1981-06-10 - Zoning Board of Appeals - Minutes • ZONING BOARD OF APPEALS VILLAGE OF BUFFALO GROVE, ILL. SPECIAL MEETING WED., JUNE 10, 1981 I. CALL TO ORDER Chairman Richard Heinrich called the Special Meeting to order at 7:37 P.M. at the Village Hall, on Wednesday, June 10. 1981. II. ROLL CALL Commissioners Present: Hefler, Kearns, Quick, Manzo and Heinrich. Commissioners Absent: Stolman Also Present: Mr. James Truesdell, Village Planner Mr. William Raysa. Village Attorney III. APPROVAL OF MINUTES Minutes of May 19, 1981 were deferredtntil the regular meeting, June 16, 1981. IV. BUSINESS A. Amendment to the Zoning Ordinance - Article XIII, Section 4.1-1 Ch. Heinrich read the Public Hearing Notice. Mr. Truesdell presented a Plat showing the Town Center and explained the need for an Amendment to allow variation of the buffer and set back require- ments. Ken Tucker and Associates, potential developers of the Center have not been able to acquire all of the property involved and cannot meet the set back requirement. Mr. Truesdell proposed the addition of sub-section (g) . Also, there is a minor change needed in sub-section (c) . The Ordinance reads M-1 District and should be I - Industrial District. Mr. Truesdell explained the need for the second part of sub-section (g) was to allow more than one developer to build at the Town Center. There being no one present at the Public Hearing to ask questions, Ch. Heinrich closed the Public Hearing. He opened up questions from the ZBA. Com. Kearns asked if B-,5 refers ONLY to the Town Center? The answer is "Yes.' Com. Kearns tilso noted that the other sub-sections 'a to ft have a controlling factor with regard to variation. Sub-section 'g' as proposed has not been given any factor to use as guidance in the future. Ch. Heinrich explained that the Village would like to be flexible, so that if a developer should come in with a proposal that is very attractive and there are limitations as to percentage, it would be difficult to proceed. Every case will be open to discussion. The proposed amendment will broaden: the procedure that will be followed by the ZBA ; After a Public Hearing and discussion before the ZBA, a recommendation will be made to the Village Board as per Article XIII, which deals with varier. tions to the Zoning Ordinance. The Village Board then grants the variation. \-1 • • • • • • . - 3 • • • v .�.r • • •' -- • • • \110/ • Mr. Raysa called attention to the last phrase of the proposed amendment (g): "when this is necessary for the reasonable and orderly development of the property." He asked if that is the criteria for the variation, or if $ection 4.5 applies also. It was discussed and the decision to delete that phrase was made. CQm, Quick made the following motion: I move we Amend the Zoning Ordinance. Article XIII, Section 4.1-i and incorporate sub-section (g): To Permit, in the B-5 Town Center Planned District, variations to the minimum lot area. and minimum setbacks and buffering requirements to residential districts. Also, sub-section (c) to amend a scrivener's technicality; to read: To permit in an- "In - instead of M-1 Industrial District........... Com. Manzo seconded the motion. Roll Call Vote: Aye - Hefler Kearns Quick Manzo Heinrich Nay - None Motion Passed 5 to 0. Ch. Heinrich said that insufficient information had been sent out regarding the proposed variation to be heard next week, June 16, 1981. Mr. Truesdell said that the application, letters and plat are now available. They will be delivered to the Commissioners by the Secretary. IV. ADJOURNMENT Com. Quick made a motion to adjourn at 8:03 P.M. and Com. Hefler seconded the motion. The meeting adjourned by unanimous approval.
