AN ORDINANCE AMENDING CHAPTER 2.I4
ENTITLED "POLICE DEPARTMENT'' AND
CHAPTER 2.22 ENTITLED'BOARD OF FIRE AND
POLICE COMMISSIONERS', OF THE VILLAGE OF
BUFFALO GROVE MUNICIPAL CODE
WHEREAS the Village of Buffalo Crove is a home rule unit pursuant to Article
Vll, Section 6 of the lllinois Constitution and, as a home rule unit, may exercise any
power and perform any function pertaining to its government and affairs; and
WHEPEAS the village board of the Village of Buffalo Crove has determined it
is necessary and desirable to amend village ordinances regarding the structure and
management of the Buffalo crove police department; and
WHEREAS the structure and management of the police department pertain
to the government and affairs of the village.
NOW THEREFORE BE lT ORDAINED by the President and Board of Trustees of the
Village of Buffalo Crove, Cook and Lake Counties, lllinois, as follows:
Section I That Section 2.14.O2O of the Village of Buffalo Crove Municipal
Code entitled "Appointment" be and is hereby amended by amending
subparagraphs B and D thereof to read as follows:
The Chief of Police is authorized to appoint Deputy Chief(s) and
Commander(s) upon the approval of the Village Manager. The Chief of
Police is authorized to suspend or discharge any or all of the olficers
holding such positions in accordance with adopted Village personnel
policies and procedures. The Deputy Police Chief(s) and
Commander(s) are exempt positions in regard to Chapter 2.22 of this
Code. The Chief of Police is also authorized to appoint sergeant(s) and
lieutenant(s) upon the approval of the Village Manager. Sergeants and
lieutenants are exempt from the appointment and promotional
provisions of Chapter 2.22 of this Code.
Section 2. That Section 2.14.O7O of the Village of Buffalo Crove Municipal
Code entitled "Rules and regulations" be and is hereby amended to read as follows:
"All off icer and employees of the Police Department are subject to the rules
and regulations of the Police Department as promulgated by the Police Chief
and the adopted Village p ersonnel policies and procedures. All officers

"D. The rank of police officer shall be appointed by the Board of Fire and
Police Commissioners as provided in Chapter 2.22 of this Code, and the
rules and regulations of the Board of Fire and Police Commissioners."
Section 3.That Section 2.22.O4O of the Village of Buffalo 6rove Municipal
Code entitled "Appointment of members - Fire and Police Departments" be and is
hereby amended by amending subparagraph C thereof to read as follows:
"C All Lieutenant and Sergeant appointments to the Police Department
shall be for a probationary period of twelve months. During the
probationary period, Lieutenant and Sergeant appointees shall be
considered as on furlough from the rank held immediately prior to
appointment, and may be reinstated to such rank without a hearing
before the Board of Fire and Police Commissioners if the chief
determines that the employee has failed to demonstrate the ability
and the qualifications necessary to furnish satisfactory service at the
higher rank. The chief shall notify the Board of Fire and Police
Commissioners in writing of such action. lf a Lieutenant and or
Sergeant appointee is not reinstated in the prior rank during the
probationary period, the appointment shall be deemed complete at
the end of the period."
Section 4. That Section 2.22.O7O of the Villa ge of Buffalo Crove Municipal
Code entitled "Promotions" be and is hereby amended to read as follows:
"The Board, by its rules, shall provide for promotion in the Fire and Police
Departments (except for those exempt positions listed in Sections 2.]2.020 and
2.14.O2O of this Code) on the basis of ascertained merit and seniority in service
and examination. All examinations shall be competitive among such q ualif ied
members of the next lower rank as desire to submit themselves to
examination having satisfied time of service qualifications as established. All
promotions shall be made from the three having the highest rating, and where
there are less than three names on the promotional eligible register, as
originally posted, or remaining thereon after appointments have been made
therefrom, appointments to fill existing vacancies shall be made from those
names or name remaining on the promotional register. The Board shall strike
off the names of candidates for promotional appointment after they have
remained thereon for more than three years, provided there is no vacancy
existing which can be filled from the promotional register."
Section 5. That nothing in this ordinance is intended to affect an existing
Police Sergeant promotional eligibility list or the ranking of candidates on that list.

appointed to rank by the Board of Fire and Police Commissioners are also
subject to the rules and regulations of the Board of Fire and Police
Commissioners. Each member of the department shall be furnished with
copies of said rules and regulations. Any sworn member in the rank of
lieutenant, sergeant and police officer shall be subject to discharge or
disciplinary action of the Board of Fire and Police Commissioners, or subject
to suspension for a period not to exceed f ive days by the Police Chiel
Section 6. That any promotional rules of the board of fire and police
commissioners will no longer apply to Police Sergeant promotions or appointments
after the expiration of the currently existing Police Sergeant promotional eligibility list
(if any).
gection 7. That all ordinances or parts of ordinances in conflict with the
provisions of this ordinance be and are hereby repealed to the extent of any such
conflict.
Section 8. That this ordinance shall be in full force and effect upon its
passage and publication in the manner provided by law.
