ROLL CALL Commissioners Present: Commissioner Stein Commissioner Dunn Vice Chairman Sandler Commissioner Lesser Chairman Entman Commissioners Absent: Commissioner Windecker Commissioner Shapiro Also Present: Edward Schar, Building Commissioner William Raysa, Village Attorney APPROVAL OF MINUTES September 18, 2007 minutes: Com. Dunn made a motion to approve the minutes as submitted of the Zoning Board of Appeals regular meeting held on Tuesday, September 18, 2007. Corn Lesser seconded the motion. Roll Call Vote: AYE — Stein, Dunn, Lesser, Entman NAY — None ABSTAIN - Sandler OLD BUSINESS 1250 RADCLIFFE ROAD, LORD'S LOVE COMMUNITY CHURCH — SIGN CODE, SECTION 14.20.010, TO INSTALL AN ADDITIONAL IDENTIFICATION WALL SIGN ON THE WEST ELEVATION OF THE BUILDING AND, IN TOTAL, WOULD EXCEED THE ALLOWABLE SQUARE FOOTAGE FOR ALL SIGNS BY 18 SQUARE FEET Reverend Jeom Kim, Lord's Love Community Church, 1250 Radcliffe Road, was present and reminded that he was still under oath. DRAFTPAGE of 6 O�CTOBERI6E2007 Ch. Entman reviewed the revised sign drawing submitted by the Petitioner and marked as Exhibit "F". He commented that the English lettering should be located above the Korean lettering and should be of equal size without increasing the overall size of the proposed sign. Corn. Sandler stated that even though he was not present at the previous meeting, he did read the minutes and he believes that the proposed Exhibit "F" does not accomplish the goals of the Zoning Board. The six inch (6") lettering will not be visible from Arlington Heights Road. Ch. Entman would approve the sign with the recommended changes. Mr. Rob Sherman, P.O. Box 7410, Buffalo Grove, Illinois 60089, was present and reminded that he was still under oath. Mr. Sherman commented that he has two (2) alternate proposals for the sign. The English lettering should not count against the overall square footage of the sign. He also believes that it is their church and their language should be on top. He would like to see the Korean lettering at the top of the sign. He is and has been a human rights activist and believes to not allow this would be a form of discrimination. He does not know the total square footage that they are allowed for signage. Corn Sandler suggested to provide both options, the Korean lettering on top and the English lettering on top, for the proposed sign for the Board's review. There were no additional questions or comments from the Commissioners. There were no additional questions or comments from the audience. The Petitioner requested to Table their hearing until the next regular meeting in order to provide the requested information. Corn. Sandler made a motion to Table the request made by Lord's Love Community Church, for variation of Sign Code, Section 14.20.010 to the next regular meeting scheduled for Tuesday, November 20, 2007. NEW BUSINESS 129 PAULINE AVENUE, NEIL BOLDUS — FENCE CODE, SECTION 15.20.040, TO CONSTRUCT A 5' FENCE EXTENDING 25' BEYOND THE BUILDING SETBACK LINE ALONG PAULINE AVENUE AND INCREASING TO 6' IN HEIGHT ALONG THE REAR PROPERTY LINE AS SHOWN ON THE PLAT OF SURVEY SUBMITTED WITH THE APPLICATION AND MARKED AS EXHIBIT "A" Li DRAFT ZONING BOARD OF APPEALS PAGE 2 of 6 — OCTOBER 16, 2007 Mr. Neil Boldus, 129 Pauline Avenue, was present and sworn in. The public hearing notice published in the Daily Herald on September 26, 2007 was read. Mr. Boldus advised that a revised Plat of Survey was submitted prior to this meeting based on the Village Engineer's memorandum. Ch. Entman confirmed that he received the revised Plat and that said exhibit was marked as Exhibit"B". Ch. Entman read the Village Engineer's memorandum addressed to Edward Schar dated October 2, 2007 which states: "Village Ordinance requires that fences at this type of intersection be setback a minimum of 45' from the intersection of the curb lines. We recommend that this requirement be observed." Ch. Entman confirmed that the proposed fence would be a wood privacy fence. He is not in favor of the proposed fence and that the fence should not be allowed beyond the building setback line. Com. Stein asked staff if a three foot (3') fence could be located within the forty-five foot (45') area. Mr. Schar confirmed that a three foot (3') fence could be so long as the height does not exceed three feet(3') above the street grade. Com. Sandler confirmed with staff that based on Exhibit "B" submitted by the Petitioner, the only portion of the fence requiring a variation would be the five foot (5')portion of the fence. Com. Lesser asked staff if Pauline Avenue is considered a major roadway. Mr. Schar responded that he did not recall. Corn. Lesser has an issue with allowing the fence beyond the building setback line but would not have an issue with allowing a six foot (6') fence along the building setback line to replace the existing five foot(5') fence. Com. Sandler does not feel that the proposed Exhibit "B" would be aesthetically pleasing but he is open to Corn. Lesser's suggestion. Ch. Entman would not have an issue with allowing a six foot (6') fence along the building setback line. Mr. Boldus amended his request to propose a six foot (6') fence on the building setback line along Pauline Avenue. Com. Lesser made the following motion: I move we grant the amended request made by Neil Boldus, 129 Pauline Avenue, for the purpose of constructing a six foot (6') fence along the building setback line, beginning a the rear property line and returning to the southwest corner of the house. Subject to the Village Engineer's memorandum dated October 2, 2007. The Petitioner has demonstrated hardship and unique circumstances. The proposed fence will not be detrimental to the public health, safety and welfare and will not alter the essential character of the neighborhood. CHEVY CHASE BUSINESS PARK, HAMILTON PARTNERS — REVIEW OF THE EXISTING FOR RENT, SALE, LEASE SIGNS AT 1001 JOHNSON DRIVE, 1080-1098 JOHNSON DRIVE AND AT MILWAUKEE AVENUE AND LAKE COOK ROAD Ch. Entman read a letter dated October 16, 2007 signed by Jim Lang, Senior Asset Manager, Hamilton Partners, which states: "Due to unforeseen circumstances, I will be unable to attend this evenings meeting and request that our portion be postponed until November. Please feel free to contact me if you have any questions." Com. Sandler made a motion to Table the review of the existing leasing signs for Chevy Chase Business Park to the November 20, 2007 regular meeting. Com. Dunn seconded the motion. BUFFALO GROVE ROAD, EXODUS COMMUNITY CHURCH — SIGN CODE, SECTION 14.20.010, TO INSTALL A GROUND SIGN THAT WOULD EXCEED 5' IN HEIGHT; WOULD EXCEED THE ALLOWABLE SQUARE FOOTAGE FOR ALL SIGNS BY 32 SQUARE FEET; AND WOULD ENCROACH INTO THE REQUIRED BUILDING SETBACK AREA Jeremiah Yi, Senior Pastor, Exodus Community Church. 385 S. Buffalo Grove Road, was present and sworn in. The public hearing notice published in the Daily Herald on September 24, 2007 was read. Mr. Yi explained that they need a sign that contains both Korean and English. One fifth (1/5) of the congregation speaks English. When driving northbound on Buffalo Grove Road, the current sign is small and church members have missed the building. When they purchased the building, they cleaned up the property. The previous owners still rent space in the building and complimented them on the property clean up. Ch. Entman read the Village Engineer's memorandum addressed to Edward Schar dated October 1, 2007 which states: "As I interpret the survey the existing parkway is about 16.5' wide (in other words the property line is 16.5' east of the existing back of curb). We recommend the sign DRAFT ZONING BOARD OF APPEALS PAGE 4 of 6—OCTOBER 16, 2007 be setback then (10') from the property line to provide adequate setback form any future sidewalk." Ch. Entman asked if the Petitioner has seen this report. Mr. Yi responded that he has seen the report. Ch. Entman stated that there is an existing wall sign at this location and advised that any approval of the proposed sign may be conditioned upon the removal of the existing wall sign. Mr. Yi replied that he has no objection to removing the wall sign. Mr. Schar advised that part of the base (that which contains the email address) is included in the overall square footage of the sign. Ch. Entman stated that he has an issue with the size of the proposed sign. He may also have an issue with the size of the English lettering. Corn. Sandler does not have any issues with the content or coloring of the proposed sign. The size may be too large,but with the visibility issue, he may allow a larger sign. Corn. Dunn also does not have any issues with the content or colors of the proposed sign. She does believe that the sign is too large and suggested to possibly make the sign wider rather than taller. She also would like the hours of illumination to be restricted to 10:00PM. Ch. Entman added that the height should be reduced no greater than six feet (6'). The width is OK. The English lettering should be larger. Mr. Yi responded that 90% of the congregation does not speak English. Consideration should also be given to the base of the sign that will require landscaping. Ch. Entman suggested to the Petitioner to come back with several different sign options based upon the comments of the Commissioners and pursuant to the Village Engineer's report. Mr. Yi asked for more specifics concerning the height of the sign. Ch. Entman replied that the sign should not be greater than six feet (6'). Mr. Yi asked if he reduces the width of the sign could he make it taller. Ch. Entman advised that it may be beneficial to have their sign contractor contact the Village to discuss the size and location requirements. Mr. Yi added that the sign would be up against the building and would be useless. Corn. Sandler suggested narrowing the width of the sign and possibly increasing the height. He does not want to see the proposed higher than what is currently proposed, but based on the circumstances, would like to see several options. Ms. Young Green, 385 S. Buffalo Grove Road, was present and sworn in. She clarified the request of the Commissioners for several different options. She also added that the name of the church is very long. Buffalo Grove Road, for variance of Sign Code, Section 14.20.010, pertaining to Residential Districts, to the next regular meeting scheduled for Tuesday, November 20, 2007. Com. Dunn seconded the motion. Roll Call Vote: AYE—Stein, Dunn, Sandler, Lesser, Entman NAY—None ABSTAIN—None Motion Passed 5 to 0. Item to appear on the November 20, 2007 Zoning Board of Appeals agenda.
