AND NATURAL RESOURCES GRANT AGREEMENT
WHEREAS, the Vtllage of Buffalo Grove has committed. itself to
a curbside, residential recycling program; and,
WHEREAS, that program requires the Vtllage to purchase 8000
ploslic bins in order to accomplish said goal; and.
WHEREAS, the State of Illinois Deportment of Energy & Nofural
Resources hcs seen fit to award in competition the Vtllage of Buffalo
Groye the sum of $19,730.00 to pay for its purchase of the recycling
bins.
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE PRESIDENT
AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE,
COOK AND LAKE COUNTIES, ILLINOIS, thot:
The Village hereby accepts the Grant Agreement attached
hereto as Erhibit A, and outhorizes the appropriate parties
to enter into soid Agreement.

The purpose of this Grant Agreement is to partially execute, through the
Grantee, certain performance obligations of the State which have been created
by Public Act 84-1319. This Act is intended to provide funding and technical
assistance to local governments, business, and not-for-profit onganizations
to deal with solid waste disposal pnoblems. This Grant is funded from theSolid Waste lilanagement Fund and is for recycling and resource necovery
p rograms .
Section 2. Scope and Description of Service.
The Grantee shall perform various technical and professional services
and shall further prepare and provide to the Department the work products
that are more fully set forth in the Statement of I'lork, which is attached
hereto as Exhi bit A.

Payments of a negotiated amount shallbe issued by the Department
during the term of the Project upon written request by the Grantee.
Such requests shall be submitted with a current Project expenditurereport. Requests for payment will not be approved unless all
appl i cabl e reports have been submitted by the Grantee. Such
payments shall be made no more frequently than on a monthly basis.
Ten (10) percent of the total Grant amount shall be retained by the
Department until the Project is completed and the final report isdelivered and accepted by the Department. Project status will be
determined by periodic inspection of the Project by the Department.
Upon confirmation that all agreed to services and work products have
been performed and delivered by Grantee, the Department shall notifythe Grantee in writing that the Project is approved for completion,
and the ten (10) percent retainage amount witl be released to the
G rantee .
B. In no event shall the Department be required to pay any amount for
expenses or labor not specified in the Project Budget. The Grantee
hereby warrants that it can and wi lI complete the Project in
accordance with the Project Budget. Grantee shall submit to the
Department Project Managen expenditure reports of actual costsincurred. These reports shall be submitted quarterly.
Section 5. Interest on Grant Funds
Pursuant to Section l0 of the Illinois Grant Funds Recovery Act (Public
Act 83-640), all inter€st earned on grant funds held by Grantee may beretained by the Grantee due to the cost of accounting for the interest and
allocating the interest to the principal .

Grantee shail submit expenditure reports and technical progress reportsto the Department on a quarterly basis during the term of the project, and
upon ten days notice to Grantee, Grantee shall prepare and furnish suchadditional work progress reports as may be requested by Department. Granteeshall submit a final technical report to the Department upbn completion ofProject activity, which shall be submitted no later thin the Gr-ant endingdate set forth in Section 3, Grant Term. Grantee shal'l make and maintainrecords of time actually spent and expenses incurred in penforming theProject.

All technical, clerical, and other personnel necessary for the effective
execution of the Project shall be employed by Grantee, and shall in all
respects be subject to the rules and regulations of Grantee governing staff
members and employees. Such personnel shall not be considered for any
purpose to be agents or employees of the Department or the State of Illinois.

Grantee shall submit, upon request, a bill of sale or other documentshowing proof .of purchase for all equipment purchased at a costgreater than $500.00. Each item of equipment purchased underparagraph (A) of this Section shall become the property of theGrantee, if uti I ized for the purposes authorized in ' thi! GrantAgreement. An inventory or property control record shall bemaintained by the.Grantee for all equipment purchased at a. costgreater than $100, purchased under this hrant Agreement. IfDepartment terminates the Grant pursuant to Sectio; 14.C., theDepartment shall have the option to recall the equipment puichasedwith grant funds or demand a cash neturn equivalent to the netsalvage value of that equipment. Similar)y, if the Grantee uses the
equjpment purchased with grant funds for purposes other than thoseauthorized in this Grant Agreement within three years from the dateof execution of the Grant Agr.eement, the Department shall have theoption_ of recalling that equipment or demanding a cash returnequivalent to the net salvage yalue of that e(uipment. For thepurposes of the Grant Agreement, net salvage value is defined as
salvage - value less any reasonable costs incurred by Grantee in
accomplishing the sale. Tender of cash return to Departmlnt must be
made by Grantee within six months of demand by Department.

B. This Grant Agreement shall be binding upon, and inure to the benefitof, the r€spective successors, assigns, heirs, or pensonal
repnesentatives of the Department and Grantee; provided, however,that none of the promises, duties or obligations created or incurredpursuant to this Grant Agreernent shall be assigned or subcontractedby the Grantee viithout written consent of the Department, which
document shall become an amendrnent to this Gnant Agreement.

STATENENT OF !{ORK
VILLAGE OF BUFFALO GROVE
The Grantee will implement a community-wide residential curbside recycling
program in cooperation with its scavenger service, Buffalo Grove/liheeling
Di sposal Co.
A. The Grantee shall perfonn the following tasks jn accordance with
the terms of the Agreement.
1. Conduct an education and promotional campaign for both program
start-up and on an on-going basis. A survey of residents will
be conducted after six months of program operation.
2. Purchase 8,000 plastic bins for distrubution to each household.
3. Provide on-going monitoring of program operation.
B The Grantee shall provide, in writing, quarterly expenditure and
progress reports to the Department, and shalI keep the Department
informed about project activities, problems encountered, proiect
management decisions, and proposed budget reallocations.
The Grantee shall provide a final report upon proiect completion
to the Department that wilI contain the following information,
as detailed in the project proposal:

and achi eved.

2, A sumnary of monthly reports received from Buffalo Grove/Wheeling
Di sposa I .
3, An analysis of program costs and revenues from both village
and contractor perspecti ves.
4. An evaluation of bins, collection vehicles, and other equipment
used in the program.
5. A sumnary of public education and survey activities accomplished
during the proiect Peri od.
6. A sunmary of actual project expenditures, presented in the
same format as the original proposal budget'
The Grantee shall appoint Lee Szymborski as project manager to
act as liaison to the Department.
