"*&t' - BUFEAIO CROVE AN ORDINANCE APPROVING A SPECIAL USE FOR OUTDOOR STORAGE AT IO5] COMMERCE COURT Heritage Pool Supply, lnc lOSl Commerce Ct WHEREAS the Village of Buffalo Crove is a Home Rule Unit pursuant to the lllinois Constitution of l97O; and WHEREAS lo5l Commerce Court, Buffalo Crove, lL ("Property") is a stand- alone industrial building in the I lndustrial District and is hereinafter legally described in Exhibit A; and WHEREAS Buffalo Crove Commerce Court LLC is the owner of the Property; and WHEREAS Heritage Pool Supply, lnc., ("Petitioner") has filed a petition for a Special Use to allow Outdoor Storage in the lndustrial District (l); and WHEREAS the Planning & Zoning Commission held a public hearing on November .l9, 2025, concerning the request; and WHEREAS the Planning & Zoning Commission made findings of fact and determined that the petition meets the criteria for a Special Use as set forth in the Buffalo Crove Zoning Ordinance, and as described in the minutes attached hereto as Exhibit C; and *r6pgAS the Planning & Zoning Commission voted 8-0 to recommend approval of the requested Special Use; and WHEREAS the Corporate Authorities of the Village of Buffalo Crove hereby determine and find that the requested Special Use is reasonable and will serve the best interests of the Village; and EXHIBIT A Legal Description of the Property EXHIBIT B Plan Set oRDTNANCE 2025-136 WHEREAS the proposed Special Use shall operate in accordance with and pursuant to the following exhibits: EXHIBIT C Draft Minutes from November 19,2025 Planning & Zoning Commission Meeting Page I of 6 smart with heart. 50 Raupp Blvd, Buffalo Grove, lL 60089 \ 847-459-2500 , vbg.otg NOW THEREFORE BE ITORDAINED bythe Presidentand Board of Trustees of the Village of Buffalo Crove, Cook and Lake Counties, lllinois, as follows: SECTION 2. The Corporate Authorities hereby adopt a proper, valid, and binding ordinance approving the Special Use for the property at 1O5l Commerce Court, Buffalo Crove, lL, subject to the following conditions: i. The outdoor storage for Heritage Pool Supply, lnc. shall be operated in substantial compliance with the business description and plans provided as part of this petition. 2. The Special Use is granted to Heritage Pool Supply, lnc. to allow outdoor storage at lO5l Commerce Court, which shall not run with the land. 3. The Special Use for outside storage granted to Heritage Pool Supply, lnc. is assignable to subsequent petitioners seeking assignment of this Special Use as follows: a. Upon application of a petitioner seeking assignment of this Special Use, the Corporate Authorities, in their sole discretion, may refer said application of assignment to the appropriate commission(s) for a public hearing or may hold a public hearing at the Village Board. b. Such assignment shall be valid only upon the adoption of a proper, valid and binding ordinance by the Corporate Authorities granting said assignment, which may be granted or denied for any reason. 4. The outdoor storage will be located within the enclosed area south of the building, the exact location of which will require coordination with Lake Zurich. The final location will be approved by the Village of Buffalo Crove prior to issuance of a racking permit for the outside storage. 5. An access easement agreement shall be made between the petitioner/property owner and the Village of Lake Zurich prior to the issuance of a racking permit for the outside storage. 6. Any incidental or directional signage for the site will be reviewed and adm inistratively approved by Village staff. 7. The fence and parking lot screening shall be maintained by the property owner or tenant in perpetuity. SECTION 3. lf any section, paragraph, clause or provision of this Ordinance shall be held invalid, the invalidity thereof shall not affect any other provision of this Ord ina nce. SECTION 4. This Ordinance shall be in full force and effect from and after its passage and approval and shall not be codified.
