1990-420 0 RESOLUTION NO. 90 -42 A RESOLUTION AUTHORIZING THE VILLAGE OF BUFFALO GROVE TO ENTER INTO AN AUTOMATIC FIRE MUTUAL AID AGREEMENT WITH THE VILLAGE OF WHEELING WHEREAS, the Illinois Revised Statutes, Chapter 14, Section 11 -6 -1, empowers municipalities and fire protection districts to enter into "Mutual Aid Agreements "; and WHEREAS, the Village of Buffalo Grove and the Village of Wheeling are members of a Mutual Aid Box Alarm System, pursuant to an agreement since 1973, renewed in 1989; and WHEREAS, each community desires to supplement said agreement to provide automatic fire mutual aid to specific areas within both communities, as outlined on the attached agreement; and WHEREAS, said agreement is a direct benefit to the Village of Buffalo Grove and its residents by improving upon the Village's fire service capabilities. NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees of the Village of Buffalo Grove, Counties of Cook and Lake, state of Illinois, that said agreement is beneficial to the Village of Buffalo Grove. BE IT FURTHER RESOLVED, that the Village President and Fire Chief are hereby authorized to enter into said agreement. CLAY N, Village esident Villa Clerk �� 1,. 0 0 AUTOMATIC FIRE MUTUAL AID AGREEMENT BETWEEN THE VILLAGE OF BUFFALO GROVE, ILLINOIS AND THE VILLAGE OF WHEELING, ILLINOIS In accordance with Chapter 24, Section 11- 6 -1.of the Illinois Revised Statutes, which empowers Municipalities and Fire Protection Districts to enter into "Mutual Aid Agreements ' , and in accordance with the MABAS agreement entered into by the Village of Buffalo Grove and the Village of Wheeling in 1973, renewed in 1989, the Village of Buffalo Grove and the Village of- Wheeling agree to provide automatic aid to each other on structural fire alarms as follows: GENERAL CONDITIONS 1. Equipment responding on an automatic response to the other community shall have a minimum of three (3) fire department personnel. 2. Only one (1) unit from the fire department providing aid shall be required to respond at any one time. In the event that the unit due is unavailable (ex. out of service, committed to another call), no back -up unit from another station shall be required to respond. 3. At all times, the municipality within which the emergency exists will be in charge and responsible for the operations at the emergency scene. If an automatic aid unit is first on the scene, the company officer shall exercise his /her discretion as to the appropriate action to be taken. Upon the arrival of a company officer from the community having jurisdiction, command of the emergency scene shall be transferred in' a smooth and efficient manner to the fire department whose municipality in which the emergency exists. 4. Each municipality shall be responsible for providing a communications system which allows the immediate dispatching of all units due to respond from the assisting municipality, as well as apparatus to apparatus communications; while enroute and while on the scene. 5. Each municipality agrees to provide and participate in quarterly training between the two (2) departments. 6. Each municipality agrees that the general provisions of the " MABAS MUTUAL AID AGREEMENT" apply to this agreement, except as modified by this agreement. 0 0 �. T. Each municipality agrees to waive all claims against the other party for compensation for any loss, damage, personal injury or death occurring as a result of performance in conjunction with this agreement. General liability insurance, personal injury insurance, and property /vehicle insurance shall be the responsibility of each individual municipality. RESPONSE AREA I. The Village of Buffalo Grove agrees to provide the Village of Wheeling; subject to the provisions of paragraph two (2) of the general conditions of this agreement: A. One (1) engine company to the following area: 1. Arlington Club Subdivision B. One (1) truck company to the following area(s): 1. Fairway View Apartments 2. Pine Hill Apartments 3. Cedar Run Condominiums 4. Lexington Condominiums 5. Addolorata Villa Nursing Home II. The Village of Wheeling agrees to provide the Village of Buffalo Grove; subject to the provisions of paragraph two (2) of the general conditions of this agreement: A. One (1) truck company to the following area(s): 1. The entire area bounded by Lake Cook Road (south), Inverary (north), Wisconsin Central railroad tracks (west), and Milwaukee Avenue (east). 2. The Riverwalk Complex at the corner of Lake Cook Road and Milwaukee Avenue. 3. Cambridge On The Lake on Dundee Road (on a special request only). Minor modifications to the above response area(s), as well as the vehicles assigned, may be made without further modification to this agreement. However, said modifications must be mutually agreed upon, in writing, by the two (2) respective fire departments. 0 TERMINATION OF AGREEMENT Either the Village of Buffalo Grove or the Village of Wheeling may terminate this agreement by notifying the Fire Chief of the other community, in writing, sixty (60) days from the date of written notice. F TERM OF AGREEMENT This agreement shall be effective as of the 10th day of September , 1990 and shall continue in full force until terminated by either party.
