B. Resolution No. 2009- : A Resolution Approving an Addendum of
New Membership in the Northwest Central 9-1-1 System (Trustee Rubin)
SUMMARY: Resolution authorizes the execution of the amended agreement
between the Village and Northwest Central Dispatch System due to the
membership of the City of Rolling Meadows into the agency; this amendment
is specific to the NWCDS 9-1-1 system.

SUMMARY: The proposed ordinance reserves a Class D liquor license (Retail
sale of beer and wine to be sold in original packages for consumption off the
premises) for Nino's Pizzeria, Inc., 960 Buffalo Grove Rd. A Class B license
can be combined with a Class D license if authorized by the Liquor Control
Commissioner and approved by the Village Board (Section 5.20.070.D). This
reservation is to August 6, 2009 and can be extended by the Village Manager
for due cause, if requested by the owner.

SUMMARY: The Golf Department requests authorization to bid three
replacement pieces of golf course maintenance equipment. All items are fully
funded within the Village's Reserve for Capital Replacement and are

CALL TO ORDER
The Village Clerk called the meeting to order at 7:30 P.M. Those present stood and pledged allegiance to the
Flag.
ROLL CALL

VILLAGE PRESIDENT'S REPORT
President Pro Tern Braiman encouraged all residents to participate in Earth Hour on Saturday,March 28,2009
at 8:30 P.M.for one hour. The purpose of this event is to send a message to world leaders to take action against
global warming.
President Pro Tern Braiman read from a Proclamation declaring the month of April as Sexual Assault
Awareness Month in the Village of Buffalo Grove, and urging all citizens to commit to taking action against
rape and sexual assault.

TRUSTEE REPORTS
Trustee Berman announced that the Buffalo Grove Symphonic Band will present their 81h Annual Spring
Concert at Stevenson High School on April 25,2009 and urged residents to attend this outstanding event.
Trustee Berman presented an update on the Route 53 advisory referendum to appear on the April 7,2009 ballot,
and he urged residents to research facts on the issue and make an informed decision.
Trustee Berman announced that the American Cancer Society Relay for Life will be held on June 12,2009 at
Buffalo Grove High School, and he urged residents to join with the students of Buffalo Grove and Stevenson
High Schools who work so hard to stage this event to fight against this disease. There are many ways to become
involved and Trustee Berman noted that further information may be obtained by contacting Village Hall.
The Village Clerk also noted that the Municipal Election will be on April 7,2009, and urged residents to attend
the candidate forum on April 1,2009 at Buffalo Grove High School, and read material regarding the
qualifications of the candidates so that they may make an informed decision as they vote for the people that will
shape the direction of the Village.
VILLAGE MANAGER'S REPORT
Mrs. Neukirch noted the submittal of the Monthly Management Report for February,2009;there were no
questions on the report.
RESOLUTION#2009-10-ROUTE 53
Trustee Berman read the proposed resolution reaffirming support for the extension of Illinois Route 53.

President Pro Tern Braiman commented on the three options discussed previously for the Didier Farms parcel,
and he reviewed his discussion with Park District personnel today.

ORDINANCE#2009-16—BRANDYWYN LANE
Moved by Berman, seconded by Glover,to pass Ordinance#2009-16,amending Title 10 of the Village of
Buffalo Grove Municipal Code,designation of No Stopping, Standing or Parking on both sides of Brandywyn
Lane in the area of Meridian School.
Mrs. Neukirch stated that staff has reviewed the proposed plan with School District 102 and they concur with the
parking restriction as well as the proposed school route plan and staff recommends approval.
Trustee Berman expressed support for the ordinance and appreciation to Mrs. Neukirch and staff for the long
process and negotiations put forth to bring this plan to fruition.
Mrs. Neukirch recognized Mr. Kuenkler for all of his work on the plan, as well as the Sgt. Kristiansen and the
Traffic Management Committee,residents and school district officials. The costs to be incurred as part of this
initiative will be$4,000, and the school district has agreed to pay 50%of that cost.
In response to a request from President Pro Tern Braiman,Mrs. Neukirch reviewed the responsibilities of the
Traffic Management Committee.

FIREARMS RANGE IMPROVEMENTS
Mrs. Neukirch introduced and reviewed the proposal,details of which are contained in the Village Board
Meeting Agenda Item Overview prepared by Chief Balinski.
Chief Balinski thanked the Board for their support of this proposal and presented an overview of the value that
the firearms range provides to the Police Department, as well as the value of proceeding with the proposed
project and the cost impact to the Village. Staff had budgeted$60,000 for this project, and they are pleased to
present a proposed expenditure of$50,100. The Chief and officers then answered several questions from the
Board.
Moved by Rubin, seconded by Berman,to award contract for Firearms Range Improvements to Action Target in
the amount of$50,100 in accordance with the memorandum presented to the Board.
In answer to a question from President Pro Tern Braiman,Chief Balinski stated that this will give us 100%
compliance for being rifle rated.
President Pro Tern Braiman stated that he would urge all residents to attend the Citizen's Academy—it is a
wonderful experience.

REPLACEMENT FIRE SERVICE VEHICLES
Mrs. Neukirch introduced and reviewed the proposal,details of which are contained in the Village Board
Meeting Agenda Item Overview prepared by Mr.Whalen.
Moved by Berman, seconded by Trilling,to authorize bid waiver and purchase of a two replacement Fire Service
Vehicles through the State of Illinois Department of Central Management Services in an amount not to exceed
$34,445.00.
President Pro Tern Braiman has a concern with the purchase of two new vehicles, and suggested keeping the
Focus and just purchase the Impala at this point in time.
Discussion ensued with regard to the suggestion of limiting the purchase to one vehicle this year, with the
emphasis focusing on possible increased maintenance costs and lower resale value.
Trustees Berman and Trilling amended the motion to approve the purchase of only one unit,the 2009 Impala
#401904 in accordance with the information contained in the staff memorandum.

INTER-TRACK PARTNERS LLC
Moved by Trilling, seconded by Berman,to refer Inter-Track Partners LLC proposal to establish off-track
betting facility at Adam's Ribs &Ale House,301 N. Milwaukee Avenue to the Plan Commission for review.
Mrs. Neukirch briefly reviewed the proposal and introduced Bob Bilocerkowycz,President of Inter-Track
Partners,LLC,Cy Sadeghi and Michael Arab of Adam's Ribs &Ale House.
Mr. Bilocerkowycz made a presentation to the Board,details of which are contained in the Village Board
Meeting Agenda Item Overview prepared by Mrs. Neukirch.
Mrs. Neukirch stated that the establishment would be required to notify the Police Department of any special
events or activities outside of the normal day-to-day operations, at which time the Police Department would
determine whether or not special duty police personnel would be required at the event. If extra personnel were
required,the business owner would be 100%responsible for those costs.
Mrs. Neukirch stated that research indicates that Police Department responses for OTB's are very minimal high-
risk incidents, and there would be no more expense to the Village than the current establishment.
Chief Balinski stated that a comprehensive and extensive review indicates that there is no real concern with
additional police presence. Also contacted were Police Chiefs from other communities, and they indicated that
the relationship with off-track betting facilities has been exceptional and very respective regarding community
response and community service, and he is very comfortable with the proposal and he does not foresee any
unusual circumstances.
In answer to a question from Trustee Rubin, Chief Balinski stated that the number of calls for the OTB would be
comparable to any restaurant/bar facility.
In answer to a question from Trustee Kahn,Mr. Bilocerkowycz stated that there would probably be two special
events per year. Trustee Kahn asked that there be something put in the referral with regard to quantification and
definition of special events so that it is manageable.
Mr. Bilocerkowycz answered questions from Trustee Glover with regard to additional parking, and the
provisions to prevent underage patrons from taking part in either drinking or gambling.
Trustee Trilling asked about possible live entertainment, which was answered by the petitioner.
Because of the nature of the use,Trustee Berman believes there should be more feedback from community, and
he asked that the Plan Commission keep track of comments that come in that relate more to the general policy of
the use rather than merely the zoning issue so the board is fully aware of the kind of feedback that the public is
providing.
President Pro Tern Braiman stated that he believes that this is a much better location than what was previously
proposed;he is concerned about the parking,both normally and for special events; he would like to see a parking
easement before the permit is issued;he suggested that the petitioner reach out to the neighbors during the
planning process to be sure that they understand what the intent is and that the petitioner will do their best to be
sure that patrons do not park in the neighborhood.

RE: ARBOR DAY PROCLAMATION
Bill, I have attached the Proclamation which proclaims Friday,April 24, 2009, as Arbor Day in
Buffalo Grove. Traditionally,the last Friday in April has been designated as Arbor Day in
Illinois. The Proclamation is one of four criteria to qualify for the Tree City USA Award.
As in previous years to be designated a Tree City USA,the Forestry Program must comply with
four(4) standards.
Standard 1: The Village must have a Tree Board or Department. The Plan Commission
qualifies as the Tree Board and our Forestry Division qualifies for and complies with this
standard.
Standard 2: The Village must have a Tree Ordinance. Chapter 12.20 of the Municipal Code and
Section 16.50,120 of the Development Ordinance comply with this standard.
Standard 3: The Village must have a Community Forestry Program with an annual budget of at
least$2.00 per capita. The Village Forestry Program provides for regular care and maintenance
of approximately 20,000 parkway trees, and shrubs and trees in open space areas, detention sites
and around Village owned facilities. Care and maintenance includes planting, pruning, trimming
and removal of trees and shrubs. Additionally, the program includes an information service for
residents with questions related to landscape maintenance, landscape plan review for residential,
retail/commercial and new development. These activities and the forestry budget of
approximately $420,747.00 meet the criteria as outlined in this standard.
Standard 4: The Village must participate in an Arbor Day Activity and a Proclamation
designating Arbor Day in Buffalo Grove. As part of Buffalo Grove's Arbor Day celebration,the
Forestry section will provide and distribute seedlings to all 3rd grade elementary classes in
Buffalo Grove. Members of the Forestry Section will be available to speak to 3rd grade classes
about Arbor Day and Forestry activities in Buffalo Grove.
Staff has submitted the information to support each of the above Standards and for the 215�
consecutive year,the National Arbor Day Foundation has recognized the Village as a Tree City
USA.

In addition, on October 15, 2007,the Village Board approved the 2007 Tree Ordinance
(amending the 1970 Tree Ordinance), upon which the Village received a Growth Award from the
National Arbor Day Foundation for the improvements to the new Tree Ordinance. This award is
designed not only to recognize achievement, but also to communicate new ideas and help for
leaders of all Tree City USA's plan for improving community tree care.
It is with great pride the Forestry Section would like to present the 2008 Tree City USA 21 year
award to the Village President and Board of Trustees during the next scheduled Village Board
meeting April 6,2009,and respectfully request that the Village President and Board of Trustees
proclaim Friday, April 24,2009, "Arbor Day" in Buffalo Grove.

that a special day be set aside for the planting of trees, and
WHEREAS, this day, called Arbor Day, was first observed with the planting of more
than one million trees in Nebraska, and Arbor Day is now observed

WHEREAS, trees reduce the erosion of precious topsoil by wind and water, reduce
heating and cooling costs, moderate the temperature, clean the air, produce
oxygen and provide habitat for wildlife, and
WHEREAS, trees are a renewable resource giving us paper, wood for our homes, fuel

maintenance of our village urban forest;

IN THE NORTHWEST CENTRAL 9-1-1 SYSTEM
WHEREAS, the President and Board of Trustees of the Village of Buffalo Grove previously
authorized entry by said Village into an Agreement to provide for and maintain a joint Enhanced 9-1-1
System known as the Northwest Central 9-1-1 System,hereinafter referred to as"the 9-1-1 System'';and
WHEREAS, the City of Rolling Meadows has made application for membership in the 9-1-1
System; and
WHEREAS, the 9-1-1 System Board of Directors has unanimously recommended approval of the
membership request of Rolling Meadows;and
WHEREAS, it is believed that the inclusion of an additional community in the 9-1-1 System will
prove beneficial to both the 9-1-1 System and the Village of Buffalo Grove;and
WHEREAS,the new member has agreed to 1)provide funds for its proportionate share of the cost
of operation of the 9-1-1 System, 2)provide all necessary funds required to add or modify hardware and/or
software in order to accommodate the operational needs of the new member, and to pay a proportionate
share of normal 9-1-1 operational expenses, and 3)pay a proportionate share of debts and liabilities which
may be incurred after the effective date of membership;and
WHEREAS,the addition of new members to the 9-1-1 System requires approval of an Addendum

ONE(1) SKID STEER ALL SURFACE LOADER
Bids will be received on or before,but not later than 11:00 a.m. on April 20, 2009 at the
office of the Village Clerk, 50 Raupp Blvd.,Buffalo Grove, IL 60089, and immediately
thereafter all bids will be publicly opened and read aloud.
Sealed envelopes or packages containing proposals shall be marked:

The Village reserves the right to reject any proposal for failure to comply with all the
requirements of this notice or any of the bid specification and bid summary documents;
however,the Village may waive any minor defects or informalities at its discretion. The
Village reserves the right to reject any and all proposals or to award a contract which
within its judgment is in the best interest of the Village.

INSTRUCTIONS TO BIDDERS
1. Proposal: It is the intent of these specifications to furnish the Village of
Buffalo Grove with a TWO (2)RIDING TRIPLEX
GREENSMOWERS and ONE (1)SKID STEER ALL
SURFACE LOADER,which are ready for use when delivered to
the Village of Buffalo Grove, and must be of the manufacturer's
current models in production at time of delivery. No such item
equipment or accessories shall be removed or omitted for the
reason that it was not specified in the bid. All parts not specifically
mentioned which are necessary in order to furnish a complete unit,
shall conform to the best engineering practices and workmanship
known in the industry. Standard production items may be removed
only where it is necessary to install other items in lieu thereof in
order to comply with these specifications.
2. Specifications: Specifications are included with these instructions. Dealers shall
include with each proposal,manufacturer's literature or
advertisement relating to this specification. All new vehicle
information, as required by law and regulation, shall be affixed at
time of delivery.
3. Quotations: The proposal should include all costs to the Village of Buffalo
Grove.
4. Pre-Delivery
Service: The dealer or representative of same, who is a responsible
authority shall contact the Golf Course Superintendent within 10
days following notification of award(purchase order), and discuss
arrangements for delivery, warranty procedures, service
information dissemination, and provide other information as may
be required. Dealer preparation shall be performed by the dealer
according to manufacturer's recommendations and requirements.
The equipment shall be delivered. Delivery shall be made during
the regular workdays of Monday through Thursday,between the
hours of 8:00 a.m. and 2:00 p.m. The dealer shall deliver the
equipment in exact compliance with the specifications and with all
pre-delivery service completed. The dealer shall correct any
discrepancy reported by the Village of Buffalo Grove within five
(5)working days of delivery either by affecting corrective
procedures at the point of delivery or by removing the deficient
equipment from Village property, until such time as corrective
measures have been made to bring the equipment in conformance.
In either case, corrections shall be made without further
inconvenience or cost to the Village of Buffalo Grove. Failure to

6. Warranty: Manufacturer's Standard Warranty must be furnished with each
piece of equipment. The manufacturer's warranty shall become
effective on the day that the new equipment is actually put into
service. It shall be the responsibility of the dealer to funush the
warranty card imprinted with VILLAGE OF BUFFALO GROVE.
Further, it will be the responsibility of the dealer to ensure that the
Golf Course Superintendent or designated representative is kept
apprised in a timely manner of all information concerning
warranty, service manuals and service bulletins.
7. Bid Reject: The Village of Buffalo Grove reserves the right to reject
any one or all bids,to accept only part of a bid,to waive any
irregularities in a bid, and to accept a bid regardless of price when
it is considered to be in the best interest of the Village of Buffalo
Grove.
8. Default: If the dealer fails to deliver the equipment,and/or perform services
in compliance with the terms of this document, it shall be liable to
the Village of Buffalo Grove,by credit memorandum or otherwise,
for fixed, agreed, and liquidated damages, and not as a penalty, in
the amount of$500.00 per vehicle involved for each calendar week
or any portion thereof, during which the failure to comply
continues. A calendar week shall be considered as,beginning at
8:00 a.m. local time Monday and ending 5:00 p.m. local time
Friday. Liquidated damages shall begin to accrue on the first
Monday following receipt by the dealer of written notification
from the Village of Buffalo Grove that such a default under the
contract/purchase order exists. The Village of Buffalo Grove may
terminate the contract/purchase order or any portion thereof on
first discovering that such a default exists or after a period during
which liquidated damages have accrued as aforesaid and no
permanent remedy satisfactory to the Village of Buffalo Grove
appears likely. In either of the foregoing events,the dealer shall be

liable for liquidated damages as aforesaid until such time the
Village of Buffalo Grove may reasonably obtain delivery or

and agreed,however,that none of the foregoing provisions of this
paragraph shall apply if dealer default results directly from
conditions or events beyond its control,including,but not by way
of limitations,Acts of God,fires, floods,epidemics,quarantine
restrictions, strikes, freight embargoes, shortages of raw materials,
or unusually severe weather.
9. Notice to Adherence to all of the aforementioned procedures is mandatory.
Dealers: Failure to abide by any of the provisions will result in rejection of
the subject equipment until such time as the provisions are met. In
order to prevent any delays in the acceptance of the new equipment
and to assure payment as soon as possible, dealers are reminded to
comply with all provisions.
10. Public The Village of Buffalo Grove Contracts statement(page b and 7)
Contract shall be completed, signed by the dealership or his designated

AN ORDINANCE AMENDING CHAPTER 17.36,
DRIVEWAYS AND OFF-STREET PARKING AND LOADING FACILITIES, AND
CHAPTER 16.50,
GENERAL DEVELOPMENT AND DESIGN STANDARD SPECIFICATIONS
OF THE VILLAGE OF BUFFALO GROVE MUNICIPAL CODE
WHEREAS, the Village of Buffalo Grove is a Home Rule Unit pursuant to the Illinois
Constitution of 1970;
WHEREAS, the corporate authorities of the Village of Buffalo Grove believe it is in the best
interest of the Village to promote the public health, safety and welfare of the residents of the Village
of Buffalo Grove to amend the Municipal Code of the Village.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT and BOARD OF TRUSTEES OF
THE VILLAGE OF BUFFALO GROVE, LAKE and COOK COUNTIES, ILLINOIS, as follows:
Section 1. The lead in paragraph of Subsection FA. of Section 17.36.030 and Subsection
FA.b. of Section 17.36.030 of the Village of Buffalo Grove Municipal Code are hereby amended to
read as follows:
17.36.030 Additional regulations — Parking.
F. Design and Maintenance.
4. Access. Parking facilities shall be designed with appropriate means of vehicular
ingress and egress to a street or alley in such a manner as will least interfere with
the movement of traffic. Driveways shall not obstruct, damage or harm any tree, fire
hydrant, street light or other Village approved structure located within the parkway.
Hard surfaces such as pavement, concrete or brick shall not be permitted within the
drip line of any parkway tree at the time of installation, as determined by the Village
Engineer. Driveways serving detached single-family residences shall also comply
with the following standards:
b. For residences with an attached one-car or two-car garage, a maximum driveway
width of twenty-four feet at the sidewalk in or adjacent to the public parkway shall be
permitted subject to the limitations of sub-section 4 a. above.

5. Required setbacks.
a. No parking space nor portion thereof established on a zoning lot without a
building shall be located closer to any street line than the established building line
on adjacent properties nor closer than the front yard setback required for the district
in which the parking lot is located.
b. Any impervious surface proposed to be constructed within five feet of the
property line or within any easement shall be subject to the review and approval of
the Village Engineer.
Section 3. Subsection A.2.b, Driveway Aprons and the associated Exhibit No. 503 which is
attached hereto and identified as Exhibit A, of Section 16.50.080, Sidewalks and Driveway Aprons,
of the Village of Buffalo Grove Municipal Code is hereby amended to read as follows:
b. Residential driveway aprons shall have a minimum width of ten feet; a maximum
width of twenty-four feet for one-car and two-car driveways and twenty-seven
feet for three-car or greater driveways, measured at the sidewalk in or adjacent
to the public parkway. Residential driveway aprons shall have a maximum width
of twenty-one feet at the curb for one-car and two-car driveways, and a
maximum width of thirty-feet at the curb for a three car driveway or greater. In
no case shall the driveway apron width at the curb be greater than three feet
wider than the driveway width at the sidewalk. Where a driveway wider than
eighteen (18) feet is permitted by the Zoning Ordinance, the driveway apron
shall be increased to the permitted width, not exceeding twenty-four (24) feet,
measured at the sidewalk, as long is the edge of the driveway apron is no closer
than two (2) feet to any street light or three (3) feet to any fire hydrant and does
not encroach into the dripline of any parkway tree, and shall be tapered to
twenty-one feet at the curbline, as shown on Exhibit No. 503. Service walks shall
be thirty-six inches wide. All residential aprons shall have a minimum concrete
thickness of six inches and a granular base of five inches minimum compacted
thickness or concrete paving brick (conforming to ASTM C-936) with a minimum
thickness of three and one-eighths inch on a granular base of twelve inches
minimum compacted thickness. Business, Office and Research, and Industrial
District driveway aprons shall have a width equal to that of the driveway at the
property line, but which width shall not exceed the maximum allowable driveway
width established in the Village's Zoning Ordinance. The driveway apron shall
be constructed with ten foot radius returns unless otherwise approved by the
Village Engineer.
Section 4. If any section, paragraph, clause or provision of this ordinance shall be held
invalid, the invalidity thereof shall not affect any other provision of this ordinance.

Section 5. Any person violating any portion of this ordinance shall be punished
according to the provisions of Chapter 1.08 of the Buffalo Grove Municipal Code.
Section 6. This ordinance shall be in full force and effect from and after its passage,

Village Zoning Ordinance and Development Ordinance—
Amendments concerning driveway and apron widths in
Residential districts
Vice Chairman Smith called the hearing to order at 8:30 p.m. in the Village Council Chambers,
Buffalo Grove Municipal Building, 50 Raupp Boulevard, Buffalo Grove, Illinois. Vice
Chairman Smith read the Notice of Public Hearing as published in the Buffalo Grove Daily
Herald, explained the procedure to be followed for the public hearing, and swore in all persons
who wished to give testimony.

Ms. Neukirch reviewed the current review and permitting process to replace, reconstruct or
extend a residential driveway. She said any variations to the driveway regulations are typically
heard by the Zoning Board of Appeals. She noted that the proposed changes to the driveway and
apron standards have been presented to Zoning Board of Appeals as well as the Plan
Commission. At tonight's staff is requesting consideration of amendments to the Zoning
Ordinance and Development Ordinance and a recommendation from the Plan Commission.

Ms. Neukirch commented that as part of the current application process property owners and
contractors work with the Building & Zoning Department, which coordinates a review by the
Village Engineering Division. Staff reviews the plans to ensure that the proposed modifications
meet the standards of Village's Zoning Ordinance and Development Ordinance. An inspection
by the Village is required prior to pouring concrete. The Building & Zoning and Engineering
staffs coordinate concerning the pre-pour inspection, and then the contractor can proceed with
the work. After the work is completed, the Building & Zoning Department staff does a final
inspection. If any changes were done during construction that are not consistent with the
approved permit, the contractor has to correct the work to be in compliance with the permit and
the applicable ordinance standards.
Ms. Neukirch stated for residential driveways and aprons for one— and two—car garages, the
standards allow a maximum width of 18 feet at the sidewalk in or adjacent to the public way and
three feet greater at the curb. For a three—car garage the maximum allowable widths are 27 feet
at the sidewalk and three feet greater at the curb. She said that the Village does not permit
alterations within easement areas or within 5 feet of the property line if stormwater drainage
would be affected. She noted that the regulations require a taper of 1:1 where the driveway has
been widened and then needs to be brought down to the maximum allowed width at the
sidewalk. The regulations allow a maximum of 40 percent of the required front yard to be used
for impervious surfaces including walkways and driveways.
Ms. Neukirch reviewed some examples where properties were in compliance initially but then
additional pavement was installed that exceeds the allowable width or yard coverage. She noted
that this situation typically happens when a homeowner adds pavement or blocks to make their
driveway larger.
Ms. Neukirch noted that in response to the Plan Commission's suggestion at the previous
workshop, staff conducted a survey of other communities concerning driveway standards and the
permitting and inspection process. The survey results indicate that a number of communities do
not initiate enforcement action if a driveway has been widened after the initial construction and
approval. The survey also showed that several communities allow wider driveways and larger
areas of pavement than Buffalo Grove.
Ms. Neukirch noted the Village's current population is approximately 45,000 which compares to
a population of about 42,900 in 2000 conducted by the U.S. Census. The average household size
is 2.72 people. The majority of households have 1 to 3 persons, and more than 80 percent of the
households have 4 or fewer residents. It appears that it is not common for households in the
Village to have more than four residents using separate vehicles.
Ms. Neukirch stated that the proposed ordinance modifications would increase the allowed
driveway width at the property line from 18 feet to 24 feet for properties with 1 and 2—car
garages. The current width of 27 feet for properties with 3—car garages would not change. She
noted the proposed regulations would also include provisions that driveways shall be set back
from trees, fire hydrants, streetlights and any other structure within the parkway. The regulations
would also address additional review by the Engineering Division if proposed improvements are
were within 5 feet of the property line or any easement.

Ms. Neukirch commented that staff will also improve the administrative process and record
keeping concerning approved driveway permits. Staff is proposing that a digital photo of each
driveway be taken at the time of final inspection. This information will be part of the permit file,
and would be checked if subsequent modifications are made to an approved driveway. The
Village also has access to aerial photography taken in 2008 that can be used to document
conditions at that point in time.
Ms. Neukirch commented that the pavement coverage limitation for required front yards was
reviewed. Staff recommends that the current maximum amount of 40 percent of the required
front yard area be retained as the standard.
Ms. Neukirch stated they also looked at the regulations concerning overnight parking on
residential streets. Currently residents can call 911 and request to permission from the Police
Department if they need to park on the street overnight. However, for reasons relating to safety
and crime prevention, the Police Department strongly encourages maintaining the current
regulations to not allow overnight parking except for situations where specific permission is
warranted.
Ms. Neukirch pointed out that a public education program would be used to inform everyone in
the community concerning the new driveway regulations. Specific elements of the programs
would include the Village newsletter that is sent to every residential and business address in the
Village, and direct communication with all contractors that have been issued permits or are
known to have worked in the Village.
Commissioner Stark asked if there are approved contractors that the Village recommends.
Ms. Neukirch replied that the Village has a data base of contractors who have worked in the
Village, but the Village would not make recommendations concerning any individual contractor.
Village staff is recommending that the Village Board consider a registration program for
contractors working in the Village, but this would be a larger initiative than just pavement
contractors.
Commissioner Myer asked for more specifics about encroachments to the property line and the
additional review that would take place.
Ms. Neukirch said this would involve a site visit by the Village Engineer to determine if
proposed modifications to a driveway or other paved area would affect drainage on adjacent
properties or streets and parkways.
Mr. Kuenkler commented said the site inspection would focus on making sure that grading and
related improvements don't affect stormwater drainage for properties adjacent to the proposed
improvements.
Commissioner Myer asked if there is some maximum as to the number of cars that are allowed to
be parked in a driveway.

Ms. Neukirch said that as long as the cars are parked on a paved surface, there are no restrictions.
Commissioner Teplinsky asked what the perceived need is to amend the Zoning Ordinance other
than the fact that there are lots of people violating the current regulations.
Ms. Neukirch replied that when a permit application is denied because it does not meet code, the
homeowner invariably comes back with a list of properties in their neighborhood with driveways
that are not in compliance. If there is an active permit, the building department will go out and
enforce accordingly. In cases where the improvement has been in place for a period of time, it is
difficult to verify when the work was done. The proposed changes will bring some properties
into compliance. Other properties that are not in compliance would not be allowed to make
further changes, and with better documentation the Village will be able to track changes made
after a final inspection.
Commissioner Bocek asked if this amendment would address only about 25 percent of the
current non—compliant driveways.
Ms. Neukirch noted that there isn't a complete inventory of all residential driveways that aren't
in compliance, so the level of compliance that would be achieved with the new regulations is
based on a smaller field survey. Of this sample group, about one—third would be brought into
compliance. But with more detailed documentation of approved driveways and follow up
inspection procedures, the compliance rate would improve from this point forward. Another
aspect of the new procedures would be that the Building & Zoning Department will conduct
inspections at the end of the construction season to review all the permits that were issued to
verify that no modifications were done to driveways after the final inspection.
Commissioner Bocek asked what would be the procedure if violations are found.
Ms. Neukirch said violations would have to be corrected to bring the property into compliance
with the regulations.
There being no further comments or questions from anyone else present, Vice Chairman Smith
closed the public hearing at 8:40 p.m.

WHEREAS, the Village of Buffalo Grove is a Home Rule Unit pursuant to the Illinois
Constitution of 1970; and
WHEREAS, request is being made by Theresa Prindiville, 388 Lauren Lane, for variance
of Zoning Ordinance, Section 17.32.020, pertaining to Location of Accessory Buildings and
Structures, for the purpose of constructing a one and a half(1-1/2) story addition on the rear of
the home that would reduce the separation of the principal structure and the detached garage to
five (5)feet; and.
WHEREAS, the Zoning Board of Appeals has held a public hearing, received testimony,
prepared minutes, made certain findings, and has made an affirmative recommendation on said
request for variation; and
WHEREAS, the Corporate Authorities of the Village of Buffalo Grove hereby determine
and find that said variation is in harmony with the general purpose and intent of the Zoning Ordi-
nance, and that(1)the plight of the owners is due to unique circumstances and (2)the proposed
variation will not alter the essential character of the neighborhood.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF

Mr. Michael Sayers, 27 S. Pistakee Lake Road, Fox Lake, Illinois, was present and sworn
in. The public hearing notice published in the Daily Herald on February 25, 2009 was
read.
Mr. Sayers distributed a packet of the information to the Commissioners. This was
marked as Exhibit"E".
Ch. Entman asked if the Petitioner was present. Mr. Sayers explained that Theresa
Prindiville was not present but that her son Raymond Prindiville was present.
Mr. Sayers explained that two (2) variances are being requested. The first variance is to
add a roofed-over front porch that would encroach into the front yard setback. They
currently have a simple eve. It is a very modest house. She is looking to add a return
gable that would allow her guests and visitors to step outside under the roof for protection
from the elements. Curb appeal is important and she wants to dress up the front of the
house.
Mr. Sayers explained that the second variance is for the distance between a proposed
addition and the existing detached garage. Cost is a huge consideration for this customer
and they are trying to keep it simple and maintain as much backyard as possible. It also
has a direct relation as to how they can use the existing house. Mr. Sayers directed the
Commissioner to the last page of Exhibit "E" and reviewed the layout of the proposed
addition. The location of the addition and the layout from right to left is very important.
Ch. Entman read the Village Engineer's memorandum addressed to Brian Sheehan dated
March 3, 2009 which states: "I have no comments on either of the proposals at this
location."
Ch. Entman would like a letter of authorization from the Petitioner to allow Mr. Sayers
and Raymond Prindiville to represent the owner.
Com. Dunn asked about the materials for the addition. Mr. Sayers stated that the house is
currently aluminum sided and the owner will do a complete update, replace windows and
reside the house. The house will be completely resided in either aluminum or vinyl. Com.
Dunn asked about the roof. Mr. Sayers stated that the roof will match. The roof is fairly
new so they will match the existing shingle for the addition.

Re: Village of Buffalo Grove Building and Zoning Variation
We have lived in the above home since 1970. My family has grown and my husband is
deceased. Today,my son Raymond and I live together and share the home. We would
like to update the home and add enough room to make this a nice place for us both.
We have chosen to add on a rec room and remodel to provide needed storage and a
whirlpool bath for my health and comfort. The cost to do this is far more reasonable if
we can keep the addition a simple rectangle.
We are asking for 2 minor variances:
l. Reduce the separation requirement between the detached garage
and the proposed addition to 5'. This allows us to build a simple
rectangle,keep the depth of the addition shallow and preserve more
of an open space rear yard for the grandkids.
2. Allow us to add a covered front porch that would encroach into the
front yard 3'6". This will keep my guests dry and greatly enhance
the curb appeal of the home.

AN ORDINANCE AMENDING CHAPTER 15.20, FENCE CODE, OF THE
VILLAGE OF BUFFALO GROVE MUNICIPAL CODE
WHEREAS, the Village of Buffalo Grove is a Home Rule Unit by virtue of the
provisions of the Constitution of the State of Illinois of 1970.
NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE PRESIDENT
AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK
AND LAKE COUNTIES, ILLINOIS AND PURSUANT TO ITS HOME RULE
AUTHORITY:
SECTION 1: Section 15.20.110 of the Village of Buffalo Grove Municipal Code is
hereby amended to read as follows:
15.20.110 Varianee Authority to grant.
15.20.110 Variance—Authority to grant.
A. The Zoning Board of Appeals or the Corporate Authorities may approve
variations to this Chapter(except Section 15.20.050)where sufficient evidence
has been provided that all of the following criteria have been met.
1. The plight of the owner is due to unique circumstances;
2. The proposed variation will not alter the essential character of the
neighborhood;
3. There are practical difficulties or particular hardships in carrying out the strict
letter of this Chapter which difficulties or hardships have not been created by
any person presently having an interest in the property; and
4. The proposed variation will not be detrimental to the public health, safety and
welfare.
B. Conditions and restrictions may be imposed upon the subject property, and on
the fence location, construction, and design as may be necessary or appropriate to
comply with the foregoing criteria and to protect adjacent property and property
values.

SECTION 2: Should any section or provision of this Ordinance be declared invalid
by a court of competent jurisdiction, such decision shall not affect the validity of the
Ordinance as a whole or any part thereof other than the part declared to be invalid.
SECTION 3: Any person violating the provisions of this Chapter shall be punished
according to the provisions of Chapter 1.08 General Penalty.
SECTION 4: This Ordinance shall be in full force and effect from and after its
passage, approval and publication. This Ordinance may be published in pamphlet form.
