provide
the Property with access to said road. Owner shall cooperate with the Village in modifying or

eliminating the current access driveways to Milwaukee Avenue serving the Property if acceptable
alternate access can be provided.
G. Owner shall make the code modifications to the Property as set forth in
EXHIBIT E hereto. The Owner agrees that the Village shall have the right and authority to enforce
Village ordinances against the Property for any items listed on Exhibit E that have not been
completed and approved by the Village within three years of the date of this Agreement.
The Village shall provide a grant to the Owner of$10,000.00 to complete the
code compliance improvements identified in EXHIBIT E. Release of the grant to the Owner shall
be subject to the Owner completing and obtaining approval by the Village for: 1)connection of the
fire alarm system to Northwest Central Dispatch;and 2)installation of panic hardware on all egress
doors.
H. It is understood and agreed that the Village of Buffalo Grove levies a real
estate transfer tax on all conveyances of real property in the Village. The Property shall be
considered to be in the Village upon passage of the annexation ordinance by Corporate Authorities.
1. It is understood and agreed that upon annexation the Village will issue a new
street address for the building on the Property to ensure proper identification for provision of
services,and Owner shall use said Village address in place of current address.Owner is also required
to contact the Buffalo Grove Post Office and submit a change of address requesting use of the
address as assigned by the Village.The address shall be posted on the building in compliance with
Title 15 of the Village Municipal Code.
J. Owner represents and warrants that the only mortgagee,lien holder or holder
of any security interest affecting title to the Property or part thereof is Success National Bank.
Success National Bank by its written approval of this Agreement acknowledges that this Agreement

is superior to its security interest in the Property.
K. Owner shall deposit with the Village the amount necessary to reimburse the
Village for any real estate tax payments made by the Village to the Lincolnshire-Riverwoods Fire
Protection District concerning the Property pursuant to Public Act 91-307(70 ILCS 705/20). Said
deposit,as determined by the Village,shall be made by the Owner within sixty(60)days of the date
of this Agreement.
L. It is understood and agreed that the Incentives set forth in Paragraph 19.A. of
this Agreement are for the benefit of the existing restaurant use and to effect the code improvements
set forth in EXF11BIT E.In the event that the Property is redeveloped for a use other than the existing
restaurant or substantially changed as determined by the Village in its sole discretion,the Incentives
set forth in Paragraph 19.A.may be terminated by the Village.
M. The Village shall not apply new ordinances or regulations(except for public
health, life and safety code matters)to the Property but only to the extent that said ordinances or
regulations would prevent use of the Property as approved herein.
IN WITNESS WHEREOF,the Corporate Authorities, Owner and Developer have caused
this instrument to be executed by their respective proper officials duly authorized to execute the
same on the day and the year first above written.

Code Compliance Required Corrections
1) The existing fire alarm does not meet NFPA, BOCA and Village Code requirements. The
system shall be inspected for deficiencies and all deficiencies shall be repaired or replaced in
compliance with NFPA, BOCA and Village Code requirements. The fire alarm system shall also be
connected to Northwest Central Dispatch for direct monitoring.
2) The building shall be equipped with an approved fire department key box accessible by the
Buffalo Grove Fire Department. The key box shall be located on the exterior of the building as
approved by the Buffalo Grove Fire Department. The key box shall contain keys to allow fire
department entry into the building.
3) Extension cords and flexible cords shall not be a substitute for permanent wiring electrical
wiring. Extension cords and flexible cords shall not be affixed to structures; extended through
walls, ceilings or floors, or under doors or floor coverings; nor shall such cords be subject to
environmental damage or physical impact.
4) All decorative materials shall either be non-combustible or flame resistant in accordance with
NFPA, BOCA and Village of Buffalo Grove codes. Decorative materials such as burlap and fish
netting or other similar materials shall not be suspended overhead from the ceiling of any building.
5) Fire extinguishers shall be provided and maintained as required by NFPA, BOCA and Village
of Buffalo Grove code requirements. The travel distance to any one fire extinguisher shall not
exceed 50 feet in length.
6) The address issued by the Village of Buffalo Grove shall be posted on the building so it is
visible from the public right-of-way. All numbers shall be in Arabic numerals at least six (6) inches
high with a one- (1) inch stroke. The color of the numbers shall be in contrast with the background
for the numbers.
7) The satellite dish and support pole shall be structurally sound and properly secured to
prevent failing. Unsecured and unsafe structures, such as the satellite dish, shall be removed.
8) All doors equipped with locking or latching devices serving rooms or spaces with an
assembly or educational occupancy with an occupant load greater than 100 shall be equipped with
approved panic hardware as required by NFPA, BOCA and Village of Buffalo Grove code
requirements. The use of inside keyed locks, thumb turns and flush bolts on exit doors is
prohibited.
9) All exit and emergency lighting shall be installed and maintained as required by NFPA, BOCA
and Village of Buffalo Grove code requirements. Testing of such lighting shall be at least monthly.
10) All means of egress shall be maintained free of obstructions at all times as required by NFPA,
BOCA, and Village of Buffalo Grove code requirements. All obstructions such as chains, gates, or
other similar obstructions shall be eliminated.
11) Signage shall be provided to identify rooms, hazards, floor, and handicap access as required
by NFPA, BOCA, and Village of Buffalo Grove code requirements. Handicap accessibility signs
shall comply with the Illinois Accessibility Code.
12) Clearance of not less than 36 inches shall be provided between all electrical service
equipment and storage as required by NFPA, BOCA and Village of Buffalo Grove code
requirements.
13) The power cord from the washer in the electric room shall be rerouted so it does not pass
through the doorway.
14) Approved lens covers shall be provided for all light fixtures as required by NFPA, BOCA and
Village of Buffalo Grove code requirements.
15) All openings and missing covers for electrical equipment shall be repaired and properly
installed as required by NFPA, BOCA, and Village of Buffalo Grove code requirements.
16) Each existing commercial cooking appliance shall be protected with an approved commercial
kitchen exhaust hood and duct system. Each existing required commercial kitchen exhaust hood
and duct system shall be protected with an approved automatic fire suppression system as
required by NFPA, BOCA, and Village of Buffalo Grove code requirements. The automatic fire
suppression system shall meet UL 300 specifications. Documentation of compliance to the UL 300
specifications shall be provided to the Buffalo Grove Fire Department.
17) Accumulations of grease in kitchen and other exhaust ducts and the accumulation of grease
on kitchen equipment, ceilings, floors and walls shall be removed or remedied so that they do not
create a dangerous or hazardous condition as required by NFPA, BOCA and Village of Buffalo
Grove code requirements
18) Direct sewer connections for food equipment shall comply with the Village of Buffalo Grove
Health Code requirements and the Illinois State Plumbing Code.

Staff and representatives of Cy's Crabhouse have reached an agreement for annexation and zoning of the
property located at 933 Milwaukee Avenue. This property is located immediately north of the proposed
restaurant use as part of Riverwalk North, approved by the Village Board in February, 2003. This
proposed location,considered for annexation, is part of the Village's Comprehensive Plan.
Exhibits of special consideration as part of the Agreement include the following:
1) Sign package (Exhibit D) - The existing signs on the property would be approved as part of the
Agreement. If any existing sign is damaged 50 percent or greater in terms of monetary
replacement value, said sign would not be reconstructed.
2) Ground Sign with Changeable Copy (Exhibit D-1) - As part of the Agreement, the proposed
changeable copy sign would be approved.
3) Code Compliance Required Corrections (Exhibit E). The Building& Zoning Department and
Fire Prevention Bureau conducted a pre-annexation inspection of the property and noted the
issues identified on this exhibit. As part of the Agreement, once the owner of the restaurant
connects the fire alarm system to Northwest Central Dispatch and installs panic hardware on all
egress doors, then the Village would provide a grant to the owner to complete all of the other
outstanding code compliance issues as detailed on the exhibit.
As part of the agenda, an Ordinance approving the Annexation Agreement is provided, as well as

ANNEXATION AGREEMENT
This agreement(hereinafter referred to as the "Agreement")made and entered into this 2nd
day of June,2003,by and between the VILLAGE OF BUFFALO GROVE(hereinafter referred to
as "Village") by and through the President and Board of Trustees of the Village (hereinafter
collectively referred to as the "Corporate Authorities")and Cosmopolitan Bank and Trust Company,
as Trustee under Trust Agreement dated April 8, 1998 and known as Trust #30812 (hereinafter
referred to as "Owner").
WITNESSETH:
WHEREAS,the Village of Buffalo Grove is a Home Rule Unit by virtue of the provisions
of the Constitution of the State of Illinois of 1970; and,
WHEREAS,Owner is the owner of a certain tract of property(hereinafter referred to as the
"Property")comprising 0.91 acres legally described and identified in the Legal Description,attached
hereto as EXHIBIT A and made a part hereof, and which real estate is contiguous to the corporate
limits of the Village;and,
WHEREAS,a Plat of Annexation, including certain unincorporated highway right-of-way
adjacent to the Property, is attached hereto as EXHIBIT B,which depicts a total area of 1.82 acres
to be annexed; and,
WHEREAS, Owner desires and proposes pursuant to the provisions and regulations
applicable to the B-3 Planned Business Center District of the Village Zoning Ordinance to continue
operating the existing restaurant called Cy's Crab House on the Property; and,

WHEREAS, pursuant to the provisions of Section 5/11-15.1-1 et seq., of the Illinois
Municipal Code (65 ILCS 5/11-15.1-1 et seq.) and as the same may have been modified by the
Village's Home Rule Powers, a proposed Annexation Agreement was submitted to the Corporate
Authorities and a public hearing was held thereon pursuant to notice as provided by Statute;and,
WHEREAS,pursuant to due notice and advertisement,the Corporate Authorities have held
a public hearing and made its recommendations with respect to the requested zoning classification
in the B-3 District; and,
WHEREAS,the President and Board of Trustees after due and careful consideration have
concluded that the annexation of the Property to the Village and its zoning and development on the
terms and conditions herein set forth would further enable the Village to control the development
of the area and would serve the best interests of the Village.
NOW,THEREFORE, in consideration of the premises,mutual covenants and agreements
herein set forth,the parties hereto agree as follows:
l. Applicable Law. This Agreement is made pursuant to and in accordance
with the provisions of Section 5111-15.1-1 et seq., of the Illinois Municipal Code (65 ILCS 5/11-
15.1-1 et seq.)and as the same may have been modified by the Village's Home Rule powers. The
preceding whereas clauses are hereby made a part of this Agreement.
2. Agreement: Compliance and Validity. The Owner has filed with the Village Clerk
of the Village a proper petition pursuant to and in accordance with the provisions of Section 5/7-1-8
of the Illinois Municipal Code(65 ILCS 5/7-1-8)and as the same may have been modified by the
Village's Home Rule powers,conditioned on the execution of this Agreement and the compliance
with the terms and provisions contained herein,to annex the Property to the Village. It is understood
and agreed that this Agreement in its entirety, together with the aforesaid petition for annexation,

shall be null,void and of no force and effect unless the Property is validly annexed to the Village and
is validly zoned and classified in the B-3 District,all as contemplated in this Agreement.
3. Enactment of Annexation Ordinance. The Corporate Authorities within
twenty-one(21)days of the execution of this Agreement by the Village will enact a valid and binding
ordinance (hereinafter referred to as the "Annexation Ordinance") annexing the Property and
adjacent unincorporated highway to the Village. Said Annexation Ordinance shall be recorded at
the Lake County Recorder's Office along with the Plat of Annexation(attached hereto as EXHI131 T
B).
4. Enactment of Zoning Ordinance. Within twenty-one(21)days after the
passage of the Annexation Ordinance, the Corporate Authorities shall adopt a proper, valid and
binding ordinance,zoning the Property in the B-3 District subject to the restrictions further contained
herein and all applicable ordinances of the Village of Buffalo Grove as amended from time to time.
5. Approval of Plans. It is understood and agreed that the Owner has not submitted a
Preliminary Plan for review and approval by the Village since the intended use of the Property is
continuance of the existing restaurant. Any changes to the current building or site, or any new
development of the Property is subject to the requirements of this Agreement and applicable Village
Ordinances,including but not limited to the Zoning Ordinance and Development Ordinance.
6. Compliance with Applicable Ordinances. The Owner agrees to comply with all
ordinances of the Village of Buffalo Grove as amended from time to time in the use and
development of the Property,provided that all new ordinances,amendments,rules and regulations
relating to zoning,building and subdivision of land adopted after the date of this Agreement shall
not be arbitrarily or discriminatorily applied to the Property but shall be equally applicable to all
property similarly zoned and situated to the extent possible. Owner, in the development of the

Property, shall comply with the standards set forth in the Village of Buffalo Grove Development
Ordinance as amended from time to time.
7. Building Permit Fees. The building permit fees may be increased from time to time
so long as said permit fees are applied consistently to all other developments in the Village to the
extent possible. In the event a conflict arises between the Owner and the Village on any engineering
and technical matters subject to this Agreement,the Village reserves the right to pass along any and
all additional expenses incurred by the use of consultants in the review and inspection of the
development from time to time. Owner shall pay any non-discriminatory new or additional fees
hereinafter charged by the Village to owners and developers of properties within the Village.
8. Right of Way Dedication. The Owner acknowledges that it is the intention of the
Village and other involved agencies that at some time in the future Milwaukee Avenue will be
widened. At the request of the Village, but no later than upon approval of the first plat of
subdivision of any portion of the Property, Owner agrees to dedicate such additional right-of-way
along Milwaukee Avenue as may be required to provide a right-of-way of 75 feet from the center
line in conformance with the standards of the Illinois Department of Transportation.
9. Exhibits. The following EXHIBITS,some of which were presented in
testimony given by the Owner or the witnesses during the hearings held before the Corporate
Authorities prior to the execution of this Agreement,are hereby incorporated by reference herein,
made a part hereof and designated as shown below.

10. Building.Landscaping and Aesthetics Plans. If improvements are proposed for the
current use or if new development is proposed,Owner shall submit building and landscaping plans
(which landscaping plans shall conform to the requirements of Village Ordinances)for approval by
the Village before commencing construction of buildings. Lighting and signage shall be compatible
with surrounding areas as approved by the Village.
11. Facilitation of Development. Time is of the essence of this Agreement,and all
parties will make every reasonable effort to expedite the subject matters hereof. It is further
understood and agreed that the successful consummation of this Agreement is in the best interests
of all the parties and requires their continued cooperation. The Owner does hereby evidence his
intention to fully comply with all Village requirements,their willingness to discuss any matters of
mutual interest that may arise,and their willingness to assist the Village to the fullest extent possible.
The Village does hereby evidence its intent to cooperate in the resolution of mutual problems and
its willingness to facilitate the development of the Property, as contemplated by the provisions of
this Agreement.
12. Enforceability of the Agreement. This Agreement shall be enforceable in any court
of competent jurisdiction by any of the parties or by an appropriate action at law or in equity to
secure the performance of the covenants herein described. If any provision of this Agreement is held
invalid, such provision shall be deemed to be excised herefrom and the invalidity thereof shall not
affect any of the other provisions contained herein.

13. Term of Agreement. This Agreement is binding on all parties and the Property for
a term of twenty(20)years from the date of this Agreement. This Agreement shall not be assigned
without prior written consent of the Village,which consent will not be unreasonably withheld.
14. Binding_Effect of Agreement. This Agreement is binding upon the Property, the
parties hereto and their respective grantees, successors and assigns.
15. Corporate Capacities. The parties acknowledge and agree that the individuals that
are members of the group constituting the Corporate Authorities are entering into this Agreement
in their official capacities as members of such group and shall have no personal liability in their
individual capacities.
16. Notices. Any notice required pursuant to the provisions of this Agreement shall be
in writing and be sent by certified mail to the following addresses until notice of change of address
is given and shall be deemed received on the fifth business day following deposit in the U.S.Mail.

17. Default. In the event Owner defaults in performance of his obligations set forth
in this Agreement,then the Village may,upon notice to Owner,allow Owner sixty(60)days to cure
default or provide evidence to the Village that such default will be cured in a timely manner if it
cannot be cured during said period. If Owner fails to cure such default or provide such evidence as
provided above,then,with notice to Owner,the Village may begin proceedings to disconnect from
the Village any portion of the Property upon which obligations or development have not been
completed or at the option of the Village,to rezone such Property to the Residential Estate District.
In such event,this Agreement shall be considered to be the petition of the Owner to disconnect such
portion of the Property, or at the option of the Village,to rezone such Property to the Residential
Estate District.
18. Litigation.
A. The Owner,at his cost, shall be responsible for any litigation that may arise
relating to the annexation,zoning and development of the Property. Owner shall cooperate with the
Village in said litigation but Owner's counsel will have principal responsibility for such litigation.
B. The Owner shall reimburse the Village for reasonable attorneys' fees,
expenses and costs incurred by the Village resulting from litigation relating to the annexation,zoning
and development of the Property or in the enforcement of any of the terms of this Annexation
Agreement upon a default by the Owner.
C. Owner hereby indemnifies and holds the Village harmless from any actions
or causes of action that may arise as a result of development activities for which the Owner is
responsible.

19. Spgcial Conditions.
A. Incentives
l. For a ten-year period from the date of this Agreement,the Village
shall reimburse to the Owner the Village's Home Rule Sales Tax(of not more than
0.5%)received on all taxable sales generated from Cy's Crab House on the Property.
Reimbursement will be subject to the terms and conditions of a sales tax sharing
agreement to be entered into by the Owner and Village.
2. For a ten-year period from the date of this Agreement,the Village
shall reimburse to the Owner additional Village real estate taxes incurred as levied
against the Property each year beginning with the calendar year 2003 (2003 tax levy
for collection in calendar year 2004). The reimbursement for Village real estate taxes
shall cease with the calendar year 2012 tax levy collected in calendar year 2013. The
reimbursement shall be limited to the difference between the Village's combined tax
levy extension(final rate times equalized assessed valuation divided by100)and the
combined rate of the Lincolnshire-Riverwoods Fire Protection District extension
(calculated in the same manner). Owner shall provide on an annual basis a copy of
the real estate tax bill for the Property in order to calculate the annual reimbursement
due. The Village shall be responsible to obtain the final tax rate for the Lincolnshire-
Riverwoods Fire Protection District.
B. Signs
1. To accommodate the Owner's business needs,the Village hereby
allows the existing signs on the Property depicted on E3GMIT D hereto. If any
existing sign is damaged 50 percent or greater in terms of monetary replacement

value, said sign shall not be reconstructed.
2. The existing billboard advertising sign on a metal monopole located
in the north end of the parking lot shall only be used to market and promote
restaurants managed by the Owner.
3. The Village hereby grants variations of Sections 14.20.030, 14.20.070,
14.40.025 of the Village Sign Code to allow the construction and installation of one
ground sign with changeable copy as depicted on EXHIBIT D-1.
4. Except for the sign allowed by Paragraph 19.B.3. of this Agreement,
any signs installed after the date of this Agreement shall comply with the Village
Sign Code. It is understood and agreed that the Owner has the right to apply for
variations of the Village Sign Code.
C. Owner shall be allowed to install a guardrail on the south side of the Property,
subject to Village approval.The design shall adhere to recognized highway standards for guardrails.
D. Owner shall be allowed to construct a roof-like structure to replace the
existing cloth canopy on the Cy's Crab House restaurant pursuant to application to the Village for
required permits.
E. Village shall make best efforts to coordinate cross-easements between the
Property and the property at 931 Milwaukee Avenue to provide for 20 additional parking spaces for
Cy's Crab House. Owner shall provide a plat of survey or site plan depicting the existing parking
spaces and dimensions of said spaces and access aisles.
F. It is understood and agreed that the Village plans to achieve a north-south
access road("North Riverwalk Drive")east of the Property,and it is the Village's intent to provide
the Property with access to said road. Owner shall cooperate with the Village in modifying or

eliminating the current access driveways to Milwaukee Avenue serving the Property if acceptable
alternate access can be provided.
G. Owner shall make the code modifications to the Property as set forth in
EXHIBIT E hereto. The Owner agrees that the Village shall have the right and authority to enforce
Village ordinances against the Property for any items listed on Exhibit E that have not been
completed and approved by the Village within three years of the date of this Agreement.
The Village shall provide a grant to the Owner of$10,000.00 to complete the
code compliance improvements identified in EXHIBIT E. Release of the grant to the Owner shall
be subject to the Owner completing and obtaining approval by the Village for: 1)connection of the
fire alarm system to Northwest Central Dispatch;and 2)installation of panic hardware on all egress
doors.
H. It is understood and agreed that the Village of Buffalo Grove levies a real
estate transfer tax on all conveyances of real property in the Village. The Property shall be
considered to be in the Village upon passage of the annexation ordinance by Corporate Authorities.
1. It is understood and agreed that upon annexation the Village will issue a new
street address for the building on the Property to ensure proper identification for provision of
services,and Owner shall use said Village address in place of current address.Owner is also required
to contact the Buffalo Grove Post Office and submit a change of address requesting use of the
address as assigned by the Village.The address shall be posted on the building in compliance with
Title 15 of the Village Municipal Code.
J. Owner represents and warrants that the only mortgagee,lien holder or holder
of any security interest affecting title to the Property or part thereof is Success National Bank.
Success National Bank by its written approval of this Agreement acknowledges that this Agreement

is superior to its security interest in the Property.
K. Owner shall deposit with the Village the amount necessary to reimburse the
Village for any real estate tax payments made by the Village to the Lincolnshire-Riverwoods Fire
Protection District concerning the Property pursuant to Public Act 91-307(70 ILCS 705/20). Said
deposit,as determined by the Village,shall be made by the Owner within sixty(60)days of the date
of this Agreement.
L. It is understood and agreed that the Incentives set forth in Paragraph 19.A. of
this Agreement are for the benefit of the existing restaurant use and to effect the code improvements
set forth in EXF11BIT E.In the event that the Property is redeveloped for a use other than the existing
restaurant or substantially changed as determined by the Village in its sole discretion,the Incentives
set forth in Paragraph 19.A.may be terminated by the Village.
M. The Village shall not apply new ordinances or regulations(except for public
health, life and safety code matters)to the Property but only to the extent that said ordinances or
regulations would prevent use of the Property as approved herein.
IN WITNESS WHEREOF,the Corporate Authorities, Owner and Developer have caused
this instrument to be executed by their respective proper officials duly authorized to execute the
same on the day and the year first above written.

Code Compliance Required Corrections
1) The existing fire alarm does not meet NFPA, BOCA and Village Code requirements. The
system shall be inspected for deficiencies and all deficiencies shall be repaired or replaced in
compliance with NFPA, BOCA and Village Code requirements. The fire alarm system shall also be
connected to Northwest Central Dispatch for direct monitoring.
2) The building shall be equipped with an approved fire department key box accessible by the
Buffalo Grove Fire Department. The key box shall be located on the exterior of the building as
approved by the Buffalo Grove Fire Department. The key box shall contain keys to allow fire
department entry into the building.
3) Extension cords and flexible cords shall not be a substitute for permanent wiring electrical
wiring. Extension cords and flexible cords shall not be affixed to structures; extended through
walls, ceilings or floors, or under doors or floor coverings; nor shall such cords be subject to
environmental damage or physical impact.
4) All decorative materials shall either be non-combustible or flame resistant in accordance with
NFPA, BOCA and Village of Buffalo Grove codes. Decorative materials such as burlap and fish
netting or other similar materials shall not be suspended overhead from the ceiling of any building.
5) Fire extinguishers shall be provided and maintained as required by NFPA, BOCA and Village
of Buffalo Grove code requirements. The travel distance to any one fire extinguisher shall not
exceed 50 feet in length.
6) The address issued by the Village of Buffalo Grove shall be posted on the building so it is
visible from the public right-of-way. All numbers shall be in Arabic numerals at least six (6) inches
high with a one- (1) inch stroke. The color of the numbers shall be in contrast with the background
for the numbers.
7) The satellite dish and support pole shall be structurally sound and properly secured to
prevent failing. Unsecured and unsafe structures, such as the satellite dish, shall be removed.
8) All doors equipped with locking or latching devices serving rooms or spaces with an
assembly or educational occupancy with an occupant load greater than 100 shall be equipped with
approved panic hardware as required by NFPA, BOCA and Village of Buffalo Grove code
requirements. The use of inside keyed locks, thumb turns and flush bolts on exit doors is
prohibited.
9) All exit and emergency lighting shall be installed and maintained as required by NFPA, BOCA
and Village of Buffalo Grove code requirements. Testing of such lighting shall be at least monthly.
10) All means of egress shall be maintained free of obstructions at all times as required by NFPA,
BOCA, and Village of Buffalo Grove code requirements. All obstructions such as chains, gates, or
other similar obstructions shall be eliminated.
11) Signage shall be provided to identify rooms, hazards, floor, and handicap access as required
by NFPA, BOCA, and Village of Buffalo Grove code requirements. Handicap accessibility signs
shall comply with the Illinois Accessibility Code.
12) Clearance of not less than 36 inches shall be provided between all electrical service
equipment and storage as required by NFPA, BOCA and Village of Buffalo Grove code
requirements.
13) The power cord from the washer in the electric room shall be rerouted so it does not pass
through the doorway.
14) Approved lens covers shall be provided for all light fixtures as required by NFPA, BOCA and
Village of Buffalo Grove code requirements.
15) All openings and missing covers for electrical equipment shall be repaired and properly
installed as required by NFPA, BOCA, and Village of Buffalo Grove code requirements.
16) Each existing commercial cooking appliance shall be protected with an approved commercial
kitchen exhaust hood and duct system. Each existing required commercial kitchen exhaust hood
and duct system shall be protected with an approved automatic fire suppression system as
required by NFPA, BOCA, and Village of Buffalo Grove code requirements. The automatic fire
suppression system shall meet UL 300 specifications. Documentation of compliance to the UL 300
specifications shall be provided to the Buffalo Grove Fire Department.
17) Accumulations of grease in kitchen and other exhaust ducts and the accumulation of grease
on kitchen equipment, ceilings, floors and walls shall be removed or remedied so that they do not
create a dangerous or hazardous condition as required by NFPA, BOCA and Village of Buffalo
Grove code requirements
18) Direct sewer connections for food equipment shall comply with the Village of Buffalo Grove
Health Code requirements and the Illinois State Plumbing Code.

AN ORDINANCE AMENDING TITLE 10 OF THE VILLAGE
OF BUFFALO GROVE MUNICIPAL CODE
WHEREAS, the Village of Buffalo Grove is a Home Rule Unit by virtue of the
Illinois Constitution of 1970; and,
WHEREAS, it is in the interest of public safety that stop signs shall be provided
at certain locations.
NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees
of the Village of Buffalo Grove, Cook and Lake Counties, Illinois:
Section 1: Title 10, Chapter 11-1204(b) of the Village of Buffalo Grove
Municipal Code is hereby amended by adding thereto the following under Stop Sign
Intersections:

Section 2: Any person violating any portion of this Chapter shall be punished

ORDINANCE NO. 2003 -
AN ORDINANCE APPROVING AN ANNEXATION AGREEMENT FOR
CY'S CRAB HOUSE RESTAURANT
933 MILWAUKEE AVENUE
WHEREAS, the Village of Buffalo Grove is a Home Rule Unit by virtue of the
Illinois Constitution of 1970; and,
WHEREAS,there has heretofore been submitted to the Corporate Authorities of the Village
of Buffalo Grove a petition to annex the property legally described in Exhibit A hereto; and,
WHEREAS,there has been submitted to the Corporate Authorities of the Village of Buffalo
Grove an Annexation Agreement; and,
WHEREAS,proper and due notice of the public hearing on said Annexation Agreement and
zoning have been given and the public hearing was held; and,
WHEREAS, it is determined to be in the best interest of the Village of Buffalo Grove to
approve said Annexation Agreement.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES,
ILLINOIS:
Section 1. The Annexation Agreement, a copy of which is attached hereto and made a part
hereof as Exhibit A is approved.
Section 2. The President and Clerk of the Village are hereby authorized to execute said
Agreement on behalf of the Village of Buffalo Grove.
Section 3. This Ordinance shall be in full force and effect from and after its passage and
approval. This Ordinance shall not be codified.

ORDINANCE NO. 2003 -
AN ORDINANCE ANNEXING CERTAIN TERRITORY
TO THE VILLAGE OF BUFFALO GROVE, ILLINOIS
CY'S CRAB HOUSE RESTAURANT
933 MILWAUKEE AVENUE
WHEREAS, the Village of Buffalo Grove is a Home Rule Unit by virtue of the Illinois
Constitution of 1970; and,
WHEREAS, a written petition signed by the owners of record of all of the land in the
territory hereinafter described,requesting the annexation of such territory to the Village of Buffalo
Grove, has been filed with the Village Clerk of the Village of Buffalo Grove; and,
WHEREAS, said territory is not within the corporate limits of any municipality, but is
contiguous to the Village of Buffalo Grove; and,
WHEREAS, notice of the proposed annexation of such territory has been given to the
appropriate authorities; and,
WHEREAS, it is in the best interests of the Village of Buffalo Grove that such territory be
annexed to the Village of Buffalo Grove.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES,
ILLINOIS:
Section 1. That the real property legally described in Exhibit A attached hereto be and
hereby is annexed to the Village of Buffalo Grove. A true and correct map of said real property is
attached hereto and made a part hereof as Exhibit B.

Section 2. The Village Clerk of the Village of Buffalo Grove is hereby directed to cause to
be filed in the Office of the Recorder of Deeds of Lake County a copy of this Ordinance with an
accurate map of the territory annexed.
Section 3. This Ordinance shall be in full force and effect on and after its passage and
approval. This Ordinance shall not be codified.

AN ORDINANCE AMENDING THE COMPREHENSIVE ZONING ORDINANCE
OF THE VILLAGE OF BUFFALO GROVE, ILLINOIS
CY'S CRAB HOUSE RESTAURANT
933 MILWAUKEE AVENUE
WHEREAS, the Village of Buffalo Grove is a Home Rule Unit by virtue of the Illinois
Constitution of 1970; and,
WHEREAS,the property legally described in Exhibit A hereto was annexed to the Village of
Buffalo Grove by Ordinance No. 2003- pursuant to a written Annexation Agreement dated June
2, 2003 and approved by the Village by Ordinance No. 2003-_; and,
WHEREAS,notice of public hearing for zoning and annexation has been given and a public
hearing was held.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES,
ILLINOIS:
Section 1. The Comprehensive Zoning Ordinance of the Village of Buffalo Grove,Cook and
Lake Counties,Illinois as amended is hereby further amended by classifying the property described
in Exhibit A hereto into the B-3 Planned Business Center District.
Section 2. Development and use of the property shall be in compliance with the Annexation
Agreement dated June 2, 2003 approved pursuant to Ordinance No. 2003-
Section 3. This Ordinance shall be in full force and effect on and after its passage and
approval according to law. This Ordinance shall not be codified.
