1993-30RESOLUTION NO. 93 -3_ A RESOLUTION APPROVING AN AGREEMENT WITH THE STATE OF ILLINOIS CONCERNING THE IMPROVEMENT OF ILLINOIS ROUTE 83 BETWEEN BUFFALO GROVE ROAD AND ARLINGTON HEIGHTS ROAD WHEREAS, the reduction of traffic congestion is essential to the improvement and maintenance of the quality of life in suburban regions; and, WHEREAS, the Illinois Department of Transportation has incorporated a number of features into its design of the currently proposed improvement of Illinois Route 83 between Buffalo Grove Road and Arlington Heights Road which had been suggested by the Village of Buffalo Grove which provide coordination with other transportation modes, such as pedestrian and bikeway facilities, and which provide mitigation of potentially negative impacts of the proposed highway improvement; and, WHEREAS, the corporate authorities of the Village of Buffalo Grove support the currently proposed improvement of Illinois Route 83 between Buffalo Grove Road and Arlington Heights Road; and, WHEREAS, an intergovernmental agreement between the Illinois Department of Transportation and the Village of Buffalo Grove is necessary in order to implement the project as currently proposed; NOW, THEREFORE, BE IT RESOLVED by the Village President and Board of Trustees of the Village of Buffalo Grove, Cook and Lake Counties, Illinois as follows: 1. The agreement between the Village of Buffalo Grove and the State of Illinois concerning the improvement of Illinois Route 83 between Buffalo Grove Road and Arlington Heights Road is hereby approved. v I ' - 2. WI THE SSETH: WHEREAS, the STATE, in order to facilitate the free flow of traffic and ensure safety to the motoring public, is desirous of improving approximately 7,397 lineal feet of Illinois Route 83, (FA Route 344, State Section:44(B &R)89, Village Section 93- 00061 -00 -PV ) by making the following improvements: A. Illinois Route 83 - Arlington Heights Road to Buffalo Grove Road Roadway reconstruction of Illinois Route 83 to provide two 12' through traffic lanes in each direction separated by a 18' landscaped median. Southbound Illinois Route 83 will be provided with one 12' left turn lane at Ranchview Court, Devlin Road, Busch Road /Checker Drive, the Buffalo Grove Park District entrance approximately 1,000 l.f. south of Busch Road /Checker Drive and the Buffalo Grove Park District entrance approximately 1,500 1.f. north of Buffalo Grove Road. Northbound Illinois Route 83 will be provided with a 12' left turn lane at Busch Road /Checker Drive. The traffic signals at Illinois Route 83 at Busch Road /Checker Drive will be modernized complete with "Opticom ". A new 5' sidewalk will be constructed along the east side of Illinois Route 83 from east of Ranchview Court to west of Buffalo Grove Road. A new 8' bicycle path will be constructed along the west side of Illinois Route 83 throughout the length of the improvement. Curb and gutter and a closed storm sewer system will be included throughout. B. Busch Road /Checker Drive - from approximately 200 1 J. west of Illinois Route 83 to approximately 1270 1 J. east of Illinois Route 83 Pavement reconstruction from approximately 260 1J. west of Illinois Route 83 to Illinois Route 83 to provide Checker Drive with one 12' and variable width through traffic lane in each direction separated by a 4' median. Eastbound Checker Drive will be provided one 12' left turn lane. From Illinois Route 83 to approximately 772 l.f. east of Illinois Route 83, Busch Road will be reconstructed. Eastbound Busch Road will be provided with two 12' through traffic lanes and a 12' left turn lane at Brandywyn Drive. Westbound Busch Road will be provided with two 12' through traffic lanes except at Illinois Route 83 where it will be provided with one 12' through traffic, one 12' left turn lane and one 12' right turn lane. Westbound Busch Road will also be provided with a 12' right turn lane at Brandywyn Drive. A 6' and variable width median will be installed. From approximately 772 l.f. east of Illinois Route 83 to approximately 1270 l.f. east of Illinois Route 83, Busch Road will be provided with two 12' through traffic lanes in each direction tapering to one 12' through traffic lane in each direction at its eastern termini, separated by thermoplastic pavement marking. An 8' Bikepath will be included along the southside of Busch Road from Illinois Route 83 to Buffalo Grove Road. Roadway drainage will be included throughout as well as all other work required to complete the improvement in accordance with its approved plans and specifications; :and WHEREAS, the VILLAGE is desirous of said improvement in that same will be of immediate benefit to the VILLAGE residents and permanent in nature; NOW, THEREFORE, in consideration of the mutual covenants contained herein, the parties hereto agree as follows: 1. The STATE agrees to make the surveys, obtain all necessary rights of way, prepare plans and specifications, receive bids and award the contract, furnish engineering inspection during construction and cause the improvement to be built in accordance with the plans, saecifications and contract. -2- 2. The STATE agrees to pay all right -of -way, construction and engineering costs, subject to reimbursement by the VILLAGE as hereinafter stipulated, and except as may be provided in other Agreements between the STATE and third parties. 3. It is mutually agreed by and between the parties hereto that the estimated cost of the improvement and cost proration is as shown on Page 3A. 4. The VILLAGE has passed a resolution appropriating sufficient funds to pay its share of the cost of this improvement, a copy of which is attached hereto as Exhibit A and made a part hereof. Upon award of the contract for this improvement, the VILLAGE will pay to the Department of Transportation of the State of Illinois in a lump sum, from any funds allotted to the VILLAGE, an amount equal to 95a of its obligation incurred under this Agreement subsequent to the Village's Play 1 , 1994 budget, and will pay to said Department the remainder of its obligation (including any nonparticipating costs for FA projects) in a lump sum upon completion of the project, based upon final costs. The VILLAGE agrees to pass a supplemental resolution to provide necessary funds for its share of the cost of this improvement if the amount appropriated 'herein proves to be insufficient to cover said cost. 5. VILLAGE has adopted and will put into effect, prior to the STATE advertising for the work to be performed hereunder, an appropriate ordinance prohibiting the discharge of sanitary sewage and industrial waste water into any storm sewers or drainage facilities constructed as part of this improvement, a copy of which is attached hereto as Exhibit C and made a part hereof. 7. Prior to the STATE advertising for the work to be performed hereunder, the disposition of encroachments will be cooperatively determined by representat -ves from the VILLAGE and the STATE. The VILLAGE has adopted and will put into effect, prior to the STATE advertising for the work to be performed hereunder, an appropriate ordinance relative to the disposition of encroachments and prohibiting in the future any new encroachments within the limits of the improvement, a copy of which is attached as Exhibit D and made a part hereof. 8. The VILLAGE agrees to adopt a resolution or send a letter, prior to the STATE advertising for the work to be performed hereunder, approving the plans and specifications as prepared. 9. The VILLAGE agrees not to permit driveway entrance openings to be made in the curb as constructed, without the consent of the STATE. 10. The STATE shall cause private utilities to be relocated at no expense to the STATE or VILLAGE. Where a municipal utility has been installed 1. on right of way acquired by the STATE or 2. within defined limits of a route the STATE has accepted for maintenance responsibilities, subsequent to the date of such acceptance the municipality will bear all utility relocation or adjustment costs made necessary by the construction of this improvement. Utility adjustments required solely for the bike path and sidewalks will be the responsibility of the VILLAGE or other third party's paying for those associated costs of the requested grading. -4- 11. Upon completion of the improvement and final field inspection by the STATE and so long as Illinois Route 83 is used as a STATE highway, the STATE agrees to maintain, or cause to be maintained, the median, the through traffic lanes, the left turn and right turn lanes, and the curb and gutter or stabilized shoulders and ditches adjacent to those lanes. The STATE will be responsible for the maintenance of lane line and median line markings. 12. Upon acceptance by the State of the traffic signal modernization work included herein the responsibility for maintenance and energy shall continue as outlined above in the Master Agreement executed by the State and the VILLAGE on February 9, 1982. -5- 14. The STATE's Electrical Maintenance Contractor shall maintain the Fire pre - emption equipment located at the traffic signal installation to be maintained by the STATE. The STATE's Electrical Maintenance Contractor shall invoice the VILLAGE for the maintenance costs related to the maintenance of the Fire Pre - emption equipment. The VILLAGE shall maintain the emitters and associated appurtenances at its own expense. The emitters shall be maintained and tested by the VILLAGE in accordance with the recommendations of the manufacturer. The financial responsibility for the maintenance of the pre - emption system shall be borne entirely by the VILLAGE. 15. It is mutually agreed that the STATE's Electrical Maintenance Contractor will send to the VILLAGE an itemized invoice every three months covering the actual cost for the maintenance of the Fire pre - emption equipment during the preceding period. Upon receipt of said invoice, the VILLAGE agrees to pay to the STATE's Electrical Maintenance Contractor the amount of the invoice by certified check. THIS AGREEMENT and the covenants contained herein shall become null and void in the event the contract covering the construction work contemplated herein is not awarded within 3 years subsequent to execution of this Agreement. A. Prohibited Disposal. It _s fir any person to place, deposit or permit to be deposited in any unsanitary manner on public or private property within the villaae or in any area under the jurisdiction of said village, any human or animal excrement, garbage or other objectionable waste. B. Unlawful Discharge. It is unlawful to discharge to any natural outlet within the village, or in any area under the jurisdiction of said village, any sewage or other polluted waters, except where suitable treatment has been provided in accordance with Section 13.04.310. C. Septic Tanks Prohibited. Except as hereinafter provided in Section 13.04.310, it is unlawful to construct or maintain any privy, privy vault, septic tank, cesspool, or other facility intended or used for the disposal of sewage. D. Who Must Connect to Public Sewer. The owner of all houses, buildings or properties used for human occupancy, employment, recreation, or other purposes situ- ated within 229 (Buffalo Grove 5/92) 13.04:.300 the village and abuttina on any street, alley or right -of- way in which there is now located or may in the future be located any public sanitary sewer of the village, is re- quired at his expense to install suitable toilet facilities therein, and to connect such facilities directly with the 229 -1 (Buffalo Grove 6/87) 13.04.310 proper public sanitary sewer in accordance with the provi- sions of this title, within ninety days after date of offi- cial notice to do so, provided that said public sewer is within four hundred feet of the property line. (Ord. 84 -53 91 (part) , 1984) . 13.04.310 Private sewage disposal. A. Conditions. Where a public sanitary sewer is not available under the provisions of Section 13.04.300, the sanitary building sewer shall be connected to a private sewage disposal system com- plying with the provisions of Section 13.04.310. B. Permit Required. Before commencement of construc- tion of a private sewage disposal system the owner shall first obtain a written permit signed by the village engineer. The application for such permit shall be made on a form fur- nished by the village, which the applicant shall supplement by any plans, specifications and other information as are deemed necessary by the village engineer. A permit and in- spection fee of twenty -five dollars shall be paid to the village at the time the application is filed. C. Inspection Required. A permit for a private sewage disposal system shall not become effective until the in- stallation is completed to the satisfaction of the village engineer. He shall be allowed to inspect the work at any stage of construction and, in any event, the applicant for the permit shall notify the engineer when the work is ready for final inspection, and before any underground porticns are covered. The inspection shall be made within seventy - two hours of the receipt of written notice by the village engineer. D. Code Requirements. The type, capacities, location and layout of a private sewage disposal system shall comply with all recoT^endations or the State of Illinois Private Se'.,a7e :_ "saw Licers -L. :ct ate.,.
