Ordinances and Resolutions A. Ordinance 2003 - An Ordinance providing for Emergency Access Lanes for Le Parc Condominiums. (Trustee Berman) RECOMMENDATION: Approve by motion. SUMMARY: The Ordinance provides for emergency access lanes for police and fire services in seven areas within the Le Park Condominiums Association, as depicted on the attached map. B. Ordinance 2003- An ordinance granting a variance to Sign Code, Section 14.40.145, pertaining to Off-Premises Signs, for the purpose of installing an off-premises ground sign at 345 W. Dundee Road (southwest corner of Dundee Road and Golfview Terrace) for Covington Investments LLC, 355 W. Dundee Road (Trustee Braiman) RECOMMENDATION: Approve by motion. SUMMARY: The ZBA recommends granting the variation request for the off-premises sign. C. Ord. 2003- An ordinance granting a variance to Sign Code, Section 14.20.030, pertaining to Business Districts; Section 14.20.080, pertaining to Wall Signs; and Section 14.40.025, pertaining to Changeable Copy Signs, for Shell Oil Company, 50 W. Lake Cook Road (Trustee Braiman) RECOMMENDATION: Approve by motion. SUMMARY: The ZBA recommends granting the variation requests concerning the Shell Oil station at 50 W. Lake Cook Rd. New Business D. COMMUNITY SCHOLARSHIPS President Hartstein announced the winners of the 2003 Workforce Board/Village of Buffalo Grove Community Scholarships. Mary Pepperel of the Workforce Board presented a history of the scholarship program. President Hartstein recognized each of the winners present and congratulated them,and thanked the generosity of the Buffalo Grove businesses that contributed to this year's scholarship fund. RELAY FOR LIFE President Hartstein commended the students of Buffalo Grove and Stevenson High Schools for the tremendous community event that they hosted in this year's Relay for Life sponsored by the American Cancer Society. DRAFT COPY 11381 6/16/03 Trustee Berman also thanked everyone that participated in the event,with a special thanks to Stacey Kelly for all of her hard work in organizing the Village team,and also to the students of Buffalo Grove and Stevenson High Schools for the tremendous job that they did in putting this event together. MANAGEMENT REPORT Mr.Balling noted the submittal of the Management Report for the month of May,2003;there were no questions regarding the report. CITIZEN'S FIRE ACADEMY Chief Sashko presented a brief background on the academy and he thanked everyone involved in orchestrating this program. There are now over 135 citizens that have participated in this program over the years,in addition to the eight youth members that were a part of this year's first Junior Citizen's Fire Academy. Chief Sashko also thanked Mr.Balling for the support of this program,particularly during these difficult economic times. Chief Sashko and President Hartstein aided Skip Hart,Public Education Officer, in presenting diplomas to the graduates of both the adult and junior programs QUESTIONS FROM THE AUDIENCE President Hartstein asked if there were any questions from the audience. Marc and Bari Levin,914 Hobson Drive,presented a concern with the curb drain in front of their house,which does not drain properly. Mr.Balling responded that he has had conversations with the Levins;he acknowledged that there is a drainage problem and it is exacerbated because it is in front of the driveway. There is not an easy solution to this problem,and Mr.Balling suggested adding a request to the design engineering proposal to be considered later on in the meeting,so as to ask the engineering consultant for an independent opinion on whether there might be another drainage strategy that has been overlooked to do just the curbing work. After discussion,President Hartstein informed the Levins that staff will follow up on this with our engineering consultant and get back to them with their findings. CONSENT AGENDA President Hartstein explained the Consent Agenda,stating that any member of the audience or the Board could request that an item be removed for full discussion. The Village Clerk read a brief synopsis of each of the items on the Consent Agenda. COMMONWEALTH EDISON Mr.Balling reviewed the background on the proposed ordinance. Diane Emerson from ComEd stated that it is standard practice for them to meet with staff or the local forester to review the proposed trimming before it takes place; she then answered questions from the Board. Discussion took place with regard to wording in the agreement dealing with tree replacement. Moved by Berman,seconded by Johnson,to table approving an agreement with the Commonwealth Edison Company concerning Vegetation Management Practices. Moved by Berman,seconded by Braiman,to pass Ordinance#2003-48,granting a variation of the Sign Code, Sections 14.32.040 and 14.40.080 for Belmont Village,500 McHenry Road,for the purpose of installing two banners to be attached to the building located on the property,one along Buffalo Grove Road and one along McHenry Road,that would exceed the number,size,material and time limit allowed. RESOLUTION#2003-35—STREET MAINTENANCE Mr.Balling reviewed proceedings that have occurred since the last meeting,details of which are contained in his memo to the Board of June 9,2003;he then answered questions from the Board and confirmed that this information will be provided up front in future situations. Moved by Johnson,seconded by Kahn,to pass Resolution#2003-35,approving an agreement for design engineering services for the 2004 Villagewide Contractual Street Maintenance Project to Baxter&Woodman for an amount not to exceed$80,000 and consistent with the materials presented to the Board this evening. PACE 640 ROUTE Mr.Balling presented an update on the status of the Pace 640 bus route,details of which are contained in the Village Board Meeting Agenda Item Overview prepared by Mr.Brimm. Moved by Braiman,seconded by Kahn,to discontinue the Pace Route 640 Bus Service at the end of the one-year initial period in August of this year. ZBA DECISION—65 THOMPSON Susan Callahan,65 Thompson Court,presented her reasons for asking for a variation of the Fence Code. Commissioner Sandler presented the deliberations that took place at the ZBA. After lengthy discussion,it was moved by Johnson,seconded by Trilling,to approve the appeal of Susan Callahan, 65 Thompson Court,objecting to the Zoning Board of Appeals decision regarding her proposed fence,and suggest that the fence be approved 18' from the sidewalk property line at a height of 4'. DRAFT COPY 11384 6/16/03 Trustee Kahn noted that he is concerned that the Village Board is making policy based on a lack of information;he believes that a nice conclusion was reached,but that is not the job of the Village Board;he does not think that the Village Board should be taking over the job of the ZBA. Trustee Berman shares Trustee Kahn's concerns,but in this case,if the issue were to be returned to the ZBA,it would be late August at the earliest before the fence could be constructed,thereby negating the use of the yard during the summer,and that is why he believes an exception should be made. Upon roll call,Trustees voted as follows: AYES: 5—Braiman,Berman,Johnson,Kahn,Trilling NAYS: 0—None ABSENT: 1 —Glover Motion declared carried. The petitioner stated that she is comfortable with the proposal. President Hartstein stated that staff will work with Mrs. Callahan in order to see that the fence is properly installed. It was requested that the Village Attorney review the current ordinance so as to avoid this type of situation in the future. INSURANCE CONSULTING SERVICES Mr.Balling reviewed the request of staff,details of which are contained in the Village Board Meeting Agenda Item Overview prepared by Mr.Brimm. Moved by Johnson,seconded by Braiman,to waive bids and approve the Request for Proposal for Health/Dental/Life Insurance Consulting Services(Professional Services Contract)pursuant to the documentation presented to the Board. Upon roll call,Trustees voted as follows: AYES: 5—Braiman,Berman,Johnson,Kahn,Trilling NAYS: 0—None ABSENT: 1 —Glover Motion declared carried. TWIN RINKS ICE PAVILION Gary Pivar of Twin Rinks Ice Pavilion reviewed their request,details of which are contained in the Village Board Meeting Agenda Item prepared by Mr.Pfeil. Trustee Berman has some reservations about the layout;he believes it is a mistake to put that many machines in that area. Trustee Johnson also has some reservations with the location;he believes this request should be referred to the Plan Commission. Trustee Braiman believes there are too many machines requested;he believes they would be better in another location;he does not have a problem referring this to the Plan Commission. Trustee Kahn concurs with the comments made;he is concerned with the line of sight from the offices to the machines. Moved by Braiman,seconded by Johnson,to refer the Twin Rinks Ice Pavilion, 1500 Abbott Court,amendment of special use in the Industrial District concerning coin-operated amusement devices to the Plan Commission for review. Trustee Johnson stated that,as much as he hesitates taking property out of a business zone,he believes this property is one of the few in the Village where it is appropriate to do so,and he believes that this is an appropriate use for this property. Moved by Johnson,seconded by Trilling,to refer the proposed rezoning and Preliminary Plan approval for two single-family homes,936 Betty Drive,to the Plan Commission for review. Trustee Braiman disagrees with removing this property from a business zone,and he will vote against the referral. AYES: 2—Johnson,Trilling NAYS: 3—Braiman,Berman,Kahn ABSENT: 1 —Glover Motion defeated. Moved by Berman,seconded by Kahn,to reconsider the motion in order to allow Trustee Glover to be a part of the discussion and vote. COMMUNICATIONS PROGRAM PROPOSAL Mr.Versten made a presentation to the Board with regard to the updated communications plan for the year ahead, details of which are contained in the Village Board Meeting Agenda Item that he prepared. Trustee Johnson stated that he believes the website should be updated first. Trustee Kahn stated that he believes the update of the video programming should come first. Trustee Braiman stated that the content of the programming needs to be addressed. Moved by Braiman,seconded by Berman,to proceed with the staff proposal. Mr. Ziemann advised that they are requesting a variance to the Sign Code to allow an off- prernises directional sign for Lieberman Office Plaza at 355 W. Dundee Road. Allowance for the requested sign was in the P.U.D. agreement when the parcel was divided. It is difficult to see the 355 building in light of the new construction of the bank and the proposed building just to the west of the bank. The 355 building is hidden making it difficult to find and harder to rent space creating an economic hardship. There is also a traffic danger caused by people looking for the building. This proposed sign would not alter the character of the neighborhood or hurt the health, safety and welfare of the community. The sign is twelve (12) square feet and only five feet (5') off the ground. The colors will be consistent with the signs of the bank. Com. Sandler asked if Lieberman solely occupies the building since the sign states Lieberman Office Plaza. Ms. Miling advised that Lieberman does not solely occupy the building. Com. Sandler then asked if the title of the building is Lieberman Office Plaza. His concern is not the idea of the sign,but rather that a tenant of the building will say that there: is no visibility for them and they want a sign also. Mr. Ziemann advised that the sign is strictly a directional sign that has the name of the building, the address and an arrow pointing directly which way to go. Com. Horwitz recalled that Fifth Third Bank wanted a sign at that location and they were denied that request and the Board had them move the sign to the entrance farther west. He then referenced the Appearance Plan indicating that ground sign will be integrated into the site design. Sign shall be appropriated in the architectural concept, size, color, materials, lettering, etc. He stated that if you look at the sign, it does not blend in with the bank at all. There is no continuity of the signs. The bank sign has a brick base. He would like to help but does not know how. Com. Stolberg asked where the placement of the proposed building is to be located. Ms. Miling advised that the building would be north of them. Com. Stolberg made a comment that the new building may want a sign also. Com. Sandler responded that he believes that there is a difference. Fifth Third Bank is right there on Dundee Road and then there is a building Dundee that can only be accessed from Golfview Terrace. The basis of the request is a reasonable one because of the setback. He does not have a problem with the request but does agree with Com. Horwitz that there should be some consistency with the architecture of the bank. ZONING BOARD OF APPEALS u'q' RAFT COPYMAY 20,2003 Page 1 of 2 Mr. Ziemann advised that he understands the Board's view of the architecture of the sign and he would agree with that if they were talking about an advertising sign. This is only a directional sign. With a directional sign, he is not sure that it is necessary to have a brick base and the gable on top. Com. Entman replied that the comments made sense because it is not what the purpose of the sign is, it is how it looks and the aesthetics of the sign. Based on what he sees, the sign does stick out and he does not like the way it looks. They made need a sign a tell people that a building is back there. It may also be a different situation than the bank. The bank has signage on the wall and a ground sign. The Board wants to keep signs as small and as aesthetically pleasing as possible, even a sign that is only five feet (5') off the ground. Com. Dunn stated that if it is a directional sign, they should want the 355 larger than the word Lieberman. They have the sign in the reverse. Com. Stolberg believes that the sign is large. The sign is on a two foot (2') tall base and the sign is three feet (Y) tall. That is a five foot (5') tall sign. Randy advised the reason why the sign is five feet (5') tall is because of the berms that are in front of the building. Otherwise, you would not see that sign coming from the west going toward the east. Consensus of the Board is that they do not like the look of the sign. The Board advised that they would like to see a few more proposals before they make a decision. The Petitioners advised that they would present new proposals at the next meeting. Mr. Raysa advised that Mr. Lieberman's letter, dated April 24, 2003 references the northwest corner of Dundee Road and Golfview Terrace. Ms. Miling advised that the letter is incorrect and that the sign will be located at the southwest corner. There were no additional questions or comment from the Commissioners. Dundee Road; and WHEREAS, the Zoning Board of Appeals has held a public hearing, received testimony, prepared minutes, made certain findings, and has made an affirmative recommendation on said request for variation; and WHEREAS,the Corporate Authorities of the Village of Buffalo Grove hereby determine and find that,pursuant to Sign Code section 14.44.010.B., said variation is in harmony with the general purpose and intent of the Village's Sign Code, and that (1) the section in question would cause undue and unnecessary hardship to the sign user because of unique or unusual conditions pertaining to the property, (2)the granting of the requested variance will not be materially detrimental to the 1 property owners in the vicinity, (3)the unusual conditions applying to the specific property do not apply generally to other properties in the Village, and (4) the granting of the variance will not be contrary to the general objective of the Sign Code of moderating the size, number and obtrusive placement of signs and the reduction of clutter. LAKE COOK ROAD, KURTZ ASSOCIATES ON BEHALF OF SHELL OIL COMPANY — SIGN CODE, SECTIONS 14.20.030; 14.20.080; AND 14.40.025, TO INSTALL RED LIGHT BANDS TO EXTEND THE FULL WIDTH OF THE CANOPY ON THE EAST AND SOUTH ELEVATIONS; TO INSTALL THE "SHELL" SIGN ON THE EAST ELEVATION OF THE CANOPY THAT EXCEEDS THE HEIGHT ALLOWED; AND TO INSTALL A CHANGEABLE COPY GROUND SIGN Mr. Rick Diehl, Kurtz Associates, 701 Lee Street, Suite 900, Des Plaines, IL 60016 (847) 824-0132 was present and sworn in. The public hearing notice published in the Daily Herald on May 31, 2003 was read. Mr. Diehl explained that the property located at the northwest corner of Illinois Route 83 and Lake Cook Road is being proposed by Shell Oil Company to improve the property by replacing the canopy for additional weather protection for the customers. Also, Shell would like to replace the existing ground sign on the corner with a smaller sign. The existing ground sign is approximately seventy two (72) square feet and is a changeable copy sign to allow for the price of the products, which is typical for fuel stations. The new sign will be forty three (43) square feet and will have changeable letters indicating the price of the product. Another item on the new canopy is the word "Shell". The existing canopy has the word "Shell" on it and at this time, Mr. Diehl handed the Board pictures of the existing signs for their review. The new "Shell" word would be approximately one inch (1") shorter in comparison to the existing. The new design of the canopy would have a different face to it, a lazy"S". In the lazy "S" design, there is a red band that runs horizontally that will be illuminated. Because the band is illuminated, Village staff has indicated that it is considered a sign. This does not exist on the existing canopy and is the only item that is new to the station. Com. Horwitz asked if the red band is neon tubing. Mr. Diehl stated that it is and the "Shell"will be lit with fluorescent. Ch. Entman asked if the red bands will be located on the south and east elevations only. Mr. Diehl confirmed that the bands would be on the south and east only because those are the only two elevations that have the lazy"S" design. The other two faces are flat. Com. Horwitz asked Mr. Schar about the height of the band at the BP Amoco on Illinois Route 83 and Buffalo Grove Road. Mr. Schar replied that he believes the band is just slightly less than the proposed Shell red band. Ch. Entman asked if the "Shell"is going to be approximately the same size that is located there now. Mr. Diehl responded that it would be. Ch. Entman asked about the size of the "Shell" sign. Mr. Diehl replied that the height of the new lettering is one foot eight and one half inches (1' 8-1/2"). Ch. Entman asked Mr. Schar what size is allowed. Mr. Schar replied that eighteen inches (18") is allowed. ZONING BOARD OF APPEALS DRAFT COPY JUKE 17, 2003 Page 1 of 4 Com. Stolberg commented that she believes that the sign looks better in red rather than white. Ch. Entman stated that the proposed ground sign is substantially smaller than the existing sign and aesthetically pleasing. He asked Mr. Schar if there was a recommendation for a brick base for the proposed ground sign. Ch. Lesser advised that he was present at the ART review of the proposed changes on June 10, 2003. He stated that there were a couple of recommendations from that meeting. One recommendation was to construct a brick base for the proposed ground sign. Ch. Horwitz commented that the rendering reflects a flagstone-looking base. Ch. Entman advised that the recommendation was for a brick base. Mr. Schar advised that on page A201 of the submittal, the ground sign depicted shows a concrete base and to remove the uncertainty, the request was made for a brick base rather than a concrete base. Mr. Diehl advised that a brick base is acceptable for the ground sign. Ch. Entman read the Village Engineer's Report dated June 4, 2003 states "I have no report for the captioned ZBA matters". This report includes 50 W. Lake Cook Road. Com. Lesser asked if it is appropriate to address the additional recommendations that came from the ART meeting. He read the recommendations that the ART team made at the June 10, 2003 meeting. Ch. Entman advised that it is appropriate if the item relates to the signage. The variations can be subject to the recommendations made by the ART team. Mr. Schar advised Ch. Entman that the landscaping sheet labeled L-1, number 8, states to see additional sheet L-2 for details. The supervisor that reviewed the landscaping made a note that if there are details that enhance the first page that would be fine. If there are other details that would require review, he would like to know if he could have a copy of the second sheet. Ch. Entman acknowledged the comment made by Mr. Schar. Com. Lesser advised that the rendering on Exhibit "El" is showing a brick planter in front of the sign. He is trying to reconcile Exhibit "B4" and he does not see the brick planter illustrated. He sees a reference to existing timbers remaining in place, but does not see the brick planter. Ch. Entman concurs with Com. Lesser. Mr. Diehl responded that the rendering was most likely an artist's freedom. They plan on having a planting bed but he is not sure if it plans on being a stone bed as depicted in the rendering. That will be worked out with the landscaping staff. Com. Lesser advised that the Board wants to be sure that what they are accepting, in terms of the aesthetics plan, is what the completed project is going to look like. Discussion took place among the Commissioners regarding the stone planter. Mr. Diehl advised that a planting bed would have some height and if plants are used that have some height to them, then eventually that height would start disturbing the visibility of the sign. ZONING BOARD OF APPEALS DRAFT COPYJUNE 17, 2003 Page 2 of 4 So if he agrees that there will be a stone or brick base planting bed in front, he does not know how high that would be and he does not know if that is appropriate at this time. Ch. Entman asked about the height of the base for the ground sign. Mr. Diehl explained that the base would be a two foot (2') high base and added that the height is not all that high especially if a planter bed is raised in front of it with any sort of plant material that will grow. He does not want to commit himself to a raised planting bed in front. Mr. Bob Archibald, Shell Oil Company, 603 Diehl Road, Naperville, Illinois was present and sworn in. Mr. Archibald commented that they wanted to depict in the rendering the brick base with the brick around the base of the sign matching the development around them to hide the concrete base with tasteful landscaping around that and throughout the closed driveway. They did not want to depict a planting bed in front of the sign because of the issue with landscaping that might become a problem when it matures. They would like to set the sign up a bit and then landscape around it. Com. Windecker advised that if the brick is going to be around the sign, you would not be able to see the brick base with a planting bed in front of it. Mr. Archibald advised that they were going to hide the concrete base of the sign with the brick planting bed. Ch. Entman asked the Board if they would prefer to see the brick base on the sign and landscaping around it or to have the concrete base of the sign and a brick wall to hide it. The Board concurred that they would like to see the brick base on the sign. Mr. Archibald agreed to have a brick base on the sign. There were no additional questions or comments from the Commissioners. There were no questions or comments from the audience. Com. If sheet L-2 has changes that must be reviewed, then a copy of the mentioned plan must be submitted. If sheet L-2 only enhances the details of sheet L-1, then the plan submitted is acceptable. c) Canopy / Fascia panel — the proposed changes were reviewed and are satisfactory. The ART agreed that the changes are apprpriate considering the improvements being made to the property such as landscaping, and the elimination of the access drive. d) Ground sign — it is recommended that the proposed sign include a brick base, as opposed to the concrete base detailed on Exhibit E-2, dated 3/5/03. The dimensions and colors of the changeable copy sign are satisfactory. Recommendation: The ART recommends approval of the proposed plans, as detailed below. Several additional issues were reviewed by staff prior to the ART Team meeting described herein. It is recommended that the Zoning Board of Appeals approve the proposed plans subject to the following: 1) Eliminate the southern curb cut on the eastern property line of the subject property and replace with landscaping as proposed on the proposed plan. 2) Construct a brick base for the proposed ground sign. 3) The canopy lighting (lenses) should be flush to shield from view of passing motorists. The report, which is unqualified in opinion, consists of the following sections: - The independent auditor's cover letter noting the scope of work and reporting that the financial statements present fairly the financial position, results of operations, and cash flows of the funds so audited. - A series of Combined Financial Statements disclosing the results of continuing operations in the form of a balance sheet, a statement of revenues, expenses and change in fund balance/equity and a statement of cash flows for FY 2002 (with FY 2001 comparisons, where appropriate). -Notes to the General Purpose Financial Statements that provide a detailed reference to accounting policies and other levels of information required under full disclosure for the funds. - Supplemental information dealing with individual fund balance sheets as well as statements of revenue and expense along with cash flow. This Report is the culmination of all of the fiscal activities for FY 2002 for the funds so audited and will be forwarded to those parties requesting and monitoring the financial operation and status of the funds. Specific Vegetation Management Practices. ComEd .vill periodically trim trees in the Municipality, consistent with the standards set forth below. A. Vegetation Management Cycle. ComEd will inspect the trees and other vegetation along its distribution lines within the Municipality on a regular cycle, not to exceed four years, trimming as necessary to meet required clearances. ComEd may also perform emergent trimming of particular trees when a need for it is identified by ComEd, by the Municipality, or by customer request. B. General Clearances. (e) Large tree trunks or major limbs of established trees may be allowed to remain as close as 2 feet from the conductors if(1)movement of either the conductor or the tree will not result in contact between the tree and the conductor,(2)the tree is not easily or readily climbed without the use of ladders or specialized climbing equipment,and(3)there is no evidence of re-growth or sprouting from the tree trunk towards the line. (t) ComEd may perform isolated secondary clearance when trimming is required. (g) Dangerous trees located off of ComEd's right-of-way should be removed if practical and if the owncr's permission has been obtained. 2 C. Exceptions to General Clearances. The following are exceptions to the general clearance standards shown above: i• ComEd may trim to special clearances because of field conditions, or when ANSI A300 standards cannot be achieved. Except as noted below, deviation from the general clearances and deviation from the ANSI A300 standards shall be approved in each case by a trained arborist employed by or acting as a consultant to ComEd. ii. ComEd may make additional allowances for multi-phase construction, wires that will sag due to hot weather, or wires that will swing sideways due to strong winds. When trimming, ComEd will take into consideration that the greatest wire sag or blowout occurs at mid-span. In the case of coniferous (evergreen) trees, ComEd will achieve proper clearance by using any one of the following methods: (a) removal of the tree, (b) topping to a point 6 feet from primary voltage conductors, or (c) trimming to achieve the provisions of subsection B above, and removal of all lower limbs within 10 feet of the ground or within 10 feet of an adjacent climbable object. iv. ComEd will not trim.trees along single-building service drops on private property. D. Debris Removal. ComEd shall remove the brush and debris associated with cyclic tree trimming. 3 2. Notice of Cyclic Trimmin¢. ComEd will give notice at least 21 days and not more than 90 days before commencing cyclic trimming in the Municipality, as follows: A. ComEd will notify the Municipality at the address shown in section 10 below where cyclic trimming in the Municipality is upcoming. ComEd will,provide the Municipality with a description of the areas,by common street address, in which the trimming will occur. B. ComEd will notify affected customers directly, by mail or by hanging a card on the customer's door. The notice shall contain, at a minimum, the following information: the nature of the planned vegetation management activities, the address of a website and a toll-free telephone number at which a written disclosure of all dispute resolution opportunities and processes,rights, and remedies provided by the ComEd may be obtained, a statement that the customer and the property owner may dispute the planned vegetation management activities through ComEd and the Illinois Commerce Commission, a toll-free telephone number through which communication may be had with a representatives of ComEd regarding the vegetation management activities, and the telephone number of the Consumer Affairs Officer of the Illinois Commerce Commission. The notice shall also include a statement that the location of the area of planned vegetation management activities is on file with the Municipality. C. ComEd will publish notice in a newspaper in general circulation and widely distributed in the:area in which the cyclic trimming will occur. 3. Non-Cyclic Ve etation Management. The provisions of Sections 1 and 2 above apply to routine, cyclic vegetation management. ComEd may conduct vegetation management, including trimming or removing particular trees, without,prior notice, when and where such activities are urgently needed pursuant to state regulations to restore electrical service or to prevent an imminent interruption of service. Although ComEd, as the electric utility responsible 4 for reliability of service shall make the determination as to when non-cyclic vegetation management is appropriate, ComEd will send notice to the Municipality within 10 business days, at the address shown below for notices, informing the Municipality of the location and nature of the non-cyclic activities. 4. Removal and Replacement of Privately Owned Trees. Prior to cyclic trimming, ComEd will examine the distribution circuits to identify privately owned trees that, because of their type and close proximity to overhead lines, would need extensive pruning or removal. Upon identifying such trees for removal: A. ComEd will contact the tree's owner, recommend removal of the tree, and obtain a signed permission from the owner to remove the tree. B. For each tree over 4 inches in diameter (breast high) that is to be removed, ComEd may, at ComEd's discretion, offer to the owner a replacement voucher. Each voucher will be redeemable at a participating vendor for one replacement tree on ComEd's approved replacement list,or for an equal dollar amount of other approved landscape materials. C. ComEd will mail the voucher, along with a planting guide and other appropriate publications,to the owner after the removal of the existing tree. D. If the owner agrees to the removal of the tree, ComEd will cut down the tree, remove and chip-associated brush, cut all wood into firewood length, and leave the wood on site. E. The owner of the tree will be responsible for any stump removal and disposal of logs left on site. This responsibility will be specified in the signed agreement of the owner before removal of the tree commences. 5. Cooperation on New Private and Public Tree Plantings. ComEd and the Municipality will work together to promote the planting of appropriate species of trees on private 5 and public property throughout the Municipality, including education of the public as to appropriate types of trees and vegetation for locations near electric power lines,.and encouraging developers of new projects within the Municipality to plant only appropriate types of trees and vegetation near electric power line rights-of-way. ComEd will supply the Municipality with a copy of a publication identifying tree species that are compatible and incompatible with electric power lines. Programs developed pursuant to this section that require expenditures by ComEd or the Municipality shall be subject to the prior mutual consent of the parties. 6. Applicability of Public Utilities Act and Village Ordinances. It is the intent of the parties that this agreement constitutes a written agreement mandating specific vegetation management practices within the meaning of Section 8-505.1(c) of the Illinois Public Utilities Act, and will supersede the provisions of Section 8-505.1(a) & (d) of that Act (220 MCS 5/8- 505.1(a) & (d)). ComEd's vegetation management activities will conform with, and this Agreement shall not preempt, the ordinances of the Municipality, including the requirement, if any, to obtain a permit for the removal of a tree within the Municipality. 7. Term of Agreement. The initial term of this agreement is four years from its effective date. The agreement shall automatically be renewed for successive four year terms, unless one of the parties notifies the other of its intention not to renew the agreement by so notifying the other party at least sixty days before the end of any four year tern. 8. Benefit and Assignment. This Agreement shall be binding upon and inure to the benefit of the Parties,and their respective successors and assigns. 9. Entire Agreement and Amendment. This Agreement contains the entire agreement between the Parties with respect to the matters described herein and it is a complete and exclusive 6 statement of the terms thereof and supersedes all previous agreements. This Agreement may not be altered or modified.except by a writing signed by the Parties hereto. 10. Notices to ComEd and Municipality. No Third Party Beneficiaries. The sole Parties to this Agreement are ComEd and the Municipality; and nothing contained herein creates any right, title, or interest in any other person or entity,whether under a third party beneficiary theory or otherwise. 13. Miscellaneous. If any provision of this Agreement or its application to any person or circumstance shall to any extent be invalid or unenforceable, the remainder of this Agreement shall not be affected thereby; and each provision of this Agreement shall be valid and enforceable to the fullest extent permitted by law. This Agreement does not waive or modify, and shall not be construed as waiving or modifying, ComEd's rates,tariffs, or terms and conditions of service. The language in all parts of this Agreement shall in all cases be construed as a whole according to its fair meaning and not strictly for or against ComEd or the Municipality, regardless of the involvement of either Party in drafting this instrument. The headings in this Agreement are for convenience only and shall not be utilized in the construction of the language of this instrument. "The range of ordinances, and the ways municipalities approach tree trimming, are pretty wide," Fowler said. The north parcel, zoned B-1, is occupied by a vacant house formerly used as an office. The adjoining parcel to the south is vacant, zoned R-4A. The Village approved a Preliminary Plan in 1995 to allow a single-family house to be constructed on this parcel. The Village's 1998 Comprehensive Plan designates the north parcel for office use and the south parcel as single-family. Mr. Niminiski proposes to construct single-family houses on both lots. The north lot would require rezoning to a residential classification. The property is abutted on the west and north by properties zoned B-1. The properties to the south and east are unincorporated single-family residences. The plat of subdivision approved by the Village in 1995 delineates the north lot (13-1) with an area of 11,200 square feet and a frontage of 112 feet. The south lot (R-4A) has an area of 8,800 square feet and frontage of 88 feet. The Petition requests rezoning of the north parcel to R-4A. The property could be re-platted to provide the R-3 minimum lot area of 10,000 square feet for both lots. The R-3 District requires a lot width of 80 feet; the R-4 standard is 70 feet. The R-3 District requires a front yard of 30 feet and a rear yard of 40 feet. In 1995 the request for the R-4A designation was based on the difficulty of providing the 40-foot rear yard required in the R-3 and R-4 Districts. Exxon Mobil proposes to acquire the property at 1250 Arlington Heights Rd. This property is zoned B-1 and occupied by the building formerly used as a Coldwell Banker office. The convenience store would have an area of 3,900 square feet. The building would be on the north portion of the site. It appears that a portion of the building will be less than 50 feet from the Spoerlein Farms residential property. The B-3 District requires a building setback of 50 feet abutting a residential property line. The petitioner should confirm the distance to the residential property line as well as the separation provided between the proposed building and the closest residential buildings. The car wash is proposed on the east edge of the site, with the access lane along the north side of the property. Screening and noise control will have to be carefully handled to avoid impacts on the Spoerlein residential neighborhood. The acquisition of the property at 1250 Arlington Heights Road provides the opportunity to enhance landscaping along the street and to modify access to the site. The west driveway on McHenry Road would be eliminated and a new driveway would be added along Arlington Heights Road. The proposed access would be evaluated in the Plan Commission review process.
