CALL TO ORDER Chairman Richard Heinrich called the Zoning Board of Appeals meeting to order at 7 : 40 P . M. on Tuesday, November 21 , 1995 in the Council Chambers of the Village Hall , 50 Raupp Boulevard . II . ROLL CALL Commissioners Present : J. Paul , L . Windecker, L . Arbus , H. Hefler and R . Heinrich. QUORUM. Commissioners Absent : B . Entman Bldg . Dept . Liaison : Edward Scharf Deputy Building Commissioner III . APPROVAL OF MINUTES Postponed until next regular meeting . IV . BUSINESS A. 427 Lamont Terrace , Irvine J. and Marcia B . Solomon Zoning Ordinance , Section 17 . 40 . 020 Purpose : Construction of Addition that would encroach 3 ' into the 35 ' Required Rear Yard Setback Irvine and Marcia Solomon were sworn in and the public hearing notice was read . Mr . Solomon summarized their reasons for requesting a variance : 1 . They would like to construct a Three-Season Room and were informed that their rear yard setback is thirty-five feet (35 ' ) , not thirty- feet (30 ) , so they need a variance of three feet (3 ' ) . 7'8 (ft Tr 2 . They have a pool in the rear yard that Mrs. Solomon uses for water exercise therapy for arthritis. She has had to enter the pool from the back because of the grading. 3 . The Three-Season Room will be connected to an existing deck so they are the same level as the pool and provide easy entry. 4 . The Three-Season Room will also be used for family enjoyment and permit outside dining. 5 . The proposed addition will add to the property value and enhance the aesthetics of the area. Ch. Heinrich asked if the Solomons have informed their neighbors of the proposed addition? Mr. Solomon said they have talked to the owners of 425 Lamont, but not to the owners of 1215 Lockwood. The room will not be heated and will not be used in the winter. Comments from Commissioners : Com. Hefler: No questions or objections . Com. Paul : Should not have any impact on neighbors. The pool is closer to the neighbors than the room will be and there are trees in the area. No problem. Com. Windecker: Asked if the room will be constructed with glass and aluminum? Mr. Solomon said it will have a series of doors with screens and the aluminum siding will match the house. Com. Arbus : No questions or objections. The Village Engineer' s Review, dated August 30, 1995 (?) States : "The proposed addition should not affect the existing drainage in the area. " No questions or comments from the audience. Windecker made the following motion: I move we GRANT the request of Irvine and Marcia Solomon, 427 Lamont Terrace, for variance of Zoning Ordinance, Section 17.40.020, pertaining to Area, Height, Bulk and Placement Regulations, for the purpose of constructing a Three-Season Room that would encroach a distance three (3') into the required thirty-five foot (35') rear yard setback. Materials should match the existing construction in like kind and quality. Addition to be constructed in accordance with plans submitted to and approved by the Village. Petitioner has exhibited hardship and unique circum- stances. The proposed addition will not alter the essential character of the neighborhood. Conditions: Construction to conform with Village Engineer's Review dated August 30, 1995 (?) . Com. Arbus seconded the motion. Roll Call Vote: AYE - Paul, Windecker, Arbus, Hefler and Heinrich NAY - None Motion Passed - 5 to 0. Findings of Fact Attached. Permit may be issued in fifteen (15) days - Dec. 7, 1995. V. ANNOUNCEMENTS - None. VI. ADJOURNMENT Com. Arbus made a motion to adjourn. Com. Windecker seconded the motion. Ch. Heinrich adjourned the meeting at 7:47 P.M.
