RESOLUTION NO. 94- 2
WHEREAS, the Village of Buffalo Grove (the Village) has certified with
the Federal Communications Commission (FCC) to regulate cable rates; and,
WHEREAS, the Village has agreed to follow FCC guidelines as
prescribed by that Agency in accordance with the Cable TV Competition and
Consumer Protection Act of 1992; and,
WHEREAS, that prescribed rate review process calls for the municipality
to provide the reasonable opportunity for the consideration of the views of
interested parties; and,
WHEREAS, the Village has resolved to carry forth and participate in the
rate regulatory process through the Continental Regional Cable Group (the
Group) ; and,
WHEREAS, FCC rules require the franchise authority to issue, within
30 days of the receipt of the rate justification submittal from the cable
operator, a written order containing the decision to approve or disapprove
the rates, or extend the review process; and,
WHEREAS, the Group has conducted, in accordance with FCC
requirements, a public hearing on the rate justification submittal received by
the Village from Continental Cablevision of Northern Cook County
(Continental) on December 29, 1993, and moved to extend the rate review
process.
NOW, THEREFORE, be it resolved by the President and Board of
Trustees of the Village of Buffalo Grove, Cook and Lake Counties, Illinois,
as follows:
1. That the Village of Buffalo Grove, in conformance with prescribed
FCC guidelines, hereby extends the review process of the rate
justification submittal received from Continental for a 150 day
period beginning from January 29, 1994 to June 28, 1994, within
which time the Group will determine whether to approve or
disapprove the reasonableness of the rates as contained therein.
