CALL TO ORDER The meeting vas called to order at 8:02 P.M. at the Village Hall on Tuesday, August 18, 1981, by Chairman Richard Heinrich. II. ftOJL CALL Commissioners Present: Quick, Heller, Kearns, Manso, Stolman, Perlman and Heinrich. Commissioners Absent: Kano. Also Present: J. D. Griffin. QttORUM PRESENT III. APPROVAL OF MINUTES July 21, 1981 - Deferred until the Sept. meeting. Aug. 4, 1981 - Motion to approve vas made by Com. Quick and seconded by Com. Kearns. Roll Call Vote: Aye - Quick, Hefter, Kearns, Perlman Nay - None Abstain - Heinrich, Stolman Iv. Bt INES 30 Crestview Terrace, Hillery and Evelyn Evans Article X, Section 4.4-2 . Attached Garage Zoning District R 3 A-7 ft. side yard required - 2 ft. variation requested. The Public Hearing Notice vas read and Mr./Mrs. Evans were sworn in. Mr. Evans stated his reasons for requesting a variation to allow them to construct an attached garage. He finds it very inconvenient to keep moving their cars in and out of the garage. Since they leave and arrive home from work at different hours, the cars must be switched often. In the winter, it is especially difficult. The location of the new garage was drawn on the Plat of Survey. Because they live in Zoning District R -3A , 7 ft. side yards are required with a total of 16 ft. on both sides combined. The ZBA has the power to grant up to /3 of 16 ft. and the request for 2 feet could be granted. This would allow for a fey extra inches. The Evans plan to keep their old garage for storage. It is located a little less than the required 10 feet from the proposed new structure. Mr. Griffin will over- see the construction to inform the builder of the necessary distance. The driveway will be widened at the apron to accomodate two cars but will remain the same width at the street. Com. Ilefler brought up the neighbors notification letter and noted that it did not clearly state the actual intent the Evans' have in mind. By leaving the old garage, and constructing an attached garage, the neighbors may not realise that there will be two structures. It was noted that the old garage will not be visible from the street. The Evans said that the only neighbor that will be affected live at 38 Crestview and they have no objections. They, in fact, have converted their attached garage into a family room and built a garage in the rear, creating the same situation. After the garage is constructed, the house and new garage will be aided to look the same. This will greatly improve the neighborhood and increase property value. f' 4•01 Hardship was further discussed. The Evans stated that it is necessary for insurance purposes to drive a certain oar. Milage effects the premiums. Also, with the present economic situation, it would be difficult to sell this house �./ and purchase a new one. Com. Quick noted that the Village will benefit from this variation. The value of the property will increase and the neighborhood will be beautified. Corn. Perlman made the following motion: I move we grant the petition of Mr. and Mrs. Hillery Evans, 40 Crestview Terr. for variation of Article X, Section 4.4-2 of the Zoning Ordinance to allow the construction of an attached two-car garage. Variation is 2 ft. at the side yard as requested. Hardship having been established. Construction as depicted in Exhibit "A" and "Bn. Com. Quick seconded the motion. Roll Call Vote: Aye - Stolman, Hefler, Kearns, Quick, Perlman and Heinrich. Nay - None Mon Passed 6 to 0. Permit can be picked up in 14 days. (Sept. 1, 1981) Ftndknits of Fact Attached. The Buffalo Grove Zoning Board of Appeals hereby makes the following Findings of Fact and Conclusions: I.. THE SUBJECT PROPERTY A. Address:, 40 Crestview Terrace B.. Legal Description: As set forth in Exhibit "B". attached hereto and made a part hereof. C. Zoning District: R - 3 D. Lot Size: 70 ft. by 143 ft. - A very large lot. II. CHARACTERISTICS OF THE SURROUNDING AREA: A. Location: East of St. Marys s Blvd. B. A&tacent Lots: Lot located next door at 38 Crestview has a very similar situation. The garage was converted into a family room and a detached garage built. III. , VARIATION SOUGHT: A. Section 4.4-4 of Article I of the Zoning Ordinance. B.. PUBLIC HEARINGS: After due notice, as required by law, a copy of said publication notice, being attached hereto as Exhibit "E" , the Zoning Board of Appeals held a Public Hearing on the proposed variation on Tuesday, August ugust 181 1981, at the Buffalo Grove Village Hall. The applicants, . Mr. and Mrs. Hillery ' Evans testified at the hearing and presented documentary evidence. FINDINGS: A. The. Board.of Appeals )ireby grants that a variation be approved • that would permit the construction of an attached two-car garage at 30 Crestview Terrace. In support of its granting of this variation, the Board of Appeals has made the following findings of fact with respect to the application for variation: B. Hardship Conditions: (l) Economic The property in question cannot yield a reasonable return if permitted to be used only under the conditions allow- ed by the regulations in that zoning district. (a) Cost prohibitive because: The present market would make • it difficult to sell the house and purchase another. (b). Economic Factors: Increase in car insurance would be necessary to alleviate the problem created by having to drive a particular car to work. Distance determines cost. (2) Uniqueness of Conditions: The plight of the owner is due • to unique circumstances; • •(a) Sizefshape of lot: The lot is very large, and being located in the R 3 Zoning District requires a wider side yard that - other districts in_Buffalo Grove (b) Cause of Hardship: Economic situation.
