The VILLAGE does hereby engage the CONSULTANT, and..the CONSULTANT hereby agrees to furnish certain professional phase I engineering services, described in Section 2 and including the preparation of a Project Deveiopment Report, in connection with the proposed improvement of the Arlington Heights Road and Dundee Road Intersection, in the Village of Buffalo Grove, Cook County, Illinois, hereinafter referred. to as the "PROJECT',, based upon the following terms and condj.tions: MCEO 2 O -1- 1.INCORPORATION BY REFERENCE The "Standard Agreement Provisions for Consultant Servicesr' dated 1977, of the Department of Transportation of the State of Illinois, hereinafter referred to as the 'STANDARD PROVISIONS", are incorporated and made part of this AGREE- MENT except as deleted or amended hereafter. MCEO 2O -2- 1.1.5 Section 4 (f) Land - An y land from a public park, recreation area, wildlife and $rater fowl refuge or historic site which a trans- portation plan or project proposes to use (from the Department of Transportation Act, 1966). 1.1.6 Environmental Assessment - An y action that is not classified as a Categorical Exclusion and for r+hich the Environmental Studies and early coordination indicate that the proposed action will not have a significant impact on the quality of human environment. L.2 (SP 1.18) Wherever the word DEPARTMENT is used, it shal1 be construed to mean the VILLAGE, except the word DEPARTIT{ENT shall also include IDOT in Subsections 2.12, 2.24, 2.31 ,2.32 and Section 6, in its entirety, of the STANDARD PROVISIONS. 1.3 (SP 2.41) The CONSULTANT sha1l invoice the VILLAGE, not the Liaison Engineer, as provided in Section 2.4L of said STANDARD PROVISIONS in a format mutually agreed to by the VTI,LAGE and the CONSULTANT. Scope of Work Since this PROJECT reguires a Combined Corridor and Design Iocation Report and a Combined Hearing, and since the Corridor aspects of the Report are limited, the Design Iocation Study wiIl cover detailed variations over the entire length of the PRoJECT. It is .anticipated that one design will be studied in detail, and that variations to this design in several locati.ons will also be studied for the entire length of the PROJECT. Upon receipt of written authorization of notice to proceed, the CONSULTANT shal-I provide the services for environmental studies and reports. The studies and reports for the PROJECT sha1l be completed as set forth in applicable provisions of 3, 4t 5 and 7 (revised) of. the STANDARD PROVISIONS and applicable provisions amended as follows: 2.7 (SP 3.2) Information shall be assembled in accord.ance with Section 3.2. Sections 3.1,3.3,3.5, and 3.5 are not applicable provisions of this AGREEMENT. 2.2 (SP 4.1) Section 4.1 of the STANDARD PROVISIONS is de Ieted . 2.3 (SP 4.2) Available aerial mosaics or plans at of In = 50' will be used for this PROJECT. a scaLe 2 4 (SP 4.3) The first sentence of Section 4.3 of the STANDARD PROVTSIONS is changed to read, "Using the existing corridor, study all feasible alternate designs to eliminate all those which are not acceptable". MCE0 20 -4- 2 2.5 (SP 4.35) The following is added to Section 4.35: 'AlI $ratershed areas affecting the proposed improvement shall be identified and shown on a Drainage l,lap. This map will include the drainage area, flood plains, if any, and preliminary storm sewer design.' 6 (sP 4.37) Right-of-way requirements will be defined on the ln = 50t scale mosaic showing the preferred plan of improvement . 2.7 (SP 4.61 & 4.621 The CONSULTANT sha11 furnish ten copies of the Draft Report for review by the VILLAGE, IDOT and FEDERAL HIGHWAY ADI"IINISTRATION, After ap- proval , he shall furnish 15 copies of the Final Report. 2.8 (SP 5.3) This section is modified to read, nStudy all feasible alternate designs in sufficient detail to eliminate thos€ which are not acceptable. For the remaining alternates, follow the same procedure as outlined in Sections 4.3, 4.4, 4.5 and 4.6 as modified and expanded in the AGREEMENT'. 2.9 The CONSULTANT vrill provide the following in addition to items enumerated elsewhere in this AGREEMENT: a)Intersection Design four prints of the improvement. Studies; Reproducible and recommended intersection b) Drainage Map; the original and four prints. Public Informational Meeting Eandouts copie s . MCE0 2 0 c) -5- 100 d)Plan exhibits (1" = 50' scale of-way) - Originals and four acceptable alternates. showing right- prints of all e)Exhibits depicting socio-economic and other factors - one original and four prints. 2. 10 The CONSULTANT shall exclusively furnish to the VIL- LAGE, all reports, data or other information prepared, obtained or assembled by him under this AGREEMENT, unless otherwise directed by the VILLAGE. 3. The VU,LAGE agrees to furnish the following items: 3.1 A11 presently available survey data' and information incJ-uding standard details and btandard specifications adopted by the VILLAGE, and other available data useful to the work being done by the CONSULTANT. 4. PROJECT SCHEDULE The CONSULTANT shall commence work on phase I within five (5) calendar days after date of authority to proceed. The work will be completed and delivered to the VILLAGE within the foLlowing period: Phase I - Authorization to proceed is anticipated to be received by October 4, 1985. On that basj,s, Phase I is scheduled to be completed by January 24, 1986. MCEO 2 O -5- 5. PRI}IE COMPENSATION 1 Phase I - Combined Corridor and Design Location Study. Subject to an Upper Limit of Compensation of $23,718.00 the CONSULTANT shall receive as full payment for completing the Phase I work required of him under this AGREEMENT, reimbursement of his eligible actual costs in accordance with Section 2.45 of the STANDARD PRO- VISfONS, ,p1us a Fixed Amount of $2,491.00 and are a result of the attached Exhibit D, Cost Estimate of Consultantrs Services. The retainage provisions contained in section 2.42'of the STANDARD PROVISIONS shall not apply to Direct Non-Salary Costs. The attached Exhibits A, B, and C are to be used as set forth in Section 2.42 of the STANDARD PROVISIONS. Invoices shall be prepared in accordance with Section 2.41. 2 The Prime Compensation may be .increased or decreased by subseguent aqreement between the contractual and approving parties if there is a major change in ..thescope, character or complexity of the Work. Prime Compensation and Specific Rates for Extra Work may be adjusted in accordance with Section 2.Zl of the STAlil- DARD PROVISIONS, if the duration of the work in any phase extends more than six months beyond the date of completion stated in Section 4 of this AGREEMXNT, due to no fault of the CONSULTANT. 3 In all instances where the VILLAGE shall request specific services of the CONSULTANT, the CONSULTANT shalI indicate to the VILLAGE whether the work shaI1 be considered "extra v/ork". When reguested by the VIL- LAGE, the CONSULTANT shal.I prepare and submit a cost estimate for such extra work.
