1993-36o � RESOLUTION NO. 93-36 A RESOLUTION APPROVING AN INTERGOVERNMENTAL AGREEMENT WITH THE COOK COUNTY HIGHWAY DEPARTMENT CONCERNING THE LAKE -COOK ROAD AND MILWAUKEE AVENUE GRADE SEPARATION IMPROVEMENT WHEREAS, the Village of Buffalo Grove supports the implementation of the Lake -Cook Road and Milwaukee Avenue grade separation improvement; and, WHEREAS, the Village of Buffalo Grove desires to have certain bikeway and emergency pre - emptor traffic signal equipment incorporated into the project; and, WHEREAS, the approval of an agreement with the Cook County Highway Department is necessary in order to proceed with the implementation of the improvement and the various desired bikeways and emergency vehicle pre - emption traffic signal items; NOW, THEREFORE, BE IT RESOLVED by the Village President and Board of Trustees of the Village of Buffalo Grove, Lake and Cook Counties, Illinois as follows: 1. The Letter of Agreement "RE: Lake -Cook Road Grade Separation At Milwaukee Avenue Section: 90- A5017 -03 -EG Letter of Agreement" is hereby approved. 2. The Village President is hereby authorized and directed to execute a copy of the approved Letter of Agreement. A copy of said agreement is attached hereto and made a part hereof. The Village agrees to an estimated cost of $100,617. for sidewalk improvements at the locations shown in Exhibit 1, plus reimburse- ment to the County for Opticom equipment based on contract bid prices estimated at $14,896 as listed in Exhibit 2 with the various locatid'n involved. During installation of these improvements, the Village shall have the, "right to insure that the work is being properly accomplished in accordance with the approved plans and specifications for same. The Village shall participate in the final inspection of the side- walks and Opticom Systems. After acceptance of the highway improvement by the County, the Village shall have full responsi- bility for maintenance of the sidewalks. The Village is to pay the installation cost for the sidewalks and Opticom Systems as determined from the highway improvement contract with respect to the quantities listed in Exhibits #1 and #2, in two installments. The first installment will be for one -half (50 %) of the total determined from summing the products of the quantities and their respective unit prices, and shall be due within thirty days Of a statement from the County for same following contract award, The * - ' second installment shall be for the remaining amount due and will tak,'account of any contract adjustments for the aforesaid quantities due to unforeseen conditions, and it will be due within thirty days Mr. Sidney Mathias Village of Bensenville Re Mt. Both pay - to the Treasurer for Cook County Fuel Tax Fund, and are to be sent of Highways, 118 North Clark Street, Upon completion.and acceptance of the Opticom Installation by Rep- resentatives of the Cook County Highway Department, the County will cause it to be maintained and energized and be responsible for all settings and timings. The Village of Buffalo Grove will: A. Pay County one hundred percent (100 %) of the maintenance charges for the Opticom System within thirty (30) days of County's quarterly (3 month) statement for same, and B. The Village of Buffalo Grove's payment to County for it's share of the maintenance charges shall be by check, payable to the Treasurer of Cook County and sent as above stated. To expedite this matter, it is suggested that you countersign your acceptance below and attach a copy of your Village Board's enabl- ing minutes authorizing your signature and the Board's willing- ness to accept the financial obligation set forth above on behalf of the Village of Buffalo Grove. This should be done on both the original and copy of this Letter of Agreement sent to you. Both copies should then be returned to this Department for processing through the Board of County Commi.ssioners,by adoption of a Re- solution of Agreement authorizing this Department to include the improvements in the contract and process the collection of the Village's financial contribution. That after acceptance of the highway impnovement by the County, the Village shall have the full responsibility for maintenance of the sidewalks; after the sidewalks and Opticom Systems are completed under the contract, the Village will pay the cost to the County in two (2) installments and further the County after acceptance of the Opticom installation will cause it to be maintained and energized, for which the Village will pay the County 100% of the maintenance charges as agreed; and the Department of Highways is directed to return one copy to said Village evidencing this decision and to abide by the terms thereof; all of which appears from the records and files of my .office.
