2025-10-20 - Ordinance 2025-105 - APPROVING AN AMENDMENT TO THE PUD ORD. 71-005, AS AMEND BY ORD. 2024-076, PRELIMINARY PLAN AND A ZONING VARIATION - 655 GOLFVIEW TERRACE - Joyce Kilmer School, District 21&, \E)'-'' - BUFEAI.O GROVE oRDtNANCE 2025-lO5 AN ORDINANCE APPROVING AN AMENDMENTTO THE PLANNED UNIT DEVELOPMENT ORD,7I.OO5, AS AMEND BY ORD.2024-076, pRELtMtNARy PLAN AND A ZONING VARIATION FOR 655 GOLFVIEW TERRACE VILLAGE OF BUFFALO GROVE, cooK AND LAKE COUNT|ES, ILLINOIS Joyce Kilmer School School District #21 WHEREAS the Village of Buffalo Crove is a home rule unit pursuant to the lllinois Constitution of 1970; and WHEREAS 655 ColfuiewTerrace, Buffalo Crove, lL is improved with a public elementary school on approximately 3.4-acres, in the R-5 One Family Dwelling District, and is hereinafter legally described in Exhibit A; and WHEREAS in ]97], the Village Board approved Ordinance No. l97l-0O5 for the Planned Unit Development of the Oak Creek Condos and Apartments, whereby the subject property was dedicated to the Village for a school and park site; and WHEREAS in 2024, the Village Board approved Ordinance No.2024-076 fot the Amendment to the Planned Unit Development and Preliminary Plan, with Zoning Code Variations, for the placement of a modular classrooms in the rear yard of the property; a nd WHEREAS Community Consolidated School District 21, ("petitioner") has filed a petition to allow construction of a trash enclosure within the frontyard of the subject school property and is requesting the following approvals: l. An amendment to the Planned Unit Development and preliminary plan approved by Ordinance No. l97l-OO5 and amended by Ordinance No.2024- O75; and 2. A Variation from Section 17.32.O2O to allow an accessory structure to be located in the front yard and closer to the street than the principal structure; and WHEREAS notice of public hearing was given and the Village planning & Zoning Commission conducted a public hearing on September 3C,2O2S concerning the petition for approval of the Amendment to the Planned Unit Development and Preliminary Plan with Zoning Code Variations; and WHEREAS the Planning & Zoning Commission made findings and determined that the petition meets the criteria for Planned Unit Develo pments, Special Uses, and Page I of 6 smart with heart. 50 Raupp Blvd, Buffalo Grove, lL60O89 \ 847-459-2500, vbg.org 6 - Johnson, Richards. WHEREAS the proposed development shall be constructed in accordance with and pursuant to the following exhibits: EXHIBITA Legal Description of the Property EXHIBIT B Plan Set NOW THEREFORE BE lT ORDAINED by the President and Board of Trustees of the Village of Buffalo Grove, Cook and Lake Counties, lllinois, as follows: SECTION I. This Ordinance is made pursuant to and in accordance with the Village's Zoning Ordinance and the Village's Home Rule powers. The foregoing recitals are hereby adopted and incorporated and made a part of this Ordinance as if fully set forth herein. SECTION 3. lf any section, paragraph, clause or provision of this Ordinance shall be held invalid, the invalidity thereof shall not affect any other provision of this Ord inance. SECTION 4. This Ordinance shall be in full force and effect from and after its passage and approval and shall not be codified.
