Chairman Entman called the Zoning Board of Appeals regular meeting to order at 7:30
P.M. on Tuesday, April 12, 2011 in the Council Chambers of the Village Hall, 50 Raupp
Boulevard.

Mr. Lang explained that the sign located at the two-story building at 1001 Johnson Drive
has been removed. They have sold the two-story building. They are working on preparing
documentation to submit a permit for a new sign to be installed a little bit to the east.
There has not been much change in the other two (2)buildings as well as the vacant land.
Com. Stein asked the Board if they would be amenable to extending the status review for
more than six (6) months to possibly nine (9) months. Ch. Entman stated that he likes to
review the signs every six (6) months to keep a handle on the signs. Corn. Windecker
stated that he would not object to nine (9) months. Mr. Lang stated that as a landlord,
they are really anxious to get the leasing signs down. Corn. Shapiro also likes to review
the signs every six (6) months to watch the conditions of the signs. He understands that
the buildings will never have full occupancy because there always seems to be tenants
rolling in and out.
Ch. Entman stated that he would like the review to remain at six (6) months. He also
confirmed that the sign at 1001 Johnson Drive has been removed.

Corn. Windecker made a motion to grant a six (6) month extension for Chevy Chase
Business Park, Hamilton Partners, for the "For Rent, Sale or Lease" signs located at

appear at the October 18, 2011 Zoning Board of Appeals meeting for a status review of

LOCATED AT THE SOUTHWEST CORNER OF BARCLAY BOULEVARD
AND APTAKISIC ROAD
Mr. Norman Ross, Arthur J. Rogers & Company, 1601 Barclay Boulevard, Buffalo
Grove, Illinois 60089, was present and sworn in.
Mr. Ross explained that they have made some progress. They seem to take two (2) steps
forward and one (1) step back. There is some activity out there but they are losing
tenants. They have a little more than four hundred thousand (400,000) feet of which one
hundred twenty five thousand (125,000) is vacant. That brings them to an approximate

thirty (30) percent vacancy. The signs do bring in traffic. They are asking to allow the
sign to remain for another six (6) months.

Ms. Martha Curnow, Hamilton Partners, 1130 Lake Cook Road, Buffalo Grove, Illinois
60089, was present and sworn in.
Ms. Curnow explained that they have the two (2) existing leasing signs. They have the
signs for the same purposes as the others, to try and increase their occupancy rates at the
Buffalo Grove Business Park. They would like to continue to keep the signs up for the
next six (6) months.
Ch. Entman stated that he is a tenant in the 1110 Lake Cook Road building, but this will
not affect his decision.

Ms. Burchard explained that they currently have three (3) units available totaling nine
thousand six hundred twelve (9,612) square feet out of fifty two thousand(52,000) square
feet. The sign is an integral part of their marketing program and leasing activities.

FRONT YARD COVERAGE LIMITATION TO EXCEED THE MAXIMUM
PERMITTED 40%COVERAGE BY 29 SQUARE FEET
Mr.Michael DeMar,Fairview Estates,Inc.,1351 B Abbott Court,Buffalo Grove,Illinois
60089,was present and sworn in.The public hearing notice published in the Daily Herald
on March 23,2011 was read.
Mr.DeMar explained that the property is a pie-shaped lot.They are looking to give the
buyer the same driveway width as other homes in the Subdivision.
Ch.Entman read the Village Engineer's memorandum addressed to Brian Sheehan dated
March 25,2011 which states:"I have no comments on the proposal."
Com.Windecker asked if the issue was brought up before the home was sold.Mr.DeMar
stated that he was not aware of the issue until after they sold the home.Com.Windecker
asked if as the developer they did not want to have the driveway match the others in the
Subdivision.Mr.DeMar responded that when they submitted the permit for the driveway,
it was determined that the driveway had to be reduced by one and one half(1-1/2)feet in
width.He added that the Village suggested that he move forward with the permit for the
construction of the home and go through the variation while the home is under
construction. The home is now half way completed. Com. Windecker stated that it

becomes are major hardship since the home has already been sold to an individual. He
stated that it puts the Zoning Board of Appeals(ZBA)in a position that they really cannot
object. The layout of the home is awful compared to the proximity of the corner of the
garage to the front entrance of the home next door.
Ch. Entman agrees with Corn. Windecker concerning the timing of the variance. The
ZBA is now being asked to grant a variance to an ordinance to comply because the
hardship will be imposed on a third party, whereas the party creating the hardship should
have known better. Due to the fact that it is such a small overage he does not have a
major objection. He does not like approving things this way. There is ample opportunity
for everyone to know what the ordinances are. The ZBA does not like having to grant
variances based on the self-created hardships.

Corn. Shapiro made the following motion:
I move we grant the request made by Fairview Estates Inc, 1351 B Abbott Court, Buffalo
Grove IL 60089, for variance of Zoning Ordinance, Section 17.36.030, pertaining to
Additional regulations-Parking, for the purpose of allowing the front yard coverage
limitation to exceed the maximum permitted 40% coverage by 29 square feet for the
property located at 339 Mary Belle Circle.
Subject to the Village Engineer's memorandum dated March 25, 2011. Subject to plans
submitted to and approved by the Village. The Petitioner has demonstrated hardship and
unique circumstances. The proposed front yard coverage will not be detrimental to the
public health, safety and welfare and will not alter the essential character of the
neighborhood.

Mr. Michael Sobel, Mark Your Space, Inc., 1235 Humbracht Circle, Unit 1, Bartlett,
Illinois 60103,was present and sworn in.
Mr. Sobel explained that the store is a Clear authorized dealer. Clear is a nationwide
cellular and internet provider. They are asking for a few deviations to the shopping center
sign criteria. First is the use of multiple colors. Clear, being a national brand, uses green
in their logo. Just a point of reference, AT&T uses blue, Verizon uses red and Sprint uses
yellow. Second they also want to use their logo in the sign, which would be the circle
swoosh. It is their nationally known brand. The third, they would like to use a raceway. A
raceway makes installation and removal a lot easier and keeps the façade of the building
looking cleaner if the sign is removed. Fourth, they would like to increase the maximum
logo height. Due to the stores distance from Dundee Road and Arlington Heights Road,
visibility is an issue. They want people to see the store from as far away as possible so
that everyone knows that the store is there. They also need to request for two (2) lines of
text. This Clear store is not owned by Clear Corporate. Therefore it is an authorized
retailer and has to be designated as such. They are also asking for an increase in the sign
width. At forty eight (48) inches, it would be extremely small. They are also asking to use
LED instead of neon. LED is more economical and does not contain mercury in it.
Corn. Windecker stated that at the Appearance Review Team (ART) meeting it was
suggested to make the "Clear" lettering red to match the rest of the center. Alternative
"E" shows the proposed "Clear" and "Authorized Dealer" signs in red and the logo in
green. There was no objection to the logo being installed in green. Alternative "E" also
shows the logo diameter being eighteen and one half (18-1/2) inches and one hundred
twenty three point three (123.3) inch width for the length of the sign. He asked if Mr.
Sobel is willing to amend his request to Alternative "E". Mr. Sobel stated that he cannot
go with Alternative "E". He created that rendering but Clear had sent him their guidelines
and the sign has to be green or white. Com. Windecker asked Mr. Sobel if Alternative
"E"was submitted in error. Mr. Sobel stated that he found out after he had submitted the
Alternatives that red was not an approved color for the sign from Clear. He did create
Alternative"E"based on the recommendation of the ART. At that point, he had not heard
back from Clear. Corn. Windecker confirmed that the only approved sign packages are
white or green. Mr. Sobel stated that is correct. They can go with any of the Alternative
proposals except "E". Corn. Windecker stated he was reluctant to believe that Clear has
no other sign package. Mr. Sobel stated that each of the cellular companies have their
own color schematic and they stay away from each other. Com. Windecker stated that he
realizes that, but Clear has been hoping around back and forth with regards to color. In
Chicago, there is all green, no white. Mr. Sobel agrees that the branding for Clear has
changed a little bit. Corn. Windecker stated that it changes over and over again. It you
look at the company history, it changes based on what the community desires. Mr. Sobel
stated that the green has always been there, that has not changed. Corn. Windecker stated
that he cannot support the request. Mr. Sobel added that there are numerous other sign in
Buffalo Grove that are not red. There is Blockbuster, Dairy Queen, Dollar City,
Starbucks, Home Ray& Son, Subway, H &R Block, FedEx Office, O'Reilly Auto Parts,
and Jimmy Johns, all of which have been allowed to keep their corporate colors. Com.
Windecker stated that Clear can keep their corporate color on the logo but not on the

letters. Mr. Sobel stated that all those signs have their corporate colors in the entire sign
and not just the logo. Corn. Windecker stated that each individual shopping center has its
own sign criteria that is agreed to by the shopping center owner and the Village, in Plaza
Verde, the sign criteria has the sign color of red for their signs. Other shopping centers
may have other colors; that is based upon their sign criteria. If there are different colors in
this center, it is because they went through the process to get the approval for those
colors.
Ch. Entman read the ART minutes dated March 28, 2011 into the record.
Ch. Entman stated that he does not have any issues with the sign being installed on a
raceway. He does not like signs to be too big, or too high, or too wide. Clear is saying
that white or green are the only colors. He understands the review of other signs that were
allowed to keep their corporate colors. He knows that in Plaza Verde, there are certain
retailers that went to red to comply with the sign criteria. There are always going to be
some that insist that they want their corporate color and/or style and logo. When the ZBA
says no, then they adapt. Just because they say they want to go white or green does not
mean that the ZBA has to go along with it.
Corn. Au stated that she does not have any issue with the white or green. The roof of the
building is green. The raceway is off-white. She understands that all of the signs are red,
but with Clear being a national brand and by forcing them to change their lettering colors,
the Village is not allowing them to trademark their brand.
Ch. Entman also noted that they are basing their comments on the tenant's inability to
change the color of the lettering to red. Corn. Windecker's line of questioning is based
upon what the ZBA has heard for a number of years, that national brands have only one
(1) or two (2) sign packages. The ZBA has found over the years that no matter what they
are told, shown or lead to believe that all national brands have more colors. Walgreens
has more color combinations and sign packages and McDonalds has them. The testimony
presented here may be fine, but the ZBA believes that there are more color packages
available. He may not have a problem if the sign is white or green. He is not sure about
the width of the proposed sign. There is comment that they are requesting to increase the
sign width because the forty eight (48) inch sign width would not be visible. Not every
store that faces Dundee Road, and is setback the same distance, has an expanded sign
width in order to be seen. Mr. Sobel added that most store fronts in this center are
narrower. This storefront is about double the width.
Corn. Shapiro agrees with Mr. Sobel that the size of the size compared to the store front
does not look out of place. With the green roof line, the green letter does not really stand
out and it is the brand color. If he had to select an Alternative, he would select
Alternative "D" as being the most appropriate because there are not too many colors and
keep all the letter matching.
Com. Windecker confirmed that Mr. Sobel received the ART minutes dated March 28,
2011 that requested that the petitioner provide the approved sign packages for Clear, or

some documented proof regarding their inability to use any other color. Mr. Sobel
confirmed that he did receive the ART minutes. He added that Clear was very adamant
that their approved sign packages could not become part of the public record.
Ch. Entman asked the ZBA if there was preference concerning the Alternative sign
packages submitted. Corn. Windecker stated that the ZBA has to look at both the length
and the diameter. Ch. Entman stated that the two (2) packages he is looking at are
identical except for the lettering"Authorized Retailer"is white (Alternative C) on one(1)
and green (Alternative D) on the other. Mr. Sobel stated that difference between the
proposed sign and Alternative"B"is the diameter of the logo. The rest of the Alternatives
use those dimensions and just change the color of the lettering.

Com. Shapiro made a motion to approve the request made by Biz Solutions, 1493 W.
Dundee Road, for Deviation to the Shopping Center Sign Criteria,pursuant to Alternative
"D" dated February 8, 2011, which depicts green "Clear" lettering, green "Authorized
Dealer" lettering and an eighteen and one half (18-1/2) inch logo with the sign being
mounted on a raceway and to allow the use of LED lighting. Corn. Au seconded the
motion.

Motion Denied 2 to 2, 1 Abstention. The Petitioner was advised of their right to appeal
this decision to the Village Board.
Mr. Sobel explained that his client will not receive reimbursement from Clear corporate if
the sign is in red lettering because it does not meet the guidelines. The tenant gets
marketing money back from Clear corporate to put the sign up. If it does not meet the
marketing guidelines, then the tenant does not get reimbursed. In which case, they will
not put up the sign.
Ch. Entman stated that what was proposed was not approved. If there is some other
alternative they wish to present the ZBA is willing to listen. Mr. Sobel asked if there was
something that the Commissioners who did not vote in favor of the sign wanted to see.
Ch. Entman stated that he could poll the Board. He would not be surprised if it had
something to do with maintaining the color of the current sign criteria for Plaza Verde.
Mr. Sobel stated that the whole basis for reimbursement is that you are paying to spread
the brand name. The O'Reilly sign in the same shopping center is green and white while
every other sign next to it red. The FedEx sign at Dundee and Buffalo Grove Road is blue
and white. The H&R Block sign is green and white. All the big corporation sign are their
colors because they do brand management. That is what he tries to teach his customers,
that you need to own your brand. You need to be consistent. You want people to visually
pick up on your brand and remember it. So when they want to buy something they

remember your brand. It is about brand management. Changing the colors to red does not
stick with their brand.
Corn. Shapiro replied that they would keep their logo in their color. There is flexibility by
some corporations. Mr. Sobel stated that unfortunately in the telecommunications
business they have made a very clear stand on the colors. AT&T has chosen the blue
spectrum, Sprint the yellow spectrum and Verizon the red spectrum. They do not want to
confuse customers. They do not want brand confusion.
Corn. Windecker asked if Mr. Sobel is the business owner. Mr. Sobel stated that he is the
sign contractor. Com. Windecker stated that there has to be some alternatives. Mr. Sobel
stated that he spoke with Clear and they will not reimburse the business owner because
the sign would not be in their colors. He does not blame them. He would not want to
reimburse them either. If is not his brand he would not pay to not put his brand up.
Corn. Windecker stated that the ZBA is not changing the color of the logo. Mr. Sobel
replied that the ZBA is changing the color of the logo. The logo includes the word
"Clear". The logo is "Clear" and the circle. Just like FedEx is the special X with the
capital F and capital E.
Corn. Steingold asked if there is a Jimmy Johns in the shopping center. Mr. Sobel stated
that there is a Jimmy Johns in the center. Corn. Steingold asked if the Jimmy Johns logo
is red and if the sign letters are red. Mr. Sobel stated that the sign lettering is in white.
Com. Steingold asked what Jimmy Johns corporate colors are. Mr. Sobel stated that they
are white and black. Corn. Windecker stated that the Jimmy Johns sign at Town Center is
red. The sign package for Town Center and Plaza Verde is red. The Jimmy Johns in
Town Center is red. Mr. Sobel stated that he is not familiar with Town Center. Mr. Sobel
stated that the owner of the Plaza Verde shopping center is the father-in-law of the
business owner and the center owner does not mind if the sign is green or white. There
are sign all over Buffalo Grove that are not red. The rules are so antiquated that they say
you have to have a neon sign. They have not been changed. The problem is it would take
four (4) times as long to get the rules changed to what he would like them to be. Com.
Windecker stated that the ZBA did not object to the raceway. Mr. Sobel acknowledged
that and added that the rules are antiquated from a time before branding became king. He
was just trying to point out how old the rules are in that neon signs aren't made anymore
except for specialty reasons. Corn. Windecker stated that maybe why people like to live
in Buffalo Grove because the Village does follow rules and regulations. Mr. Sobel stated
that he grew here. He went to Buffalo Grove High School. Corn. Windecker responded
that Mr. Sobel should know that the Village is not that antiquated. Mr. Sobel clarified that
he is referring to the shopping centers rules, not the Village's rules. The shopping
center's rules that are on file with the Village are antiquated, not the Village ordinances.
The Village ordinances are very up to date. The requirements that the shopping center put
in when the built the center are antiquated and have not been revised.
Ch. Entman stated that the comments are well taken. The ZBA did not approve what was
requested. If there is something that the business owner would like to request in any other

form or again, they are welcome to return. It must be taken into account the Village ART
made several recommendations that were not taken into account. There are minutes from
that meeting and then there is the sign criteria for this shopping center. If there is
something else that the petitioner would like to do, that can be presented. If that fact that
the sign criteria for this center is so outdated that it is cumbersome and interfering with
the business then he is not disagreeing. But, he believes then that the landlord or the
owner of the property needs to do something about it. If the landlord would have
addressed the issue when the first several deviation requests came up however many
years ago, then each individual businesses owner would not have to come before the
ZBA to request deviations for every proposed sign. Mr. Sobel stated that the guidance he
received was not to fix the sign criteria, but was to come before the ZBA for the
deviation.
