ARTICLE I - Water
lEcTroN 1.Tlrrnlng on. No water from the ViIl age water
supply shall be turned on for servlce lnto any p]lemlses by any person
but the superlntendent of the systen or some penson authorlzed by h1n
to penform thls seillce.
SECTION 2.Appllcatlon.Appllcatlon to have vrater tunned
on sha1l be oade 1n wnltlng to the vlllage Clerk, and shalL oontaln
an agrreement by the appllcant to ablde by and accept all of the
provlslonB of thl8 ordlnance as condltlons governlng the use of the
VlUage waten supply by the appllcant.
SECTIoN 3. Deposlt. A deposlt of $25.00 sha1l be made
wlth each such appLlcatlon, thls sun to be retalned by the Vlllage,
to lnsune payrent of a1I b111s; provlded, that uhere any appllcant
for waten servlce 1s the owner of the premlseB to be served no such
cteposlt shall be requlred. I{hen servlce to the appllcant ls dlscontln-
ued pemanently thls deposlt, less any €rmoumt st1ll due the Vluage
for water servlce shall be nefunded wlthout lnterest.
SECTION 4. Plumblng. No waten shall be turned on for servlce
ln pnemlses ln whlch the plrrnblng does not comply wlth the ondlnanceg
of the V111age, pnovtded, that water may be turrred on fon constructlon
work ln unflnlshed bulldlngs, BubJect to ttre provlslons of thls
ondlnance .
SECTION 5. Servlce connectlon - fee. No connectlons trlth
a water maln sha1l be made wlthout a pennlt belng lssued and twenty-four

hours I notlce havlng been glven to the superlntendent. A11 such
connectlons shall be made and all suoh wotrk done at the expense of the
appJ.lcant who sha1l also fumlsh materlals necesaarlr for such work; a]l
such connectlons shal-I be made under the superylslon of the supenln-
tenctent and no connectlon8 shall be covered untll the work has been
lnspected by h1n or some penson authorlzed by h1m. Applloatlons for
such connectlons and tunrlng on of the water must be made to the
vulage Clerk, and a fee of $50.00 shal1 be palcl for each conneetlon
and turnlng on of watetr.
SECTION 6. Resale. No water shalI be nesold or" distlrlbuted
by the reclplent thereof from the V1l1age supply to any premlses othelr
than that for whlch appllcatlon has been made and ttre meten lnstalleil
wtthout consent of the Presldent and Board of Tnrstees.
SECTION 7.Transfefi'1ng, etc.No person sha1l ln any manner
obstruct the access to any #{-"od , hyalrant or valve, or any publlc
faucet on openlng for taklng water 1n any street, a11ey, publlc g:round
or place connected wlth or pa:rt of sald waten system, notr plIe or plaee
any lunber, brlck or bulldlng natenlal or other artlc1e, thlng on
hlndranoe whatsoeven wlthln twelve feet of the same, or so as to ln
any manner hlnder, delay or obstruct the membens of the flne department
1n reachlng the sane. It shaU be unlawful for any perEon ln any
nannen to lntenfere wlth on obstruct the fIow, retentlon, stonage or
authonlzed use of waten 1n sald water eystem, reservoln on plant, or
any part thereof, or to lnJure, deface, remove or dlsplace any yrater
ma1n, htr/drant, servlce p1pe, water meter, shut-off box, publlc fountaln,
valve, englne on bulldlng conneoted wlth sald water system, or plant,
or to cause, suffen or permlt any of salat thtngs to be done. Any

person who shall perform any act ln vlolatlon of thls sectlon shaI1
upon convlctlon thereof be flned not less than Five Douars ($5.0O)
nor more than Flve Hundred Dollars ($loo.oo) for each offense, and
shall 1n addltlon be I1able for the actual damage done or caused.
SECTIoN 8. Itrrauthorlzed use. No unauthorlzed person shall
turn the waten on at any flre hydrant on senvlce cock, or use water
thenefrom when so tunied on, under penalty of Ten Dollars ($L0.00)
for each offense, and eveny person so uslng on Yrastlng water 1n such
unlawful manner shal1 be 11able to pay for the Bame at the regular
scheduled rate8.
SECTIoN 9. nistallatlon. A11 servlce plpes from the malns
to the prenlses setrved shalI be lnstalled by, and at the cost of,
the o$ner of the property to be senved or the appl lcant fon the servlce.
Such 1nstal1at1on sha1l be under the lnspectlon of the superlntendent.
SECTION 10.Plpes. No servlce shal1 be Installed unless it
confor,ms to speclfloatlons appnoved by the Plres ldent and Board of
Trustees, a copy of whlch speclflcatlons sha11 be kept on flle by the
clenk and shall be open to lnspectlon by any person lnte:rested.
SECTIoN 11 . Repalrs.AIl repalrs for servlce plpes and
plumblng systems of bulldlnge ghall be made by and at the e:rpense of
the ownens of the pnemlses Berrred. The V1l1age may 1n case of an
emer8ency repalr any servlce plpeB, and lf thls 1s done the cost of
Buch repalr wonk shall be nepalcl by the ot{ner or user of the premlses
sel.\ ed.
SECTION 12. Excavatlons. E <cavatlons for lnstalL 1ng servlce
plpes or r€pa1n1ng the same shall be made 1n compllance wlth the
ordlnance provlslons nelatlng to maklng excavatlons ln streets.

SECTION 13. Shut-off boxes. Shut-off boxes or servlce boxes
shall be placed on every aervlce p1pe, and shall. be located between bhe
curb l1ne and the sldewalk l1ne vrhere thls 1s practlcable. Such boxes
sha1l be so located that they are easlly accesslble and shall be pro-
tected from frost.
SECTION 14. Temp orary use .Any and all persons or corpora-
tlons deslrlng to use V11lage water for bulLdlng or constructlon pur-
poses shall make appllcatlon ti,erefor ln wrltlng and f11e the same in
the offlce of the V111age Clerk on a forrn to be provlded for that
purpose. Upon a permlt belng granted (permlts shall be lssued 1n
wrltlng and slgned by the superintendent ) tne servlce plpe shaU
be carrled at the enpense of the appllcant to the 1ns1de of the
curb l1ne, where a servlce cock and meter sha11 be placed, wlth plpe
leadlng to the surface, and a faucet at the end thereof above sald
sur.face. When the bultdlng or constructlon work 1s completed, the
faucet and meter shall be removed and the water shut off, unless
permanent connectlon hereunder 1s made. Charge for tne use and
connectlng of meters shall be as prescrlbed under the rate schedule
hereln set forth.
SECrIoN 15. Meters r equlred. A11 premlses uslng the Vll1age
water supp ly must be equlpped wlth an adequate water meter furnlshed
by the V1l1age but pald for by the consumer or owner; provlded, that
such water. senvlce may be supplled by the V1l1age at a flat rate of
charge untll such meter rnay be 1nstalled.
Before any premlses are occupled a water meter sha1l be
1nstal1ed thereln as hereln nequlred or appllcatlon made for such
water servlce at the flat rate of charge unt11 the meter can be
lnstalled or no vrater shall be furnlshed such premlses.

SECTION 16. Installatlon. Meters shaIl be installed 1n a
locatlon that w111 be easy of accesg.
SECTION 17. Readlng meters.The superlntendent sha1l read
or cause to be read every water meter used 1n the Vl1lage at such
tlmes as are necessary that the bllls may be sent out at the proper
t1me.
SECTION 18.Testlng !!eqe4s. Any munlclpal water meter shaI1
be taken out and tested upon complalnt of the consumer, upon payrnenl
of a fee of $1o.oo dollars. If upon test the meter 1s not w1th1n
three per cent of belng accurate, lt shall be repalred or replaced
and the $10.00 dollar fee returned to the consumer.
SECIION 19. Rates. AIl property upon trhlch any bulldlng
has been or may hereafter be erected havlng a connectlon wlth any
malns or plpes shlch nay be ilereafter constructed and used 1n con-
nectlon wlth the water system shall pay the followlng nates per month:

SECfION 20. 8111s. Bll1s for water uged shall be dated and
sent out at such tlmes as may be d .ected by the Presldent and Board
of Trustees .
SECfloN 21. Constructlon contractors. Durln g the construc-
tlon of any bulldlng and before any water 1s 1nstalled as 1s hereln
provlded the contraotor so constructlng such buUdlng may be permltted
to use the Vlllage water supply by maklng appllcatlon therefor, and
paylng the flat fee prescrlbed by the Vll1age Councll.

SECTION 22. Llab1l1ty. All connectlona and water applled
for and used hereunder, sha1l be upon the express condltlon that
the V11lage of Buffalo Grove shall not be l1ab1e, nor shall any
clalm be made agalnst, lt for damages or lnJury caused by reason
of the breaklng of any maln, branches, servlce plpes, apparatus or
appurtenances connected wlth sald system or pIant, or any pa:rt or
portlon of sald p1ant, or any lnterruptlon of the supply by reason
of the breal(age of machlnery, or by reason of stoppage, alteratlons,
extenslona or renewals.
The VlUage reserves the rlght to shut off water ln the
malns at any tlme for the purpose of repalrlng, clean1ng, rnalrlng
connectlons wlth or extenslons to gane, or for the concentratlng of
water 1n any part of the vlllage 1n case of flre; and for restrlctlng
the use of the vrater 1n case of deflcleney 1n supply. No cIa1m shalr
be made agalnst the vllIage by reason of the breaklng of any servlce
plpe on aervlce cock or damage arlslng from shuttlng off of water for
repalrlng, laylng or relaylng m81nB, hydrants or other connectlons or
repalrlng any part of the water system, or from fallure of the water
supply or lncreaslng the water pressure at any tlme, or from concen-
tratlon or restrlcted use of water as above.
sEcIIoN 23. Access. The sald VlUaBe and 1ts employees
eharl have ready access to the premlaes, praces or bulldlngs whete
meterg are located for the purpose of readlng, examlnlng, testlng
and repalrlng the same, and exarnlnlng and testlng the consumptlon,
use and flow of water, and 1t shall be unlawful for" any persona or3
corporatlons to lnterfere w1th, prevent or obstruct sald v1lrage,
or 1tg duly authonlzed agent, 1n 1ts dutles hereunder.
SECTION 24. Non-p ayment. Tne water supply may be shut off
from any premlaes for whlch the water b111 remalns unpald for a perlod
TH t(t lof 'trn/ days after the b1II ls rendered and malIed. When shut of f ,
water shall not be turned on except upon the payment of the usual
fee for turnlng on water.
SECIION 25. L1en. Cha:rgeo for water shall be l1en upon the
premlses as provlded by statute. Whenever a b111 for water se::vlce
remalns unpald slxty days after 1t has been rendered, the clerk may
f1le wlth the County Recorder a statement of l1en cIalm. T,rls
statenent shal1 contaln the legal descrlptlon of the premlses served,
the amount of the unpald b111, and a notlce that the Vl1lage clalms
a llen for th18 anount as vrel1 as for all charges for water served
subsequent to the perlod covered by the b111 .
If the consurner of water whose b111 ls unpald 1s not the
owner of the prem18es, and the clerk has notlce of thls, tnen notlce
sha1l be ma1led to the owner of the premlses, 1f hls address 1s
known to the cIerk, whenever such bllls remaln unpald for a perlod
of slxty days after lt has been rendered.
The fallure of the clerk to record suoh l1en c1a1m or to
ma1I such notlce, or the fallure of the ov{ner to recelve such notlce,
shall not affect the rlght to foreclose the l1en for unpald water
b1lls as mentloned 1n the followlng 8ect1on.
SECTION 26. Foreclosure of 11en. Property subJect to a
11en for unpald water charges thall be sold fon non-payment of the
same, and the proceeds of such sale shall be applled to pay the
charges, after deductlng costs, as 1s the case 1n the foreclosure
of statutory Ilens. Such forecloaure 3ha11 be by b111 1n eguity
1n the name of the V11lage.

The V11lage attorney 1s hereby authorlzed and dlrected to
lnstltute such proceedlngs, 1n the name of the V1llage, 1n any court
havlng Jurlsdlctlon over such matters, agalnst any property for whlch a
water b111 has remalned unpald slxty days afber lt has been rendered.
ARTICI,E II
SECIION 1. Rates. There 1s hereby establlsned a charge
of $3.00 per month for the use and servlce of the sewerage system
of the Vl11age.
SECtIoN 2. L1ens. In the event the charges for sevrerage
aervlce are not palal wlthln thlrty days after rendltlon of the b111
for Buch servlce such charges shall be deemed and are hereby declared
to be dellnquent and thereafter such dellnquency shall constltute a
l1en upon the real estate for whlch such sertvlce ls suppl1ed, and
the Vll1age C1erk 1s hereby authorlzed end dlrected to f1le sworn
statementB showlng Buch dellguencles 1n the offlce of the County
Recorder and the f11lng of such statements shall be deemed notlce
of the 11en of such charges for such servlce.
SECIIoN 3. Servlce. All sewerage servlce shal1 be d1s-
contlnued wlthout further notlce lf the charge for such Bervtce
ls not pa5.d wlthln thlnty days after rendltlon of the b111 therefor.
SECTIoN 4. Collectlons.The rates and charges hereln
establlshed shall be collected from the owners, occupants and user.s
of the premlses rrlthln sald V11lage from and after the effectlve
date of thls ordlnance.
SECTION 5. Recordln . When thlB ordlnance becomeg effectlve,
a copy thereof properry certlfled by the vlllage clerk sha1l be f1led
ln the offlce of the recorder of deeds of cook and r,ake countles; and

1t shall be deemed notlce to all owners of real estate of thelr
l1ab111ty for sewerage aervlce supplled to any occupant or user of
such servlce on thelr property.
SECTION 6. Prohlblted substances. It shaU be unlawful
to permlt or cause the flow of any of the followIng subBtances lnto
the sanlta4r sewer Eystem of the Vlllage:
(a) Any grease, fatty materlal, offal, or ga:nbage.
(b) Any stone dust, sand, dlrt, gravel, sawdust, metal
f1l1ngs, broken glas8, or an)r materlal whlch may
cauge or create an obstructlon 1n the sewer-
(c) Gasollne, benzlne, fuel oll, or any petnoleum pro-
ducts or volat11e llqultts .
(d) MlIk or any 11quld m1lk waste products 1n quanltles
1n excess of ten gallons durlng each twenty-four
hour perlod.
SECIION 7. Chemlcals. It shaIl be unlawful to cause or
permlt to fLow lnto the sanltary sewer system any cyanlde, phenols or
ar\y other chemlcal or substance stllch lnterferes wlth or prevents
the functlonlng of the sewage treatment plant.
SECTIoN 8. Interqeptlon. Bvery bu11d1ng or premlses used
or. occupled by any sewer user where any commerclal or lndustrlal
operatlons are conducted or permltted whlch result 1n the dlscharge
lnto the sanltary sewer system of the Vlllage of any of the products,
waste products or other substances ln the manner and to the extent
pr.ohlblted ln thls ordlnance, shal1 be equlpped wlth an adequate and
Bultable catch basln, grease trap, fllter or other lnterceptor,
1nstalIed 1n such a manner that the products, waste products, or
other substances hereln set forth wllL not flow lnto or be d1s-
charged lnto the sanltarry aewer system.

It shaU be unlawful to permlt the flow of waste from such
bu1ld1ng or premlaes lnto the sanltary serrer system unless Buch
lnterceptor" 1s lnstalled anat 1n good norklng order.
SECTION 8.0.D. 1lmlts. The admlsslon lnto the pub11c
sewers of any waters or wastes havlng (a) a 5-day blochemlcal oxygen
demand greater than 3O0 parts per m1ll1on by weight of suspended
soIlds, or (b) contalnlng more than 350 parts per mll1lon by welght
of suspended sollds, or" (c) havlng an average da11y flow greater than
2 per cent of the average dally sewage flow of the V111age, shall be
subJect to the revlew and approval of tae Vllla8e. i,Ihere necessary,
the owner shall provlde, at h1s expense, sueh prellmlnary treatment
as may be necessaqy to (a) reduce the blocnemlcal oxygen demand to
3OO parts per m1111on, and the suspended soLlds to 35O parts per
m1ll1on by welght, or (u) reduce obJectlonable characterlstlcs or
constltuents to wlthln the maxlmum l1mlts provlded for 1n thlg
sectlon, or (c) control the quantltles and rates of dlscharge of
such waters or wastes. Plans, speclflcatlons, and other pertlnent
lnformatlon relatlng to proposed prellmlnary treatment facllltles
shall be submltted for the approval of the Vll1age englneer and no
constructlon of such facll1t1es shall be conrnenced untll salcl
approvals are obtalned ln wr1t1ng.
SECTION 10. Penalty. Except v{here otherwlse get forth
hereln, any person, flrm or corporatlon who shall vlolate any of
the provlslons of thls ordlnance shall, upon convlctlon, 1n addltlon
to the enforcement of the for.feltur.e and l1ab111t1es thereln contalned,
pay a flne of not less than Flve DolLars ($5.OO), nor more than Flve
Hundred Dollars ($50o.oo).
