1996-34RESOLUTION NO. 96 -34 URGING AMENDATORY VETO OF HOUSE BILL 1780 - AMENDMENT 10 WHEREAS, the property commonly referred to as Conway Farms South has always been located in Lincolnshire - Prairie View Elementary District #103 and Stevenson High School District 125; and WHEREAS, the attempt of the City of Lake Forest to detach this property from the aforementioned School Districts has been rejected by an impartial special hearing board; and WHEREAS, the further attempt of the City of Lake Forest to detach this property from the aforementioned School Districts has been rejected by the Circuit Court of the 19th Judicial District of Lake County; and WHEREAS, the further attempt of the City of Lake Forest to detach this property from the aforementioned School Districts has been rejected by the Illinois Appellate Court for the Second District; and WHEREAS, the administrative and judicial reviews concluded that: 1. The proposed detachment and annexation is not in the best interest of the schools of the area or the educational welfare of the peoples therein, 2. The detriment resulting from the proposed detachment and annexation clearly outweigh the benefits, if any, and 3. The proposed detachment and annexation may not be granted on the basis of the personal preference and desires of the key petitioners; and WHEREAS, Amendment 10 to House Bill 1780 has been enacted to circumvent these administrative and judicial rulings by allowing the City of Lake Forest to detach this property from Districts 103 and 125 without an opportunity for those Districts or their residents to oppose the detachment or explain its adverse impact; and WHEREAS, this legislation circumvents the process for school detachment that has been stipulated in the Illinois School Code for nearly thirty years; and WHEREAS, we believe the legislation constitutes special legislation to benefit Lake Forest in violation of Article 4, Section 13 of the Constitution of the State of Illinois; and WHEREAS, this legislation will increase taxes for every resident of Districts 103 and 125; • • THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS that we hereby resolve to urge Governor James Edgar to prevent this abuse of legislative authority by exercising his amendatory veto power on Amendment 10 of House Bill 1780 and veto the section that states "...Amends the School Code. Provides for the detachment of territory located in a special charter city f rom one school district and its annexation to a contiguous special charter school district upon filing of the petition for detachment and annexation, by operation of law and without the necessity of hearing, under specified conditions.
