A RESOLUTION ACCEPTING THE INTERGOVERNMENTAL AGREEMENT
CONCERNING THE DUNDEE ROAD AND BUFFALO GROVE HIGH SCHOOL
DRIVEWAY TRAFFIC SIGNAL
WHEREAS, the Village of Buffalo Grove is a Home Rule Unit pursuant to the Illinois
Constitution of 1970; and,
WHEREAS, the President and Board of Trustees of the Village of Buffalo Grove desire to
cause the implementation of the Dundee Road and Buffalo Grove High School Driveway Traffic
Signal Improvement; and,
WHEREAS, the approval of a joint agreement with the Village of Arlington Heights and
the Township High School District No.214 is necessary in order to proceed with the project:
NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees of the
Village of Buffalo Grove, Cook and Lake Counties, Illinois as follows:
1. The agreement entitled, " Intergovernmental Agreement Between The Village of Arlington
Heights, The Village of Buffalo Grove And Township High School District No.214
Related To The Installation And Ongoing Operation And Maintenance Of A Traffic Signal
Located At The Intersection Of Dundee Road And The Buffalo Grove High School
Driveway" is hereby approved.
2. The Village President is authorized and directed to execute the agreement for the Village.
A copy of said agreement is attached hereto and made a part hereof.

OF A TRAFFIC SIGNAL LOCATED AT THE INTERSECTION OF
This Agreement, made and entered into, this

day of March ,
1996, by and between the Village of Arlington Heights, the Village of Buffalo Grove and
Township High School District No. 214.
WITNESSETH THAT:
WHEREAS, the 1970 Illinois Constitution (Art. VII, Sec. 10) and the Illinois Compiled
Statutes, 5 ILCS 220/1- 220/8, provide authority for intergovernmental cooperation; and,
WHEREAS, a large number of individuals utilize the existing pedestrian crossing to cross
Dundee Road near the point of intersection with the Buffalo Grove High School driveway; and,
WHEREAS, municipal and school district officials desire to improve safety for students
and other pedestrians utilizing the cross walk; and,
WHEREAS, a traffic signal with pedestrian indicators would improve traffic access to
the Buffalo Grove High School in addition to improving safety for pedestrians in this area; and,
WHEREAS, a qualified consulting engineering firm has completed a traffic signal
warrant investigation at the involved location and in a report dated October 4, 1995 reported its
conclusion that a traffic signal is warranted at this location; and,
WHEREAS, the Illinois Department of Transportation reported in a letter dated January
9, 1996 that they completed a review and determined traffic signals are warranted based on
existing pedestrian volumes crossing IL.68 (Dundee Road) at the Buffalo Grove High School
driveway; and,
WHEREAS, it is hereby acknowledged that the Village of Arlington Heights anticipates
that future development and redevelopment activities adjacent to Old Arlington Heights Road
will warrant an additional future traffic signal to be installed at the intersection of Dundee Road
and Old Arlington Heights Road;

NOW, THEREFORE, it is agreed as follows:
1. The Village of Buffalo Grove will perform or cause to occur or has caused to occur the
preliminary studies (including a traffic signal warrant study); the preparation of plans,
specifications and bidding documents and the construction of a traffic signal at the
intersection of Dundee Road and the Buffalo Grove High School driveway access, which
traffic signal shall include push button activated pedestrian indicator signals, emergency
vehicle preemption equipment, and other locally standard or necessary features.
2. The Illinois Department of Transportation shall own the completed traffic signal. The
owner of the completed traffic signal shall be responsible for performing, or contracting
for the performing of, all on going operation, maintenance, repair, and/or replacement of
,traffic signal, however, the expense relating to the operation, maintenance, repair and/or
replacement of such signal shall be borne by the parties to this agreement as specified in
items #4 and 5 below.
3. All costs for the preliminary studies including warrant studies, intersection design
studies, the preparation of plans, specifications and bidding documents, the construction
and construction engineering shall be shared equally by the Village of Buffalo Grove, the
Village of Arlington Heights and Township High School District No. 214. Upon
completion of the traffic signal warrant study the Village of Buffalo Grove will invoice
the other two parties to this agreement for their share of that cost. Upon receipt of bids
the Village of Buffalo Grove will invoice the other two parties of this agreement for 75%
of their share of all remaining projected expenses related to the initial installation of the
traffic signal. Upon final payment to the contractor for the completed project, the
Village of Buffalo Grove will invoice the other two parties to this agreement for their
remaining shares of the initial installation of the traffic signal. Any grants or payments
by other parties which may occur for a portion of the project shall equally reduce the
shares of the parties to this agreement.
4. The Village of Buffalo Grove shall utilize its credit of standard electric utility franchise
benefits for the ongoing electrical operating costs for the traffic signal.
5. Township High School District No. 214 shall bear all other expenses related to the
ongoing operation, maintenance, repair and/or replacement of the traffic signal except for

those that may be covered by electric utility franchise credits described in item no. 4
above. The Township High School District No. 214 shall make arrangement to pay the
Illinois Department of Transportation directly for the operating maintenance expenses for
which they are responsible provided that such arrangements are acceptable to the Illinois
Department of Transportation.
6. Contemporaneous with the execution hereof each party hereto shall furnish to the other
parties two certified copies of the Orders, Resolutions or Ordinances of the duly
constituted corporate authority of that party authorizing and directing the execution of
this agreement.
7. The Village of Buffalo Grove agrees to indemnify and hold harmless the Village of
.Arlington Heights and Township High School District 214 from any and all liability,
including costs of defense, caused by improper installation of the traffic signal.
8. The Village of Buffalo Grove agrees to support the Village of Arlington Heights' request
from the Illinois Department of Transportation for a traffic signal at Dundee Road and
Old Arlington Heights Road when this location meets traffic signal warrants established
by the Illinois Department of Transportation.
