1960-12-01 - Ordinance 1960-012 - LIQUOR CONTROL ORDINANCE- oRDINANCE N0.-O- &-t2 LIQUOR CONIROL ORD IMNCE BE IT ORDAIMD, by the Board of Trusteee of Ehe Village of Buffalo crove, Cook County, IlLinols, as follows: Section 1.Local Liquor Conunissioner Powers The President of the Board of Trustees of the Village of Buffalo Grove shall be the local Liquor Commiss ioner for the Village of BuffaLo Grove. Section 2. Risht to Sell nly such persons, firms or corporations as shaLl be granted a liquor license l"n accordance with the provisions of thie ordinance shalL be pemitted to ee1l or offer for sale, at retail, or to give away or to keep with the intention of selling at retail or giving away alcoholic liquors in the Village of Buffalo Grove. Section 3.{pplications. Applications for such license ehaLl be made Eo the Local Liquor Comrissioner in writing, signed by the applicant, if an individual, or by a duly authorized agent thereof if a eorporation, verified by oath or affldavit, and shall contain the following informatioa and statements: (1) The oame, age, and addreag of the applicant in the case of an individual; in the case of a co-partncrship, the persons entitLed to share in the profits thereof, and ln the cage of a corporation for profit, the date of incor- poration, the objects for which it was organized, the nameg and addresses of the officers and directors, and if a majority in interest of the stock of such corporation is owned by one peraon or his nominees, the name and address of such person; (2) The citizenship of the appllcant, his place of birth and if a naturalized cltizcn, the tlne and place of hls naturalization. (3) The character of business of the applicant; and in case of a corporation, the objects for which it was formed; (4) The length of time that 6aid appLicant has been in busineas of that character, or in the case of a corporation, the date on which its charter was iesued; (5) The location and description of the premlses or place of bueiness which is to be operated rurder euch license; (6) A statement whether applicant has made sinll.ar application for a simiLar other license on premises other than descrlbed in this appllcation, and the dleposltion of such appllcation. (7) A s tatement that applicant has never been con- victed of a felony and is not diequalified to receive a license by reason of any mptter o! thing contained in this -2- Ordinance, lawe of this State, or the Ordinances of this Vi11age. (8) I{hether a previous lLcenee by any atate or subdivielon thereof, or by the Federal Government has been revoked, and the reasona therefor. (9) A stateoeot that the applicant wilL not violate any of the Laws of the State of llllnois or of the United States, or any Ordlnance of the Vlllage in the coaduct of his place of business. Sectlon 4. Restriction on Licenses. No such license ehalL be issued to: (1) A person who is not of good character and reputation in the comruni ty in which he reeides. (2, A person who ls not a citizen of the United States. (3) A person who has been convicted of a fel.ony rmder the Lawe of the State of ILLinots. (4) A pcrson who has been convicted of being the keeper or is keeping a house of il1 fame. (5) A person who has been convicted of pandering or other crime or misdemeanor opposed to decency and morality. (6) A person whose license iosued under this Ordinance has been revoked for cause. (7> A person who at the time of appLication for re- newa 1 of any license issued hereunder would not be eligible for such license upon a firet appLlcation. -3- (8) A co-partnership, rmless aLL of the membere of such co-partnership, shall be qualified to obtain a licenge. (9) A corporation, if any officer, manage! or director thereof , or any stockholder or stockhola"r" 'S,l*gk in the aggregate more than five per cent (5%) of the stock of such corporation, would not be eligible to receive a License hereunder for any reason other than citizenship and residence wlthin the Village of Buffal_o Grove. (10) A person whose place of business ie conducted by a manager or agenE, rmless said manager or agent poeaegaea the same qual.ifications required of the licensee. (11) A person who has been convic ted of a violation of any Federal or StaEe law concerning the manufacture, pos- session or sale of alcohollc liquor, subseguent to February 1, 1.934. (12) A person who does not olrn the premises for which a license is sought, or does not have a 1eaee thereon for the full period for which the license is to be issued. (13) Any law enforcing public official, or member of the Vlllage Council. (14) Any pqrson, agsociation, or corporatlon not eligible for a State retail liguor dealerrs license. Sectlon 5. Isguance of License. A11 applications for licenses shal-I be kept -4- on file in the office of the Local Liquor Control Co'r'rise ioner, and the fees for all licenses ehalt be pald to the Village Clerk, who aha1l certify to the Local Liquor Control Cormis- sioncr the names and addresees of aL1 llcensees paying feee, together wlth the class of license for which payment Ls made, and thereupon the said Local Liquor Control Corurlssioner shall issue the license provided for in this Ordinance to applicants who have complied with all the reguirements of this Ordinance. Section 5. Claselfication - Fees. Such licenses shalL be, and are hereby divided into three (3) classes, to-wit: (r)Class A License shall authorize the retail sale of a1coho1lc liquors for consumption on or off spe- cified pramises . The annual fee for such license shall be Four Htm- dred Dollars ($400.00). Class A Licenses shall be United ln nunber as folLowe: (a) One license for the flrst 5000 lnhabltants; one addltlonal such Llcenee for each additlonal 5000 inha- bltants or fraction thereof. (2)Class B License shaIl authorize the retail sale of alcoholic liquors on the specified premises, for -5- consumption on the said premises only. The annua l- fee for such license sha11 be Three Hundred Fifry Dollars ($350.00). P ,' ' (. Class B licenses sha1l be limited in nurnber as follows: (a) One license for the first 2000 inhabitants; one additional such license for each additional 2000 inhabi- tants or fraction thereof. ) (3) Class C License sha11 authorize the retail sale of alL alcoholic liquors in lts original package only, not for consurytion on the premises where so1d. The annuaL fee for such license shall be Three Ilundred Dollars'($300. 00) . Class C tlcenses sha1l be limtted in nr-rmber as folLows: (a) One License for the first 5000 inhabitants; one addltional such license for each additional 5000 inha- bitants or fractlon thereof. Section 7.Transfer of License. A license shal1 be purely a personal or corporate privllege, good for not to exceed the period for which same ls lssued, unless sooner revoked, as in thts Ordi- nance provided, and shall not constitute property, nor shall it be subject to attachment, garnlahment or execution, voLun- -6- tarily or invo Luntarily, or subject to being encunibered ot hypotheeated. Such license shall- not descend by the lawe of testate or inte8tate devolution, but it shal1 cease upon the death of the llcensee, provided that executors or a&ninistra- tors of the estate of any deceased Lleensee, and the trustee of any insolvent or bankrup t licensee, when such estate con- sists in part of alcohoLic Liquor, may contlnue the business of the sale or manufac ture of alcohollc liquor under order of the appropriate court, and may continue the prlvtleges of the deceased or lnsolvent or bankrupt llcensee after the death of such decedent, or such insolvency or bankruptcy untl1 the ex- piration of such license, but not longer than six months after the death, banktuptcy or ineolvency of such Licensee. Any Licensee may renew his or ite llcense at the ex- plratlon thereof, provided he or it le then qualified to re- celve a License and the premises for which such renewal- licenee is sought are suitable for such PulPose. Section 8. Change of Location. Licenses issued hereunder aPPly only to the preurises descrlbed in the applicatlon and in the license issued thereon, and only one location shal1 be so described ln each license. Section l-1. Location-Restrictions. No llcense shall bo lssued for the salo of any alcoholic llquors on any premises within I00 feet of any church, school, hospital, rnortuary or undertaker, hone for aged or indigent persons, o! a ni litary or naval station or public park or publie playground. Every f-icensee sha1l cause his license in pLain vierr in a conspicuoua place on Employment of Minors . It shalL be unlawful for any licensee or any officer, associate, member, representative, agent or employee of such licensee to engage or employ or permi-t any minor to tend bar and to draw, pour or mix any alcoholic liquor in any licensed retail premises. Section 15.Other Ordinances and Larrs to Apply. Nothing in this Ordinance shall excuse or relieve the owner, proprietor, or person in charge of any tavem, or other place in the Village of Buffalo Grove where alcoholic llquor is so1d, from the restrictions and requirements of any other Ordlnance or Ordinancee ln the Village of Buffalo Grove or of the Statutes of the State of Illinoie. Section 16. Licensing on premises for which license IS revoked . I{hen any license hereunder shall have been revoked for any cause, at the discretlon of the Local Liquor -l-0- ConErol Cournissioner no license need be granted to any person, firm or corporation for the period of one year thereafter for the conduct of the sale of alcoholic liquor in the premises described in such revoked license. Section 17. Ceasation of Business. Any licensee who ceases to do business or closes his pl-ace of business for a period of more than sixty successive days shall be subject to having his license declared forfeited and lapsed by order of the Local Liquor Comissioner. Section 1[. Health and Sanitar y Requirements . It shall be the duty of every person, fil or corporation llcensed Lo carry on a business under the proviaions of this Ordinance to at all times keep the premises where such business ls carried on, clean and in proper sanitary condition. A11 persons eql.oyed or working in any such premises sha1l be kept clean and cleanly clothed. A11 utensiLs, appliances, veasels, receptacles, refrigeraEors, c1oset6, rooms or other p1ace6 or things whatsoever which are used for the purposes of selling or offering for sale, such llquors or of the storing or dispenslng of the same, muat at all .times be kept in a clean, who lesome and sanitary condition. Section L9. Card-Postiog. Every tavern, or place in the V11lage of Buffalo Grove where alcohof,lc liquor is sold for beverage purposes shall display at all tirnee in a prominent place a prlnted card -11- which shaLl be issued by the VLllage Clerk and which shall read substantiaLly as follows : I{ARNI}IG TO MINORS You are subject to a fine up to $200.00 under the Ordinance of the Village of Buffalo crove,if you purchase alcoholic liquor, or misrepresent your age for the purpose of purchaslng or obtain- ing alcoholic liquor. Section 20.Purchase by Minor. Any female under the age of 18 yeare and any rnale under the age of 2L yeats who purchasee or obtalned any alcoholic liquor in any taverrr or other place in the Village of Buffalo Grove where alcoholic llquor is sold, shal1, upon con- victlon thereof, be subJect to a flne of not 1es8 than Ten Dollare ($10.00) nor rpre than Trro llr:ndred Dollars ($200.00) for each and euery offense. Section 21. Minor Misrepresentin s Ase. Any female under the age of 18 years, and any mele under the age of 21 years, who misrepresents his or her age for the purpose of purchaeing or obtalning alcoholic Llquor ln any tavern, or other place ln Ehe Village of Buffalo Grove where a1coho1lc liquor is so1d, sha11 upon convictlon thereof, be subject to a fLne of not less than Ten Dollars ($10.00) nor more than 1\,ro llundred Dollars ($200.00) for each and every offense. Section 22. Selline to Unfir Persons No licensee shall sell, give or&liver -12- alcohollc Liquor to any intoxlcated person or to any person known by him to be an habitual drunkard, spend-thrift or insane, feeb Le -minded or dlstracted person. Section 23.Parent - Fine. Any parent or guardLan who shaLl knowingly euffer or pernit any minor chl1d of whlch he or she may be the parent or guardian, to violate any provlslons of this Ordlnance, shatl, upon conviction, be subject to a flne of not less than Ten Dollars ($10.00) nor more than t\yo Hundred Dollars ($2OO.OO) for each and every such offenae. Section 24. General Penalties. Any person, firm or corporation who ehaLl sel1, give array or offer for sale any alcohotlc beverage lrithout having first obtained a vaLid ll.cense or who shal1 make any false Btatement or otherwise vi.olates any of the provlsions of thls Otdiaance in obtaining a lLcense or who having obtalned a llcense herermder shall violate any of the provislons of thls Ordiaaace where no penalty ie othe:rrise provided, shaLl, upon convietion be eubject Eo a flne of not less than $10.00 nor more than 9200.00 for each offenee and where the offense ls in the nature of a contlnuing offense every day that such vtolation shall continue shal1 conetitute a separate offense. In addition to the fines provided in the varlous sec- tlons of this Ordiaance, any misstatement made by the applicant, or any violation of the terms and conditions of the application - r3- or any of the provisions of this Ordiaance or the statutes forbe cause d suspension orof the State of Illinois P€.v_,,6EtX. revocation of the license herein granted by the Liquor Control Cormnissioner. Section 25.Effect of Partial Invalidity. The provisions and sections of this Ordinance shall be deerned to. be separate, and the invalidity of any portion of this Ordinance sha1l not affect the validity of the remainder. A11 ordinances and parts of Ordinances inconsistent herewith are hereby repealed. This Ordinance shal1 be in full force and effect upon its passage, approval and publi.cation as provided by 1-aw.
