OPPOSING THE PREEMPTION OF HOME RULE AUTHORITY AS
RECOMMENDED UNDER PROPOSED ILLINOIS HOUSE BILL 568
WHEREAS, the Village of Buffalo Grove is a Home Rule Unit pursuant to the Illinois
Constitution of 1970; and
WHEREAS, the Illinois Legislature is presently deliberating the issue of firearms regulations,
an issue recently addressed by Village of Buffalo Grove officials; and
WHEREAS, on September 12, 1994, the Village passed Ordinance 94 -60 prohibiting the sale
of weapons within the corporate boundaries of the Village; and
WHEREAS, the Village thoroughly discussed the issue with the input of many Buffalo Grove
residents; and
WHEREAS, the end product of the Village's debate was a collaboratively drafted policy
statement about weapons reflecting the values and preferences of Buffalo Grove citizens; and
WHEREAS, House Bill 568 would preempt the Village of Buffalo Grove's home rule
authority to regulate firearms, wherein it states "A unit of local government, including a home rule
unit, may not regulate the acquisition, possession, transportation, storage, purchase, selling or
otherwise dealing in firearms, ammunition, components, accessories, or accouterments in any
manner.... and that all existing ordinances are null and void."
NOW, THEREFORE BE IT RESOLVED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE- OF BUFFALO GROVE, COOK AND LAKE COUNTIES,
ILLINOIS, as follows:
Section 1. - That the Village views House Bill 568 as a direct attack on the Village's
ability to retain local control on this issue and vigorously opposes the preemption of
its home rule authority, and
Section 2 - That Buffalo Grove's citizens are urged to immediately contact their
legislators and the Governor to engage their influence in the defeat of H.B. 568 prior
to passage because it yields our citizens' ability to determine their own destiny.
Section 3 - That if there is any easing of constitutional or legislative rules governing
the number of votes required to permit the preemption of home rule authority, the
Village of Buffalo Grove will perceive H.B. 568 as void and inapplicable and
immediately challenge said legislation at the appropriate judicial level.
Section 4 - This Resolution shall be in full force and effect from and after its passage
and approval.
