2026-01-20 - Ordinance 2026-013 - APPROVING AN AMENDMENT TO TITLE 15 BUILDINGS AND CONSTRUCTION OF THE VILLAGE OF BUFFALO GROVE MUNICIPAL CODE - Electrical Vehicle-Capable Parking Requirements for Multifamily Residential Buildingt oRDtNANCE 2026,-013 AN ORDINANCE APPROVING AN AMENDMENT TO TITLE T5 BUILDINGS AND CONSTRUCTION OF THE VILLAGE OF BUFFALO GROVE MUNICIPAL CODE Electrical Vehicle-Capable Parking Requirements for Multifamily Residential Building \ BUFEAI.O GRPVE Underlined = addition Slaekli-ned = removal 1/2012026 WHEREAS Section 6 of Article Vll of the lllinois Constitution provides that a home rule unit may exercise any power and perform any function pertaining to its government and affairs including, but not limited to, the power to regulate for the protection of the public health, safety, morals and welfare; to license; to tax; and to incur debt, except to the extent said section limits such exercise and performance; and WHEREAS the adoption of regulations pertaining to the construction or renovation of single-family homes and multifamily residential buildings that have parking spaces within the Village, and the issuance of building permits pursuant thereto, are inherently matters pertaining the governmental and affairs of the Village; and WHEREAS no provision of lllinois law, including, but not limited to, the Electric Vehicle Charging Act, 765 ILCS lO85/ et seq. ("Act") purports to declare that the regulation and permitting of residential construction or renovations are exclusive powers of the State, that a home rule unit may not exercise such powers concurrently with the State, or otherwise preempts the Village's home rule authority the manner required by Section 6 of Article Vll of the lllinois Constitution; and WHEREAS the President a nd Village Boa rd of the Trustees of the Village desire to adopt regulations pertaining to the installation of electric charging stations within the Village and appropriately tailor those regulations to the needs of the Village and its residents. NOW THEREFORE BE lT ORDATNED by the President and Board of Trustees of the Village of Buffalo Crove, Cook and Lake Counties, tllinois, as follows: SECTION I.Title 15 Buildings and Construction of the Village of Buffalo Crove Municipal Code, is hereby amended by adding the Following WHEREAS the Village, a home rule unit pursuant to said section; and Page I of 2 smart with heart. SECTION 3. Any person violating any portion of this Ordinance shall be punished according to the provisions of Chapter l.O8 of the Buffalo Crove Municipal Code. SECTION 4. This Ordinance shall be in fullforce and effect f rom and after its passage, approval, and publication and shall be codif ied. This Ordinance may be published in pamphlet form.
