AN ORDINANCE AMEND!NG TITLE IO.
VEHICLES AND TRAFFIC
WHEREAS the Village of Buffalo Crove is a home rule unit pursuant to the
lllinois Constitution of 1970; and
WHEREAS the Village has worked cooperatively with the Buffalo Crove Park
District to develop consistent and practical regulations applicable to Village streets,
sidewalks, bike paths, parks, and public property in order to responsibly integrate
emerging mobility options into the community's transportation network.
NOW THEREFORE BE lT ORDAINED by the President and Board of Trustees of the
Village of Buffalo Crove, Cook and Lake Counties, lllinois, as follows:
SECTION l. Title lO of the Municipal Code is hereby amended to add a new Chapter
titled "Micromobility and Other Vehicles," as
CHAPTER: Micromobility and Other Vehicles Definitions
For the purpose of this Chapter, the following definitions shall apply unless the
context clearly indicates or requires a different meaning:
A."Motor driven vehicle" is defined as any vehicle for which the State of lllinois does
not issue a title document, does not issue license plates or registration documents,
and is a wheeled vehicle powered by electric or gas motor, motor driven cycle, or
other similar vehicle, regardless of whether the vehicle is operated by pedals with a
chain or throttle assist. Motor driven vehicles include all Low-Speed Electric Scooters
B. " Non-highwoy vehicle" is a motor vehicle not specially designed to be used on a
public highway including, an all-terrain vehicle, a golf cart, an off-highway
motorcycle or a recreational off-highway vehicle all as defined in the lllinois Vehicle
Code. (Reference 625 rLCS 5Il-la26.l (a)(b)).
C."Personol mobility device" includes any self-propelled vehicle, including a three-
wheeled vehicle, designed for and used by a person with disabilities, that is
incapable of a speed in excess of eight miles per hour on level ground.

WHEREAS micromobility devices such as e-bikes, e-motos, and e-scooters
have rapidly increased in popularity and the growth of the industry has outpaced
the development of state and local regulations needed to maintain public safety and
protect public spaces; and
D."Toy Vehicle" includes any battery-powered ride on toy that is designed to not
exceed lO miles per hour; that includes any number of wheels, handlebars, steering
wheel, seat, or platform; and is designed for children (including Razor@ kick start
scooters and Power WheelsrM).
E."Low-Speed Electric Bicycle" means a bicycle equipped with fully operable pedals
and an electric motor of less than 750 watts that meets the requirements of one of
the following classes, as def ined in 625 ILCS sn-]4o.lo: Class 1 low-speed electric
bicycle, Class 2 low-speed electric bicycle, or Class 3 low-speed electric bicycle. A
"low-speed electric bicycle" is not a moped or a motor driven cycle.
(a) "Class 1 low-speed electric bicycle" means a low-speed electric bicycle
equipped with a motor that provides assistance only when the rider is
pedaling and that ceases to provide assistance when the bicycle reaches a
speed of 2O miles per hour.
(b) "Class 2 low-speed electric bicycle" means a low-speed electric bicycle
equipped with a motor that may be used exclusively to propel the bicycle
and that is not capable of providing assistance when the bicycle reaches a
speed of 20 miles per hour.
(c) "Class 3 low-speed electric bicycle" means a low-speed electric bicycle
equipped with a motor that provides assistance only when the rider is
pedaling and that ceases to provide assistance when the bicycle reaches a
speed of 28 miles per hour.
F. " Low-Speed Electric Scooter" as def ined in 625 ILCS 5n-140.11, a device weighing
less than IOO pounds, with 2 or 3 wheels, handlebars, and a floorboard that can be
stood upon while riding, that is solely powered by an electric motor and human
power, and whose maximum speed, with or without human propulsion, is no more
than lO miles per hour.
C."Porent" means the lawful mother or father of an unemancipated minor, whether
by birth or adoption.
H."Legol Cuordion" includes a person appointed guardian or given custody of a
minor by any court of record, but does not include a person appointed or given
custody of a minor under the lllinois Juvenile Court Act.
Acts desionated-Prohibited.
(1) Motor Driven Vehicles
(a) No person under the age of16years, or who does not possess a valid
driver's license, shall operate a motor driven vehicle upon any public street
within the Viliage.

(b) No person shall operate a motor driven vehicle, other than a low-speed
electric scooter on public sidewalks, Village-owned bike paths, Village-owned
parks, and Village-owned parking lots.
(d) No person shall operate a motor driven vehicle in the Village that has been
altered from its original manufactured design to modify speed, method of
propulsion, braking, or other operational cha racteristics, such as by removing
pedals, chains, or adding a throttle.
(e) No person shall operate a motor driven vehicle in violation of any
regulation set forth in Chapter 11 (Rules of the Road), Article XV (Bicycles) of
the lllinois Vehicle Code (625 ILCS snl-l5ol through tt-1518, inclusive, and as
amended from time to time) and all additional regulations and restrictions
provided in this Section.
(2) Non-Highway Vehicles: No person shall operate a non-highway vehicle anywhere
within the Village except upon private property with the permission of the owner.
(3) Low-Speed Electric Scooters:
(a) No person under the age of 18 years shall operate a low-speed electric
scooter upon any public street within the Village.
(b) No person shall operate a low-speed electric scooter in a manner that
violates any provision of (1) of this section or at a speed in excess of lO miles
per hour.
(4) Low-Speed Electric Bicycles:
(a) No person shall operate a low-speed electric bicycle on a public sidewalk.
(b) No person shall operate a Class 2 or Class 3 low-speed electric bicycle on
Village-owned bike paths or Village-owned parks.
(c) No person shall operate a low-speed electric bicycle in violation of State
Law regarding electric bicycle operating regulations and restrictions
(Reference: 625 ILCS 5nl-]517).
(5) Parental Responsibilit) No parent or legal guardian of a minor under the age of 16
shall permit that minor to violate any provisions of this Section.
(6) A person who is not prohibited bythis Section from operating a motor driven
vehicle on Village property, including its streets, shall not constitute an intended or
permitted user of such property, shall operate any such vehicle at such person's own
risk, and shall be deemed to have waived any claim such person may have against
the Village, its officers, or its employees for any injury arising from or related to the
condition of said property, including, but not limited to, traffic signaling and signage,
intersection design, or maintenance.

(c) No more than one person may ride on a motor driven vehicle at a time
unless it is designed to carry multiple passengers and is operated in
accordance with the manufacturer's specifications.
Exceptions.
The following shall be exempt from the prohibitions contained in this Chapter:
(1) Any motor driven vehicle operated by an employee of a governmental unit,
including a school district, while in the performance of such employee's official
duties and not as transportation to or from the place of employment;
(2) Personal mobility devices;
(3) Toy Vehicles: Toy vehicles may be operated on sidewalks or paths within the
Village, or when driven across a public street within a designated crosswalk under
the supervision of the child's parent or guardian.
Violation - Penalty.
Any person who violates any provisions of this Chapter shall be subject to a fine for
each offense as provided in Chapter l.O8 of this Code. lf a minor under 16 violates this
Section and a parent or guardian violates subsection (5), both the minor and the
parent or guardian may be fined.
SECTION 2. Amendment to Appendix A (Fines)
Appendix A, Table A-2, is amended to include the following penalties for violations of
the Micromobility and Other Vehicles Chapter:
SECTION 4. This Ordinance shall be in fullforce and effect from and after its passage
and approval and shall be codified.

SECTION 3. lf any section, paragraph, clause or provision of this Ordinance shall be
held invalid, the invalidity thereof shall not affect any other provision of this
Ord ina nce.
