ZONING BOARD OF APPEALS
VILLAGE OF BUFFALO GROVE, ILLINOIS
TUESDAY, APRIL 15 , 1997
I . CALL TO ORDER
Chairman Richard Heinrich called the Zoning Board of Appeals
meeting to order at 8 : 00 P . M . on Tuesday, April 15 , 1997 in
the Council Chambers of the Village Hall , 50 Raupp Blvd .

A. 296 Windsor Drive , Vladimir Zelenetsky
Fence Code , Section 15 . 20 . 040
6 ' Wood Fence to Replace Existing 6 ' Wood Fence
Mr . Vladimir Zelenetsky was sworn in . Notice of the
public hearing was published in the Buffalo Grove Herald
on March 26 , 1997 . Mr . Zelenetsky summarized the reasons
for requesting a variance of the Fence Code :
1 . The existing six foot ( 6 ' ) wood fence has
deterioriated and needs to be replaced .
2 . The elevation of his neighbor' s yard to the
rear is much higher and the fence will provide
privacy.
3 . All the neighbors have six foot ( 6 ' ) fences
and they do not object to the proposed fence .

Comments from Commissioners:
Com. Paul asked if any of the neighbors were present?
Mr. John Seno, 306 Windsor Drive was present . He lives
just south of the Zelenetskys and said he supports the
application for the variance because he likes the privacy.
Com. Windecker, Com. Entman and Com. Hefler had no questions
or objections .
Com. Windecker made the following motion:
I move we grant the request of Vladimir Zelenetsky,
296 Windsor Drive, for variance of Fence Code,
Section 15 . 20 . 040, pertaining to Residential
Districts, for the purpose of constructing a six
foot (6 ' ) wood stockade fence to replace an exist-
ing six foot (6 ' ) wood fence .
Fence to be constructed pursuant to the Plat of
Survey submitted with the application.
Unique circumstances having been demonstrated, the
proposed fence will not be detrimental to to the
public health, safety and welfare.
Com. Paul seconded the motion.
Roll Call Vote : AYE - Entman, Hefler, Paul,
Windecker and Heinrich
NAY - None
Motion Passed - 5 to 0 . Findings of Fact Attached.
Permit may be issued in 15 days - after May 1, 1997 .
B. 160 Copperwood Drive, John and Tina Kapinos
Fence Code, Section 15 .20 . 040 - 4 ' Wood Fence Past
the Building Line along Thompson Boulevard
Mr. John Kapinos was sworn in. Notice of the public hearing
was published in the Buffalo Grove Herald on March 26, 1997 .
Mr. Kapinos summarized the reasons for requesting a
variance :

1 . They have a corner lot that backs up to
the Westchester Park. There are many people
pass by the house every day and some cut
through the yard.
2 . The fence will permit the children to
play safely without danger from dogs .
3 . The variance will permit the fence to
enclose some existing landscaping.
4 . The fence will make the house less
accessible to would-be theives .
The fence will be four feet (4 ' ) in height and will be
open picket . None of the contiguous neighbors object .
Ken and Christine Tanaka, 156 Copperwood, provided a
letter endorsing the variance.
The Village Engineer' s Review, dated March 31, 1997,
states : "The limiting factor at the intersection is the
principal structure itself . The abutting property is a
park. "
Comments from Commissioners :
Com. Hefler said considering the park to the rear and
the way the road curves, he has no objections. There
have been no objections from neighbors.
Com. Entman, Com. Paul and Com. Windecker had no questions
or objections.
Com. Entman made the following motion:
I move we grant the request of John and Tina
Kapinos, 160 Copperwood Drive, for variance of
Fence Code, Section 15 .20 . 040, pertaining to
Residential Districts, for the purpose of
installing a four foot (4 ' ) cedar picket fence
that would extend eight feet (8 ' ) past the
building line along Thompson Boulevard, be
granted. Fence to be installed pursuant to
Exhibit A, submitted with the application.
Construction materials to be approved by the
Village.

C. 600 N. Buffalo Grove Road, Indeck Energy Services
Zoning Ordinance, Section 17 .36 . 040
Permit less than the required number of stacking
spaces for the American Enterprise Bank
Mr. James Schneider, P.E. , Indeck Energy Services, Inc .
1130 Lake Cook Road, Buffalo Grove, Il 60089 (520-3212) and
Mr. David Schroeder, American Enterprise Bank, 600 N.
Buffalo Grove Road, Buffalo Grove, IL 60089 were sworn in.
Notice of the Public Hearing was published in the Buffalo
Grove Herald on March 29, 1997 .
Mr. Schroeder summarized the reasons for requesting a
variance that will permit the reconfiguration of the
stacking to provide a safer and more efficient access to
the drive-thru teller lanes.
The original plan and the revised plan were discussed. Ch.
Heinrich observed that the stacking area has been widened
but the number of cars that can be stacked has been reduced.
Mr. Schroeder said the number of cars that can be stacked is
equivalent to the original design. A total of 26 cars can
be stacked but they do not anticipate that many cars at any
one time. Lane #5 could have six (6) cars. Lane #4 and lane
#3 could have five plus (5+) cars . Lane #2 could have five
(5) cars and lane #1 about one (1) car less. The original
design has a tight turn and they tried cars on the gravel
driveway. Because of the funnel design it is hard to get
the cars into the lanes, especially Lane #5 .

The Village Engineer' s Review, dated March 31, 1997, states :
"The comments of the Village traffic consultant have been
incorporated. "
Ch. Heinrich commented that First Midwest Bank has a similar
number of lanes and there are never that many cars stacked.
Com. Hefler concurred with that statement and said the same
thing is true at the First of America Bank.
Mr. Schroeder said one teller is usually responsible for two
(2) lanes. The first lane is for the ATM Machine and night
bank drop only so they actually have four (4) active drive-
in lanes and they have the ability to have three (3) tellers
for the four (4) lanes . This will eliminate any problems.
Com. Hefler affirmed the revision because it eliminates the
danger of drivers trying to jockey for position.
With reference to the use of the parking area, there are not
a lot of office employees using the spaces at busy banking
times, after 5 P.M. on Friday and on Saturdays .
Comments from the Audience :
Mr. Mark Zorfas, 613 Harris, was present and asked to see he
site plans. After reviewing the entrances and being
assured that there will be no effect on the residential
area, Mr. Zorfas had not objections .
Comments from Commissioners :
Com. Hefler, Com. Windecker and Com. Paul had no questions .
Com. Windecker said he banks at American Enterprise Bank
but this will not affect his decision.
Ch. Heinrich said considering the flow of traffic and the
need for decision making, the proposed plan will help avoid
some accidents.

Com. Paul made the following motion:
I move we recommend to the Village Board of Trustees,
that the variance requested by Indeck Energy Services,
Inc. , 1130 Lake Cook Road, for variance of Zoning
Ordinance, Section17.36 . 040, pertaining to Parking
Requirements, for the purpose of permitting less than
the required number of stacking spaces for the American
Enterprise Bank at 600 N. Buffalo Grove Road, be
granted.
The Village Engineering Review, dated March 31, 1997,
is attached.
Pursuant to Criteria for Variation Zoning Ordinance,
Section 17 . 52 . 070,Section A. 1 - the property in
quetions cannot yield a reasonable return under the
conditions allowed by the regulations of the zoning
district in which it is located.
Petitioner having demonstrated unique circumstances
the proposed variance will not alter the essential
character of the neighborhood.
Com. Windecker seconded the motion.
Roll Call Vote : AYE - Entman, Hefler, Paul,
Windecker and Heinrich
NAY - None
Motion Passed - 5 to 0 . Findings of Fact Attached.
An Ordinance will be prepared and the item will be
placed on the Village Board Agenda, April 28, 1997 .
V. ANNOUNCEMENTS
Mr. Schar distributed minutes from a variance that was
granted August 17, 1997 for the purpose of constructing
an addition at 1100 Hidden Lake Drive, that would encroach
a distance of six and one half feet (6-1/2 ' ) into the
required forty foot (40 ' ) rear yard setback and eight feet
(8 ' ) into the required thirty foot (30 ' ) corner yard set-
back. The materials for the addition were to match the
existing house.

Construction plans for the addition were never submitted
and the petitioner, Mrs. Janet Franchi, has requested
approval of a patio enclosure that would be constructed
of aluminum and glass . A diagram of the proposal was
submitted and Mr. Schar asked for the Commissioners'
opinion.
Ch. Heinrich observed that the size and scope of the
proposed construction is not a typical patio enclosure.
He advised Mr. Scahr to inform Mrs. Franchi that it would
be in her best interest to consult an architect and decide
what she wants before hiring a contractor to do the
work. He offered to talk to her if she would like his
opinion regarding the construction of the proposed
enclosure. One problem would be the slope of the roof.
It was the consensus of the Commissioners that the variance
granted it was based an entirely different design and that
variance has expired, so Mrs. Franchi should decide what
she wants and apply for a new variance, if necessary.
Mr.Skelton was in agreement with this decision.

Mr. Schar will inform Mrs. Franchi that the variance has
expired and it cannot be extended.
VI . ADJOURNMENT
Com. Windecker made a motion to adjourn.
Com. Paul seconded the motion.
Ch. Heinrich adjourned the meeting at 8 :45 P.M.
