ZONING BOARD OF APPEALS
VILLAGE OF BUFFALO GROVE, ILLINOIS
TUESDAY, JANUARY 16, 1996
I. CALL TO ORDER
Chairman Richard Heinrich called the Zoning Board of Appeals meeting to
order at 7:38 P.M. on Tuesday, January 16, 1996 in the Council Chambers
of the Village Hall, 50 Raupp Boulevard.
II. ROLL CALL
Commissioners Present: B. Entman, L. Windecker, H. Hefler and
R. Heinrich Quorum.
Commissioners Absent: J. Paul and A 2(3�
Bldg. Dept. Liaison: Edward Schar, Deputy Building Commissioner
Village Attorney: Richard Skelton
III. APPROVAL OF MINUTES
A. October 17, 1995 - Postponed until the next regular meeting.
B. November 21 , 1995 - Postponed until the next regular meeting.
IV. BUSINESS
A. 801 Summer Court, David Stone
Municipal Code, Section 15.20.040 - Purpose:
Construction of fence past building line along Sheridan Road.
Mr. David Stone was sworn in and the public hearing notice was read.
He summarized the reasons for requesting a variance that would permit
construction of a five foot (5') wood fence that would extend past the
building line along Sheridan Road:
1 . The fence will protect their two (2) small children and
confine their dog. If the fence is constructed within the
building line, the yard would be smaller than average and
decrease the value of the property.
2. The lot is located at the corner of Summer Court and
Sheridan Road. Sheridan Road is the main street leading
into the subdivision, so the fence will block traffic noise
and keep car headlights from shining into the house.

`-/ Mr.Stone requested a variance to permit the fence to be constructed
from ten(10)to twelve(12)feet past the building line and permit a gate
to be installed in the side yard. He selected a picket style wood fence.
Mr.Stone said he has talked to most of the neighbors.
Ch.Heinrich read a letter of concern from Mrs.Caryn Golin at 2067
Sheridan Road. She thought the fence was going to be very close to the
sidewalk and that it would be an obstruction.
Mr.Schar said that after he showed Mrs.Golin the plat of survey and
explained the proposed location,she said she had no objections.
The Village Engineer's Line-of-Sight Review,dated January 8, 1996,states:
"The limiting factor at the intersection is the principal structure itself."
Comments from Commissioners:
Com.Windecker: Would prefer the distance be limited to the width of
a gate,which is less than eight feet(8'). He observed the curve of Sheridan
Road and said the fence would be in the neighbor's front yard and could
devalue their property.
Mr.Stone responded that the fence contractor recommended that the fence
extend ten feet(10')past the building. They lost ten feet(10')of side yard
because they selected a side load garage. The house was moved up ten
feet(10').
Com.Entman commented that the back yard would be large at the building
line,but he would not object to a length of fence that would permit a gate.
He informed Mr.Stone that it requires an affirmative vote of four(4)to
grant a variance and there are only four(4)Commissioners present so
Mr.Stone can ask for the fence to be Tabled until the next meeting when
two(2)other Commissioners could be present.
Ch.Heinrich had no objection to a fence that would extend no more than
ten feet(10')past the building line. This would be a distance of twenty-
one feet(21')from the sidewalk. The lot is large but it narrows down to
about fifty feet(50')at the rear. Considering the other Commissioners'
comments,he recommended a variance of eight feet(8')which is usually
the length of one(1)fence section.

Corn. Hefler had no objection to a fence that would be eight feet (8') past
the building line that would permit a gate.
Mr. and Mrs. Andrew Were, 2042 Sheridan Road, and two other neighbors
were present but they had no objections.
It was the consensus of the Board to permit a fence that would extend
eight feet (8') from the corner of the house. Mr. Stone agreed to so amend
the petition.
Mr. Schar asked if the fence would be perpendicular to the sidewalk or if
it would be in line with the house?
Mr. Stone said he would prefer the fence to continue the line of the house
and be parallel to the sidewalk.
Corn. Windecker made the following motion:
I move we grant the request of David Stone, 801 Summer Court,
for variance of Municipal Code, Section 15.20.040, pertaining to
Residential Districts, for the purpose of constructing a five foot
(5') wooden picket fence that would be constructed a distance of
eight feet (8') past the building line along Sheridan Road, from the
rear of house extended, as indicated on the amended plat of survey.
Unique circumstances having been demonstrated, the proposed
fence will not alter the essential character of the neighborhood and
will not be detrimental to the public health, safety and welfare.
Corn. Hefler seconded the motion.
Roll Call Vote: AYE - Entman, Windecker, Hefler and Heinrich
NAY - None
Motion Passed - 4 to 0. Findings of Fact Attached.
Permit may be issued in fifteen (15) days, February 1, 1996.
