1985-01 RESOLUTION NO. 85- t. A RESOLUTION APPROVING AN AGREEMENT CONCERNING THE MULTIPURPOSE USE OF THE BUFFALO GROVE RESERVOIR AND PUMPHOUSE NUMBER SEVEN SITE AND FACILITIES WHEREAS, it is deemed beneficial to the common taxpayers and residents of the Village of Buffalo Grove and the Buffalo Grove Park District for these two agencies to cooperate in providing the services of each agency in an economical manner; and WHEREAS, the design and currently constructed Village improvements and the current plans for future Village improvements at the Village's Reservoir and Pumphouse Number Seven site may be able to accomodate the joint use of the site with the Park District for recreational purposes; NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees of the Village of Buffalo Grove that the contract entitled "An Agreement Concerning the Multipurpose Use of the Buffalo Grove Reservoir and Pumphouse Number Seven Site and Facilities" is hereby approved and the Village President is hereby authorized and directed to execute the agreement. WITNESSETH, THAT WHEREAS, the Village and the Park District desire to cooperate in providing their respective services to their common taxpayers and residents in an economical manner; and WHEREAS, the Village has acquired 7.4 acres of property (hereinafter referred to as the "400 LaSalle Lane Property") for the primary purpose of constructing maintaining and operating Village Water System and other improvements; and WHEREAS, a plat of the 400 LaSalle Lane Property is attached hereto as exhibit A; and WHEREAS, the design of currently constructed Village improvements and the current plans for future Village improvements may be able to accor.odate the joint use of the 400 LaSalle Lane Property by both the Village and Park District; NOW, THEREFORE, it is agreed as follows: 1. The primary purpose of the 400 LaSalle Lane Property is to accommodate the construction, operation and maintenance of Village Water System and other Village improvements and related improvements of other agencies. 2. The Village retains all rights to the property and reserves the right to revoke permits which may be issued to the Park District for the use of portions of the property at any time. 3. The Village authorizes its Director of Public Works to issue permits to the Park District for the use of portions of the 400 LaSalle Lane Property and to establish conditions for these permits. No permit provision or condition shall be contrary to any specific provision of this agreement. the Park District constructs and maintains tennis court fencing in accordance with a Village permit, the Village will reimburse the Park District on a pro-rated method, based upon the low bid for fencing if the Village permit is then cancelled for the use of tennis courts. The life expectancy of the fencing is twelve years. 5. The Park District authorizes its Director of Parks and Recreation to accept permits and their conditions which are established in accordance with this agreement. 6. The Park District agrees to hold 'harmless the Village, its officers, agents and employees from any liability related to the Park District's use of the 400 LaSalle Lane Property and related to any improvement which is constructed by the Park District on the 400 LaSalle Lane Property. 7. Contemporaneous with the execution hereof, each party hereto shall furnish to the other party hereto a certified copy of the resolution of the duly constituted corporate authority of that party authorizing and directing the execution of the agreement.
