1991-55• • RESOLUTION NO. 91- 55 A RESOLUTION CONCERNING CURRENT AND PROSPECTIVE LITIGATION BETWEEN THE VILLAGE OF BUFFALO GROVE AND THE VILLAGE OF LONG GROVE WHEREAS, The Village of Buffalo Grove has a lawsuit against the Village of Long Grove, known as 88 MR 674, People ex rel. Buffalo Grove v. Long Grove, 145 Illinois DEC 873, 557 NE 2nd 643 (Ill. App. 2 Eist. 1990) , and WHEREAS, The Village of Buffalo Grove is considering an appeal of a recent decision at the Circuit Court concerning a remedy of securing sanctions granted by the Illinois Appellate Court in its decision, and WHEREAS, The Village of Buffalo Grove is interested in fostering good relations with the Village of Long Grove, and wishes to broaden and expand its relations with Long Grove into the future. NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS that: 1. With regard to Case 88 MR 674 People ex rel. Buffalo Grove v. Long Grove, the Village of Buffalo Grove will not file an appeal to secure its remedies for sanctions awarded by the Illinois Appellate Court in the above mentioned decision in the interest of fostering improved relations with the Village of Buffalo Grove and the Village of Long Grove, and 2. The Village of Buffalo Grove pledges in the future not to initiate litigation until it has conducted one meeting between the Village President of Buffalo Grove and the Village President of Long Grove on the matter subject to litigation, before filing such litigation, subject to the Village of Long Grove passing a similar resolution pledging its intent to avoid further litigation with the Village of Buffalo Grove without first conferring with Buffalo Grove. 3. Paragraph 2 is not intended to inhibit the Village of Buffalo Grove or the Village of Long Grove from exercising their legal options if, after reasonable attempts, meetings are unable to be scheduled between the respective Village Presidents. Such reasonable time frame being 7 consecutive calendar days.
