FINDINGS OF FACT
VARIATION RECOMMENDATION
VILLAGE OF BUFFALO GROVE, ILLINOIS
The Buffalo Grove Zoning Board of Appeals hereby makes the following Findings
of Fact and Conclusions:
I. THE SUBJECT PROPERTY
A. Location: TOWN CENTER, Northwest Corner of Lake/Cook and Rt. 83,
identified as LAKE — 431060
B. Legal Description: Identified as LAKE —431060. Exhibit "B" attached
---- hereto and made a part hereof.
C. Zoning District: B — 5: Town Center
II. CHARACTERISTICS OF SURROUNDING AREA:
A. Location: Northwest Corner of Lake/Cook Rd. and Rt. 83; approximately
22 acres of ground. Property is vacant and bounded by residents
and commercially zoned property.
III. VARIATION SOUGHT:
A. Sections 6.3.1 — J and K of Article XI of Zoning Ordinance
B. Description of Variation: To permit less buffer zone than required.
C. Exhibits depicting variation:
(1) Survey — Exhibit "A"
(2) Plans: — Were presented at the Public Hearing and are available.
D. Variation Power: Section 4.1 — 1 (g), of Article XIII.
IV. PUBLIC HEARING:
A. After due notice, as required by law, a copy of said publication notice
being attached hereto as Exhibit "C" , the Zoning Board of Appeals held
a public hearing on the proposed variation on Tuesday, June 16, 1981 at
the Buffalo Grove Village Hall. The applicant, Ken Tucker & Associates,
represented by Michael D. Gitlitz and Harold Eisenberg. Testimony was
given at the hearing and documentary evidence was presented.
Mr. Ed Fabish, appeared at the hearing and expressed an objection. No
written objections have been filed.
V. FINDINGS:
A. The Board of Appeals recommends that the application be granted.
Specifically, the Board recommends to the Village Board that a
variation be granted that would permit less than 25 foot buffer strip.
In support of its granting of this variation. the Board of Appeals
has made the following findings with respect to the application for a
variation:
B. Hardship Conditions:
(1) Economic: The property in question cannot yield a reasonable return
if permitted to be used only under the conditions allowed
by the regulations in that zoning district.
(2) Uniqueness of Conditions: The plight of the owner is due to unique
circumstances.
(A) Building Configuration - Placement of the property as the Village
dictates imposes a need for variation. The developer has made
every attempt to meet the Village requirements regarding where
the buildings and bike path are to be located.
The developer has made every attenpt to acquire additional pro-
perty, but a number of individual property owners are involved,
who do not wish to sell.
(3) Locality: The variation will not alter the essential character of
the locality.
C. Criteria For Variations: Section 4.5 of Article XIII
(1) Variation will not serve merely as a convenience to applicant.
(2) Will not impair an adequate supply of light and air to adjacent property.
(3) Will not unreasonably increase the congestion in public streets.
(4) Will not increase the danger of fire or endanger the public safety.
(5) Will unreasonably diminish or impair established property values
within the surrounding area
(6) Will not impair the public health, safety, comfort, morals and welfare
of the inhabitants of the Village of Buffalo Grove.
D. Conclusion: Accordingly, by a vote of 5 to 0, the Buffalo Grove Zoning
Board of Appeals hereby grants the variation, subject to the
stipulation that minimal shrubbery is to be planted in the
rear according to the dictates of the Plan Commission. Also,
the berm required in Section K is to be waived.
