Windecker made a motion to approve the minutes of the Zoning Board of Appeals regular meeting held on Tuesday,July 16, 2013. Corn. Lesser seconded the motion. BUFFALO GROVE ROAD, NEWPORT EQUITIES, LLC - SIGN CODE, SECTION 14.16.030; SECTION 14.16.060 AND SECTION 14.16.070; FOR THE PURPOSE OF ALLOWING A GROUND SIGN TO BE LOCATED WITHIN TWO HUNDRED FIFTY FEET (250) OF AN EXISTING GROUND SIGN LOCATED ON THE SAME SIDE OF THE STREET; AND FOR THE PURPOSE OF ALLOWING ZONING BOARD OF APPEALS AUGUST 20, 2013 PAGE 1 of 6 - (;11 Jjj • \-11 Li MULTIPLE WALL SIGNS IN ADDITION TO THE ONE ALLOWED CHASE WALL SIGN WITH A CHASE LOGO THAT WILL BE LOCATED ON THE EAST ELEVATION OF THE BUILDING OVER THE ENTRANCE AND FACING THE PUBLIC RIGHT OF WAY AS FOLLOWS: TO ALLOW A CHASE WALL SIGN WITH A CHASE LOGO AS WELL AS A SEPARATE CHASE LOGO ON THE NORTH ELEVATION OF THE BUILDING THAT DO NOT FACE THE PUBLIC RIGHT-OF-WAY; TO ALLOW A CHASE WALL SIGN WITH A CHASE LOGO ON THE WEST ELEVATION OF THE BUILDING THAT DOES NOT FACE THE PUBLIC RIGHT-OF-WAY; AND TO ALLOW A CHASE WALL SIGN WITH A CHASE LOGO AS WELL AS A SEPARATE CHASE LOGO ON THE SOUTH ELEVATION OF THE BUILDING THAT DO NOT FACE THE PUBLIC RIGHT-OF-WAY, FOR CHASE BANK, 850 S. BUFFALO GROVE ROAD Mr. John Streetz, Doyle Signs, 232 W. Interstate Road, Addison, Illinois 60101, was present and sworn in. The public hearing notice published in the Daily Herald on June 27, 2013 was read at the July 16, 2013 public hearing. Mr. Streetz explained that he met with Village staff and provided three (3) different sign options for consideration. Additional Appearance Review Team (ART) meeting were held on July 22, 2013 and July 30, 2013. The ART came to a consensus regarding signage they would recommend for approval. Mr. Streetz advised that he misspoke at the previous public hearing concerning the existing Chase branch located inside the Dominick's. This branch will remain inside the Dominick's location. Mr. Streetz distributed a new, double-sided, color rendering depicting the signs that the ART has recommended. This rendering is labeled Drawing Number 11-2857-11, Page 4 and Page 5. This was accepted and marked as Exhibit "R". Mr. Streetz also distributed a color photograph depicting the EIFS logos with the blue up-lighting. This was accepted and marked as Exhibit "S". Mr. Streetz reviewed the proposed signs as depicted on Exhibit "R": East Elevation —There is no change to the wall sign as originally proposed; North and South Elevations —EIFS logos with blue external up-lighting; West Elevation —The wall sign has been reduced to 1'4" in height and includes the Chase letters and logo; Ground Sign —The proposed ground sign has been reduced to 40 square feet of copy area. Mr. Streetz further explained that the proposed west elevation wall sign will provide visibility to customers in the adjacent shopping center. The proposed EIFS wall signs on the north and south will provide visibility to Buffalo Grove Road and Dundee Road and offer immediate identification. The proposed blue up-lighting will be attractive. Ch. Entman stated that the authorization issue concerning Doyle Signs being authorized to represent the Petitioner has been resolved. Com. Lesser asked if the blue up-lighting for the EIFS logos is normally used or is it being proposed for this specific location. Mr. Streetz responded that the blue up-lighting has been being used at all the new Chase locations for the last couple of years. ZONING BOARD OF APPEALS AUGUST 20, 2013 PAGE 2of6 Mr. Terry Roswick, VP, Real Estate Deal Manager, Chase Bank, 131 S. Dearborn Street, Floor 5, Chicago, Illinois 60603, was present and sworn in. Mr. Roswick explained that the blue up- lighting is standard lighting for all new stores. He agrees with the recommendation of the ART regarding the use of the EIFS logos and the reduced size of the signage. Com. Windecker asked about the ATM sign on the west elevation, marked as Sign 20 on Exhibit "R". Mt. Streetz stated that sign is still included in the proposed sign package. Com. Windecker asked about the dimensions of that sign. He asked why the west elevation wall sign is necessary. Chase Bank is listed on the ground signs along both Buffalo Grove Road and Dundee Road. He asked how many signs Chase Bank needs? Mr. Streetz stated that the ATM topper is proposed at 6" high by 3'5" in length. However, the ATM topper can be removed if the Zoning Board of Appeals (ZBA) requests. Com. Windecker stated with the Chase branch inside Dominick's staying,there will be a lot of signs. Ch. Entman stated that he has reviewed the revised proposed signs. He would recommend that the ATM topper be removed from the proposed sign package. He also suggests that the hours of illumination of the illuminated signs and the blue up-lighting be discussed. He would like to see the signs turned off at some point at night. There is the signage for the branch inside Dominick's including a wall sign; two ground signs, one on Dundee Road and one on Buffalo Grove Road; a new ground sign on Buffalo Grove Road; and four new wall signs. The EIFS signs reduced clutter but this would still be a lot of signage. Corn. Lesser stated that he is open to allowing continuous illumination for safety reasons. He would also suggest including language in the motion that if the Chase branch vacates the space inside the Dominick's that the signage associated with that branch be removed. Corn. Windecker added that no additional copy or language should be added to the proposed ground sign or base at all. Mr. Streetz requested that the hours of illumination for the proposed sign not be restricted for safety reasons. He added that there is no plan to put any additional language or graphics on the ground sign. He understands the need for the condition to remove the signs associated with the Chase branch in Dominick's if they vacate the space. Corn. Windecker asked if all the signs need continuous illumination. Mr. Streets stated that if the illumination would be restricted, he would request the west elevation sign be allowed continuous illumination for the safety of customers using the ATM at night. There were no additional questions or comments from the Commissioners. There were no questions or comments from the audience. Com. Windecker made the following motion: ZONING BOARD OF APPEALS AUGUST 20, 2013 PAGE 3 of 6 I move we recommend to the Village Board to grant the amended request made by Newport Equities, LLC, Doyle Signs, 232 W. Interstate Road, Addison, Illinois 60101 on behalf of Newport Equities, LLC, 830 S. Buffalo Grove Road, Suite 106, Buffalo Grove, Illinois 60089, for variance of Sign Code, Section 14.16.030, pertaining to Business Districts; Section 14.16.060, pertaining to Ground Signs; for the purpose of allowing a ground sign to be located within two hundred fifty feet (250) of an existing ground sign located on the same side of the street; and variance of Sign Code, Section 14.16.030, pertaining to Business Districts; and Section 14.16.070, pertaining to Wall Signs, for the purpose of allowing multiple wall signs in addition to the one allowed Chase wall sign with a Chase logo that will be located on the east elevation of the building over the entrance and facing the public right of way for Chase Bank, 850 S. Buffalo Grove Road, subject to the following conditions: 1. The signs are to be installed pursuant to Drawing Number 11-2857-11, Page 4 and 5, known as Exhibit "R", with the exception of Sign #20 (ATM topper) which is to be removed; 2. The ground sign is to be located pursuant to Drawing Number 11-2857-10, Page 3, in Exhibit "P". No changes are allowed to the copy of the ground sign without the review and approval of the Zoning Board of Appeals; 3. The ground sign is to be landscaped pursuant to the approved landscape plan known as Exhibit "K"; 4. Hours of illumination are restricted to 11:00p.m. with the exception of the west elevation wall sign and under canopy lighting for the drive thru area which shall be allowed continuous illumination; 5. Subject to the Village Engineer's memorandums dated July 1, 2013 and July 22, 2013; 6. Subject to the Appearance Review Team minutes dated July 2, 2013, July 22, 2013 and July 30, 2013; and 7. If the Chase Bank branch located within Dominick's, 770 S. Buffalo Grove Road, vacates the space, the wall sign and tenant panels associated with this branch location are to be removed. Pursuant to Sign Code, Section 14.40.010, Subsections A and B. Corn. Shapiro seconded the motion. ZONING BOARD OF APPEALS AUGUST 20, 2013 PAGE 4 of 6 4 STRATHMORE COURT,CHUNBANG LI-FENCE CODE,SECTION 15.20.040,FOR THE PURPOSE OF CONSTRUCTING A SIX (6) FOOT TALL WOOD PRIVACY FENCE WITH A TWO (2) FOOT LATTICE TOP,FOR AN OVERALL HEIGHT OF EIGHT(8)FEET,ALONG THE REAR PROPERTY LINE Mr. Chunbang Li, 4 Strathmore Court, was present and sworn in. the public hearing notice published in the Daily Herald on July 25,2013 was read. Mr. Li explained that he currently has a six(6)foot high fence that needs to be replaced.The plan is to build a six (6)foot high privacy fence with a lattice top. His property backs up to a commercial shopping center.There are a lot of trucks that drive past his property and there are numerous trash dumpsters located behind the center. Hi property is very close to the shopping center. He would like privacy from the shopping center. His rear yard slopes down at the back of the yard towards the shopping center.Two of his neighbors already have eight(8)foot high fences. Ch. Entman read the Village Engineer's memorandum addressed to Brian Sheehan dated July 26, 2013 which states: "I see no problems with this fence installation." Ch. Entman confirmed that the proposed fence would be a wood privacy fence. Com. Lesser asked Mr. Li if the proposed fence would be located just along the rear property line. Mr. Li stated that is correct. Corn. Lesser asked Mr. Li is he will install a five (5)foot high wood privacy fence along the side property lines.Mr.Li responded yes.Com.Lesser stated that he understands the need for the fence and supports the request. Com.Windecker stated that it is a horrible situation behind the Petitioner's property. He asked Mr. Sheehan if the Village has regulations that require trash containers to fit into enclosures. Mr.Sheehan responded that the Village does not regulate the size of trash containers,that the size is based upon the needs of the business. Mr.Zill Khan, 3 Strathmore Court,was present and sworn in. Mr. Khan advised that he serves on the Plan Commission for the Village for twelve(12)years. He supports the request made by Mr.Li.He has lived at his address for twelve(12)years and Mr.Li has been his neighbor for the last ten (10) years. The properties at 1 Strathmore Court and 2 Strathmore Court both have eight(8)foot fences. Mr. Li is always improving the inside and outside of his home. He agrees that the garbage containers are too large for their enclosures at the shopping center. The requested eight (8) foot high fence will help stop Mr. Li's view of the back of the shopping center. There were no additional questions or comments from the Commissioners. Com.Lesser made the following motion: Li ZONING BOARD OF APPEALS AUGUST 20,2013 PAGE 5of6 I move we grant the request made by Chunbang Li, 4 Strathmore Court, for variance of Fence Code, Section 15.20.040, pertaining to Residential Districts, for the purpose of constructing a six (6) foot tall wood privacy fence with a two (2) foot lattice top, for an overall height of eight (8) feet, along the rear property line. Subject to the Village Engineer's memorandum dated July 26, 2013. The Petitioner has demonstrated hardship and unique circumstances. The proposed fence will not be detrimental to the public health, safety and welfare and will not alter the essential character of the neighborhood. Com. Windecker seconded the motion. Roll Call Vote: AYE — Steingold, Windecker, Lesser, Shapiro, Entman NAY — None ABSTAIN — None Motion Passed 5 to 0. Findings of Fact attached. The permit may be issued in fifteen (15) days — September 5, 2013. ANNOUCEMENTS Mr. Sheehan reviewed the outcome of the appeal made by BG Car Wash Management. The Village Board overturned the ZBA denial by a vote of 3-2. An Ordinance will be presented to the Village Board and will need at least 4 affirmative votes to approve. This Ordinance is scheduled to appear on the September 9, 2013 Village Board agenda. ADJOURNMENT Motion to adjourn the meeting was made by Com. Lesser and seconded by Com. Windecker.
