CALL TO ORDER In the absence of Chairman Richard Heinrich , Commissioner Mike Kearns chaired the meeting and it was called to order at 8 : 04 P . M . on Tuesday , February 16 , 1993 at Chipper ' s Restaurant , 48 Raupp Blvd . II . ROLL CALL Commissioners Present : M . Kearns , B . Entman , L . Windecker , L . Arbus and H . Hefler . QUORUM . Commissioners Absent : R . Heinrich and J . Paul Bldg . Dept . Liaison : Edward Schar , Deputy Building Commissioner Village Attorney : Tom Dempsey Trustee Bruce Kahn (V . B . Liaison) was attending the Village Board Meeting which was held on this night at the Village Hall . III . APPROVAL OF MINUTES January 20 , 1993 - Motion to approve was made by Com . H . Hefier and seconded by Com . Arbus . Correction on Page q : Com . Entman noted the directions pertaining to the Betz ' fence at White Pine Road were reversed . Roll Call Vote : AYE - Entman , Arbus , Hefler and Kearns NAY - None ABSTAIN - Windecker Motion to approve the January 20 , 1993 minutes as corrected passed . IV . BUSINESS 2911 Bayberry Road , Robert J . and Debra Scott Zoning Ordinance , Section 17 . 40 . 020 , Pertaining to : Area , Height , Bulk and Placement Regulations - 1 foot into side yard Mr . Robert J . Scott , Jr . was sworn in and the public hearing notice was read . Mr . Scott summarized the reasons for requesting a :1:1111 variance : 1 . They had twins last May and now have 4 children . aim Their house is too small , so they are going to construct a 2-story addition at the rear and they also want to expand their kitchen . 2 . The kitchen addition would require a 1 -foot variance CI) into the required 8-foot side yard setback . 3 . They like the area they live in and their children have good relationships with neighbor ' s childrens so they want to stay in Buffalo Grove . They looked around mmic: and found it would be too expensive for them to purchase a new house . • • Comments of Commissioners : Com . Hefler : No questions or objections . Com . Windecker : Verified that the additions will match the house . Com . Entman : Asked if neighbors have been informed . Mr . Scott said he has talked to all his neighbors and none of them object . The 2-story addition will include a new bed- room , bathroom and a sitting room off of the master bedroom . They reduced the size of the addition to comply with the required rear yard setback , but need the extra foot to expand the kitchen area . The Village Engineer ' s Review , dated February 2 , 1993 , states : The proposed addition will not affect the existing drainage . pattern . Mr . Scott was informed that the addition cannot encroach into the side yard easement . " Com . Arbus : The variance is minimal and since there are no neighbors ' objections , he is not opposed . Com . Arbus made the following motion : I move we grant the request made by Debra and Robert J . Scott , Jr . , 2911 Bayberry Drive , for variance of the Zoning Ordinance , Section 17 . 40 . 020 , pertaining to Area , Height , Bulk and Place- ment Regulations , for the purpose of constructing a 1 -story addition that would encroach a distance of one foot ( 1 ' ) into the required eight foot ( 8 ' ) side yard setback pursuant to the plat of survey ( Exhibit A ) submitted with the application . The roof and siding are to match the existing materials . The owner has demonstrated that his plight is due to unique circumstances . The proposed variance will not alter the essential character of the neighborhood and will not affect the existing draining pattern , per Village Engineer ' s Review , Exhibit Com . Entman seconded the motion . Roll Call Vote : AYE - Hefler , Windecker , Entman , Arbus and Kearns NAY - None Motion Passed - 5 to 0 . Findings of Fact Attached . Permit may be issued in 15 days - March 4 , 1993 . V . ANNOUNCEMENTS - The Sign Code draft should be ready next month . VI . ADJOURNMENT - Com . Windecker made a motion to adjourn . Com . Hefler seconded the motion . Voice Vote - AYE Unanimously Ch . Kearns adjourned the meeting at 8 : 21 P . M .
