A RESOLUTION APPROVING AN AMENDMENT TO THE AGREEMENT FOR ENGINEERING SERVICES
FOR THE EXPANSION AND MODIFICATION OF RESERVOIR AND PUMP HOUSE NO.7
WHEREAS, in order to implement the expansion, modification of
Reservoir and Pump House No. 7, the Village President and Board of Trustees
previously approved an agreement for necessary engineering services through
the adoption of Resolution No. 89 -26 on May 1, 1989; and,
WHEREAS, preliminary engineering studies have demonstrated the need
to amend the details of the proposed project; and,
WHEREAS, the currently proposed project necessitates an amendment
to the Engineering Service Agreement so as to properly accommodate the
current scope of the project;
NOW, THEREFORE, BE IT RESOLVED by the Village President and Board
of Trustees of the Village of Buffalo Grove,'Cook and Lake Counties as
follows:
1. The Letter Agreement amending the original Engineering Service
Agreement for the Reservoir No. 7 Expansion Modification project
dated June 28, 1990 from Strand Associates, Inc. is hereby approved.
2. The Village President and Village Clerk are authorized and directed
to execute the approved Letter Agreement, a copy of said agreement
is attached hereto and made a part hereof.

has now been fully executed and initialed by the Consultant as instructed by
Bill Raysa.

Amendment No. I
This is Amendment No. 1 to the May 1, 1989 agreement for engineering services
between Strand Associates, Inc., hereinafter referred to as the ENGINEER, and
the Village of Buffalo Grove, hereinafter referred to as the OWNER, in
connection with Reservoir No. 7 expansion and modification, hereinafter
referred to as the PROJECT. This Amendment describes additional services to
be provided by the ENGINEER and an increase to the total fee to be.paid to
the ENGINEER by the OWNER for completion of the services described.
SCOPE
THE PRELIMINARY OVERVIEW EVALUATION and EXISTING SYSTEM EVALUATION AND DESIGN
REPORT described in the original contract are being completed. The remaining
engineering services to be provided shall consist of Reservoir No. 7
expansion and modification design, drawings, specifications, bidding
assistance, general observation of construction, construction administration
and resident engineering services.
DETAILED PLANS, SPECIFICATIONS, COST ESTIMATES, CONTRACT AND BIDDING
DOCUMENTS, DESIGN DOCUMENTATION
Delete the four (4) paragraphs describing the work on page 3 of the original
contract and replace them with the following.
Services included are for a new 1.5 million gallon rectangular reinforced
concrete above grade reservoir, piping and valves to connect the new
reservoir to existing reservoir and reservoir fill line, design of four new
vertical turbine booster pumps with associated piping and valves,
modification of booster station discharge piping and flow meters, replacement
of the fill line flow meter, electrical and motor control modifications,

addition of a 1;:000 KW diesel generator for emergency power supply in an
enclosure provided by the generator vendor and repairs to the existing
reservoir.
Services include surveys for final, design (not including property or land
line surveys), preliminary plans or preliminary prints of final plans and
meeting with the OWNER to review these plans, preparation of construction
plans and specifications, b4dding and contract documents, furnishing twenty
sets of plans and specifications, and obtaining approval of Governmental
agencies. All documents, including original drawings, estimates,
specifications, field notes and data, are and remain the property of the
OWNER, but may be maintained by the ENGINEER until requested by the OWNER.
The OWNER will receive a set of reproducible record prints of drawings and
copies of other documents, in consideration of which the OWNER will use them
solely in connection with the PROJECT.
Except for the original design and resident engineering services described in
this contract, the OWNER agrees to indemnify, defend and hold Strand
Associates harmless from any claims and against any claims for damages, cost
of defense, or other expenses levied against Strand Associates, including its
employees, agents, directors, officers, contractors and subcontractors
arising out of any future use of these documents not directly authorized in
writing by the President of Strand Associates.
The estimated fee for the DETAILED PLANS, SPECIFICATIONS, COST ESTIMATES,
CONTRACT AND BIDDING DOCUMENTS, DESIGN DOCUMENTATION IS $220,000.
ASSISTANCE AND GENERAL ADMINISTRATION OF THE BIDDING PROCESS WITH A TYPED BID
TABULATION AND FORMAL RECOMMENDATION FOR THE AWARD OF THE CONSTRUCTION
CONTRACT
Delete the paragraph contained under this heading on page 3 of the original
contract and replace it with the following.
For the services as described above, the estimated fee is $4,000.
CONSTRUCTION ENGINEERING SERVICES
Delete the first six (6) paragraphs on page No. 4 in the original contract,
and replace them with the following.
Services shall include consultation and advice during construction, reviewing
contractor's shop drawings, reviewing contractor's periodic estimates and
final estimates for payment, reviewing waivers of lien, furnishing
reproducible record plans from information furnished by the CONTRACTOR,
making periodic observation visits to the job site during construction to
maintain overall review of the project, and prepare final punch lists.

In addition, ENGINEER shall provide resident engineering services.
At this time it is anticipated that construction will take 18 months. This
contract assumes that the ENGINEER will provide 2,925 hours of resident
engineering services during the construction period.
The estimated CONSTRUCTION ENGINEERING SERVICES fee is $187,000.
In furnishing resident engineering services, the ENGINEER's efforts shall be
directed toward ascertaining for the OWNER that the completed PROJECT will
conform to the Contract Documents, but the ENGINEER shall not be responsible
for the Contractor's construction means, methods, techniques, sequences or
procedures, or for the safety precautions or programs, or for the
Contractor(s)' failure to perform the construction work in accordance with
the Contract Documents.
Delay in completion of the work on the part of any contractor will be
considered justification for adjustment of the fee.
HOURLY RATES
The hourly rates which shall apply for all services described herein are
based on a maximum of 2.83 times salary cost and are generally revised on
July 1 of each year. Estimated fees for scope items are based upon OWNER
giving ENGINE €R notice to proceed no later than July 20, 1990.
The following schedule is anticipated at this time:
Design:
August 1990 through January 1991
Bidding, Approvals, Contracts: February 1991 through April 1991
Construction:
May 1991 through November 1992

TOTAL UPSET FEE(S)
The total upset limit of the fee for the work described in this Amendment
(excluding the Preliminary Overview Evaluation and Existing System Evaluation
and Design Report) is $411,000. The total upset limit of the fee for the
Preliminary Overview Evaluation and Existing System Evaluation and Design
Report is $90,900 in accordance with previous authorization(s) by the OWNER.
All other provisions of the May 1, 1989 Agreement shall remain in effect.
IN WITNESS WHEREOF, the parties hereto have made and executed this AMENDMENT
TO AGREEMENT.
