1996-259 0 RESOLUTION NO. 96-- 25 OPPOSING ILLINOIS SENATE BILL 1463 WHICH PREEMPTS HOME RULE AUTHORITY OVER THE USE OF REAL ESTATE TRANSFER TAXES WHEREAS, the Village of Buffalo Grove is a Home Rule municipality pursuant to the Illinois Constitution of 1970; and WHEREAS, Illinois Senate Bill 1463 is a direct assault on the Village's Home Rule authority'and imposes an unfunded mandate; and WHEREAS, Senate Bill 1463 would: (1) mandate that a municipality must have public notices and public hearings prior to adopting or amending a transfer tax and prior to holding a related referendum; (2) mandate a specific format for public notices; (3) mandate that a municipality make the transfer tax proposal subject to inspection; (4) mandate a referendum; (5) mandate a specific format for the referendum; and (6) mandate the termination of the tax as a way to ensure compliance with municipal codes. WHEREAS,Senate Bill 1463 would severely restrict the Village's ability to amend or administrate its current real estate transfer tax, which the Village has successfully and responsibly levied since 1991; and WHEREAS, the most troublesome feature of Senate Bill 1463 is it causes additional burdens to local property taxes because this legislation compromises building safety and takes away local means to ensure code compliance and bill payment. THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS that our State Legislators are strongly urged to defeat S.B. 1463, a financial infliction upon local governments that additionally reneges on the State's promise to eliminate unfunded mandates and abate the usurpation of Home Rule authority.
