I. CALL TO ORDER
Chairman Richard Heinrich called the meeting to order at 8:12 P.M. on Tuesday,
October 20, 1981 at the Village Hall.
II. ROLL CALL
Commissioners Present: M. Kearns, H. Hefler, D. Stolman, M. Perlman
and R. Heinrich. QUORUM PRESENT.
Commissioners Absent: J. Quick and F. Manzo.
Also Present: Mr. Dominic Saviano, Deputy Building Commissioner.
III. APPROVAL OF MINUTES
Sept. 15, 1981 — Motion to approve made by Com. Perlman and seconded by
Com. Stolman. Roil Call Vote — Aye Unanimously.
Sept. 15, 1981 minutes approved, to be placed on file.
IV. BUSINESS
A. 622 Armstrong Court — Alan M. Sax
Fence — Municipal Code, Section 15.36.040
Mr. Sax was sworn in after the Public Hearing Notice was read. He stated
the reasons for his need for a fence variation. Their yard is small and
would like to make full use of it. Since he has a corner lot, he would
like to bring the fence 10 feet out from the building. There is nothing
across the street from him and the fence will not block traffic.
The fence would be a five (5) ft. rough sawn cedar, board on board. The
neighbors have no objections and many have the same type fence. Mr. Sax
presented signatures of several neighbors giving approval for the fence.
The fence will not be detrimental to health, safety or welfare to village
residents.
Com. Hefler raised the question of proven hardship. Mr. Raysa said that
is not necessary relative to fences.
Com. Stolman made the following motion:
I move the variation requested by Mr. Alan M. Sax,
622 Armstrong Court, for a fence to be erected
10 feet from his building line, be granted as per
the plans marked Exhibit A.
Variation granted to Section 15.36.040 of the
Municipal Code.
Com. Kearns seconded the motion. Roll Call Vote: Aye — Perlman,
Kearns,
Stolman

Nay — Hefler
Motion Passed 4 to 1.

B. 966 Cambridge - Jaun A. Valdez
Article X2 Section 6.4-A (Rear Yard)
Ch. Heinrich read the Public Hearing Notice and Mr. Valdez was sworn in.
Mr. Valdez described his need for a variation in order to construct a porch
on the existing deck. The deck is 17 feet out into the yard. In summer,
mosquitoes are a problem. Space is needed for their 4 year old son to play.
There is no basement to the house. Mr. Valdez can use 12 feet of the deck
without a variation, but the additional 5 feet would be useless. The porch
gill be unheated and will be constructed with a ceiling and jalousie windows.
The deck was on the house when Mr. Valdez purchased it, therefore it is a
legal non-conforming in a sense. But according to the present Code, a deck
could be extended to the rear lot line. (This section should be reviewed.)
Mr. Valdez said his neighbors have been informed, and no one has any objec-
tions. He is in need of additional living space and cannot afford to move,
because of high interest rates, etc. Signatures of both adjoining neighbors
were presented. An existing sandbox in one corner will remain.
There were no residents present and the Commissioners had no further comments.
Com. Hefler made the following motion:
I move the petition of Jaun A. Valde z, 966 Cambridge;
for variation of Article X, Section 6.4-A - with
reference to enclosure of a deck to be used as a
sun porch only with no heat; to be used only for
the summer months - be granted. 5 ft. as requested.
Hardship having been shown via conversations of use
of present deck which has been there forever.
Com. Kearns seconded the motion. Roll Call Vote: Aye - Perlman

Motion Passed 5 to 0.
The ZBA then made Findings of Fact and Conclusions which are attached to
these minutes.
C. 861 Woodhollow Lane - Alan and Marsha Garfield
Article S, Section 3-A (Rear Yard)
After the Public Hearing Notice was read, Mr. Garfield was sworn in.
He stated that after having his house up for sale for the past 10 months,
he decided that he would keep it and add a room addition. The house has
no basement, insufficient closet space and his family needs more space.
Plans were submitted showing the proposed addition to be used as a large
bedroom, bathroom and storage. An outside door to the yard will connect
a hallway to the bathroom for the children's use when outdoors playing.
Photographs were presented showing the rear yard. The lot is pie-shaped,
and extra large. The house is a U-shape. The original garage has been
made into a family room and a garage added in front.
Mr. Garfield's three (3) adjacent neighbors have no objections to the plan
and are happy the house is no longer up for sale. A five foot variation

The addition will not encroach in the side yard. It will have the same
roof line, with a cathedral ceiling and a skylight. The same cedar shakes
will be used on the outside to match the rest of the house. The large
tree will remain.
A playhouse in the rear of the yard and could be on the easement, but
it apparently has not-interfered with power lines, etc. in the past.
There were no residents present to object, and the Commissioners had no
questions. A discussion arose concerning the definition of the rear
lot line_ of a pie shaped lot = 10 ft. in. It was determined that even
though the lot is an irregular shape, the Board would grant a variation.
Com. Perlman made the following motion:
I move we grant a variation to Alan Garfield,
861 Woodhollow Lane, persuant to Article X,
Section 5.3—A to construct an addition at the
rear of the subject property. Variation is
for a maximum of 5 feet for approximately
nine feet. Hardship having been established.
As per diagram submitted, marked Exhibit "A" .
Com. Stolman seconded the motion. Roll Call Vote: Aye — Kearns

Motion Passed 5 to 0.
The ZBA then made Findings of Fact and Conclusions which are attached to
these minutes.
V. ANNOUNCEMENTS
Ch. Heinrich dictated a letter (attached) to Pres. Verna Clayton and the
Village Board concerning a resident' s question about variance capabilities
of the Zoning Board.
VI. AT OURNMENT
Com. Stolman made a motion to adjourn and Com. Hefler seconded. The meeting
was adjourned at 9:35 P.M.
