In consideration of these premises, the parties hereto agree as set forth in the following pages numbered 1 through !.L inclu- sive. MCEO 3 9 -1- This is an AGREEi{ENT between the VILLAGE OF BUEFAIO GROVE, 50 Raupp Blvd., Buffalo Grove, Illinois, 50090, hereinafter referred to as the I'VILLAGE", and MIDWEST CONSULTING ENGINEERS, INC., 5151 North Harlem Avenue, Chicago, Il1inois, a firm of Consultants, hereinafter referred. to as the 'CONSULTANTTT. The VILLAGE agrees to furnish the following items: A1I presently available survey data and information, includ- ing standard details and standard specifications adopted by the VILLAGE, and other available data useful to the v/ork being done by the CONSULTANT. 4. Project Schedule The CONSULTANT sha1l commence work on Phase 2 within five (5) calendar days after date of authority to proceed. It is the intent and objective of the VITLAGE and the CONSUL?ANT that the work hrill be completed according to the following schedule : Notice To Proceed April 28, L987Plans & Documents (to ViIIage) JuIy 17, 1987Bid Opening August I0, 1987 Begin Construction On or about 09/01/87 5. Prime Compensation 5 1 Phase 2 - Design and Preparation of Contract plans: Subject to an Upper Limit of Compensation of $86,867.00, the CoNSULTANT shal1 receive as full payment for completing the Phase 2 work required of him under this AGREEMENT reinbursement of his eligible actual costs in accordance with Section 2.45 of the STANDARD PROVISIONS, plus a Fixed Amount of 99,990.00. The Upper Limit of Compensation is a result of the Cost Estimate of Consultant's Services, attached as Exhibit D. The retainage provisions contai.ned in Section 2.42 of the STANDARD PROVISIONS shall not apply to Direct Non-Salary Costs. The attached Exhibits A, B, and C are to be used as set forth in Section 2.42 of the STANDARD PROVISIONS. Prime Compensation and Specific Rates for Extra Work may be adjusted -in accordance with Section 2.21 of the STAN- DARD PROVISIONS, if the duration of the work in any phase extends more than six months beyond the date of completion stated in Section 4 of this AGREEMENT, due to no fault of the CONSULTANT. In all instances where the VILLAGE shall request specific servj.ces of the CONSULTANT, the CONSULTANT prj.or to commitment sha1l indicate to the VILLAGE whether the work shall be considered "extra t/ork". When requested by the VILLAGE, the CONSULTANT sha11 prepare and submj.t a cost estimate for such extia work. In the event the CONSULTANT, upon' written order from the VILLAGE, is required to perform Extra Work, he shall, in addition to the Prime Compensatj.on, recej.ve payment for such Extra V{ork on the following basis: Subject to a pre-agreed Upper Limit of Compensation for each item of Extra Work, the CONSULTANT sha11 be paid at the specified hourly rates of pay for each class of employee as listed in Exhibit rrAn for the actual time the CONSULTANT directly utilized each such employee on the Extra Work, plus the CONSULTANT I S payroll burden, overhead costs as listed in Exhibits B and c, plus actual expenses for transportation, subsistence, and electronic computer service incidental to the Extra Work.
