1991-700 RESOLUTION NO. 91 -70 u A RESOLUTION AUTHORIZING THE EXECUTION OF THE MAJOR CRIMES TASK FORCE, LAKE COUNTY ILLINOIS AGREEMENT WHEREAS, the President and Board of Trustees of the Village of Buffalo Grove desire to enter into an agreement for providing mutual police assistance in the form of the Agreement attached hereto as Exhibit "A ", and WHEREAS, the Village of Buffalo Grove is authorized to enter into said agreement pursuant to Article VII, Section 10 of the Constitution of Illinois, 1970, Ch. 127, Sections 741 through 748, Illinois Revised Statutes, and Ch. 24, Section 1 -4 -6 and 11- 1 -2.1, Illinois Revised Statues 1989, NOW THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS that the Village President and Village Clerk be and the same are hereby authorized to execute and the Chief of Police is hereby authorized to sign the Major Crimes Task Force Lake County Illinois Intergovernment Agreement, a copy of which is attached hereto as Exhibit "A ". AYES: 5 - Reid, Kahn, Rubin, Braiman, Hendricks NAYES: 0 - None ABSENT: 1 - Marienthal PASSED: September 3, 1991 APPROVED: September 3, 1991 ATTEST: C3+V IFS- 1���1'V Vil ge Clerk 0 0 MAJOR CRIMES TASK FORCE LAKE COUNTY, ILLINOIS INTERGOVERNMENTAL AGREEMENT It is hereby agreed by undersigned member departments of the Lake County Major Crimes Task Force, (hereinafter called "Member Departments "), including the Lake County Sheriffs Police Department, the Illinois State Police, the Lake County State's Attorney, and the participating municipal police departments of Lake County, as follows: 1. The Lake County Major Crimes Task Force (Task Force) shall consist of the Lake County Sheriffs Police Department, the Illinois State Police, the State's Attorney's Office, and the other Member Departments who have signed this intergovernmental agreement. 2. The purpose of the Lake County Major Crimes Task Force is to provide comprehensive investigations to Member Departments of the Task Force of major Murder cases, police - involved shootings, non - parental kidnappings, and other exceptionally heinous offenses when requested to do so by the Chief of Police of member departments. 3. The Task Force agrees to provide comprehensive investigative services to member departments in accepted cases upon request of the Chief of Police of the Police Department of the local jurisdiction wherein the crime occurred. The Member Departments agree that the Chief of Police shall contact the Task Force Commander at the onset of the investigation of the above- listed offenses. The Task Force Commander shall determine if the case shall be accepted for investigation by the Task Force. 0 0 4. The Lake County Sheriffs Police Department agrees to pay for all investigative expenses incurred by officers of the Lake County Sheriffs Police during the course of Task Force investigations. The Lake County Sheriffs Police Department further agrees to provide support services to the Task Force. 5. The Illinois State Police agree to pay for all investigative expenses incurred by officers of the Illinois State Police during the course of Task Force investigations. The Illinois State Police further agrees to provide support services to the Task Force. 6. The Member Departments agree that the investigation of crimes within the Member Department's jurisdiction that have been accepted by the Task Force Commander shall be conducted according to the procedures of the Lake County Major Crimes Task Force. 7. The Member Departments agree to pay for costs of investigations of crimes . occurring within the Member Departments jurisdiction incurred by members of the Task Force when the Chief of Police of the Member Department has requested that investigation. These costs shall be subject to the following limitations: a) The Member Department shall not pay for expenses incurred by Lake County Sheriffs Police officers, including but not limited to salaries, wages, benefits, travel expenses of any kind, equipment, or other expenses. b) The Member Department shall not pay for expenses incurred by Illinois State Police officers, including but not limited to salaries, wages, benefits, travel expenses of any kind, equipment, or other expenses. c) The Member Department shall not pay for salaries, wages, or benefits of officers from other member departments, nor shall the Member 0 0 Department pay for ordinary travel expenses of such officers to and from the Member Department's jurisdiction. d) The Member Department shall pay for extraordinary travel and investigative expenses of officers of other member departments except for Lake County Sheriffs Police and the Illinois State Police, up to a maximum of $5,000.00, if those expenses have been determined to be necessary to the investigation by the Task Force Commander. 8. A police officer or investigator of any Member Department may request to be assigned to the Task Force with the permission of the Chief of Police of his or her Member Department. The selection of officers for the Task Force shall be determined by the Personnel Subcommittee of the Board of Directors of the Task Force. The Member Departments agree that the Member Department shall make any officers of the Member Department so selected for the Task Force available for investigations and training as needed by the Task Force. 9. It is agreed that each officer participating as a member of the Task Force shall be bound by the policies and procedures of his or her own Member Department in addition to any policies and procedures of the Task Force. 10. Each Member Department agrees to assume liability for its respective personnel assigned to the Task Force, as well as for vehicles and equipment assigned to the Task Force. Each participating Member Department assumes responsibility for members of its police force acting pursuant to this agreement, both as to indemnification of said police officers as provided for by Illinois Revised Statutes, Chapter 24, Section 14-6, and as to personal benefits to said police officers, all to o 0 the same extent as they are protected, insured, indemnified and otherwise provided for by the Statutes of the State of Illinois and the ordinances of the participating municipalities when acting solely within their own corporate limits. 11. It is agreed between the Member Departments of the Task Force that the Task Force shall be governed by a nine person Board of Directors. The Board of Directors shall include one person named by the Lake County Sheriff, one person named by the Lake County State's Attorney, one person named by the Director of the Illinois State Police, and six persons to be elected by the agency heads of the Member Departments of I the Task Force. The powers, duties, and responsibilities of that Board of Directors shall be determined by a vote of the Member Departments. The Board of Directors may determine further by -laws for governing the Task Force which shall not be inconsistent with this agreement. 12. This agreement shall be in full force and effect between all police departments and agencies who sign a copy of this agreement once that agreement is sent to the Lake County Sheriffs Police department. A Member Department may withdraw from this agreement at any time by written request by the Chief of Police of the Member Department to the Task Force Commander.
