RESOLUTION NO. 88- 52
A RESOLUTION CONCERNING
WESTRIDGE PITASE IV IN ARLINGTON HEIGHTS
WHEREAS, a Settlement Agreement and Consent Decree (both
collectively hereinafter referred to as "Settlement Agreement'r)
were entered into in the case entitled Village of Buffalo Grove,
et. al v. lridwest Development, ViIlage of Arlington Heights , €t.
{1, Case Number 85 CH 2449; and
WHEREAS, the Settlement Agreement provided for the develop-
ment of certain real property (as defined in the Settlement
Agreement) pursuant to its terns and pursuant to Village of
Arlington Heights Ordinance 85-I4; and
WHEREAS, the Settlement Agreenent provided for the develop-
ment of 295,000 square feet of office space in three (3) four-
story buildings on a portion of the real property; and
WHEREAS, UIDWEST DEVELOPI{ENT CORPORATION, ( "litidwest,')
applied for and obtained an ordinance amendment (with conditions)
to Ordinance 85-14 from the Village of Arlington Heights pursuant
to Ordinance 88-92 rezoning an approximate 13-acre tract from the
B-2 zoning district to the R-G zoning district to perrnit the
development of property for I06 townhouses and allowing ap-
proxinately two acres to remain zoned B-2 as an existing parking
1ot, in lieu of the 295,000 sq. ft. of office space in 3-four
story office buildings; and
WHEREAS, ttidwest has represented to the Village of Buffalo
Grove that it has fu11y complied with the settlement Agreement
and the village of Buffalo crove has reried upon said representa-
tions; and
WHEREAS, ttidwest has requested Village of Buffalo crove
approval for the aforesaid changes which are known as llestridge
Phase IV.
NOW, THEREFORE, BE IT RESOLVED, BY THE PRESIDENT AND THE
BOARD OF TRUSTEES OF BUFFALO GROVE, COOK AND LAKE COUNTIES,
ILLINOIS, as follows:
Section L:The foregoing Whereas clauses be and hereby are
made a part of this Resolution.
Section 2:That the ViIlage of Buffalo Grove interposes no
objection to litidwest Development Corporation's plans for the
development of the approximate 15 acre tract knoern as westridge
Phase IV, as set forth above 'subject to the following require-
ments:
(a) Compliance with Village of Arlington Heights
Ordinance 88-92. In addit.ion rilidwest $riII comply with the
Development Plan for Westridge Phase IV prepared by Land
Consultants, Inc. dated 5/3/88 as revised 9/2/88, a copy ofwhich is attached hereto as Exhibit A.
(b) Compliance with landscape plan entitled BufferArea Additions dated 9/L/88 prepared by Land Consultants,Inc. attached hereto as Exhibit B, except that the six foot(6') and eight foot (8') evergreen trees reflected on thelandscape plan shall aII be seven feet (7'). Midvrest shalIalso install two deciduous trees (either honey locust oremerald queen Norway uaple) of a minimun 2-L/2 inch caliperin the parkway of Cameron Way in the Village of Buffalocrove as directed by the Village of Buffalo Grove Forestor.This work will be done as soon as possible but in any eventnot later than June 30, 1989.
_ (c) The triple box culvert under Arlington HeightsRoad sha1l be cleaned by lridr.rest of aI1 mud ind debris.Material shalI be properLy disposed of off-site.
(d) Storm inlet structures along the south propertyline of Waterford place Apartments shill be propeily- -
adjusted, as approved by the Village of euffllo-GroireEngineer, to assure that the propeity,s detention facilityshaIl properly discharge at the designated overflow pointl
_ (e) Grading along the south property line of waterfordPlace Apartments sha1l be adjusLed, al approved by theVillage of Buffalo Grove Engineer, to asiure that drainagewill remain with the project Iirnits and be properly conv6yedto the projects detention basin.

(b) the Village of Buffalo crove is in receipt ofacceptable letters of credit or bonds guaranteeing to theVillage of Buffalo Grove that the improvements delineatedherein are constructed. The Ietters of credit or bondsshall be in the following amounts: $I5,000.00 for theengineering requirements set forth in Sections 2(c) through(e) herein and $25,000.00 for the landscape requirements setforth in Sections 2(b) and 2(g) herein. The Village ofBuffalo Grove shall accept or reject the construction withinthirty (30) days of completion. Upon acceptance theappropriate letter of credit or bond may be reduced to IOtof its original face value which 10t shall provide for a one(1) year maintenance guarantee after the work is completed
and accepted.

Please be advised that I met wlth Mldwest Development Corporation on
August 15, 1988. As you are aware, the park district preferred to have an
active use site in this developnent for athletic fields.
The Westridge Phase Monation requirement 1s only 1 .25 acres which is not
sufficient sLze for athletic fields. i{e would need a minimurn of 3 acres.
In 1984 the park dlstrlct reque6ted a flve acre park site in the origlnal
developnent but did not recelve the supPort fron the Village of Arllngton
Helghts or the developer. The developer \ranted to offer prlvate recreational
faclllties for market ing purposes.
Unf ortunately the Westridge Phase Meveloprnent requlrement of 1 .25 acres
w111 be cash ln lieu of land.
It has been our praciice to provide credit for only the land that the private
amenities are construcEed upon and not the cost of the amenities.
The Vlll-age of Arlj-ngton Heights rray have Provided them additional credlt but
agalnst our recoomendation.
