A RESOLUTION APPROVING A JOINT VILLAGE/STATE AGREEMENT FOR THE CONSTRUCTION
OF ILLINOIS ROUTE 83 FROM LAKE-COOK ROAD TO BUFFALO GROVE ROAD
IIHEREAS, the President and Board of Trustees of the Village of
Buffalo Grove desire to cause the implementation of the Illinois Route 83
(Lake-Cook Road to Buffalo Grove Road) Street Improvement; and,
WHEREAS, the approval of an agreement with the State of Illinois is
required in order to proceed with the completion of the desired project;

Trustees of the Village of Buffalo Grove, Lake and Cook Counties, Illinois as
fol I ows :
I. The agreement entitled, "Agreement for Federal Project
lX-872(73)" is hereby approved.
2. The Village Manager is hereb.y authorized and directed to sign
the agreement, a copy of which is attached hereto and made a
part hereof.

I.IITNESSETH
WIIEREAS, the STATE and the VILIAGII, in order to facilitate the free flow of
traffic and insure safety to the Eoloring public, are desirous of inproving
approxinately 0.7 nile of uundelein Road (FAp Roure 872) (lllinois Route g3)
from norEhwest of Buffalo Grove Road to north of Lake-Cook Road in the Village
of Buffalo Grove, Lake County, lllinois, VTLLAGE Secrion 80-00024-00-Rpr STATE

said iuprovement to consist of the folloving:
A. Widening and resurfacing the existing tuo-lane roadway to provide
four thru traffic lanes and a 12-too! nountable nedian, with
left-turn lanes at various locaEions;
B. Constructing new curb and gutter throughout and a 6forn sever
systeD to acco@odate the iuprovement;
C. Adjusting the existing traffic signals at Buffalo Grove Road;
and perforning all other eork necessary to conplete the iEproveEent in accor-
dance with the approved plans and specifications, hereinafter called the
PROJECT; and

NOt{ ' TIIEREF0RE, in consideration of the mutual covenanta contained herein,
the parties herelo agree as follors:
l. The VILLAGE, at iEs own expenae, ghall cause the Design Report to
be satisfactorily amended for the PROJECT, and prepare or cauae
to be prepared the contract plan8, specifications and esti.Eate
(Phase lI Engineering).
2. Ihe VILLAGE, at its ot,n expenae, shall obtain or cauae to be
obEained Ehe necessary right-of-way (including all temporary and
permanent easemente) for the PROJECT in accordance with rhe
f ollowing requireoents :
A. Said right-of-way shall be acquired in accordance rith
Land Acquisition Policies and procedures of the STATE,
in the naoe of the STATE, on standard State forns which
rill be provided for that purpose.
B, No award of a contract shall be made to cover con8truc-
tion of the PROJECT, or any part thereof, vithout there
first having been Bade a Eitle approval by the Attorney
General of lllinois on each individual parcel ot said
right-of-ray, the coneideration for rshich exceeds
$2,500.00, iocluded uiEhin euch conatrucrion. A title
approval shall be rnade by the STATE on each individual
parcel of ssid right-of-ray acquired for the PROJECT
rshere the coneideration is 12,500.00 or leas. lo the

C. The coet of said right-of-uay shall include the pur-
chase price thereof as vell as the coat of negotiators,
Special Assistant Attoroeys General, appraieale, title
evidence, relocation asaistance and payEents, property
management, and such legal eervice as may be necessary
to acquire said right-of-way.
D. All parties engaged in the acguisition of said right-
of-way shall be approved in advaoce by rhe STATli.
E. Any phase of the Staters Relocation Assistance pro-
cedures to be performed by any qualified agency other
Ehan the STATE shall be covered by separate contrec-
tual egreement or agreeEents with said agency.
F. The STATE shall provide such guidance, assiatance and
supervision, and monitor and perforn audits, to the
exEent necessary Eo assure compliance irith the STATETS
Land Acquisition Policies and procedures.
G. The VILLAGE shall furnish the STATETS DistricE Engineer
the original cooveyance instruments and right-of-ray
plat, including any tenporary or peruanent eaaeoents,
irmediately after guch docuoents are properly recorded.
Ihe STATE shall furnish the resident engineer together rith the
consEruction engineering, propor!ioning of materials and inspec-
tion during Ehe construction of the ioprovenent, provide accep-
tance sampling and testing of materials and cauae the PROJECT to

be built in accordance with the approved plans, specifications
and contract.
The STATE, after approving the plans, shall receive bids and
award the contract for construction of the PROJECT.
5 The VrLLAGE, or, 0ctober 21, 1985 , appropriated, by se parat e
reso lut ion, $295 ,000 . 00 to pay its share of Ehe cosE of the

PROJECT.
The VILLAGE agrees to adopt, and put into effect prior to the
STATE advertising for the sork to be perforned hereunder, an
ordinance requiring that parking be prohibited on the inproved
roadway sithin the limits of the PRoJECT.
The VILLAGE agrees to adopt, and put into effect prior to the
STATE advertising for Ehe sork !o be perforned hereunder, an
ordinance prohibiting the discharge of sanitary and/or indus-
!ria1 uasCe uater into any atorm 6euer conatrucled as a part of
EhE PROJECT.
The VILLAGE agrees not to authorize or pernit any operation,
practice or encroachment rrhich will change, inpede or inEerrupt
the orderly flow of vehicular traffic on lhe completed PROJECT,
and to enforce such traffic regulations and local ordinances that
affect traffic operations thereon.
The disposition of encroachnenta, if any, 8ha11 be cooperatively
deternined by representaEives of the STATE and the VILLAGE.
The V ILIAGE agreea not to permit driveray entrance openings to be
rnade in the curb aa constructed eithout the irritten conaent of
the STATE.

The VILLAOi,6hall exerciee its franchise rig.l, ro the extent
thet the VILLAGETS franchise agreement allows, to cause utilities
to be relocated at no expenae to the STATE. The VILLAGE further
agrees to regulate or cauge t'o be regulated on a continuing basi.s
the use of highway rights-of-vay by utitities in the llanner set
forth in the currenr Staters Utility Accomodarion policy appli-
cable to the highway systeu involved.
The STATE shall, upon compleEion of the PROJECT and so long as

Eaintain on said route the thru traffic lanes, turnj.ng lanes,
roedians, curb and gutter flags adjacent to the thru traffic
lanes, and paveuent markings vithin the limits of tire PRoJECT.
The VILLAGE shall, upon conpletion of the PROJECT, maintain or
cause to be oaintained all portions of the PROJECT not epecified
Eo be maintained by the STATE in lteo 12 of this Agreeuent, in-
cluding manholes, inlets, catch basins, 6torn aesers, sidenalks
and VILLAGE-owned utilities and appurtenancea.
Upon acceptance by Ehe STATE of the traffic 6igna1 sork included
herein, lhe responsibility for maintenance and electrical energy
for the operaEion of the signals shall coDtinue to be as outlined

VILLAGE shall contribute an additional lunp suo of $200,000
to Ehe STATE for use at Ehe STATE'S discreEion.
Ihe VILLAGE agrees to pay the entire cost of Preliminary
Engineering and Right-Of-t{ay Acquisitioo.
The STATE agrees to pay the Eotal contract construction and con-
struction engineering cosEs, subject Eo reinburseuent of the
Federal share of 852 thereof, in accordance f,rith current billing
procedures established for Federal-Aid projects.
A. Upon award of the contract for construction of the
PROJECT the VILLAGE agrees ro pay to the STATE, as the
VILLAGETS total contribution toward the construction of
the iEprovement, a lunp suE auount of $200,000.00 frox0
any funds alloEted to the VILLAGE.
This AgreemenE and the covenants contained herein shall becone
null and void in the event the conEract covering the construction
work conEenplated herein is not auarded prior Eo January 1, 1989.
