2008-10-06 - Resolution 2008-32 - APPROVING DISPOSAL OF CERTAIN AUDIO TAPE RECORDINGS OF OPEN MEETINGS10/28/2008 0 RESOLUTION NO. 2008- 32 0 A RESOLUTION APPROVING DISPOSAL OF CERTAIN AUDIO TAPE RECORDINGS OF OPEN MEETINGS WHEREAS, the Village of Buffalo Grove is an Illinois municipal corporation and home rule unit pursuant to the Illinois Constitution of 1970; and WHEREAS, the Village Clerk of the Village of Buffalo Grove makes an audio cassette tape recording of the Village Board open meetings; and WHEREAS, said audio recordings are public records as defined by the Illinois Open Meetings Act (5 ILCS 120/1 et seq.); and WHEREAS, the purpose of Illinois Local Records Act (50 ILCS 205/1 et seq.) is to provide "for the efficient and economical management of local records "; and WHEREAS, the Illinois Local Records Act provides the no public record shall be disposed of by any officer or agency unless the written approval of the Local Records Commission is first obtained; and WHEREAS, concerning the Village's audio cassette tape recordings of its Village Board open meetings, the Local Records Commission has given its written approval to dispose of or erase upon adoption of the minutes of that meeting said cassette tape recording; and WHEREAS, the Local Records Commission has further provided that the original minutes of Village Board open meetings shall be retained permanently; and WHEREAS, the Village Corporate Authorities have previously enacted Resolution No. 2006 -32 which resolution provides for the destruction of certain verbatim records of closed session and closed meetings. NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, LAKE AND COOK COUNTIES, ILLINOIS, IN THE EXERCISE OF HOME RULE AUTHORITY, AS FOLLOWS: SECTION ONE: That, provided the minutes of the Village Board open meeting of which the audio cassette recording was made, have been approved by the Corporate Authorities, the Village Clerk or a person designated by the Village Clerk may dispose of or erase the audio cassette tape of said meeting, if there has been compliance with the following conditions: A. No less than 48 months have elapsed since the date of the open meeting; B. There is no court order requiring the preservation of such cassette recording; C. There is no threatened or pending litigation concerning any topic discussed at the open meeting; and D. The Corporate Authorities of the Village have not passed a motion requiring the preservation of the audio cassette recording of that open meeting. ti SECTION TWO: That this Resolution shall be effective from and after its passage and approval.
