NOW, THEREFORE BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, AS FOLLOWS: 1. APPROVED: iIMM IN �� ._ ✓ ✓. 6 Oh7193 RECORDER 6/1/95 LAKE COUNTY, ILLINOIS .Second Amendment to Landscape Cove nay PUG -8 FM 4' 34 This Second Amendment to Landscape Covenant is made by and between John Raef and Robin Raef, his wife, ( "Raef ") and Derek Younger and Vicki Younger, his wife ( "Younger ") (Raef and Younger are hereinafter sometimes collectively referred to as "Covenantor "), and the Village of Buffalo Grove, a municipal corporation in the State of Illinois ( "Covenantee "). The following recitations are by reference incorporated 'herein and made a part hereof: A. Central National Bank in Chicago, as Trustee under trust agreement dated March 24, 1977, and known as Trust No. 22361 ( "Trust 22361 ") and Covenantee heretofore executed a Landscape Covenant ( "Landscape Covenant ") dated May 16, 1979 and recorded by the Recorder of Deeds of Lake County, Illinois, on May 18, 1979 as Document No. 1995117 providing for certain landscape covenants upon the premises ( "Premises ") legally described as: I Lot 1, in Block 1 in Lexington Hills, a subdivision of part of the south half of Section 33, Township 43 North, Range 11, East of the Third Principal Meridian, in the Village of Buffalo Grove, Lake County, Illinois. PIN: 15 -33- 306 -017 B. Thereafter an "Amendment To Landscape Covenant" ( "First Amendment ") dated May 24, 1982 was executed and recorded by the Recorder of Deeds of Lake County, Illinois on May 24, 1982 as Document No. 26238626. C. That all of Lot 1 in Block 1 in Lexington Hills is now owned by Younger (the northerly portion) and Raef (the southerly portion). D. Covenantor and Covenantee desire to further amend the Landscape Covenant, as amended to allow for the construction of fences on Lot 1 in Block 1 in Lexington Hills. { NOW, THEREFORE, in consideration of the execution of this document and other valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the Landscape Covenant as amended is further amended as follows: 1. That notwithstanding anything to the contrary in the Landscape Covenant and the First Amendment; A. fences may be constructed on Lot 1 in Block 1 in Lexington Hills provided said fences comply with the ordinances of the Village of Buffalo Grove, and B. the existing landscape features (or their replacements) shall be maintained by the Owner(s) of said Lot 1 in a neat and orderly fashion.
