CALL TO ORDER Chairman Richard Heinrich called the meeting of the Zoning Board of Appeals to order at 8 : 08 P . M . on Tuesday , January 15 , 1991 at the Village Hall , 50 Raupp Boulevard . II . ROLL CALL Commissioners Present : J . Paul , B . Entman , R . Lewandowski , H . Fields , L . Windecker and R . Heinrich Commissioners Absent : M . Kearns Bldg . Dept . Liaison : Ed Schar , Housing and Zoning Inspector Village Attorney : Tom Dempsey Village Board Liaison : Sid Mathias , Trustee III . APPROVAL OF MINUTES December 18 , 1990 - Correction : Page Eight , Paragraph 3 , Line 6 : 120 feet should be 120 square feet ( referring to the size of the two signs that would be permitted for Riverwalk by the Sign Code . Com . Entman made a motion to approve the minutes as amended . Com . Paul seconded the motion . Roll Call Vote : AYE - Paul , Entman , Lewandowski , Windecker and Heinrich NAY - None ABSTAIN - Fields Motion Passed - 5 to 0 , 1 abstention . Minutes of Dec . 18 , 1990 were approved and will be placed on file . IV . BUSINESS A . 320 Chateau Drive , Douglas and Phyllis Colby Zoning Ordinance , Section 17 . 40 . 020 , Pertaining to : Area , Height , Bulk and Placement Regulations Purpose : Construction of addition that encroach a distance of 1 foot into the required rear yard setback . Douglas A . Colby was sworn in and the Public Hearing Notice was read . Mr . Colby summarized the reasons for requesting a variance : 1 . ' The kitchen is too small for the family which includes a 2 year old child . 2 . They need a laundry room . There is a laundry closet , but there is no room `./ for an ironing board or clothes rack . The house has a basement , but to put the washing machine and dryer down there would require trips up and down from the 2nd floor . The proposed 10 foot addition would permit the kitchen space to be doubled, the dining room to be enlarged and a laundry room to be added. They need a 1 foot variance . Ch. Heinrich asked if they have considered constructing a 9 foot addition, without a variance? Mr . Colby said the builder told them the cost differential would be minimal and in order to construct an island area for the sink and dishwasher , they need at least 9 feet from the counter to the edge of the window to accommodate their table. The addition will be constructed with identical materials to match the existing house . Mr . Colby has discussed the proposed addition with his neighbors and there have been no objections . There were no objectors present . Comments from Commissioners: Com. Paul : The rear yard is 49 ft . deep and with the 10 ft . addition, the distance to the lot line will still be 39 ft . He had no objections . Com. Lewandowski : No objections . Com. Windecker : No objections. Com. Entman: Said he is acquainted with the petitioner , but this would not affect his decision. Asked Mr . Colby if moving to a larger house would be prohibitive? Mr . Colby responded that considering the condition of the housing market , they felt they could not afford to move. Com. Fields : When he visited friends across the street they said that there have been no objections among the neighbors. The Village Engineer ' s drainage review, dated January 9 , 1991 states : "The proposed addition will not alter the existing drainage pattern. " Com. Fields made the following motion: I move we grant the variance requested by Douglas and Phyllis Colby, 320 Chateau Drive, for variance of the Zoning Ordinance , Section 17 .40.020 , pertaining to Area, Height , Bulk and Placement Regulations , for the purpose of constructing a 1-story addition that would encroach no more than one foot ( 1 ' ) into the 40 foot required rear yard setback. Addition to be constructed pursuant to plans submitted to and approved by the Village. The petitioner has exhibited hardship and unique circumstances . The proposed addition will not be detrimental to the essential character of the neighborhood. Com. Windecker seconded the motion. Roll Call Vote: AYE - Paul , Lewandowski , Windecker , Entman, Fields and Heinrich NAY - None Motion Passed - 6 to 0. Findings of Fact Attached. Permit may be issued in 15 days . (January 30 , 1991 ) B. Riverwalk - Hamilton Partners Temporary Ground Sign - Review of Existing Variance Mr . Tim Beechick, Hamilton Partners , 1130 Lake Cook Road , Buffalo Grove , IL 60089 (459-8918) requested a one year extension for the existing Riverwalk marketing sign. The original variance was recommended on Oct . 17 , 1989 and the Village Board adopted Ordinance 89-85 on Nov. 6 , 1989 . It states : "The permit issued for this sign will be for a period of one (1 ) year , with renewal subject to ZBA review and recommendation. " Sign Code , Section 14 . 32 .010A - Time Limit : "The administrator may renew such permits for additional periods of up to one year upon written application Mr . Beechick said the sign has been in existence for about seven (7) months . The copy includes a mural of Riverwalk. Because the building is now up, the mural is not necessary. It has been removed from one side of the sign and in order to fulfill their technical obligation to Zenith to have some identification, copy has been put up that reads : RIVERWALK WELCOMES Zenith data systems , along with their logo. He distributed drawings of the proposed copy. The sign will include the names of other tenants. Mr . Beechick requested approval of the copy for both sides of the sign and added that they would like to change the names of the companies every two (2) months as new tenants move in. Mr . Dempsey said the copy changes could be made a part of the extended variance. ZONING BOARD OF APPEALS January 15 , 1991 - Page Three Ch. Heinrich noted that the new copy includes a travel agency and stated that the holding company he works for also owns a travel company but this will not affect his decision. He has seen the new sign and has no objections to the proposal . Com. Fields stated that Groupe Bull (owner of Zenith) is a tenant in one of his buildings in San Diego, but this will not affect his judgement concerning the sign. Comments from Commissioners: Com. Entman: No objection. Agreed it is a good idea to announce new tenants . Asked how much of the building is left to be leased and when will the sign be taken down? Mr . Beechick responded that it is about 2/3 leased and he has several good prospects . The existing sign will be taken down when the overpass is started. It will probably be down by the 4th quarter of this year . Com. Paul : No problem with the proposal . Com. Lewandowski : Have there been any complaints about the sign? Will the widening of Lake Cook Road have an impact on this sign by bringing it closer to the intersection? Mr . Beechick replied that there have not been any complaints. The sign will be removed as soon as construction begins because the county is purchasing the property. Com. Windecker : Would this sign be moved if the Zenith monument sign is not approved. Mr . Beechick said they will have to have something on the property with the name and phone number . They will review the leasing situation in a year , and if necessary, they will submit a marketing sign to the Appearance Commission for approval . Ch. Heinrich announced that Mr . Beechick requested the Combined Workshop with the Appearance Commission regarding monumental signage for Zenith be postponed until February 19 , 1991 because agreement has not been reached concerning height , etc . He asked Mr . Beechick to clarify if this is going to be Zenith' s headquarters and if the address is going to be used for sales tax purposes? If so, it would give some rational for signage. Mr . Beechick agreed to provide this information at the next workshop meeting. He stated on account of the holidays and getting Zenith moved in, they have not been able to focus on the sign issue . They have provided Zenith with some materials but they have not responded and he did not want to have further discussion without having some agreement between the parties . ZONING BOARD OF APPEALS January 15, 1991 - Page Four Mr . Dempsey commented that Mr . Beechick requested a review for the extension in December because the permit for the sign expired in November . There was no ZBA meeting in November , and the sign issue was continued from the December until this meeting, so it is timely for, the Zoning Administrator to grant the extension as requested. A recommendation should be made. Com. Entman made the following motion: I move we recommend to the Zoning Administrator of the Village of Buffalo Grove, approval of a one ( 1 ) year extension of the Riverwalk marketing sign, pursuant to the original approval which was recommended by this Board approximately a year ago , and pursuant to the exhibit that was submitted today by Mr . Timothy Beechickafor alteration of the marketing sign, with the caveat o'?,-provision that Riverwalk be allowed to change the copy on the left hand portion of the sign so as to identify new tenants at about 60 day intervals as needed. The expiration date of the extension shall be one (1 ) year from the expiration date of the prior ordinance and pursuant to the provisions that were applicable to that ordinance . Com. Paul seconded the motion. Roll Call Vote: AYE - Windecker , Lewandowski , Paul , Entman, Fields and Heinrich NAY - None Motion Passed - 6 to 0. Com. Fields asked Mr . Beechick to provide a copy of the clause in Zenith' s lease regarding the requirement of signage. Com. Entman recalled that Mr . Beechick had also agreed to provide a scale model or drawings of proposed signage , with the possibility of 2 - 120 square foot signs which would be located one at each end of the property. V. COMBINED WORKSHOP with Appearance Commission was postponed until February 19 , 1991 . VI . ANNOUNCEMENTS - None. ZONING BOARD OF APPEALS January 15 , 1991 - Page Five VII . ADJOURNMENT Com.
