1987-12-07 - Resolution 1987-61 - APPROVING CONVEYANCE OF REAL PROPERTY TO APTAKISIC-TRIPP CONSOLIDATED SCHOOL DISTRICT NUMBER 102 (HIGHLANDS)10/28/87 RESOLUTION NO. 87- 61 A RESOLUTION APPROVING CONVEYANCE OF REAL PROPERTY TO APTAKASIC-TRIPP CONSOLIDATED SCHOOL DISTRICT NUMBER I02 (Highlands) WHEREAS, the Village of Buffalo crove is the owner of a certain parcel of real property described in Exhibit "A" attached hereto and made a part hereof; and, WHEREAS, the Village has no immediate use for said real property; and, WIIEREAS, the corporate authorities deen it to be in the public interest to have said property put to public use by deeding sane to the Aptakasic-Tripp Consolidated School District Number 102 ano their successors in office for the use and benefit of the public; and, WHEREAS, the transferee municipality has by ordinance declared that it is necessary or convenient for it to use, occupy or irnprove said real estatei NOW, THEREFORE, BE IT RESOLVED by the president and Board Trustees of the ViIlage of Buffalo Grove, Cook and Lake Counties, IlLinois: SECTION I:That the preceding llhereas clauses are hereby incorporated herew i th. SECTION 2: Pursuant to the authority granted to Municipali* ties in Chapter 30, Sections 156 to I58 (a) of the Illinois Revised Statutes, the president and Clerk of the Village of Buffalo Grove are hereby authorized and directed to execute a deed, to the Aptakasic-Tripp Consolidated School District Number 102 and their successors in office for the use and benefrt of the public, a copy of which deed is attached as Exhibit ,'A,,, and by reference made a part hereof and incorporated herein. SECTION 3: That said deed shall contain a clause, to wit "If construction of a public school building does not comrnence prior to September I, I99O the subject property sha1l revert to the crantor herein, to wit: the ViIIage of Buffalo Grove,'. Linitation of Distri ct's Res ponsibilities.It is agreed that al" VilIage will not require the Distri.ct to relrove any additionar anount of existing soir fron the site. The District wirl not be required to hydroseed the site, but will be arl.wed to use grasrs seed and strai, to create a stand of grass, and the DiEtrict will not be required to add additionaL footage to the bike path beyond t,hat speci.f ied in the attached plan (Appendix 2 which is attached hereto and incorporated by reference herein). 8. Bindinc Effect This Agreerent shall be binding upon successors and assigns of the parti.es hereto. 9.
