A RESOLUTION APPROVING AN AGREEMENT WITH THE UNITED STATES POSTAL SERVICE
CONCERNING THE DESIGN OF THE BUFFALO GROVE POST OFFICE
WHEREAS, the Buffalo Grove Village President and Board of Trustees
desire to implement the timely construction of a Post Office facility in the
area of Buffalo Grove Road and Checker Road; and,
WHEREAS, an agreement between the Village of Buffalo Grove and the
United Postal Service concerning the design phase of the project is desired
by the Village President and Board of Trustees in order to clarify financial
responsibility concerning this study;
NOW, THEREFORE, BE IT RESOLVED by the Village President and Board
of Trustees of the Village of Buffalo Grove, Lake and Cook Counties, Illinois
as follows:
1. The attached agreement with the United States Postal Service entitled
"United States Postal Service Design Agreement with the Village of
Buffalo Grove" is hereby approved. A copy of said agreement is attached
hereto and made a part hereof.
2. The Village President and Village Clerk are authorized and directed to
execute the agreement for the Village.

DESIGN AGREEMENT WITH THE VILLAGE OF BUFFALO GROVE
This Agreement is made and entered into by and between, THE
VILLAGE OF BUFFALO GROVE, an Illinois Municipal Corporation,
hereinafter called the "Village ", whose address is 50 Raupp
Boulevard, Buffalo Grove, Illinois, 60089, and the UNITED STATES
POSTAL SERVICE, hereinafter called the "Postal Service ", whose
address is 222 South Riverside Plaza, Suite 1200, Chicago,
Illinois, 60606 -6150.
WITNESSETH: The parties hereto for the consideration
hereinafter mentioned, covenant and agree as follows:
1. The Village will cause to be designed a postal service
facility (hereinafter called "facility ") to be located on the
following legally described real property:
PARCEL 5: Commencing at the North West corner of the South
West 1/4 of Section 33, Township 43 North, Range 11, East of
the Third Principal Meridian; thence North 89 degrees 58
minutes 47 seconds East along the North line of the South
West 1/4 of said Section 33, a distance of 193.09 feet to
the Easterly line of Buffalo Grove Road per Document No.
1408038; thence South 6 degrees. 30 minutes 17 seconds East
along said Easterly line a distance of 953.75 feet to the
point of beginning; thence continuing South 6 degrees 30
minutes 17 seconds East along said Easterly line a distance
of 408.13 feet to the North West corner of Lot 3 in Buffalo
Grove Town Center Unit One; thence North 89 degrees 48
minutes 39 seconds East along the North line of said Lot 3 a
distance of 376.32 feet; thence Northeasterly along the
Northerly line of said Lot 3, said line being a curve,
concave to the North West, having a radius of 160.00 feet,
an arc distance of 40.76 feet to a point of compound
curvature, the chord of said arc having a length of 40.6.5
feet and a bearing of North 48 degrees 06 minutes 06 seconds
East; thence continuing Northeasterly along the Northerly
line of said Lot 3, said line being a curve, concave to the
North West, having a radius of 375.00, an arc distance of
105.00 feet, the chord of said arc having a length of 104.6.6
feet, and a bearing of North 32 degrees 46 minutes 57
seconds East; thence North 24 degrees 45 minutes 40 seconds
East along the Northerly line of said. Lot 3 a distance of
82.00 feet to a point of tangency; thence Northeasterly.

Buffalo Grove Town Center Unit One, a distance of 263.18
feet thence South 89 degrees 05 minutes 14 seconds West a
distance of 340.37 feet; thence South 00 degrees 54 minutes
46 seconds East a distance of 74.04 feet; thence South 89
degrees 05 minutes 14 seconds West a distance of 208.98 feet
to the Easterly line of Buffalo Grove Road, said point being
the point of beginning, in Lake County, Illinois.
2. The Village may employ or cause to be employed the
services of necessary design professionals, including but not
limited to a construction manager, architect, engineer and
planner, to prepare, for the approval of the Postal Service,
complete specifications and working drawings including architec-
tural, structural, mechanical, electrical and site improvement
work and other necessary design and related work for the
construction of the facility.

3. The Postal Service agrees to appoint an individual to
receive and transmit all communications concerning the work
described above. The Postal Service agrees to cooperate with the
Village and provide necessary direction to the Village in a
timely manner.
4. Except as set forth in paragraph 5 hereof, the Village
shall initially be responsible for the payment of all fees or

changes required for the services set forth in paragraph 2
hereof. It is understood and agreed that said fees and charges
shall be included in a future lease agreement.
5. If, through no fault of the Village, the Postal Service
does not execute a lease with the Village for the facility at
the hereinbefore described location by December 31, 1990, the
Postal Service shall reimburse the Village for all fees and
charges incurred by the Village in furtherance of this Agreement
but not to exceed $180,000. Said reimbursement to the Village
shall occur within 30 days of written notice to the Postal
Service. If, through no fault of the Postal Service, the
Village fails to execute the lease with the Postal Service for
the facility of the hereinbefore described location, the Village
shall be responsible for all fees and charges incurred by it in
furtherance of this Agreement and the Postal Service will be
under no obligation to reimburse said expenses to the Village.
