ZONING BOARD OF APPEALS
VILLAGE OF BUFFALO GROVE , ILL.
TUESDAY , MAY 17 , 1983
I . CALL TO ORDER
Chairman Richard Heinrich called the meeting to order at 8: 10 P.M. on
Tuesday, May 17, 1983 at the Village Hall .
II . ROLL CALL
Commissioners Present: H. Hefler, J . Quick , M. Perlman and R. Heinrich. QUORUM
Commissioners Absent: M. Kearns , D. Stolman and F. Manzo
Building Department Liaison : Mr. Ray Henning , Housing and Zoning Inspector
Village Attorney : Mr. William Raysa
Chairman Heinrich presented a Certificate from the University of Wisconsin -
Department of Engineering and Applied Sciences to Mr. Ray Henning acknowledging
Mr. Henning ' s successful completion of a course in Effective Zoning Administra-
tion Techniques . Ch. Heinrich commended Mr. Henning for continuing to broaden
his horizons and educational achievements . Congratulations , Ray !
III . APROVAL OF MINUTES
Com. Quick made a motion to approve the minutes of April 19 , 1983.
Com. Hefler seconded the motion. Ch. Heinrich asked that spelling of two
residents mentioned on page 3 - Ziperstein and page 9 - Dennen (not Jenner)
be corrected.
Roll Call Vote to approve the April 19 , 1983 minutes as amended:
Aye - Hefler , Quick , Perlman and Heinrich
Nay - None
April 19, 1983 minutes were approved as amended and will be placed on file .
IV. BUSINESS
A. 142 Lilac Lane - Mr. and Mrs . Christopher Hacias
Article X, Section 7.4-3; Rear Yard Requirments
The public hearing notice was read. Mr. and Mrs . Hacias were sworn in .
Mr. Hacias summarized the hardship reasons for their request for a variation .
After living in a town house , they bought their house in Buffalo Grove and
immediately planned to add an enclosed patio. They did not realize that a
zoning variation was necessary. They have recently had a fourth child and
their oldest child is eight years old. The porch would provide a safe place
for the children to play after dark and still be outside in the summer.
The Hacias ' could not afford to move and do not want to because they are
very happy with their home in Buffalo Grove . They need 7 feet more than
the zoning ordinance allows , and if they only built a 12 ' x 5' enclosure
it would not be large enough . The enclosed patio will be sufficient for
a play area. They do not want a room addition , which would be too
expensive. There will be a patio built outside the screened area, to be
used for bar-b-que. The addition will be used in summer only.
Com. Quick said he had visited the property. The Hacias' are directly
in front of the Industrial Park and a warehouse has been built there.
There is a fence along the property line and there will be a screen of
trees. The house to the North of the Hacias' is angled away from the
property and will not be affected. The only house that would be affected
would be to the South.
Mr. Hacias said that this house is unoccupied. The owner bought it during
the Northwoods Auction, but has never lived there. He knows about the pro-
posed addition and has no objections.
There were no other comments from the Commissioners, and no objections.
There were no residents present and there have been no written objections.
Com. . Quick made the following motion:
I move we approve the request for a
variation by Mr. and Mrs. Christopher
Hacias, 142 Lilac Lane for the pur-
pose of constructing a room addition.
Variation of Article X, Section 7.4-3
pertaining to Rear Yard Requirements.
Variation of 7 feet is granted.
Economic Hardship having been demonstrated.

Findings of Fact attached. Permit may be issued after 15 days. An
application must be submitted prior to issuance of permit.
B. 830 Shady Grove Lane - Mr. and Mrs. Walter J. Hanson
Article X, Section 5.3-A - Rear Yard Requirements
The public hearing notice was read and Mr. and Mrs. Hanson were sworn in.
Mr. Hanson summarized the reasons for their request for a variation. The
Hanson's recently sold their former house and relocated in Buffalo Grove.
Their new house has limited facilities and they need the addition for
year round use. They have more furniture than they can use without the
addition. In the summer, mosquitoes from the adjacent forest (to-the rear)
are very bothersome and the screened enclosure would permit the Hanson's
to enjoy the outdoors. They also need the extra space to allow for some
quiet times alone. The addition will increase the value of the home.
Com. Quick said that the Hanson's have some lovely landscaping. The area
to the rear is Jo Ann's Florist and there is a forest of trees between the
two properties. A shed at rear has been moved from the location shown
on the Plat and neighbors now have a better view. The neighbors have no
objection to the proposed addition.
There were no further comments and there were no objections from the
Commissioners. There were no residents present and no written objections
have been filed.

Ch. Heinrich noted that the model is a Buckingham and has no other
family room. Without the addition, the Hanson's cannot sit outside
and enjoy their yard, sun, etc. A variation of 10 feet is requested.
Com. Quick made the following motion:
I move we approve the variation requested
by Mr. and Mrs. Walter J. Hanson, 830 Shady
Grove Lane of Article X, Section 5.3-A -
pertaining to Rear Yard Requirements.
Variation of 10 feet is granted for the purpose
of constructing .a sun room addition. Hardship
having been demonstrated.
Com. Hefler seconded the motion. Roll Call Vote: Aye - Hefler

Findings of Fact Attached. Permit application imus t tie filed and
a permit may be issued after 15 days.
C. 974 Whitehall Drive - Mr. and Mrs. Rick Voeks
Article X, Section 6.4-A, Rear Yard Requirements
The public hearing notice was read and Mr. and Mrs. Rick Voeks were
sworn in.
Mr. Voeks explained that when they bought their house 17 months ago,
they bought with the vision in mind to build a room addition. They did
not realize they would need a variation of the zoning requirements.
They plan to enlarge their family room also because it is too small .
They need the proposed addition to allow extra bedroom space when their
in-laws visit. Although they have a Gramercy with 4 bedrooms
have 1 child and desire others, and use one bedroom for an office.
Ch. Heinrich noted that the lot is an irregular shape, and only a small
portion of the length needs to be varied. Mr. Henning said it would be
difficult to determine exactly how much of a variation is needed.
Mr. Voeks said they need about 3 ft. 9 inches so they are requesting a
5 foot variation.
Com. Quick described the location and noted that the house is lower than
the house directly behind so the view would not be affected. He also
noted that the Gramercy family room is more like a hallway.
The addition will match the existing structure: same siding, same wood,
and will be painted to match. The siding is masonite. The existing
family room wall will be removed and the beams will be re-enforced.
The plans are not reviewed until the variation is granted. Mr. Henning
was instructed to supervise the construction to make sure the wall is
properly supported. Mr. Henning said that the contractor is Space Home
Improvements and they are quite reliable.
There were no other questions from the Commissioners and there were no
residents present. No written objections have been received.

by Mr. and Mrs. Rick Voeks, 974 Whitehall Drive
of Article X, Section 6.4-A pertaining to Rear
Yard Requirements for the purpose of constructing
a room addition.
A variation of 5 feet is granted. Hardship having
been demonstrated.

Findings of Fact Attached. Permit application must be filed and a
permit may be issued after 15 days.
V. ANNOUNCEMENTS
Mr. Raysa reviewed the procedure for the Findings of Fact and Com. Quick
dictated Findings for each of the three variations granted.
Com. Hefler noted that two of the petitioners had very recently purchased
their homes and planned additions. They testified that they did not realize
zoning variations would be necessary. Com. Hefler asked if new purchasers
are informed of the zoning requirements or are they sold without "caveat emptor"
(let the buyer beware)? Article XIII refers to practical difficulties or
particular hardships and these people did qualify.
It would be difficult to inform all buyers of the variation requirements.
Com. Perlman said it should be realized that people's homes are their "castles"
and they like to improve their property. They find it difficult to accept the
requirements of all the various ordinances.
VI. ADJOURNMENT
Com. Hefler made a motion to adjourn. Com. Perlman seconded the motion.
Ch. Heinrich adjourned the meeting at 8:50 P.M.
